      @@debbieellett9093 I'm just so shocked at how this case unfolded because even when a plea deal is offered & accepted Victim Impact Statements are read prior to a judge reading the agreed upon sentence into the record. The Crime Victims' Rights Act (CVRA 18 U.S.C. § 3771) dictates a victim's right to be heard. I don't want to bore anyone with the details of my personal experience..just suffice to say after I survived a near fatal DV attack the Prosecution in my case 'forgot' to "ascertain the victim's opinion (me) Not only were they required to rework the plea but I was also provided more leeway with my statements than the Court usually allowed. My former husband still got off easy with a six year prison sentence but it was a strike offense so at least I felt there was a measure of justice.

    • @djjones7226
      @djjones7226 Год назад +1

      @aaronobrien7344 The Crime Victims' Act dictates that all victim's are given the opportunity to read their impact statements into the record. My former husband was also offered a plea which he accepted. The Office of Crime Victims'Advocacy (OCVA) intervened on my behalf when the Prosecution in the case tried having a
      pi$$ing match with me after they disregarded their obligation to "ascertain the victim's opinion"...that would be me. Subsequently, they were required to renegotiate the terms of the plea to my satisfaction. My spouse accepted it and just prior to the agreed upon sentencing being read by the Judge.. I read my victim impact statement into the record. Neither Courts or Prosecutors have the authority nor the legal standing to simply decide that a victim will only be allowed to have their voice heard off the record and after the defendant has been removed from the courtroom. It is a violation of Federal statute and is, without question, sanctionable.

    I grew up in an abusive household. However, my grandmother (not abusive) would make us copy an entire section of the dictionary as punishments. I actually enjoyed it. It was better than being hit by my mom or forced to hold spices in my mouth by my step dad. Or the unholy cleaning they had us doing. . I don't find copying pages from the dictionary to be abusive at all. I think it's smart.

      Unholy cleaning? What is that....

    • @MeruAyano
      @MeruAyano Год назад

      @@cate652 ah, well, my stepmonster was in the military. He ran the house like that. When he would get mad or drunk or just felt like I was a general nuisance to his life, I was made to clean everything. If I didn't do it a certain way, or it wasn't clean enough, he would dirty it and make me clean it again. There was one night that my older bro (who was also extremely abusive--got scars from that jerk) was beating me up and I guess I was making too much noise from crying and my mother and stepmonster decided to sit us on the couch and show us how "unruly" we were. By destroying the house. Seriiusly. Toppled plants, curtains pulled off, glasses broken, dirt everywhere, slamming doors..anyway. they then made us clean the whole house from top to bottom. My hands were blistered and it was time for school by the time he let me stop. And I wasn't allowed to fall asleep in class. If I did the punishment would have been bad, I'm sure.i was 10 at the time. One of his favorite pasttimes was making me "rake the dirt" outside in the summer. I live in SoCal but am from the east coast so summers were particularly brutal and unbearable for me. Im still extremely sensitive to heat exhaustion. He loved sending me outside to rake the dirt. The lines had to be perfect, the debris gone, no rock out of place, cactus in order, weeds pulled. I rarely got lunch and dinner was always a fight so I often went without that too. I didnt make it easy on him, sure. I was combative, but mostly in a protective way of my lil bro because I'd been raising him since my mom decided to check out mentally under the pretext of grief. Later found out it was just an excuse to not have to parent because (as she puts it) she was "tired of being a mom". I had other punishments too. Holding raw spices like hot mustard in my mouth, or a bar of ivory soap until I threw up. Being hit with a wooden spoon, being smacked or punched. Forced to stay awake. Locked in dark rooms. Cold showers. Forced to drink alcohol until I got sick. Anything less than an A in grades was also unacceptable, but also not rewarded. He also poisoned my dogs and left me alone with them while they died and then I had to bury them. So yeah, copying the dictionary is a reprieve in comparison. Such is life. I don't mind cleaning now, but I can't stand when someone tells me to do it a different way. Got a lot of CPTSD from all of it, as you can imagine. But copying the dictionary? That's a treat. Lol
