    This is the second time I've watched this. The first time, I cried my heart out. I can't believe one greedy blackmailing company can do so much damage farmers. They're doing this all over the world. The very thought of this is making me sick. I just wish I could do something about it. The people they've killed, the people and the soil they're destroying, it's utterly horrific.

      Faithangel377: I'm sharing it too, with 2 big-time Monsanto farmers in my area. They won't like it....too bad. They are starting to have LOTS of trouble with their Franken-seed cotton crops..."emerging/resistant PIG WEED and insects." Very expensive to combat.

      @@charlesmrader If you put enough Roundup on your land, it will grow nothing else BUT RR crops. and when you sell your farm the new owners will only be able to grow RR crops. And you need to be very careful you don't kill the trees growing around said land.

      The simple answer to the question is yes. But the simple answer does not adequately provide an explanation or an understanding of the question. To achieve an explanation and understanding, it is helpful to rephrase the question: Does “intellectual property” allow a private company to own the seed created?
      Beginning in the early 1900s, scientists began to understand the process of developing hybrid plants. Scientists learned to develop two inbred parent lines that, when crossed, produced hybrid vigo―most often meaning greatly increased yields. Using this scientific knowledge, Henry Wallace, of Pioneer Hi-Bred, controlled the information about the parental lines as a company secret, thereby gaining the intellectual property known as a “trade secret.” Thus, seed companies have been able to have trade secrets in plants for almost a century in the United States.
      Farmers would go to a local seed dealer and request to purchase a particular brand and variety of a seed. Upon purchase, the farmers would then own the seed for planting and harvesting a crop. However, because of ordinary rules of biology, hybrid seeds, if saved and replanted, lose about 30 percent of their yield. Thus, farmers in the United States are accustomed to returning to a local seed dealer each year to purchase new hybrid seeds. The same is true for farmers around the world.
      As knowledge about plants and breeding continued to develop, scientists learned in the early 1970s to use new breeding techniques based on knowledge of genetic information. In 1980, the Supreme Court of the United States ruled that an organism produced through modern biotechnology can be protected under general patent law―via a utility patent. In 2013, the Supreme Court of the United States reaffirmed that plant breeders can obtain a utility patent in biotech organisms, including seeds and plants. (Association for Molecular Pathology v. Myriad Genetics, Inc., # 12-398, decided June 13, 2013).
      Therefore, in the United States, plant breeders can own intellectual property in seeds and plants through each of the legally protected property rights: plant patents, trade secrets, trademarks, plant variety certificates and utility patents. Farmers purchase seeds from local seed dealers, and farmers then own the seeds for the purposes of producing a harvest. But the farmer does not own the intellectual property in the seed or growing crop.
      Distinguishing between the physical seed and plants and the intellectual property in the seed and plants means that the farmer can grow the seed for a harvest but cannot, in most instances, save the harvested seed for the purpose of growing another crop.
      This is no different from a person who purchases a movie DVD. The person owns the movie DVD but does not own the intellectual property in the DVD. Consequently, the person cannot legally make a copy of the movie DVD.
      After reading this far, a person might ask, “Why does the United States law recognize these various forms of intellectual property?” U.S. law creates and supports intellectual property because intellectual property provides the incentive for innovation by allowing the inventor an IPR (legally protected property right). Using the IPR, the inventor can recover the research and development costs that went into inventing the new, useful innovation. Seed companies spend years (about 13 years on average) and millions of dollars per new seed variety to produce a new, useful seed variety.

      So, yes seed patents existed early 1900 nonetheless farmers had the choice of saving the seeds or not. Sure, reusing hybrid seeds mean 30% of decrease on production from the original hybrid see. The difference with GMO it’s the 0 tolerance to reuse the seeds. I deleted a comment by mistake, that said patented seed existed for more that a century..this is the answer for it.

      When you purchase a Beatles record do you have a right to make copies and sell them on the market?: of course not. The same with patented seeds. The patent would be worthless if anyone could steal it and profit off of the designer's expense and effort. That would destroy the market.
      I thought Monsanto was supposed to be evil and their seeds were supposed to be evil. Now people are claiming victimization by being caught stealing these evil seeds. I guess these seeds are not so bad after all.

      @@cpwm17 - The problem with this argument is that all of this farmers in the video hate Monsanto's GMO seed and have never bought any of it. No contract, no liability. Can you understand that?

    All countries need to have a 'No patents on life' law. Anything that is alive cannot be patented, research into GMO's can be done and obviously a premium paid for the seeds but there can be no patents. This will save a lot of problems later when human genes start to be patented.

      Your post is garbage Andy. We have had patented seed both gmo and non gmo every since 1970. If plant breeders could not patent their products then we would not have the research needed to have better genetics for now and the future which benefits you and the world along with farmers.

    Without wishing to pass any positive or negative comment on the benefits or otherwise of GMOs and these (and the other) patent infringement cases, no farmer is forced to use Monsanto (or any other company's) technology, just as we can choose our particular brand of car. Just as Ford, General Motors etc. can enforce the protection of their technology, should ag tech companies not be able to protect theirs as well?

      I think what’s worrisome here is the idea that the seed corps are so huge and the farmers have become so beholden to them. The seed Corp is a dangerous monopoly who buys or bullies people and farmers out of business until you’re forced to use them or fold up. Then they can charge whatever they want.

      Nobody is forced to use the seed corps seed. They have spent billions developing new varieties so it is not surprising that they might be superior to existing varieties.
      I hold no torch for Monsanto but they have spent time and money and taken all of the spurious non-science abuse (remember Frankenstein foods?) for years so they are entitled to protect their intellectual property just as assiduously as Bill Gates does.
      I stress that this is no defence of GMOs or Monsanto, just intellectual property.

      David Porter yea I get that and I fully support and share your train of thought. I also fully support their right to protect their intellectual property for their sole benefit.
      What I’m saying is that “what if” they start falsely accusing people? Most farmers and the many small business that support them do not hand the resource to refute false accusations. If things like that start happening these companies get bigger and bigger and more powerful. Now they can bully their way in to a market, bully the price through the roof.
      I have no dog in this hunt. Not wanting to see anything go to either side undeservingly. Just my .02

      Hi Robert. I accept that the relationship is David vs. Goliath in terms of resources but it is the other way around in the court of public opinion and Monsanto know that they haven't free rein to do whatever they want (gmo-awareness.com/resources/anti-gmo-groups-america/). I'm not sure where you live but anti-trust law and the legal system, while far from perfect, are there to sort these things out. Monsanto are a big company and sell about a quarter of all seed. Smaller companies still have around 30% of the market though.
      Almost 4 in 5 desktop computers use Windows and 95% use either Windows or MacOS. The tractor market is similar to the seed industry as is the mobile phone market. My point being that there is nothing different in the seed market compared other markets and few are making similar comments about or calling for a breakup of Microsoft, John Deere or Apple.

Even if the company is purely evil, they would surely know that they could be sued out of existence and people sent to jail for something like that. And for what? The company winning the suit would collect damages. The only damages would be the profit from the sale of the seeds that they didn't sell, whereas their expense, apart from the other expenses, would be the cost of the seeds they used to salt the farmer's field, seeds they could instead have sold.
      The first part, about taking some sample of crops without permission could be true. I don't know. I have heard the Monsanto claim that the neighboring farmers who obtained their Monsanto seeds legally had complained to their seed dealers about their neighbor getting them without paying the technology fee.
      The best known case was Bowman vs Monsanto, which went all the way to the Supreme Court. Bowman was an honest man, who bought and used Monsanto seeds legally and profitably year after year. But he also wanted to plant a separate post season crop of soybeans. Late plantings are very risky - an early frost will kill the crop and he would lose everything. So he didn't want to buy expensive seeds for the fall planting. He had signed a contract to not replant saved seeds. So he went to a local grain elevator where they sold the soybeans as a food. It was a mixture of some non-GMO seeds but a large majority of Roundup-tolerant seeds, and they were sold at a food price, not a seed price. But this honest man told Monsanto exactly what he was doing and that he had not violated the signed contract, but he did not think the patent could extend beyond the first use of the seeds. The Supreme Court beans as food and then planting them as seeds for a crop.

    Hello Mathieu. 2 questions:
    1. Are there many people with the name mathieu in the usa ? Are you from france or belgium origine ?
    2. Why do US farmers use seed of their own yield for seeding their next years crop? Here in Europ all corn varietys are hybrids , you can use the seed for next year, but the yield will be a lot less than the first year.

      We do NOT save seed in the USA either. Soybeans are not a hybrid so this guy thought he would save the seed illegally.

    I get that the gmo companies can be a bit anal, but gmos aren't really all that different from hybrids in a lot of cases. Gmos excel at speeding up the process and allowing completely different genes to be added. Gmos are good to increase yeild, resist the effects of drought, grow jn harsher climates overall and allow us to fortify crops with essential nutrients and minerals.
    The American chestnut tree was all but wiped out in North America. A few mature trees can be found in the northwest but its functionally extinct. Only survives as roots and shoots eventually die. It was wiped out by a fungus brought in from China. Genetic engineering has allowed us to make a tree that's essentially immune to the fungus. Planting has started fairly recently.

    I know a corn farmer in Nebraska that plants 600 acres of Monsanto seed. He likes the fact that he can use Roundup, even though his seed bill is $30,000 per year.

Any seed company will sue you if you break the law ans save patented seed to plant. Farmers quit saving seed in the mid 1930's with the development of hybrids and as each Crop was developed into a hybrid farmers quit saving seed from that crop. Now they are more rare because after that farmer got the seeds from the oregon university, so did Monsanto, and Monsanto sued the farmer. They destruct progress.

      I see you are clueless on this subject. We have had patented seed both non gmo and gmo every since Congress passed the Plant Variety Protection Act in 1970 Protecting Plant Plant Breeders with Patented Rights. Farmers quit saving seed in the mid 1930's with the development of hybrids and as each crop was developed in a hybrid over time then farmers quit saving the seed from that crop. There are many companies even foreign companies producing and selling gmo technology seed. Farmers around the world overwhelmingly freely choose gmo technology seed when it is an option. Do you why?

      It is very easy, buy organic whenever possible. Boycott Roundup. Tell your city officials to stop using poisons in all public areas. All the parks and playgrounds need to be free of the poisons. If the smaller municipalities ban the practice, then the state will follow suit. If 30% of the states ban it, the Federal Government will follow suit and ban it. And you can stop listening to Duke Steele's comments, he has a problem with reality.

      Melodramatic bullshit. Runyon was suspected of illegally saving biotech seeds and would not cooperate with Monsanto. Therefore Monsanto has not let Runyon buy seeds with Monsanto technology. There was no lawsuit.
      Roush and Monsanto mutually settled a lawsuit in which both parties agreed to say nothing about the terms of the settlement. Roush kept running his mouth about Monsanto but kept buying their seeds in 2008.
      Moe Parr illegally cleaned and resold patented seeds to farmers and misled them about patent law. The court issued a permanent injuction against him.
      Monsanto graciously declined to accept the court ordered payment as long as he complies with the court order.
      In other words Moe is a lying, stealing scumbag.
      The scroll at the end is a lying screed of crap. Farmers are not required to buy Monsanto seeds year after year. Farmers haven't been saving seeds for certain crops decades before biotech crops. Blame Mendel for that, not Monsanto. Seeds have been patented since 1930 and farmers have always been aware of this.
      Farmers can buy seed from whomever they want to and willingly sign those contracts. Organic and non-organic farmers buy patented seeds and willingly sign those contracts.
      And just think, you believe every bit of that video.
