Can I get fired when I'm on workers' comp?

    Scenario..lets say your attending puts you on modified duty and has limitations.. you get hurt again off the job ( have a regular doctor issue no work while your knee is healing)
    Torn rotator cuff at work
    Twisted knee slipped on wet surface at home.
    How would a worker play this one out

      It would depend on what the industrial injury restrictions are and whether the employer could accommodate them. If not, then the worker will get TD regardless of the non-industrial injury. If the employer could accommodate but now the worker is off work due to a non-industrial injury, then either no benefits would be paid or perhaps the worker could collect EDD benefits due to disability.

    Can you get a better Job if your on Workman's Comp?

      An injured worker can always quit his or her job and take another job. It may impact TD benefits, but the workers' comp case will continue. It's important to remember that in most all cases the employment relationship is with the employer, but the workers' comp case is with the insurance company.

      @@PUT_ME_IN_COACH Yes, TD is roughly 2/3 of average weekly wages. If an employee quits his or her job, and is later TTD, then he or she can get TD benefits. However, if he or she is only temporarily partially disabled, and released to light duty, and if the employer could have accommodated the restrictions but for the employee quitting, then workers' comp can deny TD payments.

      Absolutely. Too often I talk to people who tell me they did something, or received something, but never kept a copy of it. Emails were sent, but then deleted. Text messages received but deleted. It's very important to keep records to have as proof later.
