What happens if there's property sold without a deed of sale?

  • Yung lupa niyo ba eh, hanggang ngayon, hindi pa rin nakapangalan sa iyo?
    Paano mo ngayon ililipat ito sa iyong mga anak?
    Ideal na pag bumili ka ng lupa or minana mo ang lupa, ay dumaan ka sa proseso ng paglipat ng titulo sa pangalan mo. Pero marami sa ating mga kababayan na hindi ito ginagawa. Hindi muna inililipat sa pangalan nila.
    So, ito ang tanong ng reader natin today, Wendy M, who says:
    "My spouse and I purchased a 90 sq. m. house and lot from my aunt and uncle sometime in the early 80's. They only gave me the land title. No other legal documents were issued to prove our ownership of the land. They passed away before they could give us the deed of sale. We have been paying for its taxes since we acquired them. We really didn't mind the lack of deed of sale since we have been living here even before we bought the property and nobody contested our ownership. However, I want to transfer the property to my children. Is it possible? Please advise. Thank you."
    So today paguusapan ang:
    1. Ano dapat gagawin once makabili tayo or bigyan tayo ng lupa?
    2. Dapat bang may kasulatan to?
    3. Ano pwede gawin in case walang kasulatan?

    Pano naman po kung nawala yung documents ng house and lot? May paraan pa po ba para maitransfer your ownership sa buyer?

    Hi po!
    Nabili ko po ang lupa 15 years ago fully paid na po kaso wala deed of sale, ang meron lang po ay acknowledgment receipts lang signed by seller and witnesses. Now namatay na po ang seller and nag appear na ang mga anak at sabi may balance pa ako at gusto bayaran kung ano man ang naibayad ko sa namatay nila parent/seller. May habol po ba ako atty? Salamat po

    Hello po, ask ko lang po same issue pero what if halimbawa lang po, si windy po Yung namatay at Hindi Niya po napamana sa anak Yung lupa?may karapatan po ba Yung anak ni windy?

    Hi attys, sana po mapansin. Ask ko lang po. I have a case where my husband and I signed a Contract to Sell and DOAS with a distant relative where we will be buying the property ni relative. Title is with developer pa and the tax declaration kaya hindi pa namin naipasok sa bank loan at ma process title transfer. Although we have already paid the downpayment and renovations for the home out of pocket. Now, she passed away before we were able process loan app and TCT. My law student friend advised na technically, heirs do not have claims na to the property since we have entered a contract na with the original owner. And it's valid even if she's deceased. CTS was notarized but the DOAS was not. It's also stated in the CTS that in case hindi mafulfill ni orig owner yung terms in the CTS, that her heir will process it. Tama ba friend namin na the developer can release the TCT and tax dec in our favor instead of the heirs? Thanks in advance 🙏

    Hello po attorne. Bumili po ako ng lupa na deed of sale lang ang document ng may-ari. Ang issue po atty. eh yung tax declaration, nakapangalan parin sa seller nung naturang deed of sale ng current owner. Nung nasa notary public na po kami, hinahanap po ng attorney yung copy deed of sale prior yung current deed of sale na hawak ng present owner kasi nakalagay po sa current deed of sale yung document number na yun. Nagtanong po ako sa cityhall for a copy, pero wala daw po silang copy dahil sa nasunog noon ang city hall. May ibang paraan po ba para makakuha po ako ng copy ng deed of sale ng owner na nakapangalan sa Tax Declaration?

    Tungkol po sa estate tax. 2 po ung lote namin. Pero ung isa lang muna ang ipatransfer sa aming mga hiers. Puede po ba yun sa BIR?

    Bumili po ng lupa ang tatay ko may deed of absolute sale naman po kaso hnd po napanotarized ,at namatay na po ang may ari ng lupa, pwd pa po ba ipanotarize ang deed of absolute sale dahil gusto na po sana ibigay ng tatay ko sa amin ang lupa at ichange name na po namin. Salamat po

    Yan din po problem ko inde pa natransfer sa name ko un title sa kadahilanan po na nagtuturuan si pagibig at developer na kung sino dapat mag transfer. Sabi po ng developer na forward na nila kay pagibig ang pag transfer at pag dating naman kay pagibig si developer naman ang tinuturo. Ano po ba dapat ko gawin para matransfer na sakin title? Ako na po nagbabayad ng amilyar kahit inde pa nakatransfer sa name ko. Salamat po sa reply.

    Attorney yong original title po ayaw po ibigay sa akin ng anak ko single po ako sa title nabili ko po yong noong binata ako pede ko ba maibenta yong lupa hawak ko ay certicate of title lang salamat po
