    HOA are a huge joke. I have a friend who had a house that was never part of a HOA. as the area built up around him they formed a HOA and he never agreed to join never paid a cent to them not even once. then here they come telling him how his house needs to be painted what he can have outside. they tried everything he ended up going away on vacation and when he got home his locks were all changed the HOA did a fast one and found a judge who said he was un compliant and they seized his house to pay for the HOA dues. and they rented out his house. well were they ever in for a shock when he came back home. not only did he have the tenants who were in there illegally and the HOA stole his property he went to a judge will all evidence and had an order to evict the tenants that day. since he never rented out the house that HE BUILT. and owed outright. now they owe hom some major $$$ for there f-up and crime.

      They don't have to be permanent to be an architectural modification first of all. Secondly, they stated that they intended to leave them up permanently, which nullifies your entire argument because they then become permanent addition.

    Unsightly refers to worn out, run down items, colors clashing etc. There isn't anything unsightly about sail shades that match the house plus backing to the desert

      @@chronicawareness9986 It's pretty obvious that you have idea how things are in arid/semi-arid places cuz if you did, you'd know that it has nothing to do with spoiled children who don't want to play in the sun. You probably live in an area of the country that has a lot of trees that provide plenty of shade....take a took at the picture they took from overhead. Look at the land behind the houses. See any trees? See any grass for that matter? And the sun can be so brutal that the kids would end up with terrible sunburns from playing in the sun for more than a short period. If the heat stroke doesn't get to them first since it's not like they're sitting still. They're little kids who want to run around and play and running around gets than even hotter. All I'm saying is maybe you should make sure you know what the hell you're talking about before you start talking shit. It makes you look foolish.

      @@pk7190 very true. I'm from AZ and the UV rays are so strong here that you can get sunburnt in 10 minutes sitting in direct sunlight. Nevada is just as bad. Kids here rarely play outside in the summer

    Things like this are the reason I sold my house in Henderson. Wanted to paint my window shutters. HOA says they must review the changes before they will ALLOW me to paint. By the way, I wanted them the SAME color they were. First, they told me I could not paint them myself. Okay, hired painters to do the job. Then, they made me wait for their determination. Finally, after over 3 weeks HOA said I could procede. But I had to use a painter from their short list of approved vendors. I had already hired a painter, so I had to pay TWICE to get the job done! I think you can see where this is going. So, to paint 6 shutters in the same color cost me a bit over $800!!! Within a month I had my house up for sale. I do not like Nazis of ANY kind! Will never live in an HOA community again. E V E R !!!!!

      That’s equivalent to someone saying you can’t change a headlight bulb on your car, you have to hire someone to do it for 1000x the cost.

      I never thought of that particular word, before, to describe the HOAs, but now that I have read it, I think that is the perfect word for them. You are absolutely right. IDK who ever thought HOAs would be a good idea to invent, but it was a frikkin' TERRIBLE idea. I hate HOAs!

    To any young families out there, do not buy a home with a hoa. They own you, not the other way around. I’m a plumbing contractor and have been to hundreds of homes, the restrictions given to homes with hoas are ridiculous. I don’t care how many pools they have, it’s not worth it.

      There are getting to be fewer and fewer places that don't have them, at least in the Phoenix area. HOAs are taking over everywhere, whether we like it or not. I wish I could afford to buy a mansion soon my own property far from any HOA's area of control, but that just isn't my current reality, unfortunately. 🤷‍♀️

    All brand new homes have got HOA in Vegas now, i'm glad we bought an older home ( built in 85) funky paint, no huge problems everything fixable and NO HOA!

    As a Certified Appraiser and a Realtor I am always trying to warn buyers about buying a house in an HOA, but they never listen. If the HOA gets taken over by greedy people, it not only is hell to live with and costly, but it will eventually tank the values really bad because they usually raise the dues to high as well.

    my home is on the corner at the entrance to a subdivision, I was there for 11 years before the subdivision was built and my property is not a part of that. The residents wrongly assumed I was part of their subdivision and I started hearing complaints about my property. I went to the court house and obtained a copy of the subdivision platt and then made a copy of my platt and mailed them both to the HOA with no accompanying explanation. All has been quiet on the home front since.

    I lived in a neighborhood with HOA once. Just once. I will never do it again! Every week a little group of older women would walk the neighborhood. The kept rulers in their pockets and little cameras! I saw them check my grass every single week. Nothing like waking up to a group of women trying to find your grass in ANY spot to be over 1 inch long😑

      I would have made sure at least once when they were going through doing that stuff, that I was mowing my lawn that day and squirted the grass clippings at them on one pass. When they bitched about it, I would have apologized to them for the careless mistake and gone about mowing my lawn. Though yes getting out was the best thing you could have done kudos and two thumbs waay up for doing that.
      The house my dad owns is across the street from where at one time an HOA stoolie lived. We got no end of complaints about things and one time in order to get the complaint retracted my dad literally had to show these old bitties who came out and he showed them the only way they could have found that violation was if they came onto the property to such a degree it could be considered trespassing. Then all of suddenly the complaints...stop coming. Just out of the blue stopped. We a few years later we found out from some our other neighbors who had been living their longer than us that the old woman who lived there, well she died. To add insult to injury,(at least karma wise for her) it turns out the woman had fallen for that reverse mortgage scam that banks were pushing back in the early 2000s.

      That is a lovely idea, but it will never happen, given the number of homes available without HOAs and the number of people in need of homes. Almost every home in the Phoenix area is in an HOA, and Phoenix is the 5th largest city in the U.S., and still people keep moving here (especially from California).

    I specifically sought out a home that was not governed by an HOA. I have seen HOA abuse and power over-reach negativity affect so many people I know. Just like any group of people given a little bit of power over other, these HOA boards are arbitrary, abusive, and often serve no real purpose, but to harass people and cause disharmony. It’s disgraceful.

    I’ve lived in a HOA condo for 23 years. The management company needs to be reigned in. The HOA management company works for the community. But they seem to find one horses patutti neighbor and listen to them.

    Things like this start when someone running the HOA has some sort of "life event". Their life is some way becomes out of their perceived control. So, they do what other people do at times. Usually they take it out on fast food workers, something like that. BUT! "IF" they have a position like this then they start running the HOA like it is their own personal fiefdom. I believe that in order to have any such position (especially in a HOA) these individuals must first undergo a complete psychiatric evaluation. And for anyone who disagree, these home owners have a right to the best and most competent person for the job. Owning a home is Exactly like running a business. Now, if you have a bar or even a restaurant that serves the odd drink don't you have a right to know if said person you are hiring to run that business in an alcoholic or has other co-existing addictions as well. Yes, you do. Also, you need to know that this is a person who is capable of interacting not only with your customers but your employees as well as the surrounding community in general. You cannot make the mistake of hiring someone who is not only an addict or a recovering one but who also has anger management issues/personality disorders/history of violence of Any kind.

    This is exactly what happened to me. I am now ordered to pay over $35 to HOA lawyer fees.
    The history: board members HOA, put fraud charges on my ledger… I kept paying the charges, thinking there was legit problems, or some thing since I did not live in the same state, I believed them. I later moved into that condo and went to my first meeting and realized that there is a problem in the building and not my condo. I asked for the receipts because I paid for some thing I should’ve never paid. Very quickly, I realized that there is some thing fraudulent going on specially when I reached out to the plumbing companies and requested the original receipts that I paid for. HOA board members erased. All the bills were addressed to and hand written my address. Therefore, I always thought it was my bills. Later I find out that it was one of the board members sister bills that I paid. The more I asked from the board to present documents and asked them questions on who is on the board if they had a cam who is there treasurer and who holds what position and I pretty much begged to meet up and talk to me to address this situation and resolve it. On Thanksgiving holiday around 4 PM they decided to tape a ledger to my door with these fraud charges late fees not to mention I already paid, and fine fees. Later I found out that find fees was for not handing them the lease, and that I had supposedly more than required number of people living inside the unit. Clearly, the fine fees are fraud because I am the owner and I moved inside my own unit with my son. I also noticed some attorney fee on my ledger over $200 not sure for what. The board clearly was harassing me because I caught them committing fraud to me and questioned them about it. I start getting letters from the lawyer that they have hired saying, I owe money for all of these charges, and now lawyer fees. Upon asking the lawyer for receipts they slowly removed some of the charges, because clearly they couldn’t prove it. However, they kept adding they own lawyer fees to my ledger. They sent me different delinquency’s, and later ended up filing a lien against my property, which was also invalid, since it did not follow the rules of the law, no proper date no proper amounts, or even company name which did not exist. Also, failing to serve me, or even send me a copy of the lien. About two months later, they send me a letter that I owe money and attached a lien to the back of it. I re-searched with the lien is and found out that after filing a lien, you only have 90 days to respond to. Clearly, I did not have the full 90 days since I never received the lien to begin with. With a short amount of time I was able to file my lien dispute. The HOA lawyer ended up filing a complaint 01/08/2020. I respond to that complaint.
    On 08/05/2021 which is 18 months later, they requested a hearing date. To be honest, I was surprised, because so long time pass by. I thought they already moved on and realize they made a mistake or something. During this hearing the judge orders is mediation. Mediation did not work out and the agreement was not reached.

    On 08/13/2021 I filed counter claim
    On 12/16/2021 we have another hearing, but not on my counter. Claim this hearing was for the plaintiffs summary judgment for their lawyer fees. Which, supposedly they filed on 11/19/2021 less than 40 days prior to the hearing hearing. As per the law, it states it has to be more than 40 days. Either way, the hearing that took place I get served with this summary judgment and the plaintiff claims it’s a courtesy copy that I have not gotten. I brought it up to the judges attention, and the plaintive did not have evidence that he served me or sent me a copy of it. The judge then responded by saying if I make him refile, it will just cost more money. As you can see, I did not get a fair hearing, during this, hearing, none of my responses crossed claims or counterclaim, was even acknowledged. I never had a voice. During this hearing that clearly I was not prepared for due to obvious reasons, the plaintive presented a portion of my ledger claiming I owe for December and that they are not suing me for fine fees, plumbing charges. They are saving that for the later date. I wonder if they are allowed to change their position like that and then sue me for something that they were not suing me before for. As far as them saying, I owe that for December is completely false as I was already pre-paid till the end of that year I wrote a check in October paying for October, November and December but not like I was able to present that.
    I had no choice but to hire a lawyer at that point the judge ordered me to put $15,000 on bond while we go through appeal process. eventually appeal is denied without a reason. And ordered me to pay now additional HOA lawyer fees for appeal. I am now 50 grand in debt I got completely robbed throughout this whole process never had a voice never had a chance, never had a fair trial, which I should’ve gotten.
    I hope for someone to look into my case and help me.

    I have found that most hoas are run by small minded people who lack any real standing in life and live for the feel of power over others. They love to nit pick and live for finding "violations" that they claim take away from the beauty of the neighborhood....

    I’m glad HOAs aren’t really much of a thing in the Midwest where I now live. When I lived on the west coast it seemed like most of the newer subdivisions had HOAs.

    Here's the thing, I understand HOAs for keeping out people that trash everything, and leave junk outside, or let their lawns go crazy. They don't want their neighbourhood looking trashed. That makes sense. However, why can't you have shades up? Why does everyone have to have the same fence? They bought the house, and as long as it doesn't look terrible because the owner isn't taking care of it, I don't understand the issue.

    I’m going though something very similar in San Diego,CA. Harassment, bullying, selective enforcement of the rules, and discrimination. I can’t afford to move... it’s like living in hell... with a pool.

    I looked on Google Maps. The sails as shown are NOT up. It is pretty blurry, but there might be another shade device on the back of the property. This video is almost 5 years old - I hope that the family got out of there!

    So many comments revealing a lack of general knowledge of HOAs. No one completes a home purchase to suddenly discover that they're part of an HOA; it's all clear in purchase and escrow documents. Decision is one's to make, but if you buy in to an HOA one simply does need to read the agreement.
    In over 15 years I received only one notice from my HOA, to remove remodeling/construction supplies from my driveway since they had been there over 30 days; project took longer then planned. Moving everything to backyard was a PITA but I accepted it, as I as well don't want driveways and front yards on my street to become storage sights for cars, old washers, or stacks of lumber.
    I can't choose exterior paint color, but at same time I have no worries that neighbor will suddenly paint their exterior in a Green Bay Packers color scheme, or just never paint at all.
    Terrific neighbors, neighborhood, and HOA very well managed to everyone's benefit. Like anything, add up the positives and negatives, and then make a choice.

    My HOA complained that I parked my truck on the street facing the wrong direction in front of my house. So I started driving my truck every day and parked it on the front lawn from that day forward. Apparently they didn't have a rule that would cover that cuz I never heard another word.

    When you execute your contract for a new home purchase in a subdivision, make certain the contact specifically states "NO HOA" ...Then, prior to signing the contract have an attorney review the contract and attach and amendment stating that the property your are purchasing will NOT BE BOUND by any future HOA'S that may be agreed upon buy surrounding tenants or subdivisions.

      i bought an acre+, farm house 8 miles from town......fenced it, locked gate, have stately oaks, shade, plant what i want, have dogs, painted my house teal with cream trim.....one neighbor had a problem with it.......TOO BAD !......

    I do not think a lot of people that live n Nevada in an HOA know about the Ombudsman from the Real Estate Division. Even if they do not take your case they will still try and let you and the HOA know who is right and wrong in a situation according to bylaws. They are a great sounding board. It was a great thing that the State of Nevada put in place 10-15 years ago.

    I was involved in hoa problem there is only 5 town houses and 1 owner is the president and the other 2 are relatives who do maintenance and painting.

    We live in a HOA subdivision for 12 years and so far so good. Never had an increase in our $20 mthly dues. No heavy handed rules & no bad encounters w/ them so far. But I also question why they exist. They have no use, just another red tape for homeowners!!

    It blows my mind that a Hard Working American Home Owner, spends so much money on their homes, maintain them well and in good order, just to have a Nazi HOA pester and harass them endlessly for ridiculous shit. I'd recommend fighting it, getting on the HOA yourself and doing anyway with ridiculous things like this, or move out to a community that has common sense. So sorry you had to go thru this.

      you know, my friend lived in an HOA neighborhood for a while, he went through a similar issue, a tree in his back yard. i fixed it by wrapping 2 inch in diameter security chains around the tree. they tried to cut the chains but they where too thick, actually broke their cutters! they then tried to sue my friend for breaking their cutters only to be sued right back because they damaged my chains (there was a tiny scratch on them T_T) i won. best part is they dont have any rules against the chains. the only way they can say anything about them is if they rust (they are coated in bed liner) so they couldn't do shit.

    Bought a house in a new subdivision and unfortunately the subdivision and every other new subdivision in the area is ruled by an HOA. I've lived there for over a year now and I've received one friendly ''reminder'' to mow my lawn. Other than that, I don't associate with any of the neighbors or attend meetings or anything.

    I actually live in a very nice and reasonably priced HOA. They just maintain common grounds and never interfere. We are in AZ and our town is right next to the Air Force Base, so a few residents (including our son) are AF and so HOA’s here toe the line! 😁
