Don't you have an employment agreement which covers things you don't get paid for? If the camera is in your sleeper, you have a point if it's looking at you or looking out front, SCOTUS has already addressed this where you have no expectation of privacy. Gas lighting?, can you elaborate? Unrealistic appointment times are simply "I can't legally do that." Who is stalking you?

We have alot of people that like to reword laws to fit their definitions and most are Idiots line them up and shoot them all ..

Sometimes the original shipper and broker are involved in the double brokering ring because the scammer pays them under the table. There is something similar in the dump truck industry. There was a trash transfer station in my area. The dump truck drivers were paying the dispatcher of the the station, $100 a week so that they were able to cut in front of the line and get the load. $100 x 20 drivers is $2,000 week under the table pay for the dispatcher. Now can you imagine the double brokering with under the table pay? If the scammer scams 20 drivers and pays the original broker 20 times a cut, that would give the original broker an incentive to be part of the “ring”.

Rule number 1 before you book anything check MC with your factoring company, never work with brokerages MC starting with 14, 15 and are longer than 6 sumbers there are some exceptions but still do your check anyway, call the company and ask if that person is working there and authorized to sell loads.
I see the scam, but in order to pull it off, the scammer has to have access to that particular load that he "brokered" to you. How did he get this access? One cannot just go to a shipper and say, "Hey, I'm picking up a load." So how did the scammer get the shipping info and even the BOL number? I think another precaution to take would be to call the shipper when you receive the ratecon.

The Gmail email account is an automatic red flag. Not saying every person using a Gmail account is a scammer but tread very carefully when encountering one of these.
The FBI investigates identity theft, so I would give them a call, maybe starting with the St Louis, MO office. I bet they can solve that crime quickly. I would think the Shipper and Receiver would welcome some law enforcement resolution.
No point of calling FBI. They only listen if a single person or group of people get scammed over $250,000. Otherwise, you’ll be wasting their valuable time.

Unfortunately, it seems that Brokers need to be regulated more so than Carriers. Brokers should be registered with the FMCSA as well and EVERYTHING should be matched including phone numbers, addresses, emails and names. Carriers are getting royally screwed at every turned. Freight brokers, fuel prices, mechanics and truck stops. Price gouging should be illegal.

Yeah you misunderstood. When I say they factor through RTS, this is something you can see on the loadboard right away (there is a checkmark next to the broker) and usually that means that the broker is clean if they are factorable. I dont use factoring for all of our loads, only about 5%. Basically, the brokerage was fine, but the dude who was claiming to be a part of that company was a fraud. And yes, you can have access to posted trucks and loads even without an MC.

Double-brokering is when a broker defrauds their customer by giving the load to another broker without the knowledge and permission of the shipper. This business of sharing or giving loads to other carriers who the broker didn't enter into a legal contract is problematic. It's problematic mostly for motor carrier (1) who doesn't know if motor carrier (2) is properly insured for the cargo value and type. Is there a name for this practice? Most brokers say in the contract that you can't do this w/o their permission. Thanks

Ok. Unless I know the broker calling, I refuse all offers from brokers calling in. I don't post my truck on the load boards. All brokers I call must pass a credit check, and i only deal with the Truckstop board. (so far) Another thing I do is to have a "DO NOT CALL" list of brokers who have either shorted me, or fully admit they use Carrier411. Usually these brokers question you about inspections after they read comment said about you by other brokers. I also block these brokers on my Truckstop board so I don't have to deal with them. So if you're a broker, please state upfront that you use Carrier411. It will save us both time. Lastly, there are outfits that do the online carrier packets, like RMIS. If the broker isn't setup with them, I really don't want to haul for them. Anybody can get a carrier packet emailed to them. With doing them online, it does make it easier to trust that you will be paid for your services.

Yeah, we have contracts that spell out everything about the load, Pick up, delivery, payment etc, however, as in any business, contracts are only as good as the people who sign them. For those of you who are fairly new to this business, this might shock you to know that years ago, long before cell phones, email, the internet and even fax machines, (damn I feel old), We owner operators would get load and broker information from the DAT monitor at the truck stop. DAT stands for (Dial A Truck) and that was our reality back then. Every truck stop had a driver lounge with a monitor flashing the various loads and also a bank of pay phones so we could call brokers. The only lounging we actually did back then was looking for loads. At any one time you might see a dozen guys standing in front of the monitor, and when a load popped up, everyone would rush to the pay phones to call the broker. I've even witnessed guys fist fighting for loads just so they didn't miss out. Once you booked the load, the broker gave you your dispatch information right over the phone and then mailed the rate confirmation to your house. Yep, you read that right, Mailed the rate confirmation to you. Everything was done on the honor system back then. And while I'm sure some people, from time to time, were screwed out of payment back then, I don't recall it ever being a problem. When I eventually got home after being on the road for weeks, I had a stack of envelopes with rate confirmations waiting for me. It usually took several hours for me to sit down and hand write out invoices on each load, address envelopes and mail the BOL on each load to the broker. And then I waited for a check to be mailed to me. Fast forward a few years.... and the electronic age took over the trucking industry in a big way! I remember a time in my life thinking to myself, if only those cell phones would get cheaper, I think I'll buy one so I don't have to stand at a pay phone in a truck stop calling on a load. Back then, only doctors and lawyers owned cell phones, and they didn't fit in your pocket, rather, they were in a large bag you carried around. Well, finally we got cell phones, first a flip phone, then a blackberry, and once Apple came out with the first iPhone it was a total game changer. Soon, that DAT monitor at the truck stop and the pay phones were all in my hand while I was rolling down the road. My productivity greatly increased. There was a time it was nothing to sit around for two or even three days a week waiting for a load. Once I had an iPhone, I could keep myself booked and rolling all the time. And life was good. As I recall, the average rate per mile was around $1.25/mile. Yep, you read that right. Of course fuel and all my other expenses were much less than they are now as well. Now, everything in the trucking industry it seems moves at the speed of light. It seems that the electronic age has made it possible to become a thief in disguise. And while productivity has greatly increased, it seems that the honor system is quickly going by the way side. In some ways, nothing has changed. Instead of a dozen guys standing in front of the DAT monitor at the truck stop, there are now 50 or 100 guys and gals on their phone or at their Personal computer at home, all looking at the same load. And when that load hits the board everyone calls at once. If the broker doesn't answer, put it on speed dial and keep calling until you get a voice, or finally give up in frustration and move onto the next load posting, and ask yourself what the heck are you doing wrong. Used to be that drivers would stand around the DAT monitor complaining about how everything sucks. Now, we all log into RUclips and listen to people make videos complaining about the same things that suck in the trucking industry. What has changed to a large degree is the lack building good working relationships. It's all become so impersonal now dealing with so many different brokers that one naturally has to question whether or not you're dealing with a crook on the other end of the phone call. I have one broker who has been in business for 40 years now and still does it old school. When you agree to haul a load for him, you actually drive to his office, he has a load confirmation already filled out that shows what the load pays, the fixed 11% that he takes, and what your pay is. If you need an advance, he'll write you a check for up to 40% of the load and even let you drive his pickup to the bank in town to cash the check. Once I deliver the load, I collect a check from the customer and then I bring that check back to my broker and he immediately hands me a check for my part. Often times, I sit around his office shooting the breeze. He knows me and I know him. He knows he can depend on me to do a good job for him, and I know I can rely on him to deal with me fairly and pay me promptly. That my friends, in my opinion is how trucking should ALWAYS be. I think there's supposed to be a freight reduction; because of price increases ppl are buying less. You're better off in mechanic school. Even amzn had the biggest layoff in their history & it's busy season.
This is nothing new These big carriers have been doing this for a very long time And if you try to go after your money they'll just make sure you spend a 100 times more in court trying to get it
Go here: safer.fmcsa.dot.gov/CompanySnapshot.aspx Enter the DOT or MC of the brokerage and call the number listed under Safer. This is the actual number the broker is registered with. In my case, the RC showed the phone number of the fraudulent individual pretending to be a broker, and had I called the brokerage itself, I would have quickly realized that this dude never worked there
It's about trust- as a new broker, you probably dont yet have a credit score. Carriers would rather get paid less but PAID than get offered more and not get paid. Just like brokers wont work with new carriers, carriers will try to avoid new brokers

In the spirit of transparency, I will be completely honest. When I see a broker post a load that states 50-50 quick pay, I stay away. While I logically understand that everyone needs to start somewhere, and this 50-50 system is a way to get carriers to work with you so you can, over time, build your CS, my first thought when I see that load is "something is off". It's very unfair, I do admit, but this is just the psychology. My best advice for a newbie is this: when you find a carrier, build a relationship with them. Pay them quickly (not quickpay with a fee), dont annoy them with check calls, and be there if issues arise. Get those good reviews going (leave a carrier a good review, and many times they will leave you a good review back on DAT). In the beginning, it's all about relationships. While it SHOULD stay that way always, it rarely does unfortunately. Be patient and carriers will slowly trickle in. I sincerely wish you the best of luck, and remember- we all had to start somewhere. It's always tough in the begining.
I heard about a broker that scammed a trucker that was a blood. The gangster trucker found where the broker lived and killed the brokers family and put the broker in a coma.
Then (I would argue) you are giving the asshat who double brokered a taste of their own medicine. I am sure there are other repercussions as well though haha.

Anyway, It was the department of Justice, I mistakenly said the dot. But it’s basically just explaining the penalty for the theft of freight during transport. It’s ten years if over 1000$ Has something to do with commerce. There’s a technical name for it. Hope the feds make headway with your case
This is another reason why all brokers should have to post a $100.000 cash bond to get a license and as well shippers should be required to pay the delivering carrier and the carrier then send the broker thier fees! It's a simple fix but we have let them screw us so long that nobody is willing to force a change.

If the broker doesn't answer, put it on speed dial and keep calling until you get a voice, or finally give up in frustration and move onto the next load posting, and ask yourself what the heck are you doing wrong. Used to be that drivers would stand around the DAT monitor complaining about how everything sucks. Now, we all log into RUclips and listen to people make videos complaining about the same things that suck in the trucking industry. What has changed to a large degree is the lack building good working relationships. It's all become so impersonal now dealing with so many different brokers that one naturally has to question whether or not you're dealing with a crook on the other end of the phone call. I have one broker who has been in business for 40 years now and still does it old school. When you agree to haul a load for him, you actually drive to his office, he has a load confirmation already filled out that shows what the load pays, the fixed 11% that he takes, and what your pay is. If you need an advance, he'll write you a check for up to 40% of the load and even let you drive his pickup to the bank in town to cash the check. Once I deliver the load, I collect a check from the customer and then I bring that check back to my broker and he immediately hands me a check for my part. Often times, I sit around his office shooting the breeze. He knows me and I know him. He knows he can depend on me to do a good job for him, and I know I can rely on him to deal with me fairly and pay me promptly. That my friends, in my opinion is how trucking should ALWAYS be. Autonomous trucks are a joke. Autonomous car research company just went bankrupt because it's harder then they thought it would be.
Until a mathematician figures out artificial intelligence, the widespread use of autonomous trucks isn't gonna happen.
I think there's supposed to be a freight reduction; because of price increases ppl are buying less. You're better off in mechanic school. Even amzn had the biggest layoff in their history & it's busy season.

Enter the DOT or MC of the brokerage and call the number listed under Safer. This is the actual number the broker is registered with. In my case, the RC showed the phone number of the fraudulent individual pretending to be a broker, and had I called the brokerage itself, I would have quickly realized that this dude never worked there
I'm a new broker and offer quick pay and sometimes people won't use us but will go book a load with a broker offering less.
It's about trust- as a new broker, you probably dont yet have a credit score. Carriers would rather get paid less but PAID than get offered more and not get paid. Just like brokers wont work with new carriers, carriers will try to avoid new brokers

In the spirit of transparency, I will be completely honest. When I see a broker post a load that states 50-50 quick pay, I stay away. While I logically understand that everyone needs to start somewhere, and this 50-50 system is a way to get carriers to work with you so you can, over time, build your CS, my first thought when I see that load is "something is off". It's very unfair, I do admit, but this is just the psychology. My best advice for a newbie is this: when you find a carrier, build a relationship with them. Pay them quickly (not quickpay with a fee), dont annoy them with check calls, and be there if issues arise. Get those good reviews going (leave a carrier a good review, and many times they will leave you a good review back on DAT). In the beginning, it's all about relationships. While it SHOULD stay that way always, it rarely does unfortunately. Be patient and carriers will slowly trickle in. I sincerely wish you the best of luck, and remember- we all had to start somewhere. It's always tough in the begining.
I heard about a broker that scammed a trucker that was a blood. The gangster trucker found where the broker lived and killed the brokers family and put the broker in a coma.

This is another reason why all brokers should have to post a $100.000 cash bond to get a license and as well shippers should be required to pay the delivering carrier and the carrier then send the broker thier fees! It's a simple fix but we have let them screw us so long that nobody is willing to force a change.
