Service animal removed from grocery store. Does the ADA allow that?

    Policy needs to be changed where every service animal needs to have paperwork with it to show that it is legitimate.

      It's why business's have the right to remove a dog for being a disruption, and at their direction can trespass the dog from the property.its all really simple, stores need to stop trying to enforce thier policy and start enforcing the ada.and yes even the best service dogs have bad days, same as us

    Faking service dog is illegal with penalty up to $1,000 and 6 months in jail. Law enforcement should do their job and enforce the law.

    People with legit disabilities are not the problem. it's the entitled people who just bring their pets and ruin it for everyone else...including people who actually need their service animals.

    This is because of people taking in their therapy, dogs and other animals that aren’t actual disability trained animals and is causing problems for people. These people that are using their dogs are not actual disability dog trained. Need to be fined.

      As someone who might obtain an actual guide dog from a non-profit into my home in the next year, I definitely am very concerned about that! But this one is not simply an emotional support doggy friend. We already have a pet doggy. 😊 She has a medical need for him, probably several needs. It was well behaved and trained, so they should leave her alone.

    I do agree with the fact that if your service dog must be off leash I highly suggest having atleast a really short lead, a traffic lead, short rope just something you can use in case something where to ever happen I always carry a short leash with me too put on my service dog in case a fake comes in or something happened

    Being on a leash does not interfere with Allergen detection. Too many handlers are using this part of the ADA to keep their dogs off leash at all times. The dog can be trained to bark to get help. The ADA states the dog must be under the handler's control at all times, so if the dog is far away from the handler "getting help" it is not under the control of the handler. End of story.

      I agree. Not only that, but the dog could be on a short leash that would not interfere if they could justify that the dog needed to go get help. Plus, virtually NO ONE knows to follow a dog or what that means. You can also have a device that the dog can call 911 with if you are not able. This is just a new fad to get Drama views. And you notice it is always very young girls. Always.

    Unfortunately, all us handlers have stories like this, and what makes it worse is finding ADA legal representation isn't as easy as finding someone for a slip and fall so we are left with little help. State DOJs don't take ADA claims when they triage the case load. I have a similar store with Best Western where they cancel my reservation because of the presence of my service dog and leaving me stranded at midnight sitting outside the hotel on the floor with my dog tasking DPT while I'm passing out from my neurological issue. Because the attend didn't know the difference between an SD and an ESA. Now I've added PTSD and flashbacks to my medical treatments...

      It's sad that it happened to you. My ESA paperwork came directly from my doctor's orders. Maybe you can see her pic here. She and I lived in a Senior Independent Living Facility and I was continually in trouble with management. They made my life so bad that I moved out after 10 months of my lease there. I was told where to walk and the mailbox was one place where I was told to turn around and go in a different direction to get my mail. Since I had broken my ankle because I fell in a hole on their property and suffered a severely broken ankle that left me UNABLE TO PUT WEIGHT ON IT. MY ESA WAS NOT WITH ME AND LIVED WITH MY DAUGHTER FOR 3 MONTHS. I couldn't walk her. Rehab had to teach me how to recover and I finally got her back . The next day after she was returned to me . Management was at my door with her witness telling me that I needed to control my ESA or they would remove her. I filed a complaint with Human Rights Commission about the treatment by the manager. PLEASE GOOGLE HUMAN RIGHTS COMMISSION IN KENTUCKY AND YOU WILL SEE WHY MOST CASES GET DISMISSED. My recourse was to move after months of disparity in treatment there! During that awful time , I had paid the facility around $20,000! We who have disabilities are treated poorly! Unless they can see your disability they assume we are trying to put one over on them! My ESA and I were not treated appropriately. Maybe I should file another complaint with ADA.

      @TUCKY well you are the first ESA comment actually using it in the way it's supposed to be in as part of the Fair Housing Act, but if your dog has now taken on a task for mobility assistance then it's not an ESA anymore and is a Service dog. You need to make sure you have proof of that training (not technically required under law but helpful in this case) and stop referring to them as an ESA. Make sure to read your state laws to ensure you have ADA protection.

      @@MNSweet It doesn't say her dog has taken on mobility assistance, she said she couldn't walk her dog so her daughter kept it until she recovered. So it's still an ESA ..Now as far as her management saying to control her dog depending on the complaint if the dog is running around, barking, etc, they can have it removed even if it is an ESA or SD. This is where cameras around apartments would come in handy, for either side to have proof.

      Not to be snarky, but an honest question: who is it that calls the paramedics or immediately helps render aid to you if you pass out from your neurological condition? Your dog or a person?
      If you're going to make a reservation at a hotel, it's up to you to make sure they allow pets before you book your reservation; thanks to how out of control dog culture has gotten, most hotel chains welcome them. It's next to impossible to find a hotel that DOESN'T allow dogs these days. Kudos to those that don't; they know how unclean dogs are and how irresponsible most dog owners are.
      If you have PTSD, you should look into psilocybin/guided psychedelic treatments to CURE it. Dogs are nothing but a bandaid or crutch; if they actually helped, you wouldn't need one indefinitely.

Stores are responsible for training their employees in the laws and circumstances that are likely to be experienced in the regular course of business, but most employers don't. It's ridiculous. This was a manager, not even a cashier or stocker. Big Fail.

      @@NoOne-bp2jw You are under the impression that a min wage employee knows every law. Had my young daughter out at Walmart and small service dog was there. My daughter asked to pet and pos dog snarled and sniped at her. These things are being pushed beyond belief. Never heard of nut allergy alert dog in my life. Chronic diseases are diabetics, cancer, heart disease and such. How many die of tree nut allergy a year and why would you be in a store that 100% has tree nuts?

    Animal services in your county can provide people with a service dog ID but yes it's not required to have or carry one because not everyone can afford 6000 to 10,000 dollar dogs. Alot of people must train it at home because they are life savings tools that should not have a price on it. If a law were to be made to require it how would the people who train at home meet that requirement?

      It could be as easy as CPR certification. People don't become doctors, they just went through a basic training and understanding of CPR. Could be something similar for service dog.
      I have a friend who has a service dog harness and her dog is crazy. He barks to other dogs at the store, he's not a service dog. I've seen other dogs marking the corners of the shelves. Clearly no service dogs.
      It should be limitations.
      Blind people ✔️
      No mobile people ✔️
      People who really need them

      @@cvmarquez1534 If the dogs bark or are going to the bathroom in the store, the store is allowed to have them removed, it's even stated in the ADA. There are people who are not blind or non-mobile that do need service dogs. Severe allergies, heart conditions, etc. can be helped by service animals.

    Here's the thing how did people in the past survive and managed to grocery shop without their animals with them they either left them in the car or at home. Because you never used to see this garbage. How did they do it? What happened in recent years where people can't do it now they have to have an animal or they can't shop???? In this story that person needs to be introduced to instacart have your groceries delivered if your dog has to be off leash. It's a safety issue number one. In the United States over 12,000 people are attacked by a dog every day. Not to mention I've seen dogs sniffing and licking products on the shelf so something you buy may have dried dog snot or slobber on it isn't that appealing??? Grow up! 😒

      Service dogs weren't as known then than they are now. Times were also much different then. But us handlers deserve to grocery shop without having to pay delivery fees just like everyone else.

    Or the ADA can prevent this from happening by actually requiring service animals to have a vest with a registration badge or whatever on it. That badge doesn't have to list disabilities, just be visible. Too many people lie about having service animals just to bring their dogs inside.

      To be fair, tons of people who fake service dogs actually go through the effort of purchasing fake service dog vests and ID cards. Or do you mean a federally regulated badge that fake service dog owners cant access? If you think about it though, even if they go that route, it won't stop people from making fake replicas.

      But service animals are not required to wear a vest. The customer is also not required to show proof, but you may ask them what service does the animal provide. Either way, no company or organization should ever turn down a service animal. It's the law.

Make it harder to register such a support animal and see how many people actually qualify to have one. My neighbor has 4 support animals 😲for the same illness. Online is easy and ppl take advantage.

      If you have a dog phobia, the dog still cannot be denied access. Allergies also are not a reason to deny access. You can request that a dog is kept a reasonable distance, but they have to allow access.

    The laws need to be changed to require documentation to prove it is in fact a service animal. Too many people are abusing the system and bringing their pets in to stores and restaurants. I've worked in retail for over a decade and have seen so many people that obviously just have their pets with them.
    You also have to understand their are many people allergic to pet hair and dander. So those people would rather see less animals in places with food especially.

      Tired of “hypoallergenic” nonsense, with people saying their dog can’t cause any allergies. A dog doesn’t shed as much still has dander, and absolutely still has saliva and urine, most often even in its fur and evaporates into the air right nearby as well

      There is no law that says that people with allergies to dogs have to be near the service animal teams. Both parties can accommodate each other by staying away from each other in the same space. Denying entry to a person with a service dog is the same as denying a person who uses a wheelchair and that is wrong. Read the ADA laws idiot.

    It sounds like it is a well behaved service animal doing as it was supposed to do. That's not always the case with the self-proclaimed "ESA" and certification that's easily obtained online. This animal probably should have been allowed to stay when the owner is surrounded by foods.

      I have been disabled for many years. I carry a letter from my doctor to prove that my dog is legal. Some people will always ASSUME THE WORST. That's very sad for us who have serious needs for our service dogs.

    So right off the bat even though dogs can be off leash she is not legally required to have the dog off leash because her disability needs to equal the dog being off leash not because she feels like it.
    So technically they were in the right to ask her to leave because the dog was not under control

They had no basis to ask her to leave, the dog is under control even if it is going to find someone for help, because it won't be sniffing everything on the way to the person they are looking for. They won't potty on things either...they won't jump on ppl or any other diverting behavior, than specifically seeking out the person they know they need to find and bring back to their handler.
      Like, the ADA doesn't have an approved and disapproved list of tasks, nope just a basic definition and getting help definitely fits the definition of "a trained task that mitigates someone's disability"

      @@wturner777 Actually they ARE required to be leashed or harnessed. The only exception is if the person is unable or the dog cannot perform it's trained action, which is extremely rare. There is no reason an alert dog needs to be off leash, so she was in the wrong.

      @@littlebitofhope1489there actually is a reason if the person were to faint some dogs are trained to go get help if the person faints the dog won’t be able to go get help while the owner fell on the lead but when it’s off leash they can do it without getting yanked while the handler fainted my service dog is always off leash because the leash interferes with her task

      A Service dog should be on a leash - there is all kinds of equipment she could use like a short leash with a handle that she could just drop or hold onto if need be. Her dog is obviously well-trained but her service dog is "still" a dog and dogs are not robots. I'm sure like my daughter's service dog it's trained to ignore things like other animals etc, But there can always be an occasion where she might need to grab the leash. If she is incapacitated and drops the leash the dog could still go for help. People sometimes just want to standout as going against the grain. But to be a good handler and to also keep in mind the best interests of her partner (dog) - she should find equipment like a short leash. I'd be the first one to "buck the system" when the system is wrong - but in this case she could have defused the situation by just having a leash - or other equipment and not make it into a youtube big deal.

      Not true. If you allow the public on your property, you fall under public access laws. That means you have to follow the ADA.

    Needs to be leashed. Any dog is capable of biting service dog or not. And what do the people allergic to dogs do? Stores unfortunately can refuse service to anyone they want. Worked in a few. But I have never seen a service dog off leash that makes no sense.

That's having a service dog as well as knowing the Trainor along with obviously the disabilities they need to train for. What medical disorder would she need her dog off leash for? People who collaps or have seizures their dogs are taught to stay either lay down to help break their fall or stay with them and bark till someone comes. What exactly does her dog need to do that he has to be off leash? Again literally knowing the trainer what they teach the dogs and what for. There is no reason for a service dog to be off leash. And a store is allowed to refuse service to anyone they choose. That's the law. And if her dog did hurt someone it would be on the store and her. Service dogs have bitten it happens all the time. To think because it's a service dog it won't ever bite is ridiculous. It's still a dog. And allergies it's easy to read a label that's the biggest excuse ever. Unless she can't read either.

    So every trained/untrained dog seems to be a service animal. Needs to be more restrictions on how to obtain and verify a true service animal. This pooch is well behaved , but I've come across too many wild /fake service animals to even acknowledge the real ones anymore. Yes! I'm a dog lover but I understand both sides of this situation.     This is wonderful that her new station by her took the seriously and did a news story on it. I have tried after being refused service by a senior citizen living place where my relatives over the phone that I was told I don't care what type of animal you have a pet or an Esa or whatever you're going to follow our policies or you're not welcome in our business and you have to provide proof that your dog is vaccinated you have to provide medical documentation and a document that proves your dog is a service animal and I just said to her there's no such thing you cannot ask for those you can ask me three questions the lady was hostile over the phone contact Federal Ada and then Federal Ada said you know because of how hostile towards me they were and then she hung up on a 88 person who was trying to get in touch with her on explaining 88 for the law she didn't want to hear it from my safety and my service dog safety when we went up there to see my relative to get a police involved. We had to get a police peace officer involved who stood there as is the other executive manager continue to make up excuses to break federal aid law try to find a loophole to demand medical records in case my dog lunges a tax for bites somebody as real service dog would never do that this is not a pet she kept trying to refer to my service dog as a pet or an essay it is not and even the office got sick of it she said listen if you have to come back here after the manager told my mother this is a one-time thing I will let her in with her dog her pet here she can come back to see a relative but this is a one-time thing and I'm going to find a way to impose these policies we have on her dog because no animals should be allowed in here unless you're willing to comply to them even if we know what we're asking is a federal Ada violation. I got it on camera for most part the officer got it and the officer made a report on it and it's just disgusting like just based off your parents and your dog being a certain breed that they're not you know as they claim familiar with for being a service animal just excuses and so I had tried contacting my new station in Michigan about the matter because I'm not the only one having to deal with this and they don't take it seriously because it's not part of I guess they're woke ideology news you know baiting situation happening so they don't want to reach out they don't want to put this on the news they don't want to make people wear about this influx of problems where people are going online they see these fake scammers selling registry fake documentation fake certification and nothing you can get your dog a service dog right off the back they cost $50,000 plus the more issues that you have that need to be taken care of with the training the more expensive it becomes. We don't get any help from the government we don't get any grants from our government as a civilian with disabilities like her or I and you know we are capped at how much we're allowed to fundraise as 25000 which does not compute to the cost of getting and training a service animal. And then we have to deal with this respect and ignorance because of online scam artists and they believe they can take that and use that as a policy to demand that which they cannot and then they want to fight you on it. It's degrading when it's humiliating have to keep going through that. However like when you try to contact your new station I'm glad she got her news on her side so people would be aware of this. However in Michigan it seems veterans are more important with their service dogs and civilians so when you reach out to your new station they don't care they don't want to make it a news story because it doesn't fit their victimhood ideology on who can be victims in the system service Dog Handlers are a real minority in our cities in our state and our country unfortunately they're being abused of the 88 law is being abused we even have people trying to use diversity Equity inclusion to say we now have to include and allow anybody in with their pets who are not service the animals who are just an Esa because we want to make them feel welcome and happy and not feel stressed or anxious dogs have no right to be there they're not trying to be a service animal but they're trying to use that excuse to abuse Federal Ada put handlers in real service dogs at risk to get more quota in and more sales because of inflation and that's threatening the safety and well-being of handlers and service dogs. I now have to go on my way to go shopping because of it because the source by me want to use that as an excuse to let people in with their pets who don't belong in those stores when I am grocery shopping and putting me and my service dog at risk my service dog has been attacked three times elderly and people of a different background than me and then they cry racist and bigoted and all this other garbage because they're being called out for being a fake poser and when their dog acts out and is barking and so lunging and causing problems in the store people are afraid of the race car being played and afraid of the wolf mob and retaliation for kicking them out even though they're in clear violation of federal Ada and they're just using both propaganda to try to get their pets into the store with them where they don't belong and it's endangering handlers and service dogs but my new Stations don't care if they don't want to listen and Handler's list service dogs for civilians who are currently not from the woke left don't matter in my state

      Honestly the information may be out there but it's not well taught and much of it is assumptions. I had many of the same misconceptions before my health changed and needed a service dog. Like I thought they needed an ID and vest but nope. It's federal laws fault for leaving it to the states. Each state has its one rules and definitions.

      @learningbydesigner7449 Your statement in general is correct however the federal law doesn't have much actionable content to it and is deliberately left vague. For example and to use as a comparison, if a federal law was describing what is allowed to be called a box it says it must be a container with suitable sturdiness to hold items of various weights and sizes. Then it leaves it to the States to fill in the rest like the material of construction, dimensions, etc. So while it's a federally created law, SCOTUS would likely say it's a States issue unless the the incident occurred on a common carrier like a plane, train, or ship that crosses state lines as that is outside of ADA law as we know it and is governed by a similar version ADA that is entirely federal. It's why cruise lines and airlines can ask for doctors' notes, proof of training, and k9 medical records before departure.
      Let me know if want law/statute numbers to do your own research and to confirm my above statement. I'm happy to provide it.

    File a complaint with the ADA since it's a Federal law that service dogs cannot be denied access to facilities in which their owners are present. I'd also file a Federal lawsuit against Harmon's regarding this issue. Obviously the manager hasn't been trained on the ADA and all that is required to be in compliance by the Act, which is not uncommon.

    I live in Kentucky and the Christmas Tree Store ,Value City Furniture Ashley Furniture in Florence KY have become argumentative 😢. I carry my Doctor's letter to prove WHO SHE IS to me. I was living in an Independent living facility in Florence KY where I filed a complaint with the state Human Rights Commission. I was harassed by management often in the 8 months that I lived there. Why did they accept us and cause me more issues? We with disabilities have our own reasons that are legal however no one seems to take us seriously.

      That's illegal, read the ADA they can only ask two questions and it's none of their buisness what your medical history is, also you should always report these places. if you have 3 or 4 places that have kicked you out get an attorney and sue them that's a civil rights violation, you have every right to shop with your medical equipment ( the service dog ). If more people would do this people would have less problems. Also a fake service dog is something the government would like, without looking it up I believe UT goes as high as $5000.00 per incident.
      Service dogs pay attention to their owners and ignore other dogs, fake ones bark at other dogs and don't pay attention to their owner.

    I am all for real service animals for blind people, people with seizures. I am however quite sick of fake service animals... I flew a few years ago next to a 19 years old dressed like a slutty fitness influencer with a yellow lab as her "service animal" I love animals... I did not like that she got situated and then put her dog directly where my feet were supposed to go. I have degenerative disk disease and there is no way I can hold my feet up during a multi hour long flight.
    Over an hour into the flight I couldnt handle it anymore... when I am in pain I get angry on top of spinal damage and ortho injuries I suffered from 8 years as a soldier I have PTSD and try to stay away from stress and conflict. I kinda stood near the bathroom so I didnt lose my temper. This girl even decided she needed my armrest too and I couldnt take anymore.
    The flight attendant asked me to sit down. I explained the situation calmly. She said she understood and asked me to sit down anyway. She came with food service and saw me with my knees resting on the seat in front of me and leaning out in the asile because this chick was sleeping on the middle arm rest... she could probably also see that I was getting close to loosing my $hit and forcing an emergency landing.
    She woke the woman up and kinda scolded her saying. How do you expect him to sit here with you taking up the arm rest and also all of his leg room... she replied "That's not my problem, and I dont care"...
    They let me sit in one of the jump seats where the flight attendants normally sit until we had to prepare for landing. I had a wonderful chat with the flight attendants and was so thankful. When we landed they had airline reps inform her that she would not be allowed on her connecting flights for being disruptive to other passengers... LOL!

In addition, if the dog needs to be free to go get help, as in the disable person is incapacitated, no one is going to be hanging onto the leash. and the dog will be free to go get help.

    They did not break the law. 1:26 - Based on what she said, harnessing her dog would not prevent her from doing work. If the dog needs to go get help, the dog is able to go and drag a leash behind it or if in harness, even better, not dragging anything. Also - the dog can bark pretty loud to get people's attention if the dog "doesn't leave her side" as she claim. People just like to complain. The law sucks because you are not required to provide proof that it is a service dog and trained at all. You should be required to show proof that the dog was trained to do a specific task.

      I agree. The dog should of been on the leash. Her safety is important but so is everyone else's around her. The laws are way to lenient and definitely not being enforced in places of business. While she might actually have certification most the people I have seen don't. She's attacking a store that tries to accommodate her needs while they also have to protect everyone else's safety. Not only that, but the store will be the ones taking all the liability. If that dog can not get her help with a leash on, then she needs a new trainer.

      While it seems to be a fad now with young girls, there are instances where dogs can legally be off leash if under control. If someone does not have hands for instance, or the use of them. If a paraplegic has something fall out of reach (ie. a wheel from their wheelchair when getting it out of the car) the dog can be trained to retrieve it for them. That said I saw nothing in this video that warranted the dog being off leash.

      People with service dogs have a federally protected right to have the dog with them in the public places. No one else has a protected anything to be there free from dogs. That means that anyone who doesn't like it can move away from the dog, or leave. But the dog is permitted.

    Ok but a simple nut allergy does seem excessive for a service dog. I could understand epileptic and for the blind. The use of service animals should be very specific especially in the 21st century where tech will surely outperform service dogs for such needs very soon

      The last one that challenged me about my disability I took to court and won. I welcome anyone who *thinks* they know the laws to challenge a disabled individual. It costs is nothing for our rights to be enforced and the other party pays big time.

      I had to learn about this one the hard way (not court or being threatened with my job but I should have been) but just bc the disability can’t be seen doesn’t mean it’s not there. She was in the right no matter her age. I agree with requiring identification, as many people come into places with their pets where pets don’t belong. She had identification and knowledge about the ADA laws to back it up.

      ​@@dragongrrl3you're partly correct, but the ADA doesn't provide for licensing or certification so there is no identification to give... No one can require ID because it doesn't exist per federal law. Some states allow for registration of SA that identify them as such, but it is not required.

      My son had a lab, they were super close. When my son had seizures, she alerted me, prior to his seizures she alerted him(to make sure he was sitting).
      This is invaluable and something she did on her own. We never took the dog in public, because my sons seizures were mainly febrile(with fever), however once they progressed, I considered it.
      Why should someone stop me from training the dog myself or hiring my own trainer or whatever else the case may be?
      The dog already did the needed task! No need to go purchase a certified animal.
      Prior to the SA laws, people still had service animals. Just like prior to the laws, people had wheelchairs, they just were not protected in them.

    Good for Harmon's. I'm absolutely sick of seeing people bring their dogs into grocery stores.I've literally had to step over dog feces in the aisle at walmart. Animals should have to be legally certified and the parameters narrow. These days there are so many delivery options for everything.

(Probably because my parents raised me with odd rules that applied back in the Victorian era (even though I"m 66) because that is the way it was when they were young.       My son has seizures that caused his muscles to severely contract, he had a lab that alerted us to his seizures(but she stayed home, his seizures were febrile & outgrown by 13, but from 8-13 he often required rectal valium to come out of them....without valium, they could literally go on for hours, potentially causing brain damage or death), so she could not be tethered or closed door crated for that reason....she could open doors, so that was never an issue :-)

    What I was saying and I cut myself off and then the below comment is that this woman in the neighborhood a good good acquaintance of ours she fell and her puppy he's like under a year ran off with the leash to save her and get the neighbor which I didn't notes know she'd Fallen but they got her some help through her dog and that's I'm not even a trained dog I do agree with the grocery store that for the dog safety they need to make sure that there's at least that's to keep this grocery store from being liable for injuries to someone else or the dogs something could fall in the dog or whatever something could happen and they might be liable if there's no leash involved so yes I agree the leash is not going to prevent anything

      Do you want to ensure that many needy people will not be able to financially afford a service animal? Such government regulation as you suggest is certain to create that situation, because it will eventually lead to allowing only dogs trained by certified instructor to be registered as service dogs, resulting in 5 figure costs per dog.

      @@nj2or The cost is HEAVILY subsidized because the blind have support/lobbying groups that have spent years gaining national recognition and sympathy for the plight of the blind. How much public recognition do you think that tree nut allergy or other disability service dogs get?
      The cost for a fully trained hunting dog can be $5000 or more, and they don't have the exacting behavior standards required of a service animal that is around the general (ignorant) public.

      So, again, under the ADA law, a Service Animal cannot be separated from their owner no matter what. The Owner of the Store would be fined or arrested for violation of the law, so your argument is invalid, read up on the Adults with Disabilities Act and tell me if I am still in the wrong or not.

Costco will be enforcing rules related to service animals, and emotional support animals *do not* count as service animals to major chains. When people started to get service animals for the most ridiculous of reasons that's when these rules started to come up.

I can go into Walmart and see 15 people who are carrying around various pets and not one of them is a service animal; it's ridiculous and nobody can tell me that someone carrying around a barely-two-pound chihuahua in a little bow and dress getup is carrying their 'service animal', it's a pet.

    Hers an idea. Harmons has pickup and delivery. She could order online and not worry about the dog. That dog doesn’t seem to be that well trained to be off leash. Little kids often are running in the store and if one mishandles the dog and gets bitten, both she and the store could face lawsuits. Harmons is a clean store and I doubt peanut dust is in the air! Seems to be entitled.

      How is the dog suppose to alert to allergens in products if they do pick up or delivery? They already paid for the items, so it would be a hassle to return items if it has allergens in it.       Everytime I eat out I risk eating something that has shellfish in it. I was eating a pasta salad my work provided for lunch and realized after a few bites it had crab. I spent the rest of the day with severe stomach cramps and nausea. I had no idea their was crab and lucikly my allergy isn't severe. But it can happen so easily.

      Almost everything you can buy says may contain traces of peanuts. Or tree nuts. People with life threatening allergies can go into Anaphylaxtic shock from a ingesting a tiny trace of it.

      She has an allergy. By the time the dog went to get help, she would be dead. This would never stand up in court due to that. She would be much better giving the dog a device to dial 911, and get help immediately, instead of having a dog go to a person that has no idea what is going on, and then have them come back five or ten minutes later to then dial 911.       @Tammie Hinkle look up other articles. The excuse she used was she was allergic to nuts, and if she were to have a reaction, she needs the dog to find help. A leash doesn't limit the dog to find help. They make pull away leashes. There's a reason laws are in place.
      I have a dog and love dogs. I've also been bitten by a fake service dog in the Walmart that was off leash. There's a reason there are laws put in place. ADA requires a leash.

      @@keithscott1926 Not true. If it when to court there would be full disclosure. She would also have to prove that being without a leash was required, and she cannot do that. If she can't prove that then the business was within their rights to deny access, because according to the ADA, Service Dogs must be leashed unless the task or work cannot be performed or the handler is unable to hold a leash. She clearly can, and a serious allergy is not a reason to be unleashed. Not only that, but she would likely be dead before the dog got back with help. That would all come out in court. She can use this as a ruse to get drama views, but she will never file a complaint because she knows she will lose.

    Disgusting!! Sue them. If you were homeless or a migrant you would have every right available. The service dog belonged there. People should protest and not buy from this store.

      They didn't have a problem with the dog being there. They had a problem with it being off leash when not necessary.

    It's a service dog! It's against the law to kick someone out of a business because of the dog! They should be fined! Boycott that harmons until they get it in their heads that service animals are working not just a pet! This is pure stupidity of harmons!

    ADA allows a service/emotional support dogs are allowed in grocery stores and restaurants. Someone at the store needs to read ADA rules and regulations.

      A service dog is NOT an emotional support dog (ESA) An emotional support animal is by definition a PET.

      Not to mention that you don't know the full extent of her disabilities, the full function of her dog, etc.
      Because like an apple watch, you may purchase it with one function in mind & use it for 20 more-all allowable in life. Same with having a service dog for one function and training it to do 10 more.

    What I was saying and I cut myself off and then the below comment is that this woman in the neighborhood a good good acquaintance of ours she fell and her puppy he's like under a year ran off with the leash to save her and get the neighbor which I didn't notes know she'd Fallen but they got her some help through her dog and that's I'm not even a trained dog I do agree with the grocery store that for the dog safety they need to make sure that there's at least that's to keep this grocery store from being liable for injuries to someone else or the dogs something could fall in the dog or whatever something could happen and they might be liable if there's no leash involved so yes I agree the leash is not going to prevent anything
