In this video I summarise the helpful decision in Kaur v Secretary of State for the Home Department [2023] EWCA Civ 1353 (17 November 2023)
www.bailii.org/... where the Court of Appeal quashed the Upper Tribunal’s Article 8 decision as there was no proper proportionality assessment and relevant factors where not considered. The context of this case was there was ETS deception by the Appellant. This case will be useful when drafting representations, ASAs and grounds of appeal.
