  • Harry talks to the Honorable Shira Scheindlin, who served as a federal judge in Manhattan for 22 years, about the legal instructions that Justice Merchan will shortly provide the jury in the Trump case. There are several vexing legal issues, starting with the core felony charge, which requires the jury to find Trump caused the falsification of records with the intent to commit another crime. What other crime might that be, and need the jury agree on it? What happens if the jury concludes that Trump acted both to keep information from the voting public and to shield Melania? Will the judge give a “missing witness” charge to the jury about Allen Weisselberg? And to what strategic decisions for the parties do these issues give rise?

      She wouldn't do the corrupt bidding of the right. Biden appointed Judge Ketanji Jackson, she has proven to be worth her salt, during the short time she has held her seat. She'll become more influential with time. But she's made a difference already.

    I love that we get to learn from a wise, intelligent, older woman who is clearly staying sharp. It disturbs me how many people think Biden is mentally incapable. It's the opposite. His wisdom and the wisdom of people like this justice are essential at this time.

    Terrific to have this conversation with such an authority on these matters, and to really get into the details of how the charging process can work. That said... Harry kept interrupting the judge way too often! It's as if he wasn't reading her facial expression to see that she had more good points to make, on subject after subject. Fortunately, she was able to forcefully come back to those points at times.

    Harry, I watched this episode two times, back to back to try to absorb all that was discussed. You both have helped me a great deal to understand the elliments in this case. I agree that there is no question about the intent to defraud the voters. It should have been available to the public but it wasn't. This discussion is amazing. I am in awe of Judge Scheindlin! She is the perfect example of what the people should expect justices and judges to be like in these judicial positions. Bring her back again Harry. Very powerful discussion!

    It is my understanding that the lesser charge is not an option, precluded by statute of limitations, so it's felony or nothing.

    Karen Friedman Agnifolo says the statute of limitations has run out on the misdemeanor alone. This is all so wildly complicated and such a great window on the inside of the law. Great guest and conversation, Harry!
