    Thanks for talk about the issue. The problem is social service does not think domestic abuse is the same as domestic violence.

    May I ask? My husband is taking my to family court for domestic abuse and a punch.... I was arrested for common assault and a push.. Will this be frowned upon by the judge ... i appreciate your video very much thank you

    How do u go into it, and not be emotional I want to hold myself well but I know when the perp talks I will get upset

      Difficult to answer as each person will be emotionally triggered in different ways.In theory you should know exactly what someone will say as its already on their witness statement.     Now in the situation where there has been no violence or history of violcne and have no criminal record violent or otherwise but has made a threat on one occasion during an argument. My question is why the father literally has no rights. The father even if there was no violence or history of violence and admits his guikt(threat made) you are truly guilty until proven innocent. Child taken away without visitation and evicted from home to boot. And any allegations made by the mother are considered fact until proven otherwise. Also no charges made. In therapy of own accord also. But still whole family and home taken without trial or charges. I was even flat told that I have no rights by three police officers and the court. I'm living this now.

      in my experience childcare arrangements hearings aren't primarily about a parents rights.they are about the welfare and rights of the child.it could be the case that because of the way legal people speak it sounds like "allegations " are believed, when they are in reality listed to be decided upon at a finding of fact hearing.if you admitted a threat made then that would be accepted as fact that you admitted it. cafcass's recommendations will influence the court a lot as well.if you need to discuss through details call me on 07906 956035

      IMHO not necessarily. If one parent makes certain claims against the other or has a strong anti co-parenting stance they may simply think the situation wasn't suitable for mediation

      To my knowledge (*I am not legally trained) they are 2 separate processes.Normally if an allegation does not proceed in a criminal court then the family court will decide if any such allegations should be explored in the family court.     The law is clear, but what do courts really do?
    From what I hear from abused women who have been through this, and what I read on line (especially about judge Tolson) it seems that what happens in court has little to do with the law and is mostly about what the judge believes in.
    In many cases women can prove they and the children were abused but the judge will say it is more important for the father to have his right to see the child than the children's and mother's rights to be safe.
    What really happens in court?
    It is all secret which allows judges to just ignore the law.

      your right - in my experience the fact finding process is very much "who's account of events does the judge believe" on the balance of probability (ie who is it more probable that the judge believes). Vey little is about the "law" from what I have seen - good to understand these proceedings are civil disputes, not criminal cases. family courts can get quite nasty with malicious allegations as well made to prevent parents having a relationship with a parent. I think if a mother can prove the abuse then likely a positive outcome for them.Some mothers know the system and make false allegations as well so it a complex situation.there will always be one parent that isn't happy with the outcome

      Hi.In my lived experience (personally and observing the outcomes of people I help, mainly fathers)I don't agree.I'd say the "system" is biased against men. BUT that doesnt mean you can't achieve positive outcomes as a man, it just means you have more of a challenge to address the imbalance. I'd agree on marriage, many people don't know they are entering into a legal contract/ relationship when doing so
