    i wouldn't necessarily lawyer up to sue anyone but i would lawyer up to make sure of exactly where you stand - the nice officer might be killing you with kindness so you don't check up exactly where you stand

      agreed, plus he may be able to negotiate an easement on that road to include the power lines, etc.

      100% right since they were not told all the real legal details on that land. They need a lawyer to look over their deed, survey the land, and find out what their true legal rights are to this property. Continuing to go on without doing that would be a bigger mistake. I wouldn't want to continue working on stuff I didn't own.

      I totally agree with this. A attorney or lawyer doesn't mean negative. They're there to help you out to get what u want and may know loops holes and detect what u might be missing ...plus look over contract and small print...meaning they'll have your back. I know I'd be lawyering up to protect my investment & contract this so no future bs comes bk ..play it safe kiddos... protect yourselves legally and I'm sure oil company will understand... Goodluck prayers 🙏

      It would need to be an oil and gas lawyer. They are familiar with all the right of way clauses and rights of surface owners versus mineral owners. It looks like the mineral rights have been retained by a previous owner, maybe even 50 years ago. All that is left to be conveyed are the surface rights. An O&G lawyer can explain everything, what they can and can't do. But this OCC representative's job is to be the liaison between the surface owners and the O&G company, so neither has to resort to lawsuits. And they are there to make sure the O&G company follows the rules and doesn't step out of line.

    Jason & Danielle, my suggestion is to document everything! Everytime this officer comes out & what is agreed upon, but if things start getting bad, then get an attorney whom specifically that deals with this situation! Be careful the both of you have spent a lot of time making the property a home for all the fur babies & yourselves!

      @@cyndib3587 You are correct. I'm a 30 year investigator and you Do Not need anyone's consent to record, whether it's audio, video or both. And the previous advice to go ahead and speak to an attorney and find out your options is good advice and will help you make your plans for moving forward. I would also recommend speaking with the realtor who knew your plans for buying the property and from what I understand told you this was no problem when it obviously was and record that conversation. But remember, when you're recording someone for a purpose, your purpose is also to get them to talk, so when they start talking.... shut up and let them talk so you get it all on recording!

      @@ericanderson8556 Actually, Oklahoma Law reads: It is perfectly legal to record any conversation that; 1) you are a party to; 2) a have the expressed permission of any party thereof; 3) you can hear in a public place without the aide of an amplification device.

    Hi is the first time I write to you guys…somehow your stamina is in the right place…being nice and appropriate is the call. It is good to contact a lawyer for orientation on your options. I will keep the lawyer back just in case something happen, but getting advise from a lawyer I will say is the right thing to do. From a 68 yers old retired nurse it comes from the bottom of my heart.     You need to search the county Register of Deeds registry to determine if an oil and gas lease is recorded for your property and what the terms of the lease are because the lessor usually gets royalties in exchange for the right to produce oil, gas and other minerals. You may very well still be entitled to royalties but the oil company isn't required to notify you of that, your supposed to notify them that your the new owner and where the royalty payment can be sent.

      They should told you when you first brought it . What is the next person is going to tell you when they come in a four years. Get anything in writing go to the courthouse get information from them in writing. This is bad you paid all that money for the land and no one told you when you first brought the land yes I sue someone.

    You two are wise beyond your years and handling this the right way. I am a former oilfield production pumper of over one hundred leases most being on farmland and residential areas. Oil companies are only allowed small easements and limited areas to operate but need access roads to wells. Believe me, they don't want to be a problem or be intrusive, Just co exist. You still own the land and that's what counts.

      Rodney don't the wells have to be actively producing to keep the right of way? They have to keep the lease paid for and pay royalties. I could understand a 30' right of way. Maybe even 30' from the centerline of the right of way (60'). But, a 30' road and 30' on either side? A 90' right of way. What for? Doesn't sound right to me! Where I'm from the owner of a property just gives the oil company a key to the entrance gate.

    There should be an easement on file at the county courthouse for your property. You can search property records for free at the courthouse and some county's have them online. Regardless of how you search there may be a time limit and/or conditions for continuing the use of the easement. If you have an abstract for the property the easement should be attached to it, as well.

    Living a life of kindness is a great character trait. Talking to a lawyer doesn’t make you unkind and it doesn’t mean lawsuit as well. But a lawyer can tell you what the legal situation is, can prepare documents that protect you and your investments. Being nice to the oilfield officer is great, but checking your legal obligations first before changing plans and spending loads of money is smart too. But what do I know. Here in Germany things are quite different … Prayers for a great outcome and that you’ll stay calm and happy while dealing with this obstacle. You‘ve got this 💛🍀💛

    Sometimes these things that come up can work for you. I'm so glad that you are seeing this as a challenge instead of a negative situation. I have learned that buying bare land is full of surprises. It's just the way it is. I found out our 5 acres has a wetland on it. I learned more about it and it just means I have to add plants and put the house in a certain spot. It's a work around and teacher you new skills! I'm looking for solar now. I have found that a 5,000 watt system is good enough to run a washing machine, tv, etc. You can add up all of your electrical needs too. I've seen 5,000 watt systems for 5K to 8K. There are so many videos online for DIY solar. Also you know electrical so you can jump in much faster. This new knowledge will be needed in the future. I'm learning now too at 64 years young! Keep going and post when you can on your progress.

    Way to keep your cool in a sticky situation. I would definitely talk with a lawyer just to know for sure all of your rights as the new land owners. I would also take up the drive you have now and transfer it over for a new drive to get started. Ya’ll keep up the good work. It will all come together for you.

    I am building a tiny home myself off-grid. I plan to use as many propane appliances as I can so I won't need as much as far as solar is concerned. In the long run, you will save money on electric that will offset the cost of solar. Can't wait to see how you work it out.

    Hard to believe that the title company didn’t find out that there was an oil company easement in the middle of your property. Do they not do title searches in Oklahoma? If so, that’s where the lawsuit, if any should be directed.

    My experience with your situation in Texas , the oil company maintained the road we all had separate locks on the gate and they had no problem with me using their road with me adding a side road to my place.

    Have you thought of putting in a propane fireplace & stove for cooking? I have a propane fireplace in my house and it heats the place quite nicely. It would heat the tiny house very well. You could use solar for lights and refrigerator, etc.

    Sucks you all going through that, and having to find this out now. But I agree about getting a lawyer to see where you stand and all your options. I wouldn’t sue yet, but be ready just in case it comes to it. Hope everything works out for the best though. Love seeing the progress that’s been made

    When you bought the property, there were already plat/plot maps that conveyed with the land. They will show the easements that go along with your parcel number. If there are utilities, you always have to grant easement access (in case of equipment failure or repair). Once you read your land map, you'll know where to put power in case you want to connect to the grid. 30ft on both sides seems like a lot, because pumping or repair vehicles for access are not 60ft wide. I would definitely verify that. Your title company should give you a plat/plot map copy for free, or you can go to your county permit department to look up the easements as well.

    You and Danielle are definitely right. Staying calm and trying to nicely work with the oil company. Doing this might benefit you in the end because the oil company may be more inclined to give you a break.

    I love to watch building. There are 4 channels that I've watched for a long time. Lumnah Acres has just built an off grid home on 500+ acres. He built roads, did underground pipes for wells, did the under floor heating inside and fueled by a wood burner that sits outside his house. It also heats their water and He doesn't have to stuff wood in very often. He's got some great ideas. He's total electric and completely solar. He's also dealt with a culvert.
    Tiny Shiny Home has gone into detail about solar also. He gets really technical. Btw, they are advertising a bunch of 'lessons' from multiple channels worth $5000 (I think I remembered that correctly) for $50 through March 31. They've built a solar building from hyperadobe bags and their solar setup is fantastic. They've also got videos showing professionals talking about building berms and diverting water.
    Wild Wonderful Off Grid and Life Uncontained have solar also. And DIYfferent has redone multiple places over the years and has some great ideas.
    Lumnah Acres has most of what you're looking for in one spot. Tell Al that I sent you. ;)

      I agree. Love watching Lumnah Acres . He is a great teacher for a nonprofessional. The outside wood burner is easier for you than a fireplace as you get older but it probably is pricey.

    Keep track of every thing you say and they say to you. Keep a Journal!!!!!!!!! If you need to later then you have it in writing and if it written it didn't happen!!!! Also you will be able to show how you complied and tried to be reasonable!!!!!!!!!! Best Wishes you two!!!!!!!!!!!!

    Easement to what for the oil company? If you purchased the land do they have an easement to what? Would they be entitled to the use of your property? Were you misled to the purchase? Lawyer up for your benefit, your well being. You have a lifetime investment . Best of luck to two great people.

    You two seem to be handling this new bump in the road in a very mature and righteous manner. It is terrific that the officer has been so kind and helpful. Actually, it seems that by making a few big alterations you will be moving forward with hardly a skip. Truthfully, as far as the electricity goes, this may be a blessing in disguise. If the grid should ever go down, being on solar, your lives wouldn’t be interrupted in any way. So many of the channels I watch, the couples have build their farms/homesteads solely on solar. It is a good feeling to be self sufficient. Keep moving forward and being the positive couple that you are and you will work out every obstacle in your path of life together. I enjoy your channel soooooo much.❤

    Check with your title insurance company........they may have responsibility in this situation. Their duty is to check for those kind of issues and make you aware !

    My suggestion for you guys is to get an accurate Site Plan in scale with oil company zones of exclusion and locate where your buildings are located. Then you can see what you have and what you might need to move? That is the only way you will truly know what to do. The electric poles locations can also be determined on this plan as well as your water piping and sewers whatever they are. Legal help may be necessary to tell you truly where you stand. Remember that the officer was not there to protect you he works for OK . You need your own protection. Make sure that all easements from the oil company are there, and get that in writing from the oil company. Keep on rockin' you are doing very well as I see it.

    As a Okie as well, this wind has been crazy. most cases the oilfield is pretty easy to deal with when it comes to the land owner. good luck. We havent had rain in NW Oklahoma. in a very long time.

    We are currently running two mini-split units from our off grid solar system. Consider putting in propane range, water heater and heating and get a tank.

    I don't have any answers for you, but I do have a story. An Amish family had bought some land with an easement for an oil rig. They had like you built their pole barn right off the roadway/driveway. Well they were told they had to move or remove said barn. I saw one day as I was driving down the county road they live off a barn moving across a field. Well I knew I had quit drinking many years ago so I wasn't drunk but I sure was curios. I got close enough to see what was going on and the barn was being carried by a hundred or so men. Most amazing thing I had ever seen.

    Check out Vanwives, they have an offgrid cabin with solar power and battery storage. As an AC technician the most economical way to heat/cool a building is with a split system, modern unit have a 4-1 ratio, for every kilowatt of electrical input you get 4 kilowatt output.

    If you go with solar I'd recommend getting a propane on demand hot water heater, get a wood burning stove for heat, get a propane stove or a 110v induction cooktop, and then for AC get a mini split then you could also use that as a backup heating source.

    It's a shame there isn't more transparency that protects the buyers in this situation. Like having to have full disclosures on a property that had oil leases or what not. That way buyers can still move forward if wanted but know how it all works before they spend a good chunk of money and time building everything .

      There is laws that requires all of the disclosures to protect the buy as well as the seller. It is on the responsibility of the realtor to disclose this. Someone did not do their homework. The Crockers have all right to go after the realtor over this. They have no chance against the oil company, There is only a few people in the world that has enough money to go after big oil. But for them to be told that the oil rig and set up are dormant was a false statement by who ever it was. Yes be calm and they are doing great but they as a buyer have rights and now they lost a good part of their property that nothing can be done on. Here's one for ya..... What if he hit one of the oil or gas pipe line installing his fence post, who do you think they would have come after on that? And the oil company is not going to kill them with niceness either. SO yea SUE be nice but SUE!!!!!

But at anytime big oil could show up and ruin every thing they worked hard for much less lose a ton of value on their property. If they knew this ahead of time negotiations on price could have benefited them or they could have had an option to buy it or not. But yes they are handling it well and turning Lemons into Lemonade is a good way of handling it. Proud of them for that but they need to get what they deserve for this mess and that Lemonade would be a little sweeter!!

    I would research when the oil company lease is up. Usually, they lease the property for a certain amount of years. We have a ranch leased that had four wells and a couple of storage tanks. The oil company quit pumping oil several years ago, and the owner found out their lease had expired and demanded the oil company to remove all of their equipment. The oil company did remove their equipment.

    I would definitely get a lawyer who specializes in land disputes. Just to find out what options you have. Bottom line, the title company should’ve done a thorough title search and disclosed all of this. Good luck

    You need a map showing exactly where the oil wells are on your property and the easements to get to them. Are the shop and silo the property of the oil company? Once you know exactly what they claim, it will be easier to made building plans.

    I agree with the people who say get a lawyer to see what your rights are. Mineral rights are a different bear than land rights.
    As far as heat and cooling goes, there are a lot potions out there in the RV/Tiny home community. In one of your CWTC videos this week I suggested that you look at Campervan Kevin's videos. He has done solar on his RV and tiny house. There are even 12v air conditioners and heaters, so you are really at the ideal position to make your choice.

    Hey Jason & Danielle, My suggestion for a lawyer was NOT about suing but about KNOWING what YOUR RIGHTS are in this situation, I 100% believe it is essential that you know your rights!!! Guys it is a potentially very complicated issue, with everything from IS THE Abandoned OIL Well on your property CAPPED ( you guys NEED to find this out), to monies you might be entitled to if 'The OIL Company' (also known as 'Surface Land Rights' of Owners of the land-YOU) decides to start drilling again on Your Property; the Pad needed to drill could go from One Acre to 6 Acres. So PLEASE see a Lawyer to have him/her help you with what your RIGHTS are. Did said officier tell you what your rights are??? Has he told you about MONIES you would earn if MORE OIL was found on your property???? It is SUSPICUOUS how ALL of a Sudden he is coming around to your Property-is SOMEBODY PLANNING on Drilling again, you see because the well should be plugged & it is up to him to make sure it is!!! Lots of info.
    Please do your Due Diligence as it could affect you guys A lot!!!! The timing is wierd, for him showing up.

    The only thing I’m not understanding is how can they make you pay for land that’s not really there’s to sell, so like whenever you bought the land and they sold you x amount of acres but actually 10 acres of it belongs to the oil company but they still made you pay for it???

    Rural Power Systems (RPS) makes Solar Well Pump Kits. 1 stop shopping gets you all you need to pump your well on solar. Red Poppy Ranch and Guildbrook Farm both use them. Guildbrook Farm did recently change their pump out. I don't know what they replaced it with. All the very best!

    Oklahoma needs some sort of law that makes it mandatory for people selling property to reveal the property issues concerning any abandoned oil wells. Right now it seems that there is no accountability by the oil companies or the real-estate companies -- leaving the buyers holding the bag for something they knew nothing about.

    In the area I am in, we wanted to put in a culvert in a seasonal creek so we could have a direct shot into our drive way versus an easement from our neighbors. Just to do the culvert and 65 feet of dirt driveway.......$10,000

    30 ft on both sides of the road is for their rig and equipment if they ever bring in a rig to drill or rework a well. You’re the landowner, they’re the mineral rights owner. You still have power as a landowner. I’d highly recommend looking into that 30 feet on each side easement. Get with an attorney who specializes in oil and gas and see what your rights are as the land owner and dealing with an oil company.

    Just an FYI you own every inch of property that you bought. An easement is only an area designated for an entity to gain access to their equipment and/or property. I'm a land surveyor by profession and easement work is common. I can tell you a professional survey would tell you EXACTLY where your property corners are and where the easements are. You'll have to pay a little extra to have them stake the easement lines but it will show you/the officer where they have access and maybe you can work around it all.

    Build two small buildings to match both the tiny house and studio to put the Solar control boxes and batteries. Your neighbor I believe has a bulldozer to help you with your new road. I wouldn't put in a culvert,. I would put in a bridge with 6- 10X 10 timbers and 2x12's. If you don't want to put solar on the roof you can just make yourself a little solar field beside each building. Good luck and God speed

    You are not being nice not having lawyer. You need to protect your rights. A couple of questions: 1) Did you have a lawyer when you close on the property? 2) Did you have a survey done? 3) Did you ask about the wells? Did you ask who owns them?

    At least the studio is movable and easy to do so and you could always move it to where there is power.
    I'd still get a lawyer to make sure everything is on the up and up and y'all don't get screwed over and they can tell you all your legal options.
    Paying taxes on the full 60 acres and can't have access to the full 60 acres? That sucks if so
