Dear Sirs thank you very much for the explanation of act of payment of Graduaeity my question is on if the employee is getting the benefits of provident fund and ESI if Section 5 is applicable or not?
Under section 5, you will not get benefits under this act only if you are already getting a better gratuity like provisions from your employer which are better than this Act. PF and ESI will not prevent you from getting gratuity.

Sir if the company terminate the employee for 3 month during lockdown and 4.5year has been completed and after 3 month they rejoin the employee again an he works for more than 12 month then is it liable for gratuity plzz reply and also does 3 month also count while calculating?
if he has worked for 4.5 years then he is eligible for gratuity.

Dear Dev Yes. Your correct.video was recorded before increase..Power to fix the Max ceiling of Gratuity amount has been given to Government via amendment Act 2018, & Government has notified the Maximum amount as 20 Lacs.

@@sumitjain5393 Hi Sumit....Yes, I received the gratuity from my last organization where I worked for 4 years and 11 months......There is a clause in gratuity act which states that if we complete around 240 days in 5th year, then we are eligible for gratuity....Please explore the act for complete details.....Thanks

Sir is it applicable 4.6 years
Law provides a limit of 5 Years. However company may pay for a lesser period. It depends on company's policy. However in cease of death or disablement limit of 5 years does not apply.
Further government is trying to reduce this limit between 1 to 3 years instead of 5 Years.
