    The drinker's defense attorney argues she needs help and treatment, yet the defendant herself refuses to acknowledge that she has a problem.
    All the treatment in the world won't help someone who won't admit they need help.
    And Judge Middleton isn't helping by giving her excuses. Alcoholics drink when they're grieving. We also drink when we're happy, sad, angry, surprised, disgusted sleepy, indifferent, and nauseated...

      I’ve seen more behavior unbecoming of a judge on these zoom cases than I’ve ever heard of in 20 years. Idk if things are that different in the Midwest and West Cosst than they are on the East Coast but none of this stuff would be tolerated by defendants, plaintiffs, lawyers, DA’s nor judges. Its helped me to understand why things are the way they are out west.

    As much as I love Judge Middleton, I feel like he and many of the other judges I watch are not as tough on drunk driving as I wish they were. When I was five, my mom was nearly taken out by a drunk driver. She sustained a bad head injury and trauma to her leg. That drunk driver was my dad. As I got older I learned that he drove drunk all the time. Drunk drivers are a menace to society, just as murderers are.

      not just drunk driving… last week the ticketing officer in judge Simpson’s area reduced many SPEEDING tickets to double parking tickets!

    56:15 That's a slap on the wrist. Her DUI victim is crippled for life and her punishment is practically nothing. What a crock. Then they try to insinuate that the place the accident occurred is a dangerous part of the road, etc. Makes me sick.

    She was more embarrassed by the fact that the community found her behavior annoying than she was by the fact that this was her second OVI. Shame on her.

      That people were avoiding her at Trivia nights should have been very humiliating for her. Is she going to dive into opioid use? (Will she toss her walker aside after this trial?) However, she committed a serious crime. She’s still drinking!!!

    A drunk driver killed my nephew, my only nephew. He was 21. The drunk driver only received 3 years in jail...he ended up only serving 18 months. This was in St Clair County, Illinois. He not only took my nephew, my brother's only child, he took the last of our blood line....he killed our family tree. I will never, ever get over his death and the lenient sentence imposed on the person who took his life.

      It's because the auto industry owns your country. People can drive and are encouraged to drive any single way they can, if they own their vehicle and pay for it. Cars rule you and own your souls. You cannot even walk down a street and have a conversation in America because the engines are everywhere loud and crazy. You cannot do anything in America without a car, or being struck by own while trying to avoid using one. They destroyed your country, and the massive amount of over represented drunks on the road reflect that. I'm so so sorry for your family and for your country.

    So…hearing that the trivia crowd avoided her and thought that she was an obnoxious drunk was a wake-up call, but almost killing someone wasn’t??? That’s just messed up. Unfortunately, the only person who can change the Alcoholic is the alcoholic themself. It didn’t sound like she was ready to change.

    Watch some Code Blue Cam and see how much these officers go through with all these drunk people, and then judges/prosecutors only give them a slap on the wrist. No wonder it keeps happening!

      I agree - so many crimes continue to happen because there are no real consequences for breaking the law - unless someone ends up dead. Build more prisons, if need be. They bring jobs and income, and there seems to be a never-ending stream of scofflaws and serious offenders. Just my humble opinion.

      Having more public transit is very helpful to get rid of DUI cases. Some cities and places in the states are impossible to get from place tot place without driving.

    DUI offenders that cause other people injury should get the maximum sentence.
    When she said: “I’m on opioids so I can’t drink wine.” That gaslit me.

      She cannot drink wine, so she drinks vodka. It is an obvious substitute. Comply with the doctors orders and still get that light 0,15 buzz.

      60 days seems so light, in sobriety court can they mandate an inpatient rehab after the 60 days? How can they give just 60 days and probation and have the possibility of her back on the road? It seems absurd to me, I had no idea that driving drink and seriously injuring someone would garner such a light sentence.

      What amazes me is that if I were drunk and recklessly discharge firearm in my town, I'd get the book thrown at me and locked away for a long time. I apparently wouldn't if I get drunk and drive a 4000lb weapon around recklessly.
      The only fair conclusion I can come to is that my safety, wellbeing, and life are cheap in Michigan. Just give grandma another shot at killing someone before they do something to stop her. If she drives and kills someone now, the victim's blood is now on the hands of the state as well as hers. They knew she had a problem and they put her back out on the streets to run someone down.

    30 days and a year of probation for nearly killing someone and barely pretending to be sorry about it! The prosecutor is an unbelievable professional for not loosing it in court. I’m pissed.

    I quit drinking just over a year ago, and I didn’t notice the significant, positive changes until about 6 weeks. Those were the improvements that kept me going. I feel like more than 30 days could’ve been more beneficial to her, but hopefully the probation helps get her there, too. Granted, I’m not an alcoholic like it seems she is, I quit because I was concerned about heading that direction. So she may be further gone..I really hope this whole situation is the wake-up call she needs..His tangent seemed like a lot, but I do think it actually got to her.

    The defense listed over 80 witnesses to testify and only called a little over 20 of them. That’s why she is upset. The jurors were removed before hand.

      Sounds like a tactic to challenge the State's financial commitment to continue through the time needed to depose and cross 80 people. May result in a deal offer? Just a thought.

      It was first thing in the morning and the judge was ready to bring the jury in. No doubt she wouldn't have liked it either way, but I think they were avoiding her direct question about who would be questioning the next witness and then the lead counsel stood and said they were resting. It just all came to a head.

    A lot of people in the chat mentioned they thought pills were involved. I was a nurse and we saw a lot of misappropriation of meds from nurses and even docs. Home health care givers have a huge amount of access to meds without the training that other providers get. There's such temptation to skim drugs. Pain pills and anti-anxiety meds are easy to skim from elderly. It's a sad situation.

    Mike, The jury was NOT in the courtroom. The judge had asked for them to be brought into the courtroom, but ordered them back to the jury room when this occurred. So, they did not hear this exchange.

      The jury had not entered the courtroom. They were basically at the door to enter.

      @@momsterzz As Amy comments below, the jury had not yet entered the courtroom. They had been summoned by the judge to be brought up, but had not yet arrived when this took place. If you go back to other videos of this, you will see that a no time did the courtroom stand to honor the jurors as they entered. The only time they were in the courtroom that day was sometime later when the judge had the defense team state to them that they had rested their case, and then she gave them instructions about sequestration during the deliberation process that will take place in several weeks.

    I was a single mother with 2 children, one handicapped. I took Wellbutrin over 30 years. I have worked as a nurse over 40 years and now face a daily worry about my son after I am gone. I didn't have time to drink or take drugs. I had to be strong for us and provide. I handled grief from many lost loved ones and went to counseling when I needed it. You have to accept responsibility for both the good and bad you do. I have no pity for her.

    This woman is like many other older women I've seen, they are absolutely ALLERGIC to accountability. Anything that will show them in negative light they will seek to deflect, minimize or claim some type of victim status. I think the judge needs to sting her significantly with the sentence to humble her.

    What is most disturbing is that Judge Middleton has seen her drunk on numerous occasions and states he wondered how she got home. So many people know she has a problem and knew she was driving drunk yet didn't say or report it. Even the judge.

      What are they to do, unless they're her friends or family? To whom would they report her drinking that could do anything about it? I have no sympathy for her, but I know there's not a lot an bystander can do, unless they see her drinking, then driving off. It's one of those difficult things in the law, where everyone knows something bad is bound to happen, but there's just not recourse until it does. Much like a stalker.

      That's another reason he didn't want the case. He absolutely cannot apply things he learned from outside of court about the defendant's conduct, character, or uncharged criminal activity to his sentencing decision.

You can't just call the cops and say someone is drunk and might drive but no, they aren't currently getting ready to drive away. There is nothing they can do. They can't wait around for hours to see if she might get behind the wheel. But yes, if you see someone drunk about to start driving, report it.

    Disappointingly weak and ineffectual punishment imho. Doesn't matter what your going through or why, You can NOT disable or kill anyone you want because your "mourning" or "Depressed".

    The jury wasn’t in the room at the time they were just about to enter. This defence lawyer has been riding this judge and undermining her since day 1 I was so proud of the judge for standing up to her

      To be fair, that judge went hardcore from day1 for the death penalty and seemed pretty annoyed at the fact that she too had to do her job and sit through the entire thing and give the guy a fair trial. Like, "let's just execute this man and just get on with it". If you can't be unbiased, at least try and pretend to for the sake of your role.
      Still, executing somebody doesn't solve the core issue, as leaving these people to rot in prison and at the mercy of other inmates is often times worse than outright killing them. Sentencing them to the death penalty is just doing them a favour and giving them an easy way out for their crimes.
      But then again, the death penalty only exists in third world countries.

      @@ChaosZero. They wouldn't fight for their lives if they thought life was the worse punishment. (And if it were, by your own standard, wouldn't it then be cruel to sentence them to life in prison -- a punishment worse than death?)
      Thankfully, the U.S. has never cared what other countries do. We wouldn't be the only country in the world with free speech if we did.

      The jury came back in, and the judge basically told the jury that it was *her own* fault, to avoid the jury being biased against the defendant based on the cheesy unprofessionalism of the defense team.

    This is some real backward small town BS. The judge goes easy on sentencing the drunk driver because he knows her personally. This is the sort of thing that provokes street justice.

    Middleton frustrates me so I barely watch his court dockets. He let's people get away with way too much and in this case he is putting others in further danger by not giving her a longer jail time. She has no incentive to stop drinking.

      I watched one case where a tenant landlord was before him, the tenant was absolutely terrorizing the other residence, doing everything she could including allowing bedbugs to run rampant in her apartment and judge Middleton’s only concern with this didn’t affect her ability to get another apartment. He didn’t care in the least bit about what she done to the other tenants as long as she didn’t suffer for it

      I totally agree. He's too lenient in most of the cases I watch of his and I already think in general the justice system is too lenient. There are too many charges dismissed and lessened, too many plea deals offered, and in fact they are expected by all parties, including the judges. It should be no surprise that criminals reoffend. Very disappointing case.

      @@gwynluv5447 Oh I hope all the landlords in that area were watching that so they know who not to rent to. Hopefully in spite of Judge Middleton’s best efforts the rest of the world won’t give her a big hug and a kiss and tell her it’s perfectly fine to terrorize everyone

    Mike, I’m not sure if it’s within your control or not, or how anything works on the YT Creator’s end. However, is it possible, relatively easy, or maybe just somewhere on the realm of abilities for you to add CC to your videos? I see a handful of them have it, most don’t.
    I don’t know about others, but even the auto generated ones sometimes will catch words that I have a hard time deciphering what was said or one word from another similar sounding word. Especially on videos with “less than stellar” acoustics. Lol. Just wonderin’ Thx!

    The sad thing is that the penalties are not applied evenly…. Locally in the same year there were two DWIs that resulted in someone dying. One perpetrator was a prominent professional who could afford a prominent local lawyer… got no jail time. The other perpetrator was a joe-schmo…got 18 months. SMH

    Grandma has a serious addiction sign of a true addict " I did not feel intoxicated". I grew up with an alcoholic father who always drove drunk. He always said I feel fine and capable of driving drunk. She needs jail time period.

Give somebody a lifelong injury, you don’t get out at all and therefore you cannot ever heard anyone again. Or at least you can’t hurt a decent human being what you do to the people behind bars isn’t a concern to any normal human

    Kind of a rare thing with this case, the drunk driver actually got seriously hurt also. I get angry when i see drunk drivers injure or kill the other party only to literally walk away from the crash themselves unharmed.

    I'm at 24:41 & I'm already wondering if I should watch up to the sentence. I've been losing a bit of respect for Judge Middleton due to his "soft on crime" sentencing despite the recidivism rates in his jurisdiction. I mean, think how many we've seen him say he's dealt with someone for years for whom he still gives as soft a sentence as he possibly can? He's certainly a defendants' judge. Would I hang out with him? HELL, YES! Will I go to watch him live next time I'm visiting IL or WI? Also HELL YES (even though I usually only hit MI when I'm in the N Woods of WI, & it's limited to the UP -- but would make the exceptions to see Judge Middleton live). Do I think he's way too soft? HELL, YES!

    I hate when people say inanimate objects are dangerous. Guns, intersections. I driver has warnings and can slow down, it's not the intersection that's dangerous. That should not be a consideration in sentencing.

    A friend of mine was killed by a drunk driver so I usually have zero sympathy for them, but this woman clearly needs to get help before she does kill someone.

    Drunk is drunk no matter what the age. One glass of alcohol with medications isn’t a good idea with driving. She might be a good person in her community but alcoholism is no respector of persons. It hits the good people and the bad people. It just is. She needs to realize this is unacceptable and do what she has to do to repair the damage. And this is her second DWI with injury? No! She doesn’t accept her responsibility for her actions. That’s a person who won’t stop. Alcoholics NEVER stop unless it gets too tough for them to continue drinking.

    I worked with a young lady during a summer several years ago who had just graduated high school. She was a very bright, very pleasant person with her entire life before her. Everyone was very impressed with her. When fall came, she and a few friends loaded up a car with their belongings and headed south to go to college. Another driver decided to fill himself with booze the same night they were driving and he couldn't figure out which side of the freeway to drive on. He ended up murdering her and her friends (and I think himself) when he collided with them head on. Drunk driving is a serious crime.
    Driving drunk is like taking out a gun and shooting across the street at the wall of a building. The intent of the person might not to hurt anyone, but the fact is the decision to do that endangers everyone walking on the sidewalk in front of that building (which would be other drivers and anyone unfortunate enough to be in the same vehicle with the drunk driver). Of course, that doesn't include the fact that "shooting the gun" (driving drunk) also endangers the "shooter" (drunk driver), so I guess its also like playing Russian roulette.

    It's got to be difficult to be a prosecutor in a court where the judge is going to contextualize every decision he makes with hundreds of facts about the community and the people in it, none of which you or the opposing counsel entered into the record, or maybe even knew about before he brings it up.

    The Defence in this case has been abominable, from the small amount I've watched.
    One person at that table was caught surreptitiously giving the finger to the judge while giggling with the mass-murderer.
    They guy in the pink tie was just about thrown out for bringing the Judge's children into a pointless argument he was trying to make against one of her rulings - he'd tried to claim that the victim impact statements were inciting violence and she was very p'd off about that line of argument. And that guy's boss was thrown out for something he did, too - I think the Judge decided he was lying to her.
    Well worth watching the victim impact statements - the parents of the murdereed children absolutely loathe the defence team for their antics and disrespect during the trial.

    I feel for her. As I've said I have 4 years clean. But I don't care if she's old. If she won't take accountability, she'll continue to drink and the next person she'll kill. Honestly she's lucky she didn't in this one. This man has had his life ruined by her. Sometimes the need to heal and give justice to the victim takes precedence to helping the defendant. She's not really remorseful. It's like she sees herself as a victim. My mom was hit by a drunk driver and was injured in ways that have left her disabled for the rest of her life. It knocked all her teeth out too. So, I'm pissed here.

      I’d argue that anything more than a month is more retributive rather than rehabilitative. Jail can help an addict detox, but spending too much time there can really screw someone up.

    From the little I've seen, the Judge has had to admonish the Defense Attorney's a few times in this case. I haven't seen her do the same with the State but again I haven't seen it all. Call me being to tough but I never want to hear a defense Attorney say the drunk driver was injured so they shouldn't be locked up. Had not been for their own actions they wouldn't be hurt. Just because she admits she has a problem, probably told to say that by her Attorney, she or anyone DD be let off softly either. She could've killed many but seriously injured 1.

    My cousin was killed on his graduation night leaving his graduation by a drunk driver! He didn't make it home for his graduation party and he was the oldest child so the 1st to graduate so everyone was so excited. His dad has never been the same, that was his 1st born son and he blamed himself for letting him drive himself that night. It's destroyed their entire family. The drunk driver got a few scratches and a couple of years prison. He showed no remorse because he doesn't remember doing it, he doesn't even remember driving his car that night. I don't feel sorry for anyone that drinks and drives. I also had a neighbor that her 17 yr old son and 16 yr old girl friend was killed by a drunk driver coming back from the movies, he'd just left the bar. That too destroyed those two families. Again the driver walked away and got a couple of years and probation. They buried the kids side by side, one of the saddest funerals I have or will ever experience 😢

    I was fuming when the defense attorney plead that his client needed help AFTER the judge explained she denied having a problem in the first place. If you can’t take responsibility for your actions and ask for help, no one can help you. It’s up to you to be accountable and take that first step.
    I’m only a few minutes in now, if she doesn’t get some jail time I swear I’ll lose my mind.

    I usually don't believe defendants when they say they see the "light". Yet she genuinely seemed touched by Judge Middletown's description of her behavior and seeing the victim's medical report. 30 days seems like a fair sentence for someone who, I think, won't reoffend. It won't be easy for her.

    i hate dui cases. A drunk driver could easily kill someones kid, parent, wife, etc. they belong in jail just as much as someone who randomly fires a gun in to a building. If anything, dui laws are too lenient.

    You know, if I had been arrested for drunk driving last year, then arrested again this year. I would expect jail time because denial is a river in Egypt. If you have any alcohol outside of your house, you should not drive. Never. We all have issues, hills to climb & storms that arise. If you aren't coping, people will let you know. Especially people who don't know you. 30 days in jail is not enough and she may not get any mental or substance abuse help. She could be locked up in a hospital (many are just like jail) but she would get medical help. It's a difficult case.

    Thirty days? She has DWIs, and gets opioids for pain?! I don’t drink, or use drugs. I donated a damn kidney, and all I got was Tylenol every eight hours! I broke my shoulder and received no pain medication! I had some significant, very painful surgery last year and received NOTHING for the pain. I get so angry at drunks who don’t get punished hard enough, and still get prescribed opioids! Grrrr… 😡

    I work with the state police and several other police departments and we clean up DUI accidents all the time and I'm telling you I have no sympathy none whatsoever for drunk drivers they should be a 6-month mandatory minimum for any DUI accident injure or not if there are injuries a year severe injuries 5 years I seen a woman that had her back broken by a piece of s*** drunk driver he rear-ended her on 95 going over 120 mph all he got was a broken ankle his sentence 30 days served on weekends 4 days after his sentencing we had the wife or paramedic hit head on by another piece of s*** drunk driver she is yet to be sentenced the wife of the paramedic died at the scene

    For the first time ever I think Judge Middleton was out of line and unprofessional. He rambled on and on presenting his own irrelevant evidence about her and everyone in the town. And why does he want to talk about everywhere she's ever lived? And now the boyfriend gets to tell us what a great gal she is. 🙄Debbie eye roll 🙄 And now Judge is introducing a grieving excuse. I don't think Debbie was too happy about it all. Not too many laughs here Mike 😒

    I am a licensed addiction counselor in Montana. Depending on the extent of her alcoholism which a chemical dependency evaluation would need to be done to help with this. If she is a daily drinker that consumes large amounts of alcohol then jail would not be the answer due to the jail being held accountable should the person go through withdrawal. Putting aside the alcohol for a bit, the judge said that the lady was on opiates which we all know what it says right on the bottle in regards to taking certain meds and driving. Also taking into consideration that there was a victim in this case, I would think 90 day treatment inpatient followed by 18 months of adult treatment court would be sufficient. Also having to pay damages to the victim would be warranted. Just my two cents.

    Judge M is too lenient for my liking yet again. I'm not even going to say anything more because he just frustrates me. Nice guy, but to hear that he's teaching other judges about sentencing does not comfort me. We are too lenient as a country in general. As for Parkland, I watched that and the jury was not in the room. In fact, she was frustrated that they weren't in the room yet and that they were submitting things at that time instead of on the jury's lunchtime. I've watch a lot of this trial and judge and I like her. The defense has absolutely been unprofessional and this was her last straw. How do you miscalculate not calling 40 witnesses??? Now they are having to take 12 days off because the prosecution isn't ready for rebuttal and there's a couple of holidays. She deserved that tongue lashing. ETA...It wouldn't surprise me in the least if she has or will substitute narcotics she's being given for alcohol. It happens all the time, especially with people who have not yet realized they have an addiction. Hopefully her doctors that are prescribing are informed of her drinking problem.

    Her dad’s death circumstances have greatly upset her so she’s going to inflict that feeling of helpless injustice on other people? No excuse. Many people lose their parents and still know better than to drink and drive. I have family in Ann Arbor and this is horrible. I hope she doesn’t end up killing someone. It would be better to intervene for this offense than to lock her up after she’s killed a family.

    I know Judge Middleton would have preferred not to have the case but if ever there was a case where a judge who knows the defendant *should* have the case it's this one.
    Why?
    I think she *needed* to hear him say 'hey I have seen you on three different trivia nights drunk and you were a mess and a half all three times to the point people kept their distance'.

    My ex FIL only got 2 years on his 3rd DUI, where he ran on top the other vehicle into the sunroof into the woman’s head. Messed her up to this day. 2years was not enough.

    I have practiced in a lot of jurisdictions. Without regard to the merits, this was a damn disorderly hearing, “Everybody just speak out when you feel like it!” I think the Judge was truly undecided as the process started. You don’t see that often when there’s a PSI. It was like listening to court in a foreign language.

    Even Debbie Davis is giving signs that this is embarrassing. This is on court record not only she was stinking drunk, but the judge bore witness to this outside of a courtroom.

      DUI law is way too strict in the US. No one is impaired at a .08 (I have driven at that level thousands of times as for decades I was still above a .08 when I got out of bed the next morning after drinking, unfortunately I am an alcoholic and quit drinking in 2006). In my experience and from what I have seen the minimum for actual impairment is a .15 unless there are other drugs on board as well. It is questionable whether this chick was even impaired since she was not tested for other drugs. An anti-depressant isn't likely to impair that much. Nevertheless, the US's attitude and attempt to ban drinking alcohol through the back door with the insanely low threshold for making driving criminal (in 49 states) has caused people great harm and hassle without good reason.

    I know that the judge had a hard time with this sentence and I know that his hands were tied but take her keys away from her take her car away from her take her driver's license away from her and she chose to drive and I'm sorry that she's hurting but you have to take into consideration what she did to somebody else's life and this is her second time put her in a mental institution or whatever it takes to punish her and they can take care of her meds and whatever there but she needs to understand I hope the guy that she hit sues her for everything she has how dare her I lost my best friends family husband baby everybody in a drunk driving accident it's very dear to my heart and this is just so outrageous

    In the first clip, the judge had been having a lot of issues with both sides not behaving as if they were in court. She's given stern warnings to both sides, each time removing the jury before she does.
