"Innocent Until Proven Guilty?" MPs Face Ban After Arrest For Serious Crimes

  • Trevor Kavanagh reacts to MPs facing being barred from attending Parliament if they are arrested for serious sexual or violent offences after the Commons voted to reverse moves to water down the measures.
    The House of Commons Commission initially proposed that a risk assessment would take place on whether an MP should be prevented from attending the parliamentary estate if they were arrested on suspicion of committing a violent or sexual offence.
    The proposal was later revised so the threshold for a ban was at the point of charge.
    But MPs voted 170 to 169, majority one, in favour of a proposal from Liberal Democrat Wendy Chamberlain (North East Fife) to revert to the threshold being an arrest.

    Why are MP's not banned anyway, they are merely public servants paid by the public and must abide by the law like every other person in the country has to.

      @@tommyh4116 I think the danger with holding them to a different standard (whether that difference is lower or higher) than the population at large is that they lose contact with the lives of ordinary people.
      The other problem is to ask whether in demanding higher standards it might intimidate lots of people who might otherwise make good parliamentarians from taking up a role in parliament. How much do we want to narrow down the field of candidates for people who might otherwise be good representatives for their constituents?
      There might possibly be an argument that senior ministers should be set a higher standard than backbench MPs, but even here that standard should be of proven activity, and especially proven activity while in office, rather than accusations, especially if that is mere accusation of activity that may have taken place long before they took any political office.

      @@Hfil66 The vetting process for MPs is already more robust from other public sectors, given their access to sensitive Government information, etc. However my issue is not the vetting process. My issue is once they become an MP. That's when they are afforded parliamentary privilege and other various privileges, some that are part of the culture. This is open to abuse, as we seen with the expenses scandal.
      Given their privileged position and all it affords them, then I do feel they should be held to a higher standard than their constituents who they lord over. They have a choice to use their privileged position responsibly or not. If people who can't behave themselves feel like parliament is not for them, then so be it.

      @@tommyh4116 senior ministers may have access to sensitive information but that does not mean the average back bencher has similar access to sensitive information.
      In any case, if your assertion about how thorough the vetting of MPs was then would that not obviate the need for such measures as proposed here. If (and that is very much a conditional "if") we already know that MPs are all so thoroughly vetted that they cannot possibly have any skeletons in their closets then we can reasonably assume that any accusation of wrongdoing is far less likely to be valid than a similar accusation against an average member of the public.

    It should be on the basis of conviction. A friend has been accused of something he hasn't done, but could have lost his job, even though he is actually innocent......

      Politics is dirty and false accusation are not uncommon. They tell us to report such crimes to the police, so they should do the same. If the police fail to investigate and courts fail to convict, then MPs are in the best position to change that! If an accusation or a charge, is all it takes to remove someone, then we will end up with no male MPs and just a bunch of karens.

    What does prove guilty actually achieve with these weasels?
    How many got ANY punishment over the expenses scandal,how many are still fiddling their expenses ,and expecting the taxpayer to fund their second homes?
    How many are caught with their trousers down (literally)and no charges bought,just a few days expulsion from their Party.
    The two tier justice system extends to these people and no point in pretending it doesn't.

    This is not mob justice at all. In other jobs, you get arrested for a crime, your employer is likely to take action. Suspension, dismissal.
    MPs are not better than the rest of us. They should be held to a higher standard given the role they supposedly have in society.

    The old woman is greatly mistaken here..arrest by the police does NOT result in immediate suspension at work. I'm an employment law specialist

    No one should be treated as guilty until proven in a real Court not be the clowns on social media but also a person convicted of a crime should never be allowed to hold a position in Government National or Local we should a least be able to have honest decent people rule us

    Suspension from work is routine whilst investigation is done
    Teachers doctors police officers etc.

    Why has it taken something happening to mp's for this story to go public? The public has had to put up with this woke and abuse of power nonsense for years. Also quite frankly this abuse of power is not new and has happened repeatedly under Conservative governments this is not just about scaremongering if labour get in as it was already here.
    Serious debate need's to be had on either abiding by the rule or law or getting the law changed to reflect what is actually happening in the UK as one thing is certain we no longer have the right to be treated as innocent until proven guilty.

    What the Law states is "Innocent until proven guilty beyond any reasonable doubt" by a jury of 12 of your peers who are all in agreement ie a unanimous decision! not a majority one!

    IT does make MPs more aware to keep away from the dark areas of things. And hopefully more focused on doing the job for the people and not for "family and friends". Stay in the light so we can see what you are doing. Simple. BUT - remember that the Police and Politicians are joined at the top.

    So technically, if somebody wants to destroy a politician they don't like, they can arrange for accusations to be made and that's it? It happens all the time these days with false accusations being made and often their marriages and the rest of the family are torn apart, they can lose their work, their friends and all over empty accusations!

    If you listen to the debate, it's common practice across the UK for workers to be suspended upon arrest and MP's should be no different. This is because if a rape accusation has got as far as an arrest (and only 1 percent ever do in the UK, which is despicable) then the alleged VICTIM has the right to feel safe in their place of work until the matter is decided. To do otherwise is to exclude the alleged victim from their work place. It's right that MP's should not be a class apart but fall in to line with the rest of the UK. This video is biased, try bringing in a rape victim and see how the conversation goes.

      This woman is talking nonsense & your post is false the police have a list of notifiable occupations at the point of charge depending on the offence that you’ve been charged with. Also the reason why rape convictions are low is because the vast majority of rape allegations are between people who know each other, have been in a previous sexual relationship & consent is often contested. Stranger rapes are still rarely rare.
