We discuss why it is that most private land in America gets no protection from warrantless government surveillance. We are joined by IJ attorney and co-director of IJ’s Project on the Fourth Amendment, Josh Windham.

      Why do the people whose job it is to enforce our law need protection from it? And don't give me the bullshit of trespassing. We could just write a law saying that when necessary cops can trespass! We could also make a separate law for undercover work. Regular cops don't need the same protections that undercover cops need. And it's ridiculous that they have them.

    • @coldkill207
      @coldkill207 15 дней назад

      We already have that, if there's enough evidence police can get warrants to circumvent rights to a degree. Undercover has to work within the law or the evidence collected can become fruit of the poisonous tree.
      The big issue with what police are doing is they figured out they don't actually get in trouble when they break the law so they started ignoring law. If the police want to screw your life over temporarily or even permanently just because they want to, they can do whatever they feel like and just say for officer saftey and the courts then go oh okay carry on. When that doesn't work the courts punish the taxpayers by paying out settlements instead of punishing the bad behavior of the police. And that only happens if it gets to the court to begin with since police investigate police and DAs are gun shy to go after police.

      What does it cost for 6' high chain link fence with gates around a 30 acre parcel? That's close to 7000 feet of fence, far above most private land owner's budgets.
      That kind of fence also disrupts wildlife, in ways where a legal standard based on that kind of arrogant costs imposition and tampering with nature violates religious and cultural rights, if honestly upheld.
      That may be why a mix of limited signs plus in between tree paint swatches are recognized in some states, but so inconsistently most of us wouldn't recognize such provisions in law if not local and familiar.

      While I agree with you, I think the problem is the 4th amendment uses the word HOME instead of property. The courts and government like to play semantics so they are saying only your home is protected, not your property outside the home. But if you can have someone trespassed, then that defies their logic. Also go lurk and try to set up cameras on GOVERNMENT property and see how THEY perceive the law. If the court actually believes that your HOME is only protected, then I guess your business is not protected and that is open fields as well. They just make it up as the go. If open fields is really a thing, then why do police who knock and talk have to leave when you tell them to. No reasonable person actually believes that the government lurking on your property in cammo, hiding in the woods is reasonable . Try that on G.W. Bushes ranch once and see how it goes.

      years ago, There was a guy with money, whom bought a few acres in NJ, and decided to put in a commune (he had a commune fantasy). He put a building, with individual apartments, but without bathrooms, and kitchens. They used the public kitchen/bathrooms. The neighbors were losing their minds that the high fence was around the property, and they accused them of being a cult. Their dogs were able to run free in a fenced in area. They could play tennis, but never did. They could play basket ball, but never did. They went to work, paid their "rent", and not much else. The guy in charge, became disillusioned, as the tenants, were not clean, and left their dishes without cleaning too long, nor were they farming for food, etc. So, he was shutting it down for 20 years. While the neighborhood was growing. But the neighbors fear of the fence, got weirder, and weirder. The tenants were upset, because they thought they should have some ownership of the commune. lol. After twenty years, he narrowed it down to one last tenant, and eventually died. Everyone was so worked up, about what illegal activity was going on behind the fence. (lol). The shocker, is how much law enforcement was involved, where no crime was committed. (lol).

Remember too that wildlife is the property of the state, not the landowner. The state needs the legal right to monitor wildlife populations and control wildlife harvest, even on private land. Landowners in my state can get inexpensive permits to harvest wildlife on their own land too so there is no need for them to poach.

    How does a Supreme Government Court ruling apply to EVERYONE if there is no PERSONAL JURISDICTION?

    • @thegoondockswarcouncil9543
      @thegoondockswarcouncil9543 14 дней назад

      The ruling doesn’t apply to you in the direct sense. But the principle established by the ruling sets the rules that lower courts will apply when similar cases arise. If you find yourself as the defendant in such a case, it is the lower court hearing your case that will have personal jurisdiction over you, and it is their ruling that will be applied to you. They may base their ruling on the legal principle of the Supreme Court ruling (or they might ignore it), but they are not applying the Supreme Court ruling to you, they are applying their own ruling for which personal jurisdiction does exist.
