The real problem is not judges who are lied to by police who don't do due diligence when signing the warrant. It's when those judges after finding the cop lied don't immediately jail the officer for contempt and have charges pressed for perjury.

The law enforcement slush fund (the civil forfeiture monies) is over 5 Billion now. That is "off the books" monies that can be used by agencies for whatever they want... mostly to increase the militarization of the police departments meant to serve and protect (we are not foreign combatants!) And used to continue to fund new task forces and schemes to gain even more in civil forfeiture! (Look up project/ operation runway... where police officers not even in the jurisdiction of the airports can go "fishing" for monies as passengers are literally in the final walkway boarding a plane. Saying they are part of TSA, or that it is a random "final check before boarding!) The laws protecting criminals are much harder, so, like any other unethical and immoral predator, they go after the "easy money" (Look into criminal asset forfeiture versus civil asset forfeiture.) I'm so glad for the institute for justice taking on the government about this outrageous atrocity against our own citizens.
The legislation was drafted in 1984, and passed shortly thereafter as part of a budget bill. When I point out the name of the sponsor of that legislation, my comments are removed. But it was a prominent senator …

Regarding the drug sniffing dog. The 6th amendment guarantees the right to be confronted with the witnesses against him. In trial, can you have the dog take the stand and testify to what they smelled?
Yes, the dog handler testifies for the dog’s competency. If a firearm is submitted as evidence at a trial, does the firearm have to take the stand and answer questions?
Considering that the dogs accuracy rate for sniffing for things is under 50%, that means the dogs have "testified" untruthfully more than 50% of the time..The doggies should be on the Brady List....And as such be barred from testifying. And that fact should be admissible in court. Because it is as reliable as flipping a coin.

That cop should really go out with honor in the Japanese manner. Dude claims to be a veteran then immediately proceeds to shit all over the Constitution.
The fact that there are no consequences for bad stops is what enables this behavior to continue. Officer: "suspect is acting suspicious" Dog: "alerts on car" (supposedly, in the officer's judgement) Officers: detain citizen and search vehicle in over one hour stop NOTHING FOUND AT ALL Officer: "have a nice day" (rinse, repeat) There have to be repercussions for making wholly bad stops. The officer was wrong. The dog was wrong. The search revealed nothing. It was all lies and/or incompetence and the system as it currently exists encourages and incentivizes all of it. No one gets in trouble. No one has to pay for this man's time. If this is the case, then why not simply have K9 units running traffic? Make up some pretext for a traffic stop, talk to driver, claim they are acting suspicious, bring out the the K9, K9 "alerts", search the vehicle, rinse repeat. This is completely out of control.
If more than x% of canine alerts are false, that department shouldn't be allowed to use canines anymore. They should only be allowed to use methods that consistently work, and since they obviously can't train a dog properly, that means no more dogs 🙃
The cops care so much.for their dog partner that when the dog was retired Sargent talked his cop to take the dog home with him . He murder the dog by starving it to death. Nice retirement package. The cop was scolded.didnt get charged for animal abuse. Scoialpath!!!

There is a reason for it, such as abandoned property that they believe to be the proceeds of a crime. However, if the owner is there, then they need to bring the suit against that person, and not charge the property with being tainted.
When the supreme court openly takes bribes, it's no surprise they say the 4th amendment is null and void because courts once said abandoned ship cargo could be seized.
You are too nervous, you are guilty. You are too calm, you are a professional conman. You talk too little, you are hiding something. You talk too much, you are nervous and guilty.
Drug dogs should be unconstitutional, A person should have to be able to communicate with its accuser. The drug dog is actually the accuser or at least being the perceived accuser accordingly to its handler.
Institute for Justice is a wonderful group, based on the work it does. This interview was most excellent and is full of information that all of us can install in our memory bank. IJ is doing important work, and it is much appreciated.
In the US, the level of justice you receive depends on your class status. If you are rich, you can hire people who spend their lives studying the law. If you are poor, you can't. Lady justice is a hooker.
Speeding tickets and fines are for the poor and middle class. What's a $500 speeding ticket to someone that makes hundreds of thousands of millions a year. This whole police state is designed to put the proles(cops)aka same lower-middle class as us in general. Up against the proles(us). If you don't know what prol is, it's a reference to George Orwells 1984. These cops are badly brainwashed and don't know it.
This is why you don't ever talk to cops beyond what is absolutely mandated by law, such as presenting your license, registration, and insurance. It is none of any officer's business if and how much money you have, or any other possessions. An actual criminal won't admit to wrongdoing, and good, law abiding people have zero obligation to incriminate themselves.
Nice job Kim and Keith! Cops should take special note. If you continue to do this stuff we're going to find you. You'll be disciplined. It will go in your file forever. That's why we love IJ. Thank you Josh. Keep up the good fight IJ! The little guys, the citizens of this country are behind you. Please support IJ if you can.
I had an unethical police officer pull me over for a cell phone violation in which I didn't have a cell phone . Lie under oath numerous times at trial . Be found guilty based on his word alone . Appealed which cost $550 . Get railroaded in appeal based on my free speech in the traffic stop which cost another $900 then was denied all discovery therefore I couldn't prove my case before the supreme court of Tennessee so had to pay the original $60 fine . Nothing but a cash grab using lawfare ...
@valcaron exactly as I was trying to do however the cop kept demanding unlawful things so in frustration I said a cuss word . Which was why the second judge said he found probable cause to convict me beyond a reasonable doubt .
@valcaron actually, the judges shouldnt use your free speech on you. While we need to not talk to them at all, but you should have the right to exercise all rights. What you said, to me, sounds like you dont want people to exercise their rights.
The officer extended the traffic stop the second he said he wasn't going to cote him. If officer discretion is going to be the basis then it should be able to be challenged in court without the court giving deference to the officer.
Assuming a judge is doing his job right, how laughable. Local magistrate put a 100k felony bond on me and 3 others for recording police at a pokice station. District judge quashed it. Magistrates are the ones signing blank check warrants every day.
It was a rookie magistrate that signed off on the warrant to toss that newspaper office, which resulted in a woman dying from the stress of her home being raided by police.

But to say I have given you all that the laws require me to do, other than that means you are trying to get rid of or remove my rights under the constitution by your badge beyond your authority !...
You guys missed a HUGE point in talking about to dog alerts. That is, perfectly legal Dr. prescribed oxy smells the same as stolen illegal oxy. Marijuana has gone recreational legal in my state of Ohio, but none of the K9s that have been trained to alert to Marijuana have been pulled from service. How does the scent of something that is perfectly legal generate probable cause for a search. The dog will never be able to tell us what it smelled. Also, in this day in age, who thinks cops aren't just teaching them to alert to diesel fuel, gasoline, or even automotive carpet. I think some agencies just bring in dogs from home and just say that they alerted so they can search. Bottom line is if cops really want to search they are going to do it legal or not.
THANK YOU, THANK YOU FOR WHAT YOU ALL ARE DOING. I just read up on Steven's case and glad to see his $$ returned AND as important, his case can continue.
I remember seeing this video with Alek. I’m thrilled to hear he’s partnered with IJ and suing to defend his rights. The 4th Amendment is being ignored and constantly violated by traffic police and it needs to stop.
The stop did not "suddenly" turn bad when the cop took the man to his car. The problem started the moment the cop saw the guy and flipped on his blue lights. He was going to do what he did from that moment forward. Cooperation does not help you. Shut up, other than to assert your rights. Don't consent to anything, the outcome of your interaction is predetermined. Say no, and let them do as they will.

You’re shaking.” But I wasn’t shaking. I didn’t contradict him but I said but I don’t feel myself shaking or see myself shaking… but he just went on with asking why I was nervous… what’s in the car etc. I finally just was honest and said well, I’ve seen videos of police and I just kept saying “you know… “ because I couldn’t finish the sentence and say “Sir, I’m afraid you might murder me! 😂 he let me go. I’d been going 5 miles over the speed limit. This was in NY. They shouldn’t train cops to do this… this is what they are instructed to do! It’s treating innocent people like criminals. ive seen video's of that cop before. He is complete Trash. We need laws changed nation wide. We love you guys. You fight for the majority of us who cant afford to.
No matter what you do cops spin it as suspicious. There is no proper way to not be suspicious. That's why you should assert your right to remain silent and your right to an attorney. They can't use that against you as being suspicious if you do? Or can they? Can a cop legitimately say that he had RAS because you asserted your right to remain silent and your right to an attorney?
You are under no obligation to speak to a cop. Just tell the cop "I don't answer questions." Your 5th Amendment allows you to remain silent. Never talk to cops.
Most magistrates will sign any warrant request and have total immunity for it. Not a solution. Need to bolster probable cause and reasonable suspicion thresholds. Need to have instant reparations for mistakes made.
The legal precedent that allowed for warrantless searches started during Prohibition, an amendment that was as so bad it was repealed. Why the legal precedents set during Prohibition remain valid is unclear. But the 50 year old “War on Drugs” has amplified the impact of a poor decision. The police will claim any behavior is suspicious and gives them probable cause to search anyone. The only relief an innocent victim can persue is a Civil suit. But in cases such as this one what were the damages? What amount would be necessary to make someone whole for a ransacked truck and 90 minutes of his time?
Everyone here needs to immediately go and watch Barry Cooper’s videos “Never Get Busted Again.” Barry Cooper is a former Narcotics Task Force Agent and he has exposed a mess of secrets and unlawful methods the police use to get an arrest. It's not "seems" , it is.
It’s the military “us v them” mentality
There is no better description of a narcissist than a police officer who ruins lives every single day and goes home feeling like a hero…
The real problem is not judges who are lied to by police who don't do due diligence when signing the warrant. It's when those judges after finding the cop lied don't immediately jail the officer for contempt and have charges pressed for perjury.
It should be a 10 year felony for lying on a police report.
Highway robbery.
Imagine how much money the ATF ,DEA and FBI have obtained since the inception of this "law" and haven't disclosed it. Smh

@@3_Klos1122you nailed it
The law enforcement slush fund (the civil forfeiture monies) is over 5 Billion now.
That is "off the books" monies that can be used by agencies for whatever they want... mostly to increase the militarization of the police departments meant to serve and protect (we are not foreign combatants!)
And used to continue to fund new task forces and schemes to gain even more in civil forfeiture! (Look up project/ operation runway... where police officers not even in the jurisdiction of the airports can go "fishing" for monies as passengers are literally in the final walkway boarding a plane. Saying they are part of TSA, or that it is a random "final check before boarding!)
The laws protecting criminals are much harder, so, like any other unethical and immoral predator, they go after the "easy money"
(Look into criminal asset forfeiture versus civil asset forfeiture.)
I'm so glad for the institute for justice taking on the government about this outrageous atrocity against our own citizens.
The legislation was drafted in 1984, and passed shortly thereafter as part of a budget bill. When I point out the name of the sponsor of that legislation, my comments are removed. But it was a prominent senator …

The messed up thing is invoking your constitutional rights does not protect anyone in the moment. Invoking someone's rights just raises the odds of being physically injured. Legally, it may protect you, but physically, in the moment, it won't
Regarding the drug sniffing dog. The 6th amendment guarantees the right to be confronted with the witnesses against him. In trial, can you have the dog take the stand and testify to what they smelled?
Dogs in LE are unconstitutional.

The fact that there are no consequences for bad stops is what enables this behavior to continue.
Officer: "suspect is acting suspicious"
Dog: "alerts on car" (supposedly, in the officer's judgement)
Officers: detain citizen and search vehicle in over one hour stop
NOTHING FOUND AT ALL
Officer: "have a nice day" (rinse, repeat)
There have to be repercussions for making wholly bad stops.
HORIZONTAL AND BLOODY COSTUMES LITTERING OUR ROADS WILL SOON BECOME A DAILY SIGHT, IF THE PIRATES DO NOT STOP!

There is a reason for it, such as abandoned property that they believe to be the proceeds of a crime. However, if the owner is there, then they need to bring the suit against that person, and not charge the property with being tainted.

How does "probable cause" segue so easily into "reasonable suspicion"?
The gullibility of Americans is mind-blowing. Back the Blue, support the courts, make sure you hire a BAR member, and don't forget to vote! You may notice that we are not perpetually getting more free with unalienable rights as courts make more and more rulings.

People doing many jobs, multi-tasking, exigent expediency, lack of oversight, makes the Constitution more needed!

The second they say "I smell an odor", you know you have a criminal cop. Tell him he should shower.
You are under no obligation to speak to a cop.
Just tell the cop "I don't answer questions."
Your 5th Amendment allows you to remain silent.
Everyone here needs to immediately go and watch Barry Cooper’s videos “Never Get Busted Again.”
