    I'm in the middle of selling my house, and I also gave a contingent offer to buy another. I have an offer on my place now, which I just accepted, and the buyer of my place got his own house inspector out yesterday, and a guy to inspect my trees. So far everything I've signed has been electronic, and my listing agent might call to tell me something like, the "inspector is coming over and the buyer with him", and it is a brisk, fast phone call, (he's always in a hurry) he doesn't ask if that time is convenient for me. He's always in a hurry. Well fuck that. When he calls about the buyers new inspection report I'm going to tell him I'm not signing anything without meeting in person. He has only set foot on my property twice. It's been like fast food service. Thank you for this advice!

      Ugh...I hate to hear this! This is why I am creating my videos...to protect others agains situations like this. You deserved better. I do like you taking matters into your own hands. You should know what you are signing. If not, report this agent to the National Association of Realtors. This is their job to explain the process and what you are signing.

I've bought and sold so many homes over my 55 years of marriage, that I've lost track....and NEVER, have we found an agent with this lever of ethics, EVER! Again, if only you would have a training for realtors NATION wide.     Great video! As a licensed Home Inspector, I see the tremendous value in performing a Pre-Sale Inspection prior to listing. It can help set realistic expectations for the Seller and the Buyer. To me, it reflects the caliber and character of a better Realtor. Great job!

    I know an attorney in Orange County who bought a house, had an appraiser check the square footage and the size came out 50 square feet less. He sued (being an attorney it cost him nothing) for $50,000.

      Not cool...I do think some lawyers abuse their power. I had an attorney purchase a home from me and wanted a $15,000 deduction off the price because his appraiser came up with 19 sq. ft less than what the tax assessor and builder stated. . PULLEZZ!! All buyers need to confirm and verify the details of the home they are purchasing. Ugh!

    Audra, thank you for teaching us! We put an offer in on a contingent. It said “Accepting back up offers”. My loan was already approved. I like your idea of having a home inspection before listing and saying here’s the stuff that’s wrong we’re not taking any reductions. 19 ft.². Really. Did this guy get out his measuring tape? If anybody pulls that crap with me I’m pulling the offer. I don’t care if I have to wait longer to sell.

    I have sold 6 homes, 4 of them when I was living in another State. I did not ever meet any of the Agents in person. I think I got taken at least once. maybe twice. But any questions I asked they answered. But they never volunteered any info.

      Hello there..I know, I don't understand that. You sign a listing contract and then you don't hear from your agent. Weird. I would just set the expectation upfront with your agent that you want consistent feedback...maybe have a set time they check in every week or twice a week. Crazy.

    Some Buyers think that a working yet older HVAC system is reason to ask for a new unit or credit at closing. That would be considered an upgrade, not a repair. That's void of logic to replace a working unit, despite its age. Advertise "everything is working, but selling AS IS."

    Agreed, great video Audra!! Need to go back over and take notes. Originally from San Diego, now in Columbia, Missouri for last 17 yrs. Unique sellers mkt with good equity leverage for the next 6 months due to new homes going in across the street with pricing 100k higher. Tha ks for you insights!!

    You're the kind of agent that I'd like to have on my team. You didn't even touch on the less obvious scams that some agents perform in their contracts. For instance, they'll come in with what looks like a great selling price from a shill buyer (somebody they know), but then they expect the seller to pay a lion share of the fees and have some financing like FHA that won't be supported by the appraisal. Then they tell the seller that he or she must lower the price. I saw this very thing happen in an ascending market. So what looks like a high price for the home turns out to be a loser. They couldn't do it with me involved.

      Thank you, and in this case I had to be. It was my elderly mom who was subjected to this crafty scam. She could have lost somewhere around $50K on the deal. It didn't happen. Needless to say, it has made me very careful about hiring real estate agents. I interview them with very revealing questions. @@AudraLambert

      Using a “strawman” buyer to drive the price down is illegal! I worked for a mortgage company for several years and found that this is one of the most common types of fraud, especially for sellers needed a quick sale. Just SAY NO.

    This happened to us about 20 years ago, so I don't remember specifics. We rented our contracted house to the buyer before closing. The market downturned and the buyer demanded a (substantial) price reduction or would back out. We went with it because of our situation at the time (that I don't remember). This happened using a "top selling" Coldwell Banker.
    Another NO NO NO story for you.

      This is amazing information! I’ve lost count of how many of your videos Hubby and I have watched. We’re taking notes, and have already learned so much. If not for you, we would be clueless. Thank you for all that you do! This Upper Texas Gulf Coast area is not an easy market, and we’ve already heard numerous horror stories concerning some of the agents. I’ll be SO thankful to hear “SOLD!”, and see that transfer of funds. After this home sales, I doubt we will buy again. We are now both retired, moving closer to adult children and grands, and with taxes, the cost of maintenance, and insurance, we will probably rent/lease from now on. Besides, we wish to spend our time traveling more extensively while we’re still able, not babysit a home. Besides, after putting pencil to paper, we should actually come out ahead financially! We never wish to have to deal with this again, and we don’t want our children to have to deal with a sale of ours in the future if we’re unable to do so. We all have enough to deal with. Mercy, but I hope this upcoming sale isn’t a nightmare. Neither of us are looking forward to this process. 🤦🏼‍♀️ Again, thank you for sharing your wisdom and experience. You are a dear!

    My problem with real estate agents is the commission structure. Some are a percentage of the sale price; some reduce the percentage with increased price. This is exactly backwards. If a seller is leveraged, the agent should be similarly or more leveraged. I'd sooner pay 50% commission on anything over an agreed on floor than 5% or whatever on the entire price.

    Being a broker, what a shame.
    I go over my contract with my clients. Commission of 10% is robbery. 100% agree a realtor should stay in touch with the client at least 2 times or more a week.
    Depend on the market , a 30 day listing I would past. In a hot market, yes. We spend money to get the property advertised only to lose it after 30 days. So 3 to 6 mos ok.
    There r bad acting people in all career fields.

    Thank you , can you please do a section on HOA's , I am moving from a part of the world where we don't have HOA's to one that does have. I know that there are a lot of bad apples but knowing what to look out for can be handy if one thinks of an investment as important as a home where predatory HOA's can ruin the whole experience.

    My son-in-law put $4k deposit on an out of state house OK). The listing agent got him to sign a rights release (before seeing the house) by confirming (orally) that they could still get their earnest money back as long they cancelled in the specified timeframe. They saw it and cancelled only to find the listing agent was wrong and her company would not refund. The agent offered to pay it out of her pocket until she was told it was illegal. Should he sue?

      What? That is crazy. Take the brokerage/agent to small claims court for misrepresentation. Why is it illegal for a agent who is an independent contractor to pay for a mishap. Its called cost of doing business. Never heard of such a thing. Unbelievable!!!

    Regarding contingency period….17 business days?.. or calendar days?

      In California, we have 17 calendar days for the buyer to complete all their buyer's investigations. If that 17 date lands on a weekend or holiday, then the contingency date moves to the next business day. I would always try to negotiate shorter contingency periods.

      @@Rikkcas Yes, my family is located in Northern California. Every area is different. I would just really investigate what is customary in your area. In my area, inventories are still so low that buyers are just thrilled to get a home. Best of luck to you...you'll do great.

    Audra i just signed a sellers contract , the agent is a long time friend of the family and i did hesitated to sign all of those pages and i asked if he could leave them for me to read them before signing them but he acted uncomfortable so i just figured hes a friend he would not do me wrong . now i am faced with the task of doing a lot of extensive decluttering cleaning and repairing , i'm 78 years old with bad health issues and i cannot undertake this responsability , what do i do now ? HELP !!

      Well, I would contact your agent and ask if they could help...because that's what long term friends of a family do for each other. If you already signed a contract, the agent is not required to help with preparing the house for sale. There are companies that can come to the house and help declutter and/or donate...this, of course, costs money. So sorry to hear about your health condition issues. Also, call in the troops, see if other friends and family can help. I can tell you are kind hearted and would hope they could help ya. I know this process is overwhelming. By the way, I don't like that your agent wouldn't leave the contract behind for you to read. Doesn't make me feel good for you. Wish I could be of more help.

      @@AudraLambert update on my post , i had a heart to heart with my (agent-friend) and i ask him to cancel the contract with the understanding i would be responsible for any penalty and i'm very happy to tell you he told me no penalty was applicable , no advertising , photos or any expenses involved as this was just a few days ago , to say im extremely relieved is an understatement . i learned my lesson thank you sweetheart for your kind words . 💗

    I have a question I need money I am retired which way is better for me? Remortgage my home ask for a credit line on my equity or chip mortgage?

      Hello there! If you are retired and have little income coming in, you may not qualify for a Refinance or a Credit Line. You will need to show how you intent to pay off the loan. A chip mortgage or reverse mortgage may be a better option for you. I don't know your financial situation. I would really recommend you talk to a financial advisor or someone you trust financially who knows your situation. Best of luck to you...and thanks for watching!!

    Thank you for this video. This might be a dumb question, but why does seller pay buyers agent commission? The buyers agent isn't working on your behalf or in your best interest. It seems like you are paying someone to work against you.

      Thats a very interesting question. There are lawsuits currently about this very topic. I will do an entire video on it. Bottom line, back in the day when there were no rules governing real estate (Before National Association of Realtors Existed) it was the wild wild west in Real Estate (much worse than today). The National Association of Realtors created guidelines and rules regarding how the real estate industry should be conducted. The sellers offering commission to both the buyer and listing agents was created for "Cooperating" purposes. Sellers wanted their house to be shown, some buyers can't afford representation, hence where we are today...but that is changing.

    Do find the buyer will have a home inspection done even if you (the seller) present them with one you had completed?

      Yes, the buyer usually still completes their own home inspection. There are usually no surprises because we already did ours and already made repairs.

      Hello there! It really depends. Buyer's agent commission are not set. The seller is not required to give a buyer's agent commission but it does assist with the buyer's paying for their own representation. If I was selling my house, I would give the buyer's agent a commission because I want that buyer well represented. Most buyer's can't afford to pay for their buyer's own commission. The buyer is the one who is paying most the money out of pocket. I would consider my price when offering a buyer's agent's commission. So glad you are learning from my videos. That makes me happy.

    Pre sale listing inspections performed by a random professional home inspector will fix most problems in real estate and we all know this. Why hold the most important detail until the very end when the buyer is emotionally attached to the house. This is done on purpose as a means to hide deficiencies.

      Noooo...there is no such thing as a set listing term. Heck you can make it 1 day if you'd like. You can negotiate any length of term you want. I hate that too.

      Not sure where you are from, but in California we use escrow companies to process the sales transaction. Some states use attorneys and/or title.

      You can always negotiate your commission...but try to find the best agent you can. Sometimes its worth paying an agent a full commission. However, 6% sounds like a lot...just saying.
