  • This is a long video clipped from Chessbrah's recent twitch stream titled 'update': / 978764250
    The purpose of uploading this video is to follow up on the previous video which I made explaining the whole scenario about Hikaru Nakamura copyright striking Chessbrah videos.
    I have no stand on this issue and am just putting forward one side's opinion here without any intention of spreading hate or negativity. If anybody has a problem with this content being here, just let me know and I would be happy to take this down. This video is not monetized.

      I see this is a new or at least small channel. I watched the whole video and enjoyed it. However, it was 100% not your content. You added nothing. This is stealing from Chessbrah as well as adding reputation, for good or bad, that he hasn't sanctioned. And if I'm wrong about the last part, it was on you to state this as you are 100% lifting his material without adding to it. Better to remove before it becomes an issue.

      @@TheSwiftCreek2 You are absolutely right, it's not my content. I have obviously stated that in the description. My only contribution here is trimming down a 3hr stream (whose link is provided in the description) to a 24 mins video whilst retaining the info which I thought was most crucial. I watched that whole Eric stream and he mentioned it there that he doesn't have any problem with people using this content. Also, I made it easier for people to follow the chat along with the video, which is not part of the original video. If Chessbrah has a problem with this content being here, I am more than happy to take it down!

      Yeah, pretty much anything involving human beings will have drama. "Avoiding drama" is a cliche people like to tell themselves and others. Resolving and handling drama is a much better pursuit than avoidance. This kind of "airing" out, while ugly, does have the potential to be productive. Hopefully no one actually involved "avoids" the drama, but rather uses the public nature of the drama to accentuate a more civil approach than would typically be expected when online personalities get all too human.

Fischer's open awfulness just shows he didn't have an issue with being a pos. If someone I know starts ranting on the street about how they hate black people i'm not going to say "oh fair enough mate, you're being honest about yourself", i'm going to tell them to shut up

      @@David-hg5uo It's not a matter of apologizing, if you get a copyright strike it is permanent and irreversible. If you get 3 strikes your youtube channel gets deleted. This is RUclips's policy and it does not matter whether or not copyright was infringed in the first place. The only person who can reverse the strike is the person who made it and often times the person who makes the strike is not the actual creator themselves but rather someone in a massive network who supposedly "represents" them but in reality doesn't actually care.
      Long story short, it is likely that not even Hikaru can reverse it at this point (not that he wants to anyways) and apologizing won't help.

    What Hikaru is doing that I don't like he realizes is he is now setting a precedent. He is telling everyone, the entire chess scene, that if you play against him, and you show clips of him he dislikes, that he will DMCA your content. He is loud and proudly taking the stance that he will attack your career. How do you think the rest of the scene sees that? Do you think it gives off the message of "Hey, let's colab and grow the scene!"? Of course not, who in their right mind would want to partner with him now? Put the morals aside, think of it as purely business, that's a huuuuuge risk to take now, playing with Hikaru. He's attacking Eric's career, and I wouldn't be surprised if he just tanked his own.

      He is and gotham chess always toxic personality. They use their mask to hide their toxic personality. You can see how gotham chess always very mad when lose in his old videos.       Hikaru is well off. He doesn't need his channel to do well. I think his net worth is like 50 million or something.
      That all being said, I'm not sure about this whole situation. Especially since Hikaru recently trashed Bobby Fisher by saying he wasn't talented, he just worked harder than anybody else during his time period.
      That should at least constitute a strike on you tube.

    This is just sad to hear. I'm one of the "new" chess players and to hear about all of that is sad. I hope it gets better, but I'm affraid it won't, because it seems like Chessbae and Hikaru's personalities aren't changing over time, and that's a big part of the problem

    I'll be honest, I'm confused by Alexandra's response. It feels like she's saying, "I didn't break up with Eric because of Chessbae, because we weren't really in a serious relationship. I didn't end a relationship over Twitch or Chessbae" But, saying it like that *implies* "I distanced myself from Eric, with whom I have a unofficial 'seeing each other' relationship with, because of Twitch and Chessbae." She didn't actually categorically deny that Chessbae tried to get in the way of a relationship between herself and Chessbrah, whatever that relationship might be,
    I mean, yes, that makes a difference in terms of Alexandra's actions. But, Chessbrah already talked about that although he was initially upset and emotional, that he understands that she's not the one who did something wrong. His comments were 100% directed at Chessbae's actions and how inappropriate that was. After Chessbrah's explanation of events, I had zero emotions towards Alexandra's actions. I didn't feel like she did anything wrong. The only person I felt like crossed the line was Chessbae.
    So, while I'm sure there are some people who felt like Alexandra did something wrong, and so she felt like she needed to explain her actions and the context of her relationship with Eric, ultimately this is a side issue that distracts from the main problem: Chessbae's abuse of power, while remaining immune from any real consequences due to remaining anonymous, within the online chess community.

      @@rexknowsless3187 She's a really rich lady from the UK who basically donated tons of money to a lot of chess streamers years ago, when they were still small, and became a mod for a lot of them. She then used her money and power as leverage and tried to get the community shaped the way she wants it to be. She even became a mod on chessdotcom, giving her the facilities to decide who gets famous and promoted by them and who doesn't. She then started shunning people she didn't like, and once Hikaru became really famous on twitch, she became his sort of manager, giving her even more power as he was the face of the chess community. This should be enough to sort of get you started on her, go and read Daniel Naroditsky's document on her to get more info about both her and Hikaru.

She told me her name (not chessbae obviously) and where she was from, but she never said it was the UK. Suspicious shit. But either way, I knew what she was doing when she kept doning obscene amounts of money.

      @@staypositive4358 Pretty sure that's against youtube's TOS, it's a bannable offense if a creator who has already been banned makes a new account to dodge the ban. They could always get someone else to make an account in their name and say they have "no association with the account," even though they do.

      You just cannot own the channel if previously banned for copyright. People just care about subs, views,, and AD revenue which a new channel won't get right away. Copyright strikes disappear after a year unless it has changed.

    An ironic part of this is that I hear a lot of Hikaru’s short rants on his political beliefs and that businesses at the top get too much and don’t help those less fortunate....according to this..he does the same thing on his own platform.

    There was a copyright case involving DramaAlert, often referred to as Keemstar, on the one side, and on the other side h3h3Productions. The case was not settled out of court, and so an actual verdict resulted from that case. The verdict of the case established some "precedence" in American law that a news story about a celebrity could, under "fair use", make use of images of that celebrity, even if the images of that celebrity might otherwise be under copyright protection.
    In practice though, they say that it is mostly just the wealthier RUclips channels that now have the legal right to use images of an American celebrity in a news or current events story that is about that American celebrity. They say that poorer channels faced with an arguably false copyright claim or alternatively a poorer channel that claims copyright infringement in an arguably correct manner often lose by "default judgment" after running out of money for various types of legal fees, or alternatively the poorer channel settles in a highly disadvantageous manner out of court for fear of an even more disadvantageous "default judgment" after the opposing lawyers from the wealthier RUclips channel run up the legal fees enough to run the poorer channel out of legal fee money with a default judgment unfavorable to the poorer RUclips channel happening after being run out of money. One recent example of de facto American copyright law is RUclips celebrity Lyssy Noel issuing a copyright complaint against a critique video from a kid. Another recent example of de facto copyright law is the JT channel becoming silent for more than a half year after issuing a copyright strike against the American RUclips channel DramaAlert for use of a JT thumbnail image without prior permission from JT, in a video that was about the American celebrity RUclipsr LeafyIsHere who had very recently been banned by RUclips. To sum up, in contrast to the face value of American copyright law, recent experience seems to indicate that de facto American copyright law only rarely allows poor RUclips channels to successfully defend against a copyright claim against a news or current events or critique video from a wealthy RUclips channel, and that de facto American copyright law only rarely allows poor RUclips channels to successfully issue a copyright claim against a wealthy RUclips channel. When a wealthy RUclips channel in America wants to shut up a RUclips channel owned by some kid for a week after an unflattering critique video from the kid, there in practice is nothing the kid can do about being shut down for a week. When a poorer RUclips channel wants to defend its thumbnail copyright against a richer RUclips channel, in practice it would appear that the richer RUclips channel can extract money from the copyright owner by threatening to run up legal fees, unless the copyright owner agrees to an out of court settlement after which the copyright owner pays money to the copyright thief and gives permission to the copyright theft after the fact and the copyright owner does not make RUclips videos for more than half a year.
    They say that Hikaru is an American, and that therefore de facto American copyright law most likely applies. As such, recent de facto practice in American copyright law will most likely apply that whatever the technical merits of the case, if one RUclips channel is much wealthier than the other RUclips channel, then it is the wealthier RUclips channel that comes out the financial winner in a copyright case and the poorer RUclips channel that comes out the financial loser in the copyright case. RUclips will sometimes decide to become directly involved in a copyright case when copyright bullying by some wealthy entity seems to be especially incorrect, but such direct involvement by RUclips happens less than one percent of the time.

      From an environmentalist point of view, Big Oil and Big Coal will be paying attention to such events.
      For example, if some kid makes a video critique of an oil company that is a little bit too effective, and the critique video uses copyright material from the fossil fuel industry, the oil company lawyers can consider simply copycatting from Lyssy Noel in order to get RUclips to remove the critique video from public view and shut down the kid's channel for a week.
      As another example, if some oil company wants to use someone's art work without prior permission and the copyright owner issues a RUclips copyright strike against the oil company, the oil company lawyers, knowing that there will be less than a one percent chance of RUclips deciding to get directly involved, can consider simply copycatting from DramaAlert and extract money from the copyright owner of the art work in an out of court settlement, and get after the fact permission to use the art work, and have the artist not make any public RUclips videos for more than six months.
      As such, as a result of de facto American copyright law, environmentalists should strongly avoid the use of copyright material, even if at face value the legal concept of "fair use" applies. Otherwise, Big Coal and Big Oil can simply copycat from what wealthy Internet celebrities are doing to various smaller RUclips channels, in order to shut down all sorts of environmentalist RUclips channels that become a little bit too effective at critiquing Big Coal and Big Oil.
      Carlsen, who was generally regarded as the world's top chess player last year in 2020, recently made a statement that he always believed in a free Internet. The effect of recently established de facto copyright law is that the Internet is however not free. It is possible that the current copyright squabble that involves Nakamura and another chess player will eventually evolve into a different type of match between Carlsen and Nakamura, a match involving making arguments for and against Internet freedom, as opposed to a match involving moving white and black wooden pieces on a chessboard.

    Let me tell you a chess story. I went to a bar, where some guy was supposedly this amazing chess player. I beat him 7 times and he beat me 3 and we drawed 2 games. Point is this he kept making excuses and trash talking when I won.
    But when he won, it was , "See? I'm not drunk anymore/ No one can beat me when I'm on point"( Which is hilarious, because i played every game against him after smoking weed and drinking at least 3 to 4 beers.) The last game we played I lost and wanted to play him again before i left the bar. He said he needed to go to the atm and that he would be back. He never came back, and I'm pretty sure he stole my cigarettes.
    This all seems relatively harmless but some people would even say its toxic. I mean chess breeds an egocentric crowd and more often than not, toxicity.
    So im okay with Hikaru being an asshole and being hated amongst his peers....
    However, fucking with chess brah and causing him to get a strike via youtube is just toooo much. It certainly causes me to rethink my subscription.
    I mean Hikaru doesn't need money.(google his net worth.) his content has been lacking lately anyways.

      I wish only gentleman played chess, but chess has made many a man curse, swear, want to fight, etc.
      Unfortunately many a grandmaster has been toxic. At least Magnus is a decent world champion unlike Kasparov.

    I've long since stopped watching Hikaru for different reasons but I am going to try to give as neutral as an approach to this as possible. From what I have read I believe that it might be TSM striking the videos. If it is not tsm and it is indeed Hikaru and/or chessbae then I think they are acting rather childish and hurting the community; which is seemingly against what Hikaru has preached in the past. However, Hikaru owes the community a transparent statement.

    Did anyone else notice some people use the word ‘toxic’ interchangeably with emotional? Now, Hanson seems to understand the experience of toxicity from people. Some people call being nominally upset as toxic. The toxicity GM Eric is speaking about has to do with saying one thing to your face and working behind the scenes to undermine and to downgrade (or even to degrade) you behind your back. Ali Reza, by contrast, as a young and honest individual, is know to wear his heart on his sleeve; that would not be known as toxic unless he showed himself unable to eventually accept results gracefully. This is ultra-competitive, and there is a fire inside of a competitor that does not need to be toxic.

    I kinda had this feeling about chessbae being centre of some big issue someday and here it is
    Actually:- generally top donors are easily made mods simply cuzz they "have lot money and shall donate more" but the truth is ... Not all the people with high money are good mods cuzz money has no relation to person's attitude or personality whatsoever ... Infact I suspect most of top donors are just "rich kids" since hard working rich people tend not to waste money donating on gaming and rather on good things.
    Chessbae is possibly a highly privileged girl with overly inflated self esteem and Hikaru might or might not be just a puppet here,I don't completely blame him

    The discussion around this from the chess community, from Naroditsky to Finegold, bothers me somewhat. I keep hearing this notion that it's okay to use someone's work provided you don't "portray them in a bad light."
    Yet, how someone is portrayed isn't a factor in Fair Use. You have the right to use a limited portion of another RUclipsr's (or any creator's) content, ESPECIALLY for purposes of criticism.
    Now, I don't know the specifics of the incident, how much or in what way the content was used. But I can say safely that it doesn't matter if Eric was portraying Hikaru in a bad light.

    People in the top are serious people, They worked hard until They got into the top pushing Themselves into insanity, not generalizing but only a few of them stay sane, and some in the middle.
    This was just the surface of toxicity in Chess, a good player would not bring that toxicity outside the game.
    To cite some things about toxicity, in case people are naïve enough to believe one side of another:
    * Game itself is a war game, it does not automatically make it toxic but it conditions the atmosphere for toxicity to settle in.
    i.e The game is about beating more opponents to get the highest points in a tournament.
    * There is already discrimination called chess elitism.
    It does not need an explanation nor an example, it commonly lingers around competitive environments.
    * The Game can be about the guy who work harder, totally not about being the nicer guy.
    "Why become nice when you could just work and work, get into the top, get the fame, money, and your dream"
    Concluding to what I have been talking about, the game itself can exhibit toxicity and therefore must be treated accordingly in order to avoid the situation to worsen. It was back then when I used to think that toxicity were being failed to notice due to it blending around ignoramuses. Some might ignore this message but this is what I have been worrying about concerning the future of Chess, if the public is not ready to accept and treat it, it might be the cause of the demise of Chess, I could imagine Chess losing sponsorship due to it being toxic, or it surviving and spreading the toxicity outside of it's environment.

    There is no denying that hikaru’s stream is very entertaining okay. I watch the dude almost everyday. And as a viewers of his I gotta say that sometimes he can get a little childish and get salty over a loss. Comments like “you suck” sometimes pisses him off and he goes all the way to ban the person. I mean he has the right to ban, its his channel so he can do whatever he wants. But I’m just saying given that childish behavior of his, it is definitely a possibility that he would go all the way to copyright strike someone. Just sayin Haha

      With a 3200 ELO in bullet chess and god knows how many hours of puzzle rush practice... Yes, it's entertaining. You get to see how someone with that rating thinks and plays. Very few people want to watch a 3 hour game of people staring at a board. Is bullet chess a bit "junk food"? Sure. But, it's better than having no one watch Chess.
      Admittedly, I don't know much about this drama. I guess I'll wait for someone to break it down nice and simple. I have to tend to the garden and don't have 24 minutes to watch this vid.

      Furthermore, I'm slightly scared that Chess.com could potentially go rogue and copyright strike the channel. It's legally possible for them to do so. (The graphic designs of the chessboard are copyrightable.)
      However, I doubt this'll actually happen. At least, I hope.
      (Edit: since some Lichess piece sets, to my knowledge, are licensed under free licenses, you can stream on Lichess safely.)

      Agreed, surprises me only a handful of comments seem to have much of a clue about fair use. There are several ways of qualifying - from what I can gather of the video Hikaru DMCA'd I would imagine it would qualify.
