    Story 1: to the commenter who said "violence is never the answer to what can be solved by words" all I can reply is that while that statament is true, it's also missing a part of it that goes as "unless the person you are talking to can't be reasoned whit words". Racists like OP's brother are past the talking stage, only punches can make the point to this kind of people.

      The problem with that sort of reasoning is that you are now being the judge of "what kind of people" are deserving of words and who are deserving of violence.
      Kinda like racists, homophobes etc, who also divide people into groups of who are deserving to be treated as humans and who deserves to get beaten for something they said, are, thinks etc.

    Your brother used words to deliberately provoke violence, per the Fighting Words Doctrine, in essence, he threw the first punch. Unfortunately his alligator mouth overrode his humming bird Fanny.

      While that is generally correct, it would be a misapplication of the doctrine in this case. "Fighting Words" simply goes to whether or not a statement is protected under the first amendment. It does not empower anyone to actually fight. It merely establishes such statements as being outside of legal protections.
      Properly applied in this case, some courts (depending on what district they're in), may view racial slurs as "fighting words", which would imply that it was a direct personal insult intended to provoke a violent reaction, and thus could be considered grounds for legal intervention (like getting an HRO granted). It would not give anyone license to haul off and hit the guy without legal consequences. Assault is still assault, and unless there was an objective threat of violence, you couldn't raise a self-defense claim on the words alone (which you wouldn't want to anyway, as it's an affirmative defense and shifts the burden of evidence off the state, which is pretty universally a bad move for a legal defense... that's the last resort option 99% of the time).

      There is also a point where it stops being self-defense, no matter how justified it was at the start, and turns into plain revenge and no longer legally defensible.

      The U.S. Supreme Court first defined them in Chaplinsky v New Hampshire (1942) as words which "by their very utterance, inflict injury or tend to incite an immediate breach of the peace.

      The fighting words do not negate the criminal assault of the husband.
      What they negate is the basic self-defense claim of the brother:
      example: husband beats brother, brother does not fight back: husband committed assault, brother not (since it was still just words)
      example 2: husband starts beating brother, brother fights back (winner doesnt matter): both commited assault; as the brother self-defense, defense, was voided by his fighting words
      separate from the basic assault charge, (not legal use of force) is a separate matter of use of excessive force
      even if the use of force is justified the level of force and duration for which force was used may not be justified
      example: provation with fighting words
      response: there is huge diffierence between a singular push or strike, even a singular knockout strike as a response versus continually using physical strikes and further reexamined when others are trying to end the altercation (pull husband off) but husband continues the assault

      @@idministeralthough the aggressor in the court case that I referred to in my previous reply received a severe beating required stitches and staples, the court did not hold the defendant accountable. As in this case, the “victim” initiated the assault and battery which led to him being beat up. Therefore I’m just going to go with the reality of that judges statement (which is case law that can now be cited) rather than the what ifs and mental gymnastics proposed by you. Hard agree to disagree.

      99% of football players are cobsidered healthy and fit but if ya look at them they all got beer guts and fat. Same goes for those strong men competition. All obese guys who can run longer and faster than the average gym bro and lift 10x more than them without trying. Its called supportive fat it stops your guts from leaving your ass when ya go to lift something its also the only reason why your muscles dont seperate from your bones when ya lift anything. Having very little to no body fat is extremely unhealthy and should he treated as severe medical emergency but morons on social media like yourself are too stupid to look up basic medical facts altheletes and actual gym rats know. Ya just dont like women who dont look like theyre twigs who will snap in half if ya grab them too roughly. And i say this as a former gym rat who got lazy after medical issues and im now over weight trying to lose it again. I dont have my almost 30 lbs of muscle anymore so my 20 lbs of extra fat is unhealthy when it use to good weight training i use to do.

    I have to say, the brother is a POS but it shouldn’t get to violence. If you can’t use your words walk away from a situation but a comment shouldn’t lead to violence unless it kept escalating and escalating. Brother is still the bad guy but Mikaah needs to get that under control
