Great video as usual!! Very informative! Does specific performance not apply if the company decide to breach the contract (if there isn’t an express condition that say something like you don’t get paid “unless” the job is fully completed)? I was thinking the company should still pay for the work that was performed bc you started prepping/organizing everything. They made an offer, you accepted the offer by signing the contract and starting the task, there was a bargained for exchange, and mutual assent. You just didn’t post the full content. I was thinking you should get paid for the amount of the work you performed bc they terminated the agreement.
Generally, yes, you are absolutely correct! But some companies / brands are overseas and our general contract laws may not apply so it just makes it easier to make the contract as clear as possible. Also, it becomes the debate of what establishes partial performance, how much should be paid for that performance as opposed to full or only starting etc. Contracts can get messy so I’m always leaning on the better safe than sorry.
