  • In this video I discuss some of the reasons you WOULDN'T want to get your FFL. There are more rules and things you have to do once you get one.

    3:06 Not quite an "open door policy". Home-based FFLs as well as storefronts must declare their Hours of Operation on their license application. The ATF can enter only during those hours. If they come at other others, you don't have to answer the door. If you're a home-based FFL, and there are far more of those than gun shops, you can make your Hours of Operation anything you choose. Mine are a few hours a week in the middle of the week when an inspection visit would be convenient for me. The ATF does not have a right to search your whole house, they can only enter your office where ATF records and gun inventory are kept. The ATF inspects approximately once every 5-6 years, and they call the day before they inspect- that's been my experience. I make money, so the $90 fee every 3 years means little to me.

    I believe we should all apply for an ffl in mass . If we can get 10-15 million applications submitted we could make change

      That or they would just higher 85,000 agents. But yes I do get your point. I think the same way for the pistol brace issue. If you have an SBR and need to cross state lines with it just to go shoot with family, or go to the range, you have to fill out paperwork, hopefully they just get inundated with NFA travel applications.

      Well if everybody was the FFL then the government would have detailed information on what guns you have which is what they want anyway when you are a private citizen you don't have to have that because you just sell them or say you sold them or whatever so there's no real list which is exactly what the government wants they want to list of what you have and don't have

    We had a guy in our gun club who had a home-based FFL. It was great when New York started mandating ammo be ships to an FFL cuz he lived down the road from me. Alot of times i would pick it up right off his porch. There were lots of perks, but there was also a few downsides. He mainly had his FFL to increase his own collection. He had 4200 guns in his book when he died and they found another 300 in storage areas. He didn't do many background checks because he didn't sell many guns. So basically if you came in and bought a gun part you had to do a 4473. I bought a bunch of handirifle barrels from him. 4473 on each one a few days apart. He said i was helping him out but i didnt really care. I love #1 rugers and encore and other single shots. When he died he left me all of his custom No. 1 rugers in odd ball wildcat chamberings and all the dies he had for them. 338-06, 17-222, 14 calhoun (my favorite its a 25acp neck down to 14 caliber!), 6.5 BRM, 45-110, 7mm-378 weatherby, and a 17 K-hornet. He was a great guy.

      Nice! Having a friend with an FFL is super nice. Cool you inherited a lot of cool stuff! Haha, 25ACP, that is a little guy, down to a 14? That is something I have never seen.

    Don't get a FFL if you're "hobbyist," ATF changed rules in 2022 that you have to sell "X" amount of firearms to be a valid business. A friend of mine had a FFL but only sold a few guns a year, he would buy some, shoot them for awhile and then sell them, the ATF revoked his FFL this year stated he didn't sell enough firearms to be considered a "business." I don't remember if he said they told him it was 7-guns per months or 7-guns per year, but he didn't meet the requirements.

      I haven't read anything like that... but it doesn't surprise me. The ATF seams to be itching to pull licenses. I have heard all sorts of stories from other people of the ATF coming up with lame reasons to pull licenses.

      I see the same myths are still spewed out. Ask 10 guys if you can get a home FFL and 8 will tell you it's impossible. That's 8 guys talking out their ass. So much ignorance and false information out there. Getting an FFL is ridiculously simple, If you can't figure out how to do it then you probably wouldn't succeed in the business anyway.

      This is not true. I just went through my interview 2 days ago and was approved and this was never discussed or mentioned during the entire process.

      To my understanding, one piece of legislation (06/2022) and an executive order (03/2023) have some text where they're trying to expand the definition of "being a dealer."

      He's buying more for himself then as a business the way he was doing it . If you are buying firearms for yourself and selling them after you decide you don't want them to buy more then it's not a business really, it's a hobby. 😅😂

    Spoke with the ATF yesterday. Still debating getting it. I want to engrave guns. He basically told me you can do them and I even thought I could only do parts that were not considered the gun like a slide. But he said you can as long as you return the gun that day. When the FFL comes in is if you engrave one and they don't pick it up that day! Once its in your possession overnight it must be logged properly. I was surprised and asked again. He said yes you can just make sure they stay or don't leave it overnight. He said most get the FFL just to avoid issues. He was actually really cool and polite. I asked about gun safes to secure the guns and and other question he answered them all. He's said the 01 was good and explained both 07 and 01's.

      Nice, honestly the ATF individuals that come and explain FFLs have always been super nice, often pro 2A, and professional. However... I am still not a fan of the ATF as a whole.

    Something to note- if you are interested in becoming a home based ffl your home address will be openly listed on the internet for anyone searching for an ffl. So if you for any reason don’t like that idea, consider a different approach.

    Question: I read on one of ATF's pages that you are supposed to make an effort to run a business and make a profit. Is that correct? I only want an FFL for my own use. I have no intention of becoming a business.

      Yes you absolutely have to use it as a business. FFLs for exclusive personal use are a no go.

    This is all just part of having a business. This why most people are better off as employees.
    It majorly depends on which kind you are getting. Good information but everything you said does not apply to every type of license.

      True, the cost is different for each one, the laws you have to follow are also different. It also varies from state to state. So very true, not everything always applies in every application.

    I have some questions. I'm looking into being a gunsmith and working retail for a gunshop. Not owning a business but working for people who already have a business in place.
    1) Do I need an FFL to sell a firearm as a retailer employee and what goes into that.
    2) Do I need an FFL to be an apprentice gunsmith and a what level of FFL would be required to do basic gunsmithing (Repairs, refitting, engraving)

    Iv been researching on how to own a legal, fully automatic rifle and seems i can either pay 100+ grand for pre 86 or i have to apply for ffl. Am i understanding this correctly? Thanks.

      U can't own it, u can possess, sec license is nonvalid for w.e reason u have a illegal one, and ur on record. And restrictions on who u can sell it to, means ull most likely be lowballed. Since anything after 86 isnt just a nfa item at that point. Imagine a false restraining order, and you having 24 hours to dispose of it.

      To get the SOT you will also need to submit an application to ITAR as well.

    So do you still need to intend to sell guns to customers even you only want the license for discounted dealer sample machine guns/ or self made ones?

      Yes you have to be in the business of selling firearms. If it is just for yo they will pull your license.

    so you are saying, they make you keep the records forever?? even after you lets say get out of the business???

      Yes, it used to only be 20 years and then you could start shredding them. But that changed a year or two ago. Now you have to hold onto them forever and turn them into the ATF when you close your business/FFL.

    I wouldnt consider any of these that bad, yeah you have to pay a fee but if you simply transfer 8 guns in 3 years youve already paid for it, not including personal benefit, the ATF can come knocking but you should have your books in order for good business practices anyway and they can come to your door if you dont have an ffl as well, everyone knowing you have your ffl is good because it means more people to buy guns. Liability is a concern, sure, but its a business, every business has liability for its products or services, the title of this should be why not to get your ffl for personal use, which is already not permitted anyways

      By personal use what are you refuring to? Just getting an ffl to have weapons shipped to your house for you yourself to own or are you legally allowed to do that but you have to work transferring and helping others purchase firearms or owning them? I have a hard time understanding what people mean by personal use is an issue or can you only order and buy firearms for yourself through another ffl in person?

      It can be, but it takes a lot of time to get your name out there. Also if you are selling guns as a home based FFL a lot of people will avoid shipping or buying items from you because they would rather go to an "established" gun store rather than some dudes garage. So take that into account. If you want to give it a shot you should just start small as a side gig and see if you like it. Then go big if it works out. I just do it on the side and I don't make much at all. But it is fun.

      Ammo bot? I am assuming you mean like factory equipment to essentially automatically re-load ammunition. Yes, it can be a good and profitable business, in fact there are LOTS of people already doing that. If you look on Ammo seek you will see what they call "remanufactured" ammunition. Remanufactured ammunition is just ammunition that has been re-loaded. If done right it is as good as new.

      NO! Just because your own NFA items doesn't make you have an open door policy with the ATF. If they come to your door without a warrant you can kindly tell them to pound sand. Even with an FFL you can tell them to pound sand, but you would get your FFL pulled in 2 seconds flat. And an FFL denying an inspection would likely be enough probable cause for a judge to sign a search warrant anyway. But I denying the ATF entry for just owing NFA items would not be enough probable cause for a search warrant in any free state.

      No government entity can enter your home without warrants . Unless they cook up justifiable cause and generally that’s not to their benefit .

      All Guns laws are illegal to the 2nd amendment of the US Constitution. It's illegal in the eyes of the Government. The Government surpassed the US Constitution long ago to add restrictions.

    Like half of the stuff you talked about is to NOT true lol. Some of this is false information. I’ve got my class 7 FFL and already have had my meeting with the ATF. And half of the stuff you talked about is wrong

    What about me just wanting to have legal firearms imported to a nearby store an also that I won't like every firearm at a gun store and sportmall?

      If you are buying it online they will only ship to an FFL. If it is a foreign country they will only ship to an 08 FFL if the firearm is outside of the country. However once it has been imported it can be transferred to any regular 01 FFL. If fact this is how most "imported" firearms are. By time you see it for sell on a website it is likely already in the US.

    None of the reason were valid!
    Cost- what licenses is free?
    Everyone knows - you are applying to sell firearms you need to run background checks yes the chief of police and city need to know!
    Liability- by the book, documentation 🫠 did you just want to sell firearms and not write paperwork?
    Open door ATF- no true there is a law that prohibits them from doing so unless your business keeps raising red flags and they still need a warrant!

    You're wrong on one part. Just because you have an FFL doesn't mean the ATF can just come right in. They can show up for an inspection but you don't have to let them in without a warrant, if you don't want to. In doing so, your license might get yanked, but the constitution still applies. They'd probably get butt hurt and come back with a warrant, but fuck em.

      Very true! You don't HAVE to let them in, but you don't your license will be pulled SOOO fast. And in that case it is probably better to just not get one. Then they will likely return with a search warrant. An FFL refusing an ATF inspection would very likely be a red flag and I am sure a judge would happily sign a search warrant.
