Trying to get him out of the house is in eviction problem, If he never handed over the house or had any intentions of handing over the house. it is now a theft issue. He defrauded these people of $500,000 they should be trying to get their money back not the house. Pursuing the fraud, would have him taken to jail not just removed from the property.

I am a realtor, trust me in every single real estate transaction in the United States there is a duty of good faith on all parties. Which means that no party involved in the transaction can intentionally deceive others, doing so constitutes constructive fraud. This is sometimes very hard to prove because someone can say I didn't know that wasn't inaccurate, and unless you have emails or a recorded conversation of their intent to deceive. This usually goes nowhere, but in this particular case The evidence is overwhelming. He had no intentions on handing over the property and hasn't done so to date. Pursuing criminal fraud charges has nothing to do with an eviction moratorium or landlord tenant laws. It's no different than if you were to go to buy something off of craigslist and the person took your money and did not give you the product it's simply theft. Their intention was always to steal from you, never to complete the transaction. They are what's called bad faith actors. When we bought our home they wanted us to do a walk through the night before with some of their stuff in it. Our realtor said absolutely not. We did a walk through and hour before and here in NJ both parties are present at the signing. But the couple we bought from were shady individuals and I'm glad we got through it.
Yep when we did our walk through the day before purchase they didn't have one thing packed up. So they scrambled and moved in 24 hours leaving a big mess and a hole in the wall trying to get furniture out. They were super kind about it all, but my God people are lazy motherfuckers.

A contract is binding Covid or not. The old saying goes, a person who represents himself in court has a fool for a client. Same thing when it comes to real estate. Step one, put a lien on the seller bank account through a judge (this isn’t a rental/eviction case) step 2 when judge is in favor, charge 10k a month for not giving up house, and extra fines for utilities and related suffering. And looser pays all court and attorney fees. Result: seller won’t see a dime from selling that house.

This situation is the exact reason why you don't sign closing documents until the home has been vacated. Before closing day you continue to document the moving out process of the previous owner. And schedule a move out inspection days before or on the day of the closing. And it is advised to have your locksmith on standby at the property.
I sold a home a few months ago. The buyers were let into the house the morning of settlement to confirm condition of the home and that we were gone. Of course I wasn't trying to scam anyone but can't imagine agreeing to close on a home when people are still living in it.
Sounds like negligence here and I'm not sure it wasn't the buyer's fault in a large part. This situation could have simply been avoided by pre-closing walk-through. Oh, he has boxes staged, but if his furniture is still there, well, duh. Postpone closing. Headache and legal action avoided. Once again, the law protecting the wrong-doers.

Its people like this that really mess up help for other people that really need it. I was behind on rent four times but paid it with the stimulus that was given. I wasn't evicted but I still paid my past due rent plus with fees. I am continuing to work really hard to not fall behind again. But people like this abuse the help that is given.

I am a landlord and I wish we could give people more breaks but people like this make it impossible for us to afford the taxes and fees we have to pay annually. We have three tenants who are refusing to pay and refusing to leave that owe us a combined 30k since the beginning of the pandemic. We can barely afford all of the taxes we are still forced to pay. We have empathy, but if we don't pay the government what they demand from us we'll be screwed.

Back in the early 2000s my husbands step father and his mother just purchased a house. When everything was official and they had the keys the people who lived there previously were still living there with nothing moved out. They wanted to demo the house so he broke the door and started tearing down walls and cabinets and said “if you’re in my way too bad this is my house”
Once we went to help a friend move this squatters sht out. He moved in with the gf and when she moved out he stayed. My friend told him he had a like 6 weeks or so to find a new place since he was NOT paying rent (I think the friend was trying to sell the house actually). It seemed fair, but when the time was up he had refused to leave and pay rent. So we thought it was ok to go in and clean and pack his stuff up. But actually nope! We were trespassing and had no right to touch his garbage. The walls were yellow and it smelled from all his habits, he had piles of garbage everywhere. But he had squatters rights. He called the cops on us and they reluctantly sided with the drug addict non paying trash bag. I think it took 3-6 months to get him out. It took the friend having to go to court (lose pay) to get him out. This ahole knew how to play the system and got away with it, this was in NY years ago. Unfortunately these people can’t do anything until they get a court order and they send over the sheriff to escort him or them out. Plus during a pandemic I doubt they will evict anyone. I also think squatters in CA have even more rights than in NY. But I am not familiar with their system or laws.

In this situation the seller is not protected by the eviction moratorium, this is fraud. Also, the buyers should have included in the contract, the seller has to vacate by closing. If the seller refuses to vacate the buyers should notify title immediately, the money held in escrow *can* be given to the buyers as a penalty.
There is definitely something weird going on here. On the one hand it's cut and dry fraud on his part. He listed the house and then refused to leave, he obviously had no intention of leaving. On the other hand why did they even sign paperwork without a final walkthrough with him gone? Who buys a house that isn't empty yet, for all they know there is a big gaping hole in the floor being hid by the bed or something.
@@Mantae123 It may be a shock to some but, there is rarely a final walkthrough just before closing. Once the final showings and inspections are done, that is usually it. Everything should be listed in the contract and any damage, liens, defects, etc. should be listed in the disclosures.
I feel really bad for the couple for going through this. It's obvious that the previous homeowner is is trespassing and has committed fraud. I really hope they win their upcoming court case.

I mean he probably couldn’t run and catch someone but look out if he grabs you.

Most utilities will contact the previous customer to confirm a account change as they do not want to get sued. That said if they could cut or remove the power box from the side of the house that might be legal as they own the land and home, but a claim could be made about harassment..
I’d call a locksmith when they were gone and have the locks changed and start putting they stuff on the curb, let them call the cops, you hold the mortgage on the property. So the old guy would have to leave.

Sounds like a backyard deal that they made with the owner. On a legit home purchase, the lending bank requires a home inspection and valid code permits to release the funds. There’s something the couple is leaving out of the details of this situation; that’s why the man has not been arrested for trespassing 🤔
What if the buyers waived the inspection and appraisal contingencies AND got a property inspection waiver? Or they could have paid all cash for it. And or they could have agreed to let the owner rent back for a few days/weeks/months and he refused to move out because of the moratorium. Once it's lifted I'd imagine he'll be booted but until then it sounds like they are stuck? EDIT: someone in the comments above mentioned "from another video they had last week it mention them paying partially in cash and getting a hard money loan for the difference. That is not your typical mortgage." - so there you go, no inspection needed in this case.

New owner said there’s an HOA. Never buy a property with an HOA. They are mini dictators. Communities need to vote to dismantle the HOA and return the properties to single family homes. Don’t need HOA to tell you how to run your home.

It was definitely not a foreclosure, the old owners are out of the house for months before those get sold (I owned a company that managed them for the banks), there is a chance it could be a short sale. Though there aren't a lot of those going on these days because prices have come back so much.

People sell houses they are living in all the time and usually get a period of time to move out. I had 30 days to pack up and find another place which I agreed to and accomplished.
Totally agree.. I signed all my papers, backed up the moving truck and found the former owner still had not removed one item from the garage and out buildings. I was moved into the house and his crap was still in the garage and sheds. Pre-signing inspection is the ONLY way. Make sure they are completely out and they left all the items you expected to be in the house (hot water tank, appliances, cabinets, etc.)

I had a “friend” in D.C. who had a situation like this. They tried for about a month to get the people out. The people wouldn’t leave. 15 or so distant cousins showed up and went in the home. The people requested for the cousins to forcibly removed them and their belongings from the home. The main person who caused all the problem requested to be driven across a couple state lines and dropped off on a random highway. The cousins accommodated the main person’s request. Yup, that’s what happen.
That’s why it’s important to have friends of diverse backgrounds. Having the right friends could put a stop to this...within days...that family would be out.

Used his children for an excuse etc...we ended up in court and told him his rent was 4000 a month..he moved. Several attorneys weighed in on this trying help the couple. They have to take them to court and have them evicted.
You have proof that you're the legal homeowner, then start by turning off all utilities.

I am a realtor, trust me in every single real estate transaction in the United States there is a duty of good faith on all parties. Which means that no party involved in the transaction can intentionally deceive others, doing so constitutes constructive fraud.
This is sometimes very hard to prove because someone can say I didn't know that wasn't inaccurate, and unless you have emails or a recorded conversation of their intent to deceive. This usually goes nowhere, but in this particular case The evidence is overwhelming.
He had no intentions on handing over the property and hasn't done so to date. Pursuing criminal fraud charges has nothing to do with an eviction moratorium or landlord tenant laws. It's no different than if you were to go to buy something off of craigslist and the person took your money and did not give you the product it's simply theft. Their intention was always to steal from you, never to complete the transaction. They are what's called bad faith actors.

We did a walk through and hour before and here in NJ both parties are present at the signing. But the couple we bought from were shady individuals and I'm glad we got through it.

Yep when we did our walk through the day before purchase they didn't have one thing packed up. So they scrambled and moved in 24 hours leaving a big mess and a hole in the wall trying to get furniture out. They were super kind about it all, but my God people are lazy motherfuckers.

Step one, put a lien on the seller bank account through a judge (this isn’t a rental/eviction case) step 2 when judge is in favor, charge 10k a month for not giving up house, and extra fines for utilities and related suffering. And looser pays all court and attorney fees. Result: seller won’t see a dime from selling that house.

This situation is the exact reason why you don't sign closing documents until the home has been vacated. Before closing day you continue to document the moving out process of the previous owner. And schedule a move out inspection days before or on the day of the closing. And it is advised to have your locksmith on standby at the property.
We close on our 1st home on Monday. Thank GOD its already vacant because it was completely renovated. But thank you for this wise info.
I sold a home a few months ago. The buyers were let into the house the morning of settlement to confirm condition of the home and that we were gone. Of course I wasn't trying to scam anyone but can't imagine agreeing to close on a home when people are still living in it.
Sounds like negligence here and I'm not sure it wasn't the buyer's fault in a large part. This situation could have simply been avoided by pre-closing walk-through. Oh, he has boxes staged, but if his furniture is still there, well, duh. Postpone closing. Headache and legal action avoided. Once again, the law protecting the wrong-doers.

Its people like this that really mess up help for other people that really need it. I was behind on rent four times but paid it with the stimulus that was given. I wasn't evicted but I still paid my past due rent plus with fees. I am continuing to work really hard to not fall behind again. But people like this abuse the help that is given.

I am a landlord and I wish we could give people more breaks but people like this make it impossible for us to afford the taxes and fees we have to pay annually. We have three tenants who are refusing to pay and refusing to leave that owe us a combined 30k since the beginning of the pandemic. We can barely afford all of the taxes we are still forced to pay. We have empathy, but if we don't pay the government what they demand from us we'll be screwed.

When everything was official and they had the keys the people who lived there previously were still living there with nothing moved out. They wanted to demo the house so he broke the door and started tearing down walls and cabinets and said “if you’re in my way too bad this is my house”

Once we went to help a friend move this squatters sht out. He moved in with the gf and when she moved out he stayed. My friend told him he had a like 6 weeks or so to find a new place since he was NOT paying rent (I think the friend was trying to sell the house actually). It seemed fair, but when the time was up he had refused to leave and pay rent. So we thought it was ok to go in and clean and pack his stuff up. But actually nope! We were trespassing and had no right to touch his garbage. The walls were yellow and it smelled from all his habits, he had piles of garbage everywhere. But he had squatters rights. He called the cops on us and they reluctantly sided with the drug addict non paying trash bag. I think it took 3-6 months to get him out. It took the friend having to go to court (lose pay) to get him out. This ahole knew how to play the system and got away with it, this was in NY years ago.
Unfortunately these people can’t do anything until they get a court order and they send over the sheriff to escort him or them out. Plus during a pandemic I doubt they will evict anyone. I also think squatters in CA have even more rights than in NY. But I am not familiar with their system or laws.

In this situation the seller is not protected by the eviction moratorium, this is fraud. Also, the buyers should have included in the contract, the seller has to vacate by closing. If the seller refuses to vacate the buyers should notify title immediately, the money held in escrow *can* be given to the buyers as a penalty.

There is definitely something weird going on here. On the one hand it's cut and dry fraud on his part. He listed the house and then refused to leave, he obviously had no intention of leaving. On the other hand why did they even sign paperwork without a final walkthrough with him gone? Who buys a house that isn't empty yet, for all they know there is a big gaping hole in the floor being hid by the bed or something.

@@Mantae123 It may be a shock to some but, there is rarely a final walkthrough just before closing. Once the final showings and inspections are done, that is usually it. Everything should be listed in the contract and any damage, liens, defects, etc. should be listed in the disclosures.
I feel really bad for the couple for going through this. It's obvious that the previous homeowner is is trespassing and has committed fraud. I really hope they win their upcoming court case.

Most utilities will contact the previous customer to confirm a account change as they do not want to get sued. That said if they could cut or remove the power box from the side of the house that might be legal as they own the land and home, but a claim could be made about harassment..

I’d call a locksmith when they were gone and have the locks changed and start putting they stuff on the curb, let them call the cops, you hold the mortgage on the property. So the old guy would have to leave.

We have a family who has a dog grooming business out of their garage a few houses down, I don't care, they are trying to make money in a legit way.

This happens when you don’t do your homework and you don’t do a walkthrough before closing like the lady in the comments said! Every deal that I have been a part of there was a walkthrough the day of closing! Not to mention, if I am paying all cash for something, it is done so with some safeguards in place!

I was in the process of buying a house. The person selling wanted five thousand dollars cash and if something happened and the sell didn't go through. He wanted the money non-refundable. I backed out fast!

Not really, because possession would take place at/around settlement. Final walk through is PRIOR to closing.

Sounds like a backyard deal that they made with the owner. On a legit home purchase, the lending bank requires a home inspection and valid code permits to release the funds. There’s something the couple is leaving out of the details of this situation; that’s why the man has not been arrested for trespassing 🤔

What if the buyers waived the inspection and appraisal contingencies AND got a property inspection waiver? Or they could have paid all cash for it. And or they could have agreed to let the owner rent back for a few days/weeks/months and he refused to move out because of the moratorium. Once it's lifted I'd imagine he'll be booted but until then it sounds like they are stuck?
EDIT: someone in the comments above mentioned "from another video they had last week it mention them paying partially in cash and getting a hard money loan for the difference. That is not your typical mortgage." - so there you go, no inspection needed in this case.
A home inspection and valid code permits have absolutely zero to do with this situation.

They already stated that they are paying a mortgage so it was not all cash . Also , mortgage companies do not require property inspections , that is between buyer and seller . And how in the world would anyone know if they used a hard money lender ? Where would they get that information ? Certainly the buyers would not broadcast it. Funny that people are hell bent to put the blame somehow on the buyers when this is the seller who the sole cause of this situation. You are right that they may have agreed to rent to back for a short period usually no more than 2 months.
This is one of MANY incidents that have shown up in my Recommendations. My heart goes out to these buyers.

New owner said there’s an HOA. Never buy a property with an HOA. They are mini dictators. Communities need to vote to dismantle the HOA and return the properties to single family homes. Don’t need HOA to tell you how to run your home.
It is ridiculous. I agree! I have lived in areas with NO HOA and the neighbors and areas are wonderful. You do not need an HOA to tell you how to upkeep your home.

This is what happens when you allow squatters to have rights rather than simply chaining them up in handcuffs and dragging them away. Criminal trespass is all squatting is. And should be dealt with accordingly.
Hopefully the News coverage will help get these people their home. I’m guessing the old owners defaulted on their mortgage and this was a quick sale or foreclosure. There are a lot of people exploiting the pandemic. These people are not alone.
Very good point, it certainly appears that the sellers were folks of "high moral fiber" to begin with so it is assuredly "buyer beware". Just sucks that there is a moratorium having to do a straight eviction on your new home would be bad enough but this is ridiculous.
It was definitely not a foreclosure, the old owners are out of the house for months before those get sold (I owned a company that managed them for the banks), there is a chance it could be a short sale. Though there aren't a lot of those going on these days because prices have come back so much.
This closed in January last year before the pandemic.

People sell houses they are living in all the time and usually get a period of time to move out. I had 30 days to pack up and find another place which I agreed to and accomplished.

Totally agree.. I signed all my papers, backed up the moving truck and found the former owner still had not removed one item from the garage and out buildings. I was moved into the house and his crap was still in the garage and sheds. Pre-signing inspection is the ONLY way. Make sure they are completely out and they left all the items you expected to be in the house (hot water tank, appliances, cabinets, etc.)

I had a “friend” in D.C. who had a situation like this. They tried for about a month to get the people out. The people wouldn’t leave. 15 or so distant cousins showed up and went in the home. The people requested for the cousins to forcibly removed them and their belongings from the home. The main person who caused all the problem requested to be driven across a couple state lines and dropped off on a random highway. The cousins accommodated the main person’s request. Yup, that’s what happen.

Shut the water off. Go outside and put a lock on the water main. It's your home. Turn off the power too. After the pandemic is over start to sue the family squatting, the state and the county. Sue them till oblivion and have your home paid for.

Wow this is unbelievable. When I was 21 my husband and I bought a house. The tenant refused to leave. Used his children for an excuse etc...we ended up in court and told him his rent was 4000 a month..he moved. Maybe if you make him your tenant it would work...or go to the DAS office or your president Judge in the county...good luck!!! Let me know
