    The HOA president lied and “screwed” the landowner first, by canceling all the agreements they had. I would have never agreed to any of those easement, etc in the first place. However, the landowner had tried to be a good neighbor and the HOA president was not a good neighbor back.
    The HOA and the president got what he deserved. As the saying goes,”What comes around go’s around”.

      Yeah it was pretty clear the HOA president was being the tyrant of his "domain" and though it was impossible for him to be defeated there. Also it seems like he was someone who inherited his wealth and heard their parent or grandparent use the line they used on the OP but never really got the wisdom behind that line, the sloppy copy/paste on the contract suggested as much as you always double check all relevant info on a contract even if you're the one benefiting as a simple error can make the contract null and void.
      Then there's the fact when lawyer says "Are you sure you want to sign this" it typically means you need to read what you're signing and not just rely on suing after the fact.
      One thing my late dad who was a contract lawyer taught me and my brother was that you always check before you sign anything since by signing you accept the terms of the contract and courts (mind I do not live in the US but as far as I understand this true there too) won't just give you better contract because you thought the original was "unfair". Only exceptions being contracts that are considered "unjust" (what this means depends, but for example a contract cannot demand something that's literally impossible or illegal) and even then the contract is just declared void.

      honestly Im surprised the exemptions could be retracted in the first place, that was part of the terms of the deal and part of the reason it was accepted in the first place, if I was involved in that I would make sure the contract has the exemptions immutable and in writing, and including exemptions from any future additional restrictions. HOA president proved why Im never living in another HOA community real quick, can't trust HOAs or the people in them to be even somewhat reasonable, if anything I swear my non HOA neighbors are nicer than any HOA ones Ive had, probably because we all just want to live our lives

      @@refraggedbean Yea, I was floored a judge upheld the retroactive shenanigans. That should be flat out illegal. You don't get to change a contract once it's been signed. If that's legal, then contracts aren't worth the paper they're written on. Now...if the HOA had voted to change the rules, then I might understand, but NOT retroactively.
      I hate HOA's. I've never heard of a good one.

    This is the greatest story I've ever heard. I heard a story once where some guy had bought a house in a new subdivision, and when the developer told him about the HOA he'd created, the purchaser realized he was the only member -- and after reading the bylaws, he called an emergency meeting and dissolved it on the spot

Not to mention just because the people on THEIR land agreed to some rules doesn’t mean the person buying land near them has to kneel at their feet and pay them a tax to live there. “Live somewhere else” as if HOAs aren’t all over the place.

      Not a lawyer, but I bet the paralegal was right that the contract wouldn't hold up. But, I definitely think OP had a good strategy. As long as they don't mess with the HOA further I bet OP comes out on top in the long.

    I shouldn't be but I'm mind blown at how badly the HOA tried to utterly, immediately bulldoze OP for the mistake of showing them trust and good will. It's like the kinds of folks who run these things can't help themselves. Always good to hear of a case where they were made to regret it.

      I agree that seemed all too coincidental, but depending on where this story takes place drunken idiots or people high on something shooting guns randomly into the night isn’t uncommon. It could have been a real incident.

    The dude’s tenants get the benefits of a prim and proper, nice looking quiet neighborhood, while also not having to listen to the Karen’s that live in it. Being apart of it and experiencing it, but not actually apart of it.
    He’s made himself (or, rather his property) a golden egg, plus he gets monthly payments!
    I’d totally rent from him. (He should have no shortages of renters)
    He got to have his cake and eat it too! This was so satisfying.

    Absolutely loved every minute of this. I once worked as the Foreman of the team of contractural gardeners for an HOA in England and we managed to silently, "Get one over on them", on many occasions by sticking to their own stupid rules. Came to the conclusion that HOA stands for "House Of Arseholes". Relish every victory anywhere, against such narrow minded selfish, entitled people.

    HOA's are a good example of "you will own nothing". Anyone part of an HOA like that ( maybe I only hear the bad stories) can never talk about property rights, personal property, personal liberty, they don't believe in it.

    This actually reminds of a thing i did in college. I rented an apartment, and the company that managed the property sent me a rental contract in the mail. I had heard from another student at the university that these property management types never really double checked their documents. The last page only had about 1/6th of it used up, so i used MS word to add a couple things to the last page of contract. I included a pet clause (i would pay 10$ extra per month for pets, not including my service dog, and the amount did not increase per pet) and i would be allowed to have my own washer and dryer in my unit due to my student nursing work meaning i would either be in class, or at work while the basement was unlocked for access to the laundry room there (they locked it at night, because drug addicts would steal the chemicals)
    I also added a bit having a designated parking spot in the lot, for an additional cost of 10$ per month. I wasnt trying to screw them over completely. And that actually worked in my favor, i got a phone call, and the property manager was actually having giggle fits over what i added. He accepted the new terms, but told me to bring it up in person next time. He even added that i was free to ask his wife, who lived in the building with him, to watch my service dog if i couldnt take her with me for any reason.
    i mean, i TRIED to pull a fast one, but this was a smaller rental management business, and the guy was actually really great. When his son took over, i moved out because the whole thing turned to shit. My new landlord insisted i call her MeeMaw, and i swear, she got me to put on 60 pounds in the first year i was living in her upstairs inlaw apartment. I had always struggled with weight gain, but this woman made food you could not refuse.

    I met a trucker who owned some farm land surrounded by a country road. He had a dirt drive that people in a housing tract used to save a half mile loop around his land. He had no problem till he learned that if he allowed unlimited use he'd lose title to that piece of land, so he had to close the drive one day a year.
    So he for one day he put up a big locked chain closing their shortcut. One of the citizens called the police, when he refused to open the drive the cop cut the chain and arrested the owner. In the south he called the county constable for help. Due to the fact that the cop had taken the innocent man on his own land the officer was in the wrong. Constables are over the regular policemen.
    The matter was solved when it was agreed that the city cops would use their cars to block the drive, closing it one day a year. He retained control of the property and everyone was happy.

    I remember when my uncle convinced almost everyone in my old neighborhood to build a ham radio tower in their backyard to piss of the HOA it pissed the living shit out of my HOA that they would get on anyone for even the smallest thing but eventually the HOA went away which was a blessing

    This story warms the cockles of my heart. I love it. I *_HATE_* HOA's. Having to sign an HOA agreement when buying house is an absolute deal breaker for me. "Oh, I have to sign the HOA rules to purchase the home? Ok. Find another patsy. Because I won't be a member of an HOA *AT ALL, PERIOD.*

      I think they advantages are definitely outweighed by the disadvantages, but it’s difficult to find a home in my area that isn’t part of an HOA unless you want to live in the boonies.

    It seems that every HOA is toxic. I never really dealt with an HOA before, until I moved into my new apartment. We had some rips in our screens so they had us send them out to get fixed (they paid for it) then they sent us a fine for not having screens. Our landlord took care of it. Recently they told us we need to remove the cable/internet lines coming out of our apartment, going into the ground, hidden by bushes, not bothering anyone. We told our landlord we weren't going to do that, unless they pay for them to moved somewhere else. Haven't heard anything since.

      There probably are many non-toxic HOAs, it's just that a HOA is good when it limits itself to taking care of the common areas and any conformity standards are just the the bare minimum and barely intrusive at all for the people who live there. Thus they are basically invisible and certainly don't into the news. Some of the people living there might not even quite realize they have a HOA save for the dues, and even that might get missed if they do the paying of bills more or less on autopilot.

      Here's an example of a good HOA (IE. mine). All grounds work is paid for, all exterior maintenence is covered, the roofs on all townhouses is budgeted for to be replaced every 17 years or when needed, all road work is covered, gated security is covered, HOA even went and sued the roofer that originally built the propertyu on the owners behalf due to defects discovered in construction. I find that HOA management companies are the best, no petty little lords who want to rule a fief, just usually a normal corporate governance for a fee.

      We just moved into a home with an HOA after terrible experiences owning a non-HOA home (it was a nightmare to sell). We did a lot of research and found a very reasonable and small rules HOA. So far, we have been extremely lucky.

    Contractu: a minor god that takes the form of a neighbor, boss or manager that will tell people who are struggling with a issue under contract to check said contract. Any incident that Contractu interferes with will ultimately end with the the given person winning in any and all legal actions and will end in a feeling of extreme satisfaction

    The president of the HOA was the one that scared that tenant to force OP to join the HOA and the rest. It was the president or someone he hired. So I'm glad he got what was coming to him.

      Yea, this was so obvious I'm surprised OP didn't call them on it. I'd have just set up security cameras and made sure the HOA, and more importantly my tenants, knew I suspected their board.

    That judge is completely wrong. It is illegal to alter contracts without both parties agreeing. This would make the contract void at the violators expense.

      It may not have been mentioned in the story, but the contract itself may have had a fine print clause, which is why it was technically legal in this case. I mean this story covered a number of years, I'm sure it's not 100% of the details involved, just the majority overview.

      Contracts and TOS often say they can be modified at any time without advanced notice, and that they merely have to notify you of the changes. Go read some. This website has one like that.

      my current home is in a really weird spot, we live in two counties at once, we are physically inside of the hoas area, but due to weird government zoning our home is part of a separate county from the hoa and so they can’t do shit to us. best thing since sliced bread

    When we were looking for a house a few years ago, I found a really nice one, very close to a school in a nice neighborhood. I asked the realtor if there was an HOA, and he said there was one when the subdivision was built, but the homeowners dissolved it 20 years prior. I knew this was the neighborhood for me, and we bought the house.

    A HOA is Not a Money Making Business. Yes, it needs to have Money to Pay for Upkeep for things. But a HOA is All Voluntary. There is NO PAY Positions Except for the LAWYER/Law Firm, Lawn Services, Snow Removal Services types. But the Board Members Do Not Get Paid PERIOD. If you are in a HOA and Board Members are Getting PAID. Then Run Away from that HOA, Consider a Class Action Lawsuit then, That HOA is then Corrupt.

    HOA are a pain in the ass. It seems like the people running them are always on a power trip. They went after my mom over a couple of dandelions. My mom pointed out that the big area next to her house with a walking path through it, had hundreds of dandelions. And that the HOA should take care of those dandelions before going after her. Because that’s where all the dandelion seeds were coming from.

      I don't even know why people hate dandelions, it's just flowers, same with clover and a few other things that might grow in a lawn, why does it matter if it's 100% grass? I swear I think I'd end up just building a border around the yard and calling it a flower bed, and if I want grass between my flowers and clover patches, that's just the variety I like.
      Why not have grass and flowers mixed? Nice green instead of dirt under and around the flower.

    14:43 FYI, arbitration is not the same as mediation. In mediation, the mediator tries to work with the parties to help them reach a settlement, but no one’s required to settle if they don’t get an offer they find acceptable. In arbitration, the arbitrator basically decides the case and the arbitrator’s decision is binding on everyone (it can be overturned in court, but not easily). Basically, mediation is like settlement talks with a neutral third party helping out (which helps a lot more than you’d think), while arbitration is like a far less formal (and less expensive) form of court case-many reality courtroom shows are actually arbitration to avoid the rules that make actual trials less entertaining.
    OP’s point is that the agreement was for mediation, not arbitration, so no one had to agree to anything they didn’t want to, and the HOA’s apparent belief that the paralegal could rule in their favor was simply wrong.

      They are handy for managing property features that are held in common between properties such as a pool when none of the properties have much more than 100 ft^2 of dirt for a "yard" or when many buildings share a common exterior, see some townhouses.

      HOAs were almost absolutely designed after the end of the Civil War to try and prevent minorities from being able to own houses in neighborhoods, by giving a body headed by existing neighbors the power to enforce arbitrary rules on the entire neighborhood that could be easily fine-tuned to target people who could just barely afford their houses.
      They really don't need to exist, or their power needs to be significantly rolled back for the good of all people, but due to democratic shenanigans, they're probably not ever going to...

      The main reason they exist now is because the home appraisal system is bullshit. The value of your home could be reduced by as much as 10% due to a bad neighbor's home. There would truly be no need for an HOA if your home value wasn't dependent on my home.
      The idea behind an HOA isn't bad. It's basically: "let's all agree to keep our homes decent so that we don't fuck each other over." The problem is in the administration because people become assholes when you give them a little bit of power.

    As a grandson of someone who got screwed over by an OO becoming a shadowy HOA doing everything they can to get money from property owners, this story not only washed my mind, but also gave me many ideas on what to look for whenever they come at me (the property in question was already legally passed on to his heirs, and since my mother passed away, I'm already a legal owner, so any day now we may receive official letters - instead of him, who they always go after singled-out first, just to get the case dismissed or ammended - and I'll be the one dealing the cards...) I could relate the story to so much detail in our case, that I think I'll look for whoever wrote it and see if it isn't the same HOA. That would just be wild...

    Good thing the HOA from where I live doesn't enforce what plants to plant, what your number of dogs are, and most definitely they don't enforce one single lool of house. If anyone can see the houses here you can tell that everything lools way different from each other. What we do like about our HOA here is that the street road is now leveled and clean and the sewage is always fixed.

    Whenever I go house shopping, my first question to the Realtor is, "is there an HOA?" If there is, I say, "skip that property and any other property you find that has an HOA, I will not be purchasing property in an HOA, no discussions!"

    Could someone please explain to me what the pros are from being part of an HOA? I just don't get the concept of it and why you would want to be part of it

      managing community property like a common pool or lake. best to let their rights of government start and stop with the common properties though.

      They're not a bad idea on paper. Making sure that homeowners are keeping their property in good repair etc to help keep the property values high (since an eyesore house can potentially reduce your property's value, which costs you money if you decide to sell your house) and to provide for some other neighborhood perks that improve property values. Like paying to make it a gated community.
      The problem is that power corrupts and so you inevitably have someone get a bit of power and have it go straight to their head (assuming they aren't doing anything else illegal like, embezzling), and the system has few or any checks and balances so unless they piss enough people off to the point where they're motivated to take action... they're free to continue to be their petty dictator.

    I have been advising people all of my adult life to NEVER, EVER join any HOA for any reason. The people running HOA's all too often go nuts with malicious intent, fining people, ruining their lives simply because they can.

    My GF lived in an HOA when I met her. They were so screwed up. Two oases of a 5 phase development with a shared pool.
    Except they hadn’t been legal, and really never were, from the time the second phase was built and crated their own illegal HOA instead of adding to the existing one.
    On reading the legal docs I became a “recognized co owner” as there was no requirement to be in the deed.
    I then became the HOA chairman (her side) and met with the other side that was trying to get us to pay for a new fence they had had installed around the pool without consulting our Board.
    When we left they were not happy as they I offered to pay 25% of the fence….. the pool side was the two HOAs but the other side was an outside owner. I told them that the outside owner was responsible for 1/2 and each half of the HOA was responsible for 1/2 of the other half I.e 25%.
    Then they wanted me to help them recover the other 50% from the outside owner and I said “No, you arbitrarily did it just like you’ve done other things in the past like imposing pool rules, locking the pool, etc.
    Until it’s uncomfortable or even painful, you’ll keep doing those things. So we are prepared to pay 25% or nothing.
    They chose nothing for some reason.
    Shortly after I did a layman’s reserves study. The total assets of the HOA were about $3500 cash and nothing else. No required reserve accounts, no plan for big ticket items the HOA was responsible for.
    We sold and got out of there FAST

    This is why *_ALL_* HOA's, _nation-wide,_ should be required to be voluntary. Even if a previous owner _was_ a member of the HOA, you are not required to join and the HOA cannot contact you in any way and can enforce _nothing_ about *_your_* property.
