I have been living and working in the UK since November 2014. I hold dual citizenship: Portuguese, with UK settled status, and British citizenship acquired by naturalisation in December 2021. I married in India in May 2014. My wife and two daughters, who are under 18, are still in India and have never been to the UK. Our elder daughter was born in March 2015, and our younger daughter in September 2017. If a qualifying period was between 01 June 2014 to 01 June 2024, what rules apply? 1) 01/6/14-11/04/24 - no single absence >184 days; is the 548 day limit still applicable for this period? 2) 11/04/24-01/06/24 - no absence >180 day in 12 months period. You can also work up to 20 hours a week in another job *or for your own business*, as long as you’re still doing the job you’re being sponsored for. What does "for your own business" mean? Can we be self employed or start a business and be its director?

Hi Adam, if I read the home office website: www.gov.uk/skilled-worker-visa/second-job , it states ‘You can also work up to 20 hours a week in another job or for your own business, as long as you’re still doing the job you’re being sponsored for. ‘ does this mean one can do a side hustle or business as well under these rules?

We expect to hear whether the appeal is allowed by 26/01/2024. However, if the appeal is allowed, she has no representation to prepare the tribunal case. Is this something you can support with? And if not, can you advise where else she may be able to seek support?

In the long residence issue most of the judges are not fair enough because they do not want to follow the long residence policy properly. They just try to overlook the long residence policy. In terms of the home office published long residence policy, disregarded period must be count as lawful because there was declared discretion within the policy, please see page number 28 of the long residence policy version 13.0 There is blank and white declaration that lawful residence is continuing under home office discretion. In this judgment has no answer why people would not get home office declared discretion and can not rely on the published policy. Judicial decision should be more clear and appropriate. Thanks
