If you make something cool like a map mode that Epic likes and can spinoff into another game and make billions of dollars off it, there’s nothing you can do about it
Yup. It kind of stifles creativity to an extent. I still plan to make maps one day but all my big ideas will have to just be my own game.

And also the lawsuit thing is scary. They've been slammed by like 4 lawsuits recently like the ftc one. It feels slimy to write that into the eula.
They dont want another DOTA situation happening. So, if you are somehow a guy that can create good stuff, might as well do an original game instead of using Fortnite Creative.
They're so scared about what's happening with Mojang that they're pulling the 'you cant sue me' card

From what I hear, the "you can't sue us" rule almost never holds up in court, so it's mostly a illusory deterrent.

@@DangitKev Oh when you have the right lawyer you can sue anyone for anything, this is just gonna make it so less there's lawyers willing to try and take the case. Also it's the U.S. you can sue anyone for anything.
⚠They recently gave every single player a paid for skin. The candy cane skin costs 1200 v bucks I believe meaning they stole those players' money out right.
They did this to not get in trouble.
The problem is they released the skin for free BEFORE making people sign this new policy.
Not only that but it is ILLEGAL to make a contract like this under false pretenses.
Someone needs to sue them and then everyone who purchased the skin gets money from the settlement.

@DangitKev I got the same as you but when gamers will start to point it to the EU, Epic will have to change it because the right to sue a company is not negotiable in Europe.

They should do is, if people don't agree with the terms, they are still allowed to play but won't take any benefits compared to those who do, or allow to agree or disagree some of the terms in them and still allow to play the game, just not get the benefits from some of the terms you did not agree with, or something like all that tbh

Well you know what companies are like. They like their stacks of cash more than basic morality.
While I can see where you're coming from, at the end of the day Epic aren't forcing you to play their game. This is akin to signing a disclaimer before you jump out of a plane or whatever. If you choose to continue then you do so on your own volition and have no recompense if you slam face first into the ground.

@@PeteRatcliffe But the point is that they're doing this so they can get out of ANY responsibility, signing a disclaimer and jumping out of a plane while the instructor cut your parachute should not make that contract binding unless it literally said we will kill you.

So now all companies come in with the "if you use my product, you can't sue me" thing, that's SO miserable that you can just as easily avoid legal problems and do whatever you want with your service or consumer
It indicates that if an incident occurs with the game or if they make any "questionable" changes to the game for their benefit and then we the players cannot do anything about it...that's so bullshit that that's even a legal thing you can do as a company
This isn’t going to hold up in the European Union, unlike Americans they actually have rights against these sort of things. In America we worship and defend corporations like this, and they get away with it

Just to be a bit clear, just because it says that these things can happen, doesnt mean they intentionally wont. It just covers the grounds for things like skins getting vaulted or removed, Creative maps appearing in social media, etc. but class action lawsuits getting banned is a weird thing imo
I agree. I'm not even sure if they can legally stop someone from taking them to court just because they click agree to play a game. But they're trying at least.
@@DangitKev It's just like an nda if they do something illegal or a judge thinks it's serious enough they won't care what the nda or eula or whatever said you can or can't say/do. They can do that for pretty much anything ever there just needs to be a really good reason with good evidence.
The skins could disappear is probably referring to when they’ve removed skins from lockers due to game breaking bugs.
Epic has always provided vbucks compensation to players if any items get deleted or changed.
I agree that's the most likely cause of including that section, but it's always good to think of the possible implications
@@DangitKevI agree this gives them a legal right to remove any item such as with the music that I’m worried about I believe their contract with UGC ends 2025 dec (that is when the jam tracks are being removed from the shop in game) and I’m worried they will disappear from lockers since it’s just a license

It was rumored a a few weeks back that Disney was going to forbid some of their IP Character skins from being able to use guns, making them unusable for Modes like Battle Royal, Save the World or any mode where firearms are needed. This New EULA may be preparing EPIC to deal with that blowback.

What epic fails to realize is a judge can choose to ignore the arbitration clause contracts eula etc are not as binding as you think if a judge says nah ill let them sue then epic has to show to court or cry when they lose for not defending themselves and have to pay or whatever the punishment is

ive been banned and removed mid match in fortnite saying cheats or vpn and such, reason given to me exploiting and handed me 24 hour ban turned into perma.
im living in a country that banned discord if thats the case, i have to use vpn for connecting discord and be in touch with my friends and relatives.
and the worst part is i had ikonik, currently waiting to support answer from a incompetent miserable company for 3 days.

It is illegal to steal people's money. This falls under fraud. Not only is it false advertising but unlike most cases Fortnite just tried to say "you can't tell on us" with their new policy which is illegal

@@MuchMoreMatt Everything you asked I already answered in my comment. It is financial fruad. They made people pay for something that was free. There isn't anything you can say to stop a contract from being void because it tried to arbitrate the law. That is illegal. Highly illegal.
I'm not a legal expert, but I really doubt "Cannot go to court with Epic Games" would hold up in alot of parts in the world.

I wonder if the skins disappearing without warning part is due to the Paradigm situation. Like, if this new eula was in place, they would've been able to take away Paradigm from the accounts instead of letting people keep her and compensating old owners.

@ it’s not that worth it, once you beat the main story and do all the storm shield defences it’s only roughly 2k vbucks. Then there were login rewards and daily missions. Now it’s just daily missions that give 80-130 vbucks

Update (Edited): I now received it when logging on a Playstation Console (Wasn't getting on the PC Version via Geforce Now)
I logged in today and yesterday haven't got to notification to accept the new terms. Only thing I received was email few dayys ago claiming that I will soon be notified to accept the terms the next time I log in. Little worried because I still haven't gotten yet and my account may be locked if i don't accept with a specific timeframe of theirs. I do remember accepting new terms few months ago when I logged in Fortnite but that was pretty much it as it was few months back around August/September 2024.
The owners of the old battle passes should definitely have more opportunities to unlock previous styles and also old battle passes returning for everyone!

This was the first time I read a Eula and I saw something talking abt agreeing to waiver the lawsuit if u agree to this Eula and I didn't know if this was abt the settlement that js happened

@DangitKev I got curious again and went to epic games website and in my account area there's a euls history so I went and checked other fortnite eulas and v5 had it. I didn't check others but v5 has got to be a lot older then v9 of the eula that js came out. I'm sure we're fine tho

About the maps and fan art. What they want is the ability to use game footage in trailers and for promotional purposes, and you forfeit the right to sue them stating that Epic used your game and your visual audio assets for commercial purposes without consent. I think this new TOS simply gives Epic consent. What they mean by "they don't own it, but can use it", is that they cannot take your original assets from the game away from you and market/sell it as their own intellectual property. Say you just created the new Ballistic mode, it got huge. Epic can't then claim it's theirs, slap the "made by epic" label on there, update it, charge battle passes for it. It's still your game, your creation, and you can with draw it from their servers. Of course they can always take your idea and re-create the assets and make that their own, but they were able to do that before this TOS update. When it comes to video games, you generally can't own concepts, only assets (sounds, visuals, lines of code). I will end by stating: I do not work for or with, Epic, I am not a lawyer, just a youtuber in the comments making guesses.

The problem is agreeing is not a legal contract and judges have agreed to this also. Anoher issue is if a 13 yo or even 17yo clicks i agree without ever consulting the parent its an extra void contract.

He stated that, in his opinion, this agreement and that specific clause are not practically useful.
