    Following a judgment of dissolution, especially a divorce which occurs while an immigration application is pending, divorcees often want an answer to the question, "I have a green card denial what next?"
    Generally, such inquiries are based on short term perspectives.
    For many permanent residence seekers, the issue is viewed solely in terms of the green card marriage divorce itself - and not in terms of whether the disputes raised in family court will adversely affect future efforts to win a subsequent adjustment of status case.
    However, in matrimonial break-ups, it is not uncommon that arguments over child custody, child support, spousal support, child visitation, division of property often lead to acrimonious allegations and characterizations between husband and wife.
    In many instances, these can cause an immigrant spouse to admit certain types of conduct or for the family law judge to make certain findings of fact which create long term obstacles if the immigrant later remarries.
    As government officers review the previous marriage and divorce, they uncover the allegations, admissions and judicial findings, leading to a new adjustment of status denied.
    Moreover, such results happen whether, in the first attempt to win permanent residency, it involved a divorce before a green card was granted, a divorce while a green card petition was pending, or a divorce after a conditional green card was temporarily issued.
    In other words, the stage of the earlier immigration efforts when a divorce takes place s is irrelevant.
    On the other hand, the content of the allegations, admissions, and findings do matter - and matter greatly - regardless what stage of the green card process the couple is in at the time of the dissolution.
    Hence, immigrants going through matrimonial dissolution should make every effort to remain diplomatic and reach an amicable settlement when the end of their marriage is imminent.

    What about if the US citizen is the one BEING abused and threatened with vawa by their immigrant spouse? Are there any firms that can help with that?

      You do not necessarily need just one attorney. In fact, family law courts are state courts. So you need a local lawyer to handle your divorce case. Immigration attorneys can pratice in different states. Good luck.
