How Marijuana Is Both Legal and Illegal in the U.S.

  • More than half of the states in the U.S. have legalized recreational and medical marijuana use. However, cannabis remains just as illegal as heroin on the federal level. This environment can be tricky to navigate, both for cannabis businesses and for the lawyers who advise them. In this video, Boston University law professor Jay Wexler explains how states got around the federal ban on cannabis, and Lauren Thomas, general counsel of the marijuana software company, Dutchie, describes the unique legal challenges that cannabis businesses face. Not to mention all the chemicals added to tobacco strictly just to make tobacco products more addictive (which has always been and is still legal in my lifetime at least) why does the legalization of marijuana on a federal level have to be so complicated still, what a Joke

      @bruceniblett959 2 года назад +21

Yeah, I always think about this. The USA doesn't make sense on so many issues. Alcohol is the worst drug in the world. Most violent crimes are committed when people are drunk or blackout drunk. Drug offenses can have mandatory sentencing but rape, child molestors get out on good behavior and go do it again. I've heard of murderers getting out in 13 years and then committing murder. But some college kid gets caught selling cocaine for the first time to his friends. He gets mandatory 25 years. That is sick. Violent criminals should get the harsh sentencing not drug users or even dealers--if they aren't violent. Like you said it makes no sense when junior can go out and buy 151 and risk alcohol poisoning or a blackout where he may unknowingly commit a violent crime. Meanwhile cigarettes kill more people than all illegal drugs combined but they are ok. What a crazy country. But in Asia where I live, they think all drugs are the same as heroin. Probably because they follow the US federal policy and don't think for themselves. And of course alcohol and cigarettes are fine--oh yeah and they hand out benzos like candy and never tell you they are addictive. UPSIDE DOWN WORLD

I turned around to see a haggard looking ole fellow.....that started weeping right there in the mall?!?! The owner came around the counter and was consoling the man. After several minutes he composed himself enough to blurt out, "Mam my flashbacks have near left me and Im now sleeping 6-7 hours a night"! The gentleman was/is a Vietnam Veteran that suffered all those decades with the flash backs and rarely slept more than 2-3 hours a night. It was the gentlemans first time back to the kiosk, since purchasing his CBD and I just happened to be there! Completely random situation. F.W.I.W. I have 2 adult children with severe psychiatric challenges, one being coupled with ALS2 (Stephen Hawking) CBD ALONE haas been a GOD send for them both!! I can only imagine what Cannabis might do for them! Their story is on RUclips, "Is CBD being suppressed". Until this Federal prohibition is struck down there are alot of disabled folks that will suffer until it is!! AS evidenced in my interview about my daughter. She is in a Federalty funded nursing home and they will in no way allow or assist with the administering of CBD oil. Even if she gets her medical card we have been told. This is violation of my daughters civil liberty and civil rights!!! The Federal Cannabis prohibition needs to go now!!!!!!!

Sounds like some have a curb on the business and some don’t, I live in Texas where it should have been legalized many years ago to keep the illegal weed from crossing the border, and now it’s fintenal that comes across the border along with meth, heroin , and other drugs, not as much marijuana crosses the border like it use to,marijuana is like smoking a strong cigarette and you might get a little buz but not like the film that was made back in the sixties where they show a man going mad after smoking a marijuana cigarette, that just don’t happen the truth being stretched a little, and if their gonna legalize it for over half the United States then they should make it excess able to everyone in this country, otherwise it’s not fair to other law biding citizens who would like to share in the right to have legal marijuana in their state too, and medical should be excess able to whom ever wants it and not the stuff rated at less than one percent of t h c that Texas is promoting for medical marijuana, when other states can get whatever they want with as much t h c as needed for their pain, we want ours too.

The prison industrial complex has spent lot of money pushing to keep the law prohibiting Marijuana used. When the drug testing were put in place it was easier to catch THC not coke n heroin users. The law is illegal and eliminated lot of good blacks from jobs that are handed over to mediocre whites. The laws give white cops more power to bring in blacks. Basically white used more cannabis and blacks get more jail sentences more often. This a law for white supremacy to be able to rule. Now you can understand that the South n heavily republicans states are in love with the prohibition.

Marijuana is made illegal because it threatens the pharmaceuticals establishment on making profits on medications that helps with insomnia, anxiety, stress, seizures, PTSD, and the list goes on. It's against the law to put a patent on nature so they could not own it but they could outlaw it. With the introduction of GMOs it now has the potential to be profitable to the pharmaceutical establishment. The problem is the already existing strains of marijuana out there and the fact that it's recreational in a lot of States. Pharmaceutical companies will lose billions if marijuana is made completely legal. Yes reefer madness did happened, but that's not ultimately why it was made illegal. That was just used as an excuse to ban a substance over greed.
Please share my comment with everybody. More people need to know the truth.

Yea legalize the dam stuff and be done with it, I’m 73 years old and I’m tired of going out of state to buy my dam pot, I need the dam stuff because of ptsd I got on my tour to Vietnam, you know it’s about time they legalize the stuff because everybody smokes the dam stuff, if you pull 15 people off the streets of some big city and checked them to see if they use marijuana they would find that ten or twelve out of those fifteen people use marajuana and that’s a fact, their are more users now days.

Schedule I isn’t for the most dangerous drugs, just ones without recognized medical use. It’s an easy assumption since Schedules V-II are numbered based on their potential for abuse (5 being smallest 2 being highest), but that grading system only applies to drugs with an accepted medical use. Schedule I is for *ANY* drug with a federally recognized potential for abuse but without any recognized medical use. So in this system heroin, mdma, weed and ayahuasca are scheduled together but not because anyone considered them to be the most dangerous, or to have a similar harm potential, just that there is abuse potential and no medical use.
Other drug schedules that might surprise you are Meth and Crack at schedule 2.
Meth is used medically like it’s chemical cousin amphetamine (Aderall) as a diet aid, narcoleptic therapeutic and focus medication. It’s marketed under the brand name Desoxyn.
Cocaine is still used as a topical numbing agent (if you’ve ever used it recreationally you’ve experienced the affect first hand). Typically only used on patients who can’t tolerate other first line medicines like Lidocaine. Drug dealers will sometimes rub cocaine on their gums to test the strength and purity. Faster, stronger numbing means stronger, purer product.

I think I realize what else could be keeping marijuana illegal, and that's the fact that the price of farming in general is at an all time high. Farmers are paying 300% more on fertilizer, and marijuana requires more nutrients than most common crops. Thats not all, barrels of oil were $30-40, now they are over $100 a barrel. So the fuel we need to use for powering these farmers machines are even higher. Another thing is, when everyone and their moms can now buy weed. Bro, those people are going to eat more.
Lets say all the milk is gone when you walk into a grocery store, expect the price to be higher next time you see milk again. Thats just how it works, the cow does not magically produce more milk. The same goes for when weed dispensaries are all over the place and you go in expecting to buy in bulk, when now you are limited to what you buy so they can control the supply and demand.

2:37 The clown states that "Category 1 is the most dangerous drugs." But, at the same time, the chart on screen indicates nothing about danger or addictiveness. It only has two qualifications: high potential for abuse (i.e. popularity) and no medicinal value. That's why Marijuana was made Schedule 1. While no one in their right mind has thought Marijuana was dangerous, at least since the 1970s, it's probably the most widely popular illegal drug in the US. Also, the federal government decided there was no medical use for it, and then banned or highly restricted medical research until very recently. So that was a self-fulfilling criteria. Gradually, more research has opened up and it's now commonly understood to have large medical potential. But the drug remains hugely popular, so remains Schedule 1.
Ultimately, the federal scheduling process needs to either be reviewed or eliminated entirely. This issue should be left to the states. Keep in mind that psychedelics such as Psylocybin and Peyote/Mescaline are also Schedule 1 drugs, despite psychologists finding value in prescribing them.

The legalization of marijuana should be regulated at federal level to protect children and teens. The news at the TV was about a teen smokes marijuana and passed out drooling. All the dispensaries around the country should be monitoring and check the content. How much they sell? The dispensary that sells the product to the kids, should be immediately close. A girl purchased a lollipop couldn't close the mouth and dull until the effect pass away. Any adult providing kids with marijuana should go to jail. Human being should always have rules and regulations. Protect the people.

This all puts a bind on law enforcement when it comes to 'just' laws. The same principles that apply to cannabis legalization, are now used to limit access to abortion, sex education, Medicare, etc. It was the same principle that Alabama used to fight against civil rights, In the 60s.
This is not brought on by moralists, with real objection to abortion or drug use, this is the social policy design of selfish people with a personal stake on controling society for their own ends. Personal and civil rights shouldn't be a piecemeal option.
