I don't know how many times I've said this to people now, but I'm pretty sure tariffs on canvas items imported from China created this problem. The important thing to remember about that though is it has more to do with wanting to exploit cheap Chinese labor than it does the price of the raw materials themselves.

It may sound a bit sinister and mean-spirited, but I'm SOOOOO happy this is blowing back on Bethesda. Not only because of the lousy business practices and essentially conning the customer with the preorder items, but because of the back alley slandering Todd Howard did against Sony regarding allowing crossplay. Remember “We’d really love that but right now we can’t. Sony is not as helpful as everyone would like.”, yeah that was not a good look for Sony, however as soon as Sony opened up to the idea he backtracked and said "we have no plans of introducing crossplay into Fallout 76". That, to me, was an ever worse look as he was pouring gasoline on the raging internet fire on the topic of Sony not allowing crossplay and trying to appear that Bethesda is consumer friendly and trying to add more features to the game, instead they NEVER had any intentions of doing so and looked like immature fanboys.
I would really like to know why all the big companies got a sudden and intense case of the stupid. Bethesda could have hired a 12 yo kid sat him in front of their twitter account and that kid would have made a better job at PR. Crossplay between PC and PS3 has been a thing for a long time. PS were the first to do it. They just don't do it with Microsoft or Nintendo. Which may I remind you turned Sony down when they initially tried to make it happen. So not only were they turned down but the gaming community in general only criticised Sony for doing so. Claiming Sony only wanted it to leech off of Microsoft. I still remember being made fun of for buying a Play Station. And I still remember getting shit from everybody and everyone for suggesting cross play might be a good thing. But why would Microsoft give a shit about filthy Sony fan boys right? According to google the current price for a canvas bag is $36 with a sales over 400 dollars. canvas bags themselves can be sold for less. With this in mind there is no excuse they can give that justifies the fraud they commited

No there isnt, the only line is whether they can get away with it. Sadly for Bethesda they overstepped. Though theres always the possibility that they'll get away with this free and clear, that'd be pretty funny, and we all know no matter how pissed people are now, virtually all of them will come back for Elder Scrolls 6.
Canvas is generally more expensive than synthetic nylon, there is little doubt about that. Though there are varying quality and workmanship in canvas and nylon materials. My best guess is that Bethesda (like most companies these days) subcontracted some party to help them design and source the bag for them however someone down the line (probably Bethesda) did not foresaw the actual cost of making a quality canvas bag that can live up with the appearance of their advertised so-called "prototype" so instead of doing the ethical thing like canceling those pre-order or compensate their customers with other physical item of similar value, they instead choose the cheaper and scummy way out by doing the old bait-and-switch routine. This is very common oversight that happens in a lot of businesses since a company like Bethesda does not produce or market bags or similar products for a living, they are first and foremost a videogame development studio. Regardless they basically dug their own legal grave since such practice are widely considered misleading to the consumers.
Hmmm not when they’re charging $200 for it. Canvas bags don’t cost that much to make compared to what they’re charging. You can get one for $20 with your name and pictures printed on it.
I work for a distributor in the promo products industry and you’re spot on. They either had someone internally make a virtual of the bag and then when they got it sourced and found out the actual cost was a lot higher than they anticipated. Or they fucked around and waited till the last minute to order them and at the quantity they probably ordered weren’t able to secure enough stock and had to go with nylon. Who knows but they’re definitely scuzzy ethically.
@@colonelflom262 I do get that they probably outsourced the bag to a different party, but what they could have done is actually is order the material themselves by the 1/2 yard and seriously save money because many other people sell canvas at different prices. Meaning that the possibility of saving money was there, giving said canvas to the third party and ordering the rest of the material that isn't the prime canvas itself. You can buy canvas by the bulk; while they sold the Power Armor edition for 200 a piece, the chance of zero losses profit wise is there. Literally anyone could buy canvas, even any company that might possibly need it.

I dont know about you but the Collector's Edition is way less attractive with a nylon bag than a canvas bag. Other than that, pure semantics :)

Take a look at this bait and switch example on the FTC website www.ftc.gov/news-events/blogs/business-blog/2016/10/abating-bait-switch-buyback-tactic-devices . It involves a company offering a large sum for tradeins and then when they got the product they gave a different amount which was much lower. This is what bethesda is doing, offering a high value canvas bag and instead providing a shitty plastic bag.

Verlisify that doesn’t make much sense though. Yeah it would maybe cost less, but the damage done to their reputation was huge here (as if Fallout 76 wasn’t enough.) Honestly they could have mitigated the entire thing. Had they been honest with people I don’t think much would’ve changed. The big sell of the collectors was the helmet and (apparently) the game. The bag was one of the weaker items in the offer. They could have honestly just advertised the change and I’m sure they would have saved themselves the backlash.

no legal expert here, but i think taking their offer of 500 atoms would count as "accepting a settlement". after you accept a settlement then you cannot ask for more later in court.

It's also unsustainable. It only appears to be more profitable over the short term. The relationship between consumer and the market is a two way street and simply can not survive yet alone thrive without one or the other. One side parasiticly devouring the other inevitably stunts growth and we've already seen evidence of that. They've given up on attempting to grow their farm of consumers and instead have resorted to bleeding what they already have dry. And the smaller that audience becomes the harder they feel the need to squeeze to compensate. It's like butchering all your livestock in one go because you can't wait for them to breed to sell your beef. There'll be nothing left when they're done.

Obsidian isn't the same company anymore but honestly I think I would rather play an EA game over a Bethesda game now, at least with EA you know they suck. So all in all they would make anything better than Fallout 76.

We have a similar system to the FTC here in Australia, the ACCC (Australian Competition and Consumer Commission). I can see them taking this pretty far, the ACCC managed to fine Valve 3mil for misleading representation of Steam's refund policy back in 2016. When it comes to consumer rights that's one thing our country is pretty good at :P

As a professional in related but different industry verticals to gaming, I can pretty comprehensively say as the compliance official for my company that if we ever did anything like this, the Government would rain brimstone on us. It would just take 3-7 years for it happen. Without a leader to promote the complaint, a sufficient number of individual complaints filed with the FTC directly by consumers, and a law firm or three to take up the mantle of the case, this will go nowhere. Big companies have all the advantages, all the money, and none of the fucks. If everyone who purchased the edition with the deceptive item filed individually, followed by a class-action case, the FTC would have almost no choice but to begin an investigation. It might take years, but those years are punishing for the company(s) under such scrutiny.
Tbh if i was in Bethesda's position, I would immediately refund those that bought the special edition AND give them the free atoms. It would lose me a ton of profit, but its the only way to salvage whatever faith the fanbase has left.

I don't know how many times I've said this to people now, but I'm pretty sure tariffs on canvas items imported from China created this problem. The important thing to remember about that though is it has more to do with wanting to exploit cheap Chinese labor than it does the price of the raw materials themselves.
There are laws against this. A judge can rule that the compensation was unfair and thus unlawful.

It may sound a bit sinister and mean-spirited, but I'm SOOOOO happy this is blowing back on Bethesda. Not only because of the lousy business practices and essentially conning the customer with the preorder items, but because of the back alley slandering Todd Howard did against Sony regarding allowing crossplay. Remember “We’d really love that but right now we can’t. Sony is not as helpful as everyone would like.”, yeah that was not a good look for Sony, however as soon as Sony opened up to the idea he backtracked and said "we have no plans of introducing crossplay into Fallout 76". That, to me, was an ever worse look as he was pouring gasoline on the raging internet fire on the topic of Sony not allowing crossplay and trying to appear that Bethesda is consumer friendly and trying to add more features to the game, instead they NEVER had any intentions of doing so and looked like immature fanboys.
It's not sinister at all they are getting the backlash they deserve for their lies and scummy business practices. Bethesda has lost my respect.

Crossplay between PC and PS3 has been a thing for a long time. PS were the first to do it. They just don't do it with Microsoft or Nintendo. Which may I remind you turned Sony down when they initially tried to make it happen. So not only were they turned down but the gaming community in general only criticised Sony for doing so. Claiming Sony only wanted it to leech off of Microsoft. I still remember being made fun of for buying a Play Station. And I still remember getting shit from everybody and everyone for suggesting cross play might be a good thing. But why would Microsoft give a shit about filthy Sony fan boys right? Now the tables have turned and the hypocrisy is apparent. So perhaps show just a little bit of leniency for the people who felt burned by it. Sony were never against crossplay. They're just against working with Microsoft for the benefit of Microsoft for a community that for the most part doesn't even buy their shit. Like you said. You don't intend to buy a PS. So the question isn't how much you want to play with your friends. It's how much your friends want to play with you. So do tell. If you aren't a customer of Sony and don't intend to be one. Then who should they be listening to? You? Or their customers? Because currently more and better exclusives is well above crossplay on the priority list of most PS owners.

No there isnt, the only line is whether they can get away with it. Sadly for Bethesda they overstepped. Though theres always the possibility that they'll get away with this free and clear, that'd be pretty funny, and we all know no matter how pissed people are now, virtually all of them will come back for Elder Scrolls 6.
Canvas is generally more expensive than synthetic nylon, there is little doubt about that. Though there are varying quality and workmanship in canvas and nylon materials.
My best guess is that Bethesda (like most companies these days) subcontracted some party to help them design and source the bag for them however someone down the line (probably Bethesda) did not foresaw the actual cost of making a quality canvas bag that can live up with the appearance of their advertised so-called "prototype" so instead of doing the ethical thing like canceling those pre-order or compensate their customers with other physical item of similar value, they instead choose the cheaper and scummy way out by doing the old bait-and-switch routine.
This is very common oversight that happens in a lot of businesses since a company like Bethesda does not produce or market bags or similar products for a living, they are first and foremost a videogame development studio. Regardless they basically dug their own legal grave since such practice are widely considered misleading to the consumers.
Hmmm not when they’re charging $200 for it. Canvas bags don’t cost that much to make compared to what they’re charging. You can get one for $20 with your name and pictures printed on it.

I work for a distributor in the promo products industry and you’re spot on. They either had someone internally make a virtual of the bag and then when they got it sourced and found out the actual cost was a lot higher than they anticipated. Or they fucked around and waited till the last minute to order them and at the quantity they probably ordered weren’t able to secure enough stock and had to go with nylon. Who knows but they’re definitely scuzzy ethically.
@@colonelflom262 I do get that they probably outsourced the bag to a different party, but what they could have done is actually is order the material themselves by the 1/2 yard and seriously save money because many other people sell canvas at different prices. Meaning that the possibility of saving money was there, giving said canvas to the third party and ordering the rest of the material that isn't the prime canvas itself. You can buy canvas by the bulk; while they sold the Power Armor edition for 200 a piece, the chance of zero losses profit wise is there. Literally anyone could buy canvas, even any company that might possibly need it.

That is the most common example of a bait and switch. It doesnt mean that it is the only valid one. Take a look at this bait and switch example on the FTC website www.ftc.gov/news-events/blogs/business-blog/2016/10/abating-bait-switch-buyback-tactic-devices . It involves a company offering a large sum for tradeins and then when they got the product they gave a different amount which was much lower. This is what bethesda is doing, offering a high value canvas bag and instead providing a shitty plastic bag.
This is all so much funnier when you remember how awkwardly self-assured and cocky the company’s E3 presentation was a few months ago.
They'll have a lot of explaining to do at E3 next year, provided they even show up.

Verlisify that doesn’t make much sense though. Yeah it would maybe cost less, but the damage done to their reputation was huge here (as if Fallout 76 wasn’t enough.)
Honestly they could have mitigated the entire thing. Had they been honest with people I don’t think much would’ve changed. The big sell of the collectors was the helmet and (apparently) the game. The bag was one of the weaker items in the offer. They could have honestly just advertised the change and I’m sure they would have saved themselves the backlash.

Because fans of the old, actually good games keep buying the new ones no matter how crappy they are. Take this game for instance. It's not new. It's a crappy re-skin of Fallout 4. It cost them very little to make. If a few thousand people buy it, they made money.

i agree with you, although it did not help that the game itself has been riddled with issues on top of the bag issue. this was a very poor move for Bethesda all round. $200 for a crap bag and a glitchy game just really pours salt on an already aggravated consumer base. this has been a real bad year for the games industry due to some companies trying to make a buck by screwing their base.
To be completely fair most of your $200 was for an ugly hunk of plastic with a "teach yourself electronics" kit.
I don't actually understand why they would think it would pass... Battlefront 2 didnt pass, neither did No Man Sky so why would they do something so... Uninsightful just for the sake of christmas sales and profit...
There may have been a pass on the bag, had the game been working properly, but instead, it was really a cherry on a shit sunday. There should have been announcements made to give players a chance to opt out.

It's so weird. Such large corporations have the capacity to make even more money without cheating. Scamming is for small time crooks who are just looking for easy cash before slinking back to where they came from. It's almost like they do it because they enjoy it.

It's also unsustainable. It only appears to be more profitable over the short term. The relationship between consumer and the market is a two way street and simply can not survive yet alone thrive without one or the other. One side parasiticly devouring the other inevitably stunts growth and we've already seen evidence of that. They've given up on attempting to grow their farm of consumers and instead have resorted to bleeding what they already have dry. And the smaller that audience becomes the harder they feel the need to squeeze to compensate. It's like butchering all your livestock in one go because you can't wait for them to breed to sell your beef. There'll be nothing left when they're done.

We have a similar system to the FTC here in Australia, the ACCC (Australian Competition and Consumer Commission).
I can see them taking this pretty far, the ACCC managed to fine Valve 3mil for misleading representation of Steam's refund policy back in 2016.

As a professional in related but different industry verticals to gaming, I can pretty comprehensively say as the compliance official for my company that if we ever did anything like this, the Government would rain brimstone on us. It would just take 3-7 years for it happen. Without a leader to promote the complaint, a sufficient number of individual complaints filed with the FTC directly by consumers, and a law firm or three to take up the mantle of the case, this will go nowhere. Big companies have all the advantages, all the money, and none of the fucks. If everyone who purchased the edition with the deceptive item filed individually, followed by a class-action case, the FTC would have almost no choice but to begin an investigation. It might take years, but those years are punishing for the company(s) under such scrutiny.
