      I am somewhat curious about your opinions about the lawsuits Jason Scott talked about at Defcon. He was being aued for over a million dollars, as he was hosting a text file transcript of a book that the author himself released for free.

    I like how a guy woke up one day and realized that he was God, and the first thing he did was sue magicians. Didn't try to end all suffering, he just looked at magicians and was like "these mfs gotta go".

      I agree, I have been served coffee at Starbucks that was definitely much hotter than normal and food from sonic that was also much hotter than normal. I'm sure restaurants and coffee shops aren't allowed to serve food or drinks above a certain degree to prevent burns, but what w was served was like too hot to hold the bag or the cup hot.
      When I ate the food from sonic, it was so hot it burned my esophagus and left a cyst for several months that interfered with breathing and eating. So, the macdonald's lawsuit was not frivolous.

      what can I say, women and their unrealistic standards. I mean, girl, come on, sueing people for money with the flimsiest of reasons is practically a US tradition, he was being a good patriot! *And* he kept the sum realistic instead of sueing her for 5 million for emotional distress and suffering - what more can a girl possibly ask for?!

    As someone who works at a theater, while you're not supposed to text, texting for someone to pick you up from a creepy date is no where near the worst thing for the future of "civilized society" that I've seen happen.

      It's also common for women to check in with friends or family during a date as a safety precaution. Make sure people know you're ok, and where to send the cops if you're not.

      I absolutely hate disruptions in theaters, and I originally thought the whole thing was funny because of the absurdity.     Ok so the fire fighter story... My brother in law has been trying to get hired as a fire fighter for years now, and with the training he told me he needed to do to even start that process makes me REALLY wonder how that man even got hired, let alone got through the training.

      When I first did maritime fire fighting training, I learned to push through the fear and do it anyway. After the 5th or 6th time having huge gouts of flame blown right over my head, it started to get harder not to freak out... I think eventually I will either need to find another psychological tool, or give up my certification. That said, the litigant is a nuisance who needs to swallow his pride and admit he's not cut out for the job.

      In either cases, the Fire Captain should just... take a different role instead if he still really really wanted to be associated with firefighting that doesn't involve jumping into flaming buildings tbh. The lawsuit is just dumb all in all.

      Yes! My father is a firefighter and I’ve been to some training sessions to watch, and it’s astonishing to me that if he had a fear of fire he was hired and put onto a suppression unit. It could be likely that he’s developed ptsd from fighting fires.

It could be argued that a reasonable person who bought a box of junior mints years ago may be deceived into thinking they're buying the same amount cuz it's the same box they remember, but when they got it they realized the portions were much smaller. I'd be interested to see what Junior Mints' slackfill looks like over time.

      Sounds a bit like the larval stage of an incel: I didn't have a perfectly good time on the date, I want my money back.
      (Honestly, I agree that texting is annoying because it's a distraction for the people next to her, but how about being an adult and _asking_ her if those texts are really that important? I mean, a date is so you learn something about a person and find out whether you want to spend more time with them. Certainly worked in that regard.)

    The most disturbing part about the story of the firefighter who was afraid of fires is that he somehow managed to get promoted to captain. I think a better lawsuit would be from the community against the fire department for allowing this guy to get promoted to that kind of leadership position in the first place.

    My favorite ridiculous lawsuit ever was a woman who's husband embezzled millions of dollars from his company but got arrested for it, but the woman divorced her husband during this and the embezzled funds suddenly got held up in court because the woman claimed half those funds were legally hers and thus the company owed her that money. It took several months for that to be throw out of court, and this was with actual lawyers representing her!

      While this obviously sounds ridiculous, there is some merit to it: whether legally received money that was previously attained through illicit means should be reclaimed is a complicated subject. In this case, her being married to said criminal makes things simpler, but the base argument has some merit.

      Unless all the stolen money was just sitting in a private bank account, that’s not an especially ridiculous case.
      If they bought a house with a mix of legal income and illegal embezzlement, how do you split that up? How about a child’s college tuition?
      Commingling legally and illegally obtained funds, especially over years, means a tremendous amount of work sorting out the specifics. Add in jointly held marital assets being divided fairly, and a couple months’ delay seems almost too fast.

      Seriously though, I feel this was likely an act of desperation, because often funds get embezzled to cover debts, and it's possible that because of her ex-husband's idiocy she faces poverty.

    A surefire way of getting more dates in the future, is establishing a reputation of suing your previous date when it didn't go the way you planned it. I'm sure that will get the ladies interested.
    Seriously, most of the time it's better to cut your losses and move on. And I mean, it was like 20 bucks, and not an expensive lobster dinner just to be ghosted afterwards.
    Wonder how this guy's dating life is going.

HOWEVER the original commenter is correct in how most potential partners will perceive this mans actions. It's not just that he asked for the money back, it was the huge escalation. Although, I suppose it did "send a message" that the only potential partners that should approach this guy are the ones okay with his antics and attitudes.

    I sort of agree with the slack-fill candy boxes, but at the same time you also know how much you are getting because those boxes are filled by weight and not by volume. The weight is printed on the outside of the box for all to see.

      Yeah the unused part of the box is just unnessisary trash, but nothing to sue them over ny gawd. Its weight not how much it fills the box! The visual aspect is important for customers because you feel like you get more.

      I don't think people are stopping to read the boxes on the way to the film, everyone is rushing to take a seat and not be late, and even if you are chill, other people might be pushy for you to not hold the line.

      You can also feel the weight by shaking it. Also, while I don't know if this applies to boxed candies, I know companies actually decide the amount of slack fill for chips by testing the best air to chip ratio to minimize the number of broken chips, so there could be a practical reason for the slack fill in candy boxes.

      Movie theater boxes are oversized to help prevent the candies from melting, while they sit on your lap for as longer as 2 hours. Junior mints needed more room because of the low melting temperature of the bare chocolate coating.

    On the disability case, I have to appreciate if not like the unintentional(?) reference to Catch-22. The titular rule in the book says that fearing to go into combat is not a psychological disorder, and is in fact evidence of sanity, which means you can't use the insanity clause to avoid combat because the only way to be ruled insane is to be excited to go fight, in which case you wouldn't be trying to invoke the clause.

      A person filing a lawsuit like that should be sent to a mental hospital for a 2 week evaluation, not be given the courts time. Why is it so difficult to call a spade a spade? Something like that is a no-brainer, but we are so hung up in procedure and bureaucracy. I mean, you wanna be a firefighter, get hired, but won't do it because you are afraid to???

    This video reminded me of a story my paramedic instructor was telling me. One day, many years ago, she was called to a location for a woman suffering cardiac arrest. My teacher followed protocol, cutting her shirt open, giving drugs, and using the lucas CPR machine, and was able to revive the person. Weeks later, my teacher’s department was informed of a lawsuit coming their way because they cut open a shirt that was a gift from the patient’s grandma, and was suing for damages of around………wait for it……..$100. My teacher never told me what came of the suit, but I can only assume it was dismissed fairly quickly

    A friend of mine's dad actually used to be a personal injury lawyer and he explained why as a small private firm lawyer he had to have a standard consultation fee or 90% of his day would be listening to scammers and crazy people who think they have case when they don't and he'd be unable to run a viable firm if the fee didn't deter most of those people and guarantee some sort of payment for listening to the ones that still came to him. Now granted he'd waive that fee for people that had legit cases and where low income, but even if he told people over the phone "I don't think you have a case, but you can book a consultation if you'd like" a lot of people would still think they knew better and made appointments more often than not.

      I wish the lawyers near me a few years back would have done the whole "waive the fee for low income and legit cases" so I could have sued my apartment company. The ones that didn't have fees wouldn't take the case despite clear evidence of wrong doing and evidence from a doctor on the harm being done due to their neglect.
      Private property meant they had to ban someone who DID NOT LIVE ON THE PREMISES from coming there. They told me they would after there was a police report. I ended up having to call 911 and 4 different cars arrived. Then after the fact they did nothing and refused to ban him. claiming they couldn't get the police report?? police records are public records and all they had to do was ask for it. They said I could't just bring the report though. I had to suffer while being unsafe in my own apartment for several months of them refusing to ban the guy and without the ban the police couldn't make him leave

    the best lawsuit i ever heard of happen in my country of Croatia. Man sued his brother over a showel, he lent it to his brother and he broke it. After a few years in court people from the court offered him to buy him a new showel just to end this idiocity. And the man responded with "that kind of showel does not exist anymore".

    I actually think the candy lawsuit has some merit.
    You can't tell me, that the size of the package isn't intentionally a lot bigger than the amount of candy you get and it doesn't seem obvious, that it doesn't meet the criteria that are listed (although they could probably say it's cheaper that way and that could be enough).
    It certainly doesn't deserve to be listed with the rest.

      I agree. I don’t think a reasonable person could ascertain the amount of candy present just by reading the box. Overwhelmingly we justify our purchase of boxed candy by its weight compared to its size. Of course there’s the argument of whether the size of individual pieces can diminish the “slack fill,” and I’m sure many others. But it didn’t deserve to be thrown out, in my opinion, especially with the level of disrespect that the judge used.

      I think it's reasonable to assume the box was filled almost to the top and not mostly empty.

      Yeah, it's a fact-based case that is actually trying to protect a buyer's right.
      And the judge's response is very aggressive and dumb. Any person of average intelligence can determine how much slack air is in the package? What a bitch, the only thing written on the package is the weight, so you would need to do density calculations to determine how much volume does a given weight takes. While that's hardly an Einstein-worthy task, it's not easy to do without pen and paper or a calculator and while you're buying something for a movie that will start in minutes or has already started.

    The Roller case makes me sad. A close relative developed grandiose delusions with paranoia, and they also think there's a tv show based on them and that the whole world is watching and discussing their life. It's really hard. You cannot make someone get help, and delusions are probably the mental illness most resistant to treatment. As with Roller, such delusions have real-world effects, in taking up so much of a person's time and energy.

    I just watched a Food Theory episode a few days ago that covered a marketing test by some chip company. They found through marketing trials that bigger packaging with less product sold far more than smaller bags filled with nearly full capacity (which contained more product by weight than the larger packaging).

    Not clear to me how the Junior Mints packaging doesn't fullfill all the legal requirements for misleading containers with regard to slack fill. There's nothing in that list which says it's OK as long as it lists the true weight even if it only fills half the container.

      My guess is that it could be a case of several products with different volumes (but the same weight) being sold in the same cardboard packaging (with different labels printed, obviously). In which case I think it's considered okay since otherwise they'd need multiple machine set ups to make the different sized boxes.

    something that the plaintiffs should maybe have mentioned, is that in a movie theater you aren't allowed to pick up the box, so it looking bigger than it is matters more in a movie theater, than say a grocery store where you can feel the weight of the box in your hand and closely read the servings per box and suggested serving size to determine how many pieces of candy are in said box.

    I should have sued Planter's Nuts years ago, They had "Deluxe mixed nuts" can with macadamias. First one I bought seemed short on the macadamia nuts, so I bought another and sorted the nuts by type. It contained ONE macadamia kernel, in two halves. Perhaps the two halves satisfied the plural in the content description. They don't sell this mix any more, so maybe someone did sue them and they discontinued it rather than add more expensive nuts.

    I have a question about the Fire Captain. How on Earth did he make it to Captain if he refused to go into fires? To me that sounds like appointing Chief of Surgery a surgeon that refuses to do surgeries because he faints at the sight of blood.

      So I did some Googling, and it looks like he wasn't actually afraid of fires. Or at least not all fires, assuming their squad was called to more than two fires over two years.
      Rather, there were two instances where Proler (the firefighter in question) supposedly didn't help fight a fire. In 2004, one firefighter filed a complaint alleging he refused to get into gear while on scene. Proler denies this ever happened. And another time in 2006 where he froze up and supposedly wasn't even able to walk. Other firefighters say they needed to carry him over to a bucket where he could sit down. Proler (and his doctor) claim this was due to one-off "global transient amnesia."
      That's what Mr. LegalEagle is talking about in the video.
      Interestingly, he wasn't fired after this lawsuit. But he was eventually fired after a third incident that happened five years later. In this third incident, he apparently fell asleep on the fire truck on route to a highway collision and other firefighters were unable to wake him up. He remained asleep for, at least, the whole ride there, during the call, and on the way back.
      Honestly, if the guy is falling asleep in a situation like that and can't even be woken up by people trying to wake him up, there might actually be something wrong with him. That seems really suspect to me, but hey.
      He fought his termination in another lawsuit, but I wasn't able to find the outcome of that lawsuit. The most recent document I could find was from 2016, when the 14th Court of Appeals denied the City of Houston's appeal to exclude evidence about Proler's alleged disability. No idea what happened after that.

      Unfortunately, the dirty little secret of law enforcement is that there no legal or specific job requirement that they risk their lives to protect the public. Their training is basically all about how to protect themselves. That is also true to a large degree for fire fighters (trained to protect themselves), except that their job is specifically tied to fighting fires which is inherently dangerous. The fact that most firefighters choose to take what we perceive as a greater risk probably has to do with them feeling like they have more direct control over the outcome, as it's them with their tools against the fire, rather than them and their tools versus unpredictable humans.

      Tbh it is both messed up but if there was some fine for people texting or looking at their phone in the movie theater I would be okay with it. It's understandable to be a huge pet peeves as the added light desaturates the screen and is also just annoying. I don't think this should actually be a law because it be near impossible to enforce though.

      The answer is yes, but proofs would have to be brought by the Defendant that the person was tested by a qualified medical person to certify this.
      An easier way would be to have a ruling that the plaintiff has brought vexatious and frivolous suits and must prove on a Motion that the case has legal merit.

      Interesting idea, but I can see that being a potential deterrent for filing legitimate lawsuits--plaintiffs might be scared that defendants might get them thrown in a psych ward even though their claim is reasonable.

And then as the story went on I got more convinced. not that I think it should be required, but I think someone he cares about should address it with him. :(

      @@eatingketchupchips9567 Yeah, I was upset that she ended up paying him on television and he counted the money and didn't apologize. That sounds kind of like extortion to me. Even with the fact that he paid for the movie and pizza, there is an assumption that paying for a date's expenses is a gamble -- if you don't like the date, you don't get your money back. Just don't date them again. Paying for a date is not a purchase of services -- it is a gift given freely and does not entitle the giver to anything in return, other than a reasonable attempt to make the date work.
      (I would be pissed if I bought my date a ticket to a theme park and they showed up without me and didn't meet up with me at the park at all, and posted pictures of their 3 hour stay on insta afterward. That's not a good faith action -- accepting the gift means making some attempt to go on the date. But that's it. A reasonable attempt at a date. Nothing more. If they leave after 15 minutes, oh well, that's fine. Emergency comes up 2 minutes in? Leave if you need to. Want to text during the movie? I might not invite you again, but you don't owe me money. That's my take, anyway.)

      BTW a side note to this, consider sugar babies. Being a sugar baby sounds like a very scary game to play, because you kind of are implicitly promising something in return for receiving money and expensive things. Like, if you get an allowance, I could understand why the richer person might expect something from you in return. I wonder if would be better to be a sex worker outright and be clear about what services you're giving and what you're charging. Dating a rich person and being their sugar baby sounds like a recipe for communication failures and exploitation.

      Sure, you simply shouldn't pay for someone on the first date unless you're willing to take the risk. I wouldn't call his behavior self-entitlement though,. She seems like the entitled one, but I guess I mainly feel that way because I too hate people who can't keep their phones off the few hours modern movies usually take.
      Would I have sued, no. I wasn't there, but from what have been said, I'd consider her the entitled one.

    Whether or not the judge thinks it's stupidity or coddling, extra packaging is not good for the environment. We don't need extra waxed board impossible to recycle at most facilities. That alone should be reason enough to have laws in place to prevent slack-fill.

    Qustion: for that firefighter chief. Lets say that he had a incident at work that caused his fear. would his pstd of that event have helped him win that case? Effectively replace the idea that it was a phobia into pstd

      I don't think it would help his case since it seemed like the transfer he was fighting. If he did have his fear as a result of PTSD from a work event, it would qualify as a disability and the department would be wrong to cause him any reduction in pay or benefits, but the transfer to an available non-field position at the same pay rate would be completely reasonable. If no such position was available, and he was deemed unable to perform the duties of his position, the department would be justified in forcing him into medical retirement. Involuntary reassignments are not against the law unless they are done in an arbitrary manner or due to some form of unlawful discrimination. In the case of a firefighter afraid to fight fires, it's not unlawful to reassign the person to non-firefighting duties even if the fear is connected to a workers compensation claim.

      It goes back to what constitutes invalidity. A phobia of fires is not a problem in normal life. Ptsd can give you huge trouble with day to day life, even when not fighting fires. So no matter if it happened at work or not, being diagnosed with ptsd instead of a phobia would change the situation to him actually being disabled.

    When I worked for the Federal Courts, pro-se litigants and attorneys that filed these ridiculous lawsuits were sanctioned by the judges for repeatedly filing "..frivolous and vexatious lawsuits." In severe cases they would have to petition the Court to file a lawsuit and get permission before filing the Complaint.

    My cousin was a volunteer firefighter for years before getting a full-on paid position a couple years ago. I tell you, there's few people I admire more than him. So yeah, firefighters get and deserve mad respect.

      @@GuacJohnson Not where I live. We have a volunteer fire department. Which is both good and bad. It's good that we're not big enough to need a full time department. It's bad because they can be subpar in their abilities. Example: roughly 10 years ago less than 50% of our fire fighters were actually fit enough to go into a burning building.
      Don't even get me started on how few hot fire fighters we've had.

He certainly deserves a generous workers comp package- something representing how the disability won't effect his everyday life (unless it is and he has to subside on microwaved food because he's too afraid to turn the stove on) but that has barred him from his chosen career path, which he put all this time into.
      Although since the fire department moved him away from the front lines and that's what he had a problem for, they could aurge that since he isn't out of a job he deserves less worker's comp, not something for being forced out of your job, but something that covers your therapy bills. But from the way Devin described the suit, it sounded like the firefighter was sueing to get back on the front lines

    FYI, patents no longer expire 17 years after their issue date - that was changed back in 1995 when the US brought its patent system into compliance with the Uruguay Rounds Agreements Act. Since then, patents expire 20 years from their earliest priority date, similar to how pretty much every other country calculates patent terms. The earliest priority date is the filing date (not issuance date) of the first filed non-provisional patent application in a family (patent applications can claim back to older applications in what's called continuation practice; provisional applications can buy an additional year and don't count in calculating a patent's expiration date). Practically speaking, for an original filing it still more or less winds up around 17 years, as the average time for prosecution from date of filing until issuance is around 3 years, although I've had any number of applications get allowed in less time. Also, time can get tacked on the back end by way of patent term adjustments, basically to compensate for when the USPTO drags its heels. As you might imagine, this is a gross simplification of how patent terms are calculated, and there are many other factors that could come into play. In fact, the USPTO actually has a spreadsheet-based calculator you can download that will tell you when a patent expires.

    As somewhat a regular occurrence where a countersuit is filed I’m sure a person got sued and they sued that person for suing them because the whole case caused them immense stress and trauma. Reasonable, logical people like C L and Colin Deal will read this now and see that this is a counter suit filing a lawsuit in retaliation for them filing a lawsuit against them, not that they sued them for damages because they lost the lawsuit

    The slack fill sentence makes more sense than the judge gives it credit for - I have no idea how many mints would be in 1 ounce of mints, but the packaging size gives me a rough idea.
    That, and it's just waste: not just on the individual packages, but also on the larger boxes all the way up to how many ounces mints you can fit into a truck.

Are you able to imagine a fairly accurate estimate of how many mints of the particular size are in the box? what about 1 pound of mints, how many mints in a pound? if i have a box thats a bit bigger than a larger phone how many mints would you think is in that box if i told you there was 2 ounces in it? The answer to all this, you will estimate how much is in the box by the size of the box. A reasonable person would assume the company is using an appropriately sized (or at least close) box for the product being sold.

      @@Draganot1 The size of those mints is irregular. That's one of the many reasons they're sold by weight instead of volume, so that the customer can know the amount they're getting. There's also the basic fact that all things change their density with the temperature, so the volume contained within the package would vary regardless.
      You're also being quite obtuse with those rhetorical questions. You would know how much an ounce of mints is by either A) having personal experience with mints, or B) asking someone who does, things a normal person would do before making a purchase of any product. There's also the fact that the *number* of mints in the product is irrelevant to how much product you're getting. 1 ounce of mints? Could be 100000, could be 4, both would be within the range of expectations measuring solely by volume. That's, again, why they're sold by weight in the first place.

    Not very far in but I think junior mints might be packaged that way because of how easily they get crushed. Even under their own weight a lot of the time when I get them there are crushed candies at the bottom of the package, and I can’t get them out because the released filling glued it to the side of the box. I’m not a junior mint engineer or anything, but that’s always why I thought it was filled that amount. Could be wrong tho

    My brother has been mistaken for Ben Roethlisberger several times. They are only two years apart and there is a passing resemblance, but much like with Jordan's look alike there is a 6 inch height difference. I think part of the problem is that these athletes are mostly seen on the field next to other athletes of similar size and we don't realize how much bigger they usually look next to average people.

    I used to work behind a bar and on a quiet day I was talking to a barrister who defended companies against ridiculous lawsuits.
    The one that sticks out most is a 40+yr old woman went back to work, after her kids grew up, in a sandwich shop (Greggs for anyone from the UK). When making sandwiches they were trained to put the teacake/bread bun on the table, hand on top and slice through sideways.
    She held it in her hand and cut through too far slicing into her hand. Apparently the lawsuit was "no one told her the bread knife was sharp".
    After a very stunned pause it took me quite some time to stop laughing! 🤣😂

      I mean just look at trumperton, he was just staggeringly dumb with no concept of reality outside the fantasies of godhood outside his own head.
      The entire republican party is just full of corrupt, misogynistic conspiracy theorists. At least the Democrats seem to have got their heads out of the 1800's and are pushing for decent healthcare and human rights for POC and women.
      The US isn't even vaguely a democracy (or Republic/Democratic Republic) though, it's a Corporatocracy, it's run by big corporations via politicians owning them/being part of their board or being bribed by them.
      At least your politicians didn't deliberately cripple your economy by destroying the value of the currency purely to make them and their friends money (that's what Brexit was all about, that and dodging having to declare offshore holdings in tax havens).

    Regarding the disability thing, I have a question: suppose a surgeon develops Parkinson's, and it severely inhibits his ability to perform surgeries. Since Parkinson's is classified as a disability, would it be illegal for the hospital to re-assign him to a more administrative role, as that would be ability-based discrimination? Like, would they be forced to let him keep operating, potentially costing lives, or be penalised for re-assigning him?

    with the case on disability; I'm surprised there isn't a clause in the law about 'relevant disabilities' (taking into account the duty to make adjustments), for example if someone is incapable of driving (say they are blind or something) wouldn't be discrimination, whereas someone with limited mobility might be within the companies duty to make adjustments

      The law says that employers are to do "reasonable accommodations" - which is fairly vague and companies like to abuse that. But in this case, assigning him to training was in itself a reasonable accommodation. His fear was taken into account, he was still seen as a very skilled professional who was fully able to train others to do what his fear wouldn't let him do. I'm guessing his problem with the reassignment stemmed from having to take a pay cut. I'd imagine the hazard pay was what he was missing in his new role.

      It doesn't need any clauses. It was mishandled from the beginning. You have to be able to perform the job IN SPITE OF your disability. The law only protects people who are discriminated against because of a perceived disability even though they can FULLY perform all functions. If you can't perform any of the functions, the law is moot, and you can be fired for underperforming. it's not designed as charity.

      @@aoikemono6414 This isn't QUITE true. You have to be able to fulfill your duties with or without "reasonable accommodation" from your employer. Your employer is required to provide any accommodations you might need to perform your job, as long as they are "reasonable" (which, as another commenter pointed out, is a bit vague and can be abused by employers). For example, if you are a checkout clerk but have a disability that prevents you from being on your feet all day, your employer could be required to provide you with a stool.
      There's also some wiggle room on what "accommodation" means- I used to work at a bookstore and a small part of my job was supposed to be moving heavy boxes of books, which it turns out I couldn't lift (and not even because of a disability). Rather than fire me, my employer had other employees help me, and we got a wheeled cart that I could use when stocking books. I imagine that my employer was being generous in that situation, but if I'd had a disability that prevented me from lifting heavy boxes, and other employees were around to help, my employer might well have been required by law to have them help, instead of firing me. (Of course, if lifting heavy boxes was a SIGNIFICANT part of my job, and not a small one, it would be different.)
      Businesses aren't charities, it's true, but we have laws like this because otherwise, all disabled people would be forced to be unemployed and living off disability. The government doesn't like paying disability, and would much rather have disabled people find employment.
