YOu sign up for a HOA, you don't get secretly victimized. IN most states now, non payment of condo fees can be liened and at some point when someone buys it or it is forclosed on someone has to pay up or you dont have clear title. That said, possessing and rerenting ahome is NOT an HOA power. HOA screwed up.
First of all I don't believe in HOAs 1 you don't really own the home because you can't do what you want with it they have the right to tell you what to do with your home and they have no right to kick people out that's your house you should be able to do what you want with it I lived in an H away where I couldn't paint my house of color I wanted to paint it I couldn't put my garbage cans were I wanted to put them I couldn't put my car in my driveway and had to go into a garage too many damn rules ho I should not have that kind of control over what you can do with your house or your property

For communities with detached homes like this I agree, having common areas and community amenities (pools, parks) are not worth it. But for condos or townhome communities where you share portions of the buildings with other owners the HOA is there to ensure exterior maintenance is implemented to protect the buildings. If the CC&Rs focus on those types of things rather than petty things then the Association is there to help. Owners have the ability to vote to change the CC&Rs and should do that when there are oversteps by the Association board.
Why abolish something that millions and millions of people voluntarily enjoy and choose to use. Individuals have a choice when they move into an HOA neighborhood....move in there and abide by the community rules or go elsewhere. Millions choose HOA. The solution is not to abolish something that works for most....just don't move there if you do not like it.

You DO NOT have to allow the fire department on your property at all unless you are a possible danger to homes near by --stupid ha?

It depends on your HOA governing documents. My HOA docs clearly state that the HOA can foreclose on an owner and rent out the unit to get money owed. It's all clearly stated in the docs (I've read them cover to cover).
It really depends on who has the proper paperwork and name to the house. There is really is nothing that the police can do if someone can prove that they are the legal and rightful owner of the house. IT is up to the court system to sort that out. Until then, Whoever has the deed and paperwork can the claim the house theirs.

The foreclosure provision exists to protect the HOA (homeowners -- an HOA is simply a collection of homeowners). I suspect proponents would argue the greater good is more important than any individual, and that the provision ensures fairness. I can tell you first-hand, owners get pissed when their neighbors aren't paying their fees, demanding that the HOA "do more" to enforce payment.
I lived in a HOA in Fl for almost 10 years and can tell you that ANYONE that sees those letters in the contract should run like HELL in the other way.The stress and crap will give you nightmares for years!!!
Just remember that you only hear horror stories of the horror stories. I grew up in an HOA and no one ever had a problem with them. They basically existed to maintain a communal pool and clubhouse and some walking trails. There were a few rules about what you could do on your property, but they amounted to 'don't stack up rusted out cars' and that's it. We never had any problems or knew anyone who did. It probably helped that it was operated by people in the neighborhood and not a 'management company' and that if you showed up to a board meeting, you were effectively volunteering to help. By that I mean they were constantly looking to involve the people of the neighborhood in the neighborhood's business to make sure it was the neighborhood itself handling things, not a couple of nosy neighbors.

I found a disturbing update to this news story: "Joanne McCarn left a Pasco County courtroom in tears Wednesday, saying her HOA is out of control. ... Wednesday the McCarns went to court to try and get their house back. But Bridgewater's attorney said the HOA followed state law. ... The judge agreed, leaving the HOA in control of the home and McCarn shocked about his decision." (Source: "Judge rules HOA can rent out investor's home" ABC News, May 11, 2012).
What I find especially terrifying about this whole situation is that: "The HOA filed for and received a court ordered eviction. McCarn says that was when she was first notified of the lien." (1:33) This suggests she didn't receive due process. I'm not familiar with the applicable local laws, but there is definitely something VERY wrong if an HOA can put a lien on a home and then evict the owners for "non-payment" without telling them that the lien even exists until they are being kicked out!!

Especially those that are suppose to serve in minds they become overseers of the community or people not servant of to the people or caretakers of a responsible. The HOA I was in was elected and the community quickly put them in their place but some are so powerful or the task of enforcement has been delegated to a private firm and then it is just about revenue.. And once money starts to flow good luck getting these HOA representative kicked out.

It was interesting and a lot of work but in that instance it was headed by homeowners wanting good for the homeowners, neighborhood and community.
Abolish all HOA's! A HOA tried to force my parents to pay their stupid fees. There was one small problem...my parents didn't live in the HOA community they lived on the other side of it.
They tried to start an HOA in a neighborhood I used to live in. It wound up being 1/2 the neighborhood in an HOA, my half not. A year later, the HOA had to be disbanded because nobody wanted to pay dues for an association that was doing nothing for anyone but the nosy person that ran it, and they had insane requirements for the homeowners. She was a retired interior decorator who spent all her time outside sprucing up her home, and expected everyone else, who worked 8 am - 5 pm jobs to pay $50 a month to justify her trespassing on their property, telling them what they had to do to their homes to make HER happy about the neighborhood she lived in. Our lawnmower broke down and spent 3 weeks in the shop, waiting on backordered parts. The stupid bitch called the Town Police Code Enforcement out to my home to write me a ticket for not mowing my yard. The guy got out there, started to write me a ticket, and then stopped when I reminded him that my neighborhood was not in Town Limits, and was in the jurisdiction of the County Sheriff's Office, and the County did not have Codes regarding lawn maintenance. Then I told him about the lawnmower, and showed him the estimate from the shop and he just shook his head, and left. I then went to her house and told her to keep her nose in her own side of the neighborhood. She told me that my yard invited thieves, and she would have no part in her neighborhood looking unkempt. So I asked her if she had any "Civil War era" pre-industrial yard equipment laying around. I hated that old hag. She tried to get someone cited and fined for taking down a chain link fence, and replacing it with a privacy fence made of wood, because it was taller than 5 feet, and the HOA said 5 feet was the max allowed height. The same people had to fight a citation for replacing the concrete stairs to their front door with brick stairs, because they were trying to increase the value of the home to sell it. Her complaint? They didn't ask HER permission to do the upgrades to the home. HOAs are nothing but a group of self-important people who feel the need to impose their will on others.

According to the story, the HOA had the authority under the law to evict the owner's tenant, but not the authority to place a tenant of their own. Further, they are obligated to take payment made in any attempt to satisfy the lein placed on the property. Deputy should just turn and walk away.
The second amendment doesn't give you the right to force someone at gun point. It only gives you the right to have a gun. Depending on the state, showing up brandishing a gun to force the people to move out could very easily land you in prison. Yea, that would show the HOA.

There was a guy who rented a beach house for the summer. He spent his time showing the house to potential buyers. He collected deposit checks from a couple of dozen people. When all the checks cleared, he gave them all a move in date. Imagine the look on the face of the actual owner when dozens of moving vans from all over converged on the same beach house, all claiming the house was theirs! True story. They never found the guy.

It's sad that she's in this situation, but this is the price you pay when you sign an agreement with an HOA. Basic rule of thumb - A homeowners association is selling you the 'right' to buy YOUR home, and telling you what you can and can't do with it. That agreement you sign isn't to protect YOU, it's to basically hand all your rights to THEM. There is virtually NO benefit to an HOA, and you should run fast, run far, and run IMMEDIATELY when you encounter one.

Where I live in Florida, The people across the street live in HOA, my side of the street thankfully doesn’t. We put in a black mailbox & We’re told it had to be white when I told him we are not HOA they backed off. My friend moved from there because she could not even paint her door the color she wanted to. Nah, extortion implies the HOA wants them to pay. Instead, the HOA would rather have the rental income indefinitely without having to pay the property taxes. At the point that the HOA refused to accept payment it has legally forfeited it's right to collect on any debts under the Federal laws which established US currency as legal tender. Every note says that it must be accepted for all debts public and private, and if it's not accepted the debt is void.

I am not a lawyer but what this HOA did is ILLEGAL. I work as a repo agent and therefor know laws about what people can and can not do with loans, liens and etc.. and like I said what this HOA did was illegal. you cant just put a lien on a car, house, plane, boat etc. that you don't own. its like I walk up to your car when you are sitting at a red light and saying that you owe me money and forcing you out of your car making you watch as I drive away. its the same thing. this HOA forced a renter out of the property, changed the locks and moved their own in. then the claim they own the property which they don't. all are highly illegal and can if I lived there would be suing the HOA, HOA president and filing charges again these people for the theft that they clearly did.
They can legally place liens on the property for fees and dues, but the only way to exercise a lien is foreclosure, not what this guy did. He must have a very stupid lawyer.
in the US they can not legally. I would know more then most because I work for a repo company. different states have different laws but they pretty much all have the same thing. the only one who can put a lien on a house, car or whatever is the holder of the deed or title to that whatever. yes I know it contradicts what I just said but what I am saying is that this HOA was not the holder of the deed or title so what he did was illegal. she was the holder of the deed to this property. what the HOA did was to get a duplicate deed and then go in and kick out her tenant. then they moved their own tenant in so they would start paying money towards them instead of the rightful owner. I do agree with you that this guy must have had an idiot lawyer but I am also betting not a lawyer at all. when you sue someone or go after money you think you are owed, what happens? by law you have to let them know they have one final chance to pay you. and if they don't then you take them to court. then what happens? you get a process server to serve them with the legal papers that say they are being sued. I am betting she didn't get any of these so she now has the legal right to sue them and if she wanted to she could probably take the HOA presidents home if she wins.
+teacher555555 You clearly *don't* understand how the law works. *Anyone* can establish a lien against a property: a lien is placed by the courts, after a petitioner has established that a debt is owed. The HOA *can* establish a lien for debts owed. In most states (Florida & Texas are notable examples due to their arsebackwardness in terms of real estate law) you could not evict a tenant for the owners failure to pay a debt as most states in the US recognise the common law practice of a tenancy surviving conveyancing (ie. sale or foreclosure). What's odd in the story, and there's no background given, is that the HOA is not taking ownership via foreclosure (which they often can) but is simply taking possession. The homeowner was a muppet though: any decent lawyer could stop what was happening, and if there was a mortgagor then they would step in to protect *their* interest and slap the HOA down.

I know more about different types of property laws because I have to being a repo agent. if we get one little thing wrong it could cost us everything, so we do our research on who owns the property we are trying to repossess. just for an example lets say the property is a car, who owns it? is it a bank? a person? a company? these are just one question we ask to see who owns it because only the owner of that property can come and collect the property in the car or the car itself. in most areas if there is a process that most people take first and its called a sheriff sale. if someone owes you a debt you can go to court and ask for it, what happens first is the person who the debt is against is notified about the debt and that they X amount of time to either settle it or their stuff will be sold. if the debt is not settled in that time you can ask for the sheriff sale. what happens then is the police come to your house with the papers saying the amount you owe and that they will start removing your stuff to pay for the debt. they hold the sale right then and there, there is no waiting for the date of a sale as it happens right on the front lawn of the person the debt was against. they continue to sell that persons stuff until you have the full amount of the debt in your hands.

I'll say it again because you keep repeating your mistake: *anyone* can petition a court to establish a lien for a debt they can prove. It happens all the time throughout the US. There is nothing illegal about it. What was portrayed in the video, however, is nothing like the legal process. Hence, my saying that we don't have enough info and/or the info is screwy. You keep going on about how much you know, but you clearly don't. Take, for example, the irrelevant sidebar you gave about Sheriff sales. 24 states in the US allow sheriff sales. The rest *do not allow them for real property*.
This is surprisingly almost legal. An HOA can place a lien on a property for payments owed, and just like a bank mortgage or delinquent taxes, the HOA can foreclose on a house, and use the money from the sale to satisfy the debt. But they are also required to pay off tax liens and the mortgage (in that order) before taking any money, then what remains goes to the homeowner. What can't be legal is taking possession and control of the home while it is still legally owned by the homeowner. I wouldn't be surprised if someone in California tried doing that, but if this were Texas, you'd find the HOA president's body in the front yard riddled with bullet holes... and nobody bats an eye.

In most cases, preserving and providing for the look and feel of a community. They may provide services, like groundskeeping for lawns or neighborhood entrance ways, pay for security patrols, or maintain facilities like a shared pool or park open to HOA members only. I had one in my old condo that basically owned the outside of the buildings and all communal spaces. If a branch fell on the roof and caused damage, the HOA would fix it an they kept the parking areas paved and painted, etc. The trade off is generally a loss of some autonomy to help maintain community standards. Obviously, there is usually a financial payment (monthly in most cases). Additionally, there are often rules around property maintenance (you have to keep your lawn mowed and take your trash out on time) and presentation (maybe having to get paint colors approved before painting your house). They may also have rules about things like the size and types of additions a home can make or renting out your home since the rate of rentals in an area can lower value and can lead to people less invested in home upkeep since they aren't the owners. In theory, all this can make your living in the house more comfortable (like using the pool or always driving past nice flowerbeds as you enter your neighborhood) and make your property worth more and easier to sell (since your neighbor won't park their cars on the overgrown lawn and paint their house lime green which can affect your property value). Most HOAs are fine and really do seek to protect the community of homeowners. My new one is voluntary, but puts on four mini community festivals a year and rallies awareness and support for learning about zoning changes that might affect the feel of the neighborhood (allowing 1 home lots to be turned into duplex lots, for example, which changes how the neighborhood looks as houses take up more space per plot and doubles traffic volume). However, that's not to say some HOAs don't go too far. They certainly do. Some interpret maintaining the feel of a community in rather sinister ways (like being racist) or get overly oppressive in what rules they pass and how they enforce them. But I still feel this is generally the exception for HOAs and not the rule.
They are allowed to require a specific form of payment within reason. The "pennies are legal tender" argument doesn't actually work ever. They can require that the payment is made with a money order for example, and not cash or a personal check... so long as the payment amount is in U.S. dollars, they can refuse cash. But you're absolutely correct, if you try to pay them, and they just say no, you're scott free. I used this with the cable company. I bought a router third party online, and when I go to hook it up, the C.C. says it's stolen "reported lost in a fire". I go back and forth with them and with the seller who insisted it was obtained legally from a reputable source so I took it to the local office. They said the same thing, and I asked if they would take it from me and they said no. Next time I talked to them I informed them that they had refused ownership of it, and they just gave up.
My landlord refused rent and then evicted me for non payment, the judge said that he wasn't required to take the rent, it basically depends if you live in a state run by Republicans or not
Perhaps the government needs to step in and limit the abuses by HOA's. Pretty clear that a few people gain power in their HOA and then abuse that power. It should be abundantly clear to every owner in an HOA how to remove officers that exceed their authority.
AN HOA Tried that crap with me an my EX years ago. I simply told them UNLESS they had a contract with the MILITARY to get off my property. We then filed a COMPLAINT plus trespassing. They never bithered us again. Our house wasn't EVEN ASSOCIATED with woth the HOA.
Our HOA went after us for putting a climbing frame in the front yard without planning/building permission. We ignored them, they fined us, we ignored that, they assessed us penalties. After six months, the fines totaled $6,000. We paid our lawyer $100 to send them a cease and desist order. We also hinted that we might sell the house to someone with a subprime mortgage, who would then take in teenage foster children with sex offender records, and unleash them on the gentile neighbors.

The big problem is people do not know their HOA's rules and regs until something like this happens. As a land surveyor I try to warn people about this beforehand if possible.
Homeowners associations have jurisdiction over the common areas the lot house sits on is private property the same as any neighborhood that doesn't have an h o a. I would call this Homeowner Association squatting.
The HOA received a court ordered eviction for the woman's tenant? How does that happen? The courts shouldn't be doing that. The HOA aren't the property owners, they're only an organisation that is owed a debt.
gphell33 that’s the problem, they didn’t foreclose the property. They illegally got the tenant evicted, because of court oversights. First of all, the lien that was set was under HOA terms, for a house that was not under the HOA’s jurisdiction. It wasn’t owned by them, therefore they can NOT set those fines. Then, the fact that they started renting it without the property owners consent, the one who’s name is on the deed, is how they’re trying to get this property under their control. If you squat in a house for 5 years in Florida, it’s officially yours. So, if they keep tenants in this property for 5 years, they will legally own it.
They have the authority to evict tenants in order to enforce a lien. They have a lien on the property and since the owner did not live there under the current law, they can evict those tenants in order to recuperate their money for the lien. Never buy an HOA house it is a trap. Unless you like paying a bunch of money to someone, so they can tell u how to live your life. They tell how many cars you can put on your property. What kind of grass you can have. How long you have to keep it, and god forbid there is a drought and water restrictions. Then they will fine you when it turns brown. Decided you want a bright pink house one day? No can't do that, you can only paint your house an approved color. I could go on but you get the idea. HOAs should be illegal. At least be stripped of most of the powers they have managed to lobby into existence.

HOA is not the only person to tell you how to do things on your property. Theres buildin codes, setback lines, ect. Thats why you live in the country. The only people who can that your property are government officals as it will be iminant domain. Course they are also required to give current market value of the property.
Building codes, setback, etc are primarily to protect all property owners rights. That way your neighbor can't do something that will harm your property, or build something unsafe that could not only burn their house down, but yours as well. These regulations exist and serve their intended purpose. HOA rules are about keeping "the wrong people" out, etc.
And this is why i will never live in a housing addition that has an HOA. you would have to be insane to allow anyone this much power over you and your property.
If the HOA collects more than is owed to them and does not return the excess funds to the lawful owner of the property, the have committed an act called unjust enrichment. Would love to know what happened in court.
HOA's need to be abolished Nation Wide! Don't allow builders to build HOAs ever again. They always charge exorbitant fees, disallow you to plant flowers that are bright red, yellow or orange. Don't worry about what your neighbor has/does with his property.
For communities with detached homes like this I agree, having common areas and community amenities (pools, parks) are not worth it. But for condos or townhome communities where you share portions of the buildings with other owners the HOA is there to ensure exterior maintenance is implemented to protect the buildings. If the CC&Rs focus on those types of things rather than petty things then the Association is there to help. Owners have the ability to vote to change the CC&Rs and should do that when there are oversteps by the Association board.
Why abolish something that millions and millions of people voluntarily enjoy and choose to use. Individuals have a choice when they move into an HOA neighborhood....move in there and abide by the community rules or go elsewhere. Millions choose HOA. The solution is not to abolish something that works for most....just don't move there if you do not like it.

It depends on your HOA governing documents. My HOA docs clearly state that the HOA can foreclose on an owner and rent out the unit to get money owed. It's all clearly stated in the docs (I've read them cover to cover).
It really depends on who has the proper paperwork and name to the house. There is really is nothing that the police can do if someone can prove that they are the legal and rightful owner of the house. IT is up to the court system to sort that out. Until then, Whoever has the deed and paperwork can the claim the house theirs.

The foreclosure provision exists to protect the HOA (homeowners -- an HOA is simply a collection of homeowners). I suspect proponents would argue the greater good is more important than any individual, and that the provision ensures fairness. I can tell you first-hand, owners get pissed when their neighbors aren't paying their fees, demanding that the HOA "do more" to enforce payment.

When looking for a home and I see HOA I immediately say Oops nevermind.
Just remember that you only hear horror stories of the horror stories. I grew up in an HOA and no one ever had a problem with them. They basically existed to maintain a communal pool and clubhouse and some walking trails. There were a few rules about what you could do on your property, but they amounted to 'don't stack up rusted out cars' and that's it. We never had any problems or knew anyone who did.
It probably helped that it was operated by people in the neighborhood and not a 'management company' and that if you showed up to a board meeting, you were effectively volunteering to help. By that I mean they were constantly looking to involve the people of the neighborhood in the neighborhood's business to make sure it was the neighborhood itself handling things, not a couple of nosy neighbors.

Wednesday the McCarns went to court to try and get their house back. But Bridgewater's attorney said the HOA followed state law. ... What I find especially terrifying about this whole situation is that: "The HOA filed for and received a court ordered eviction. McCarn says that was when she was first notified of the lien." (1:33) This suggests she didn't receive due process. I'm not familiar with the applicable local laws, but there is definitely something VERY wrong if an HOA can put a lien on a home and then evict the owners for "non-payment" without telling them that the lien even exists until they are being kicked out!!

Oh, there are many positives of HOA's as they were originated to be but many have evolved into something completely different.
I served on a HOA. It was interesting and a lot of work but in that instance it was headed by homeowners wanting good for the homeowners, neighborhood and community.

Abolish all HOA's! A HOA tried to force my parents to pay their stupid fees. There was one small problem...my parents didn't live in the HOA community they lived on the other side of it.
They tried to start an HOA in a neighborhood I used to live in. It wound up being 1/2 the neighborhood in an HOA, my half not. A year later, the HOA had to be disbanded because nobody wanted to pay dues for an association that was doing nothing for anyone but the nosy person that ran it, and they had insane requirements for the homeowners. She was a retired interior decorator who spent all her time outside sprucing up her home, and expected everyone else, who worked 8 am - 5 pm jobs to pay $50 a month to justify her trespassing on their property, telling them what they had to do to their homes to make HER happy about the neighborhood she lived in.
Our lawnmower broke down and spent 3 weeks in the shop, waiting on backordered parts. The stupid bitch called the Town Police Code Enforcement out to my home to write me a ticket for not mowing my yard. The guy got out there, started to write me a ticket, and then stopped when I reminded him that my neighborhood was not in Town Limits, and was in the jurisdiction of the County Sheriff's Office, and the County did not have Codes regarding lawn maintenance. Then I told him about the lawnmower, and showed him the estimate from the shop and he just shook his head, and left.
I then went to her house and told her to keep her nose in her own side of the neighborhood. She told me that my yard invited thieves, and she would have no part in her neighborhood looking unkempt. So I asked her if she had any "Civil War era" pre-industrial yard equipment laying around. I hated that old hag.
She tried to get someone cited and fined for taking down a chain link fence, and replacing it with a privacy fence made of wood, because it was taller than 5 feet, and the HOA said 5 feet was the max allowed height. The same people had to fight a citation for replacing the concrete stairs to their front door with brick stairs, because they were trying to increase the value of the home to sell it. Her complaint? They didn't ask HER permission to do the upgrades to the home.
HOAs are nothing but a group of self-important people who feel the need to impose their will on others.

originalShorai the issue is the lean. The HOA made sure to get a court order from a judge to evict the previous tenant. The police won't touch the house until another judge gives a court order to evict the HOA's tenant.
That's why they are fighting it in court.
According to the story, the HOA had the authority under the law to evict the owner's tenant, but not the authority to place a tenant of their own. Further, they are obligated to take payment made in any attempt to satisfy the lein placed on the property. Deputy should just turn and walk away.
The second amendment doesn't give you the right to force someone at gun point. It only gives you the right to have a gun. Depending on the state, showing up brandishing a gun to force the people to move out could very easily land you in prison. Yea, that would show the HOA.

There was a guy who rented a beach house for the summer. He spent his time showing the house to potential buyers. He collected deposit checks from a couple of dozen people. When all the checks cleared, he gave them all a move in date. Imagine the look on the face of the actual owner when dozens of moving vans from all over converged on the same beach house, all claiming the house was theirs!

It's sad that she's in this situation, but this is the price you pay when you sign an agreement with an HOA. Basic rule of thumb - A homeowners association is selling you the 'right' to buy YOUR home, and telling you what you can and can't do with it. That agreement you sign isn't to protect YOU, it's to basically hand all your rights to THEM. There is virtually NO benefit to an HOA, and you should run fast, run far, and run IMMEDIATELY when you encounter one.

Where I live in Florida, The people across the street live in HOA, my side of the street thankfully doesn’t. We put in a black mailbox & We’re told it had to be white when I told him we are not HOA they backed off. My friend moved from there because she could not even paint her door the color she wanted to. Nah, extortion implies the HOA wants them to pay. Instead, the HOA would rather have the rental income indefinitely without having to pay the property taxes. At the point that the HOA refused to accept payment it has legally forfeited it's right to collect on any debts under the Federal laws which established US currency as legal tender. Every note says that it must be accepted for all debts public and private, and if it's not accepted the debt is void.

I am not a lawyer but what this HOA did is ILLEGAL. I work as a repo agent and therefor know laws about what people can and can not do with loans, liens and etc.. and like I said what this HOA did was illegal. you cant just put a lien on a car, house, plane, boat etc. that you don't own. its like I walk up to your car when you are sitting at a red light and saying that you owe me money and forcing you out of your car making you watch as I drive away. its the same thing. this HOA forced a renter out of the property, changed the locks and moved their own in. then the claim they own the property which they don't. all are highly illegal and can if I lived there would be suing the HOA, HOA president and filing charges again these people for the theft that they clearly did.
They can legally place liens on the property for fees and dues, but the only way to exercise a lien is foreclosure, not what this guy did. He must have a very stupid lawyer.

I would know more then most because I work for a repo company. different states have different laws but they pretty much all have the same thing. the only one who can put a lien on a house, car or whatever is the holder of the deed or title to that whatever. yes I know it contradicts what I just said but what I am saying is that this HOA was not the holder of the deed or title so what he did was illegal. she was the holder of the deed to this property. what the HOA did was to get a duplicate deed and then go in and kick out her tenant. then they moved their own tenant in so they would start paying money towards them instead of the rightful owner. I do agree with you that this guy must have had an idiot lawyer but I am also betting not a lawyer at all. when you sue someone or go after money you think you are owed, what happens? by law you have to let them know they have one final chance to pay you. and if they don't then you take them to court.

The HOA *can* establish a lien for debts owed. In most states (Florida & Texas are notable examples due to their arsebackwardness in terms of real estate law) you could not evict a tenant for the owners failure to pay a debt as most states in the US recognise the common law practice of a tenancy surviving conveyancing (ie. sale or foreclosure). What's odd in the story, and there's no background given, is that the HOA is not taking ownership via foreclosure (which they often can) but is simply taking possession.
The homeowner was a muppet though: any decent lawyer could stop what was happening, and if there was a mortgagor then they would step in to protect *their* interest and slap the HOA down.

I know more about different types of property laws because I have to being a repo agent. if we get one little thing wrong it could cost us everything, so we do our research on who owns the property we are trying to repossess. just for an example lets say the property is a car, who owns it? is it a bank? a person? a company? these are just one question we ask to see who owns it because only the owner of that property can come and collect the property in the car or the car itself.
in most areas if there is a process that most people take first and its called a sheriff sale. if someone owes you a debt you can go to court and ask for it, what happens first is the person who the debt is against is notified about the debt and that they X amount of time to either settle it or their stuff will be sold. if the debt is not settled in that time you can ask for the sheriff sale. what happens then is the police come to your house with the papers saying the amount you owe and that they will start removing your stuff to pay for the debt. they hold the sale right then and there, there is no waiting for the date of a sale as it happens right on the front lawn of the person the debt was against. they continue to sell that persons stuff until you have the full amount of the debt in your hands.

They went to court and had the lien put on by the court. Which is exactly how I described the process as well. What isn't covered in the video is why wasn't the homeowner aware ahead of time? They had to have been served notice. The HOA can't just petition the court absent the homeowner. There's lots that isn't covered by the video.

This is surprisingly almost legal. An HOA can place a lien on a property for payments owed, and just like a bank mortgage or delinquent taxes, the HOA can foreclose on a house, and use the money from the sale to satisfy the debt. But they are also required to pay off tax liens and the mortgage (in that order) before taking any money, then what remains goes to the homeowner.
What can't be legal is taking possession and control of the home while it is still legally owned by the homeowner. I wouldn't be surprised if someone in California tried doing that, but if this were Texas, you'd find the HOA president's body in the front yard riddled with bullet holes... and nobody bats an eye.

Generally, to maintain common areas such as a shared pool or park or playground and to set and enforce guidelines for property maintenance to keep property values from dropping due to neighbors refusing to keep up their property.

In most cases, preserving and providing for the look and feel of a community. They may provide services, like groundskeeping for lawns or neighborhood entrance ways, pay for security patrols, or maintain facilities like a shared pool or park open to HOA members only. I had one in my old condo that basically owned the outside of the buildings and all communal spaces. If a branch fell on the roof and caused damage, the HOA would fix it an they kept the parking areas paved and painted, etc.
The trade off is generally a loss of some autonomy to help maintain community standards. Obviously, there is usually a financial payment (monthly in most cases). Additionally, there are often rules around property maintenance (you have to keep your lawn mowed and take your trash out on time) and presentation (maybe having to get paint colors approved before painting your house). They may also have rules about things like the size and types of additions a home can make or renting out your home since the rate of rentals in an area can lower value and can lead to people less invested in home upkeep since they aren't the owners.
In theory, all this can make your living in the house more comfortable (like using the pool or always driving past nice flowerbeds as you enter your neighborhood) and make your property worth more and easier to sell (since your neighbor won't park their cars on the overgrown lawn and paint their house lime green which can affect your property value). Most HOAs are fine and really do seek to protect the community of homeowners. My new one is voluntary, but puts on four mini community festivals a year and rallies awareness and support for learning about zoning changes that might affect the feel of the neighborhood (allowing 1 home lots to be turned into duplex lots, for example, which changes how the neighborhood looks as houses take up more space per plot and doubles traffic volume). However, that's not to say some HOAs don't go too far. They certainly do. Some interpret maintaining the feel of a community in rather sinister ways (like being racist) or get overly oppressive in what rules they pass and how they enforce them. But I still feel this is generally the exception for HOAs and not the rule.

They are allowed to require a specific form of payment within reason. The "pennies are legal tender" argument doesn't actually work ever. They can require that the payment is made with a money order for example, and not cash or a personal check... so long as the payment amount is in U.S. dollars, they can refuse cash.
But you're absolutely correct, if you try to pay them, and they just say no, you're scott free. I used this with the cable company. I bought a router third party online, and when I go to hook it up, the C.C. says it's stolen "reported lost in a fire". I go back and forth with them and with the seller who insisted it was obtained legally from a reputable source so I took it to the local office. They said the same thing, and I asked if they would take it from me and they said no. Next time I talked to them I informed them that they had refused ownership of it, and they just gave up.
private companies/people can refuse certain legal tender (i.e. pennies and such) but public/government run institutions cannot.
My landlord refused rent and then evicted me for non payment, the judge said that he wasn't required to take the rent, it basically depends if you live in a state run by Republicans or not

Perhaps the government needs to step in and limit the abuses by HOA's. Pretty clear that a few people gain power in their HOA and then abuse that power. It should be abundantly clear to every owner in an HOA how to remove officers that exceed their authority.

AN HOA Tried that crap with me an my EX years ago. I simply told them UNLESS they had a contract with the MILITARY to get off my property. We then filed a COMPLAINT plus trespassing. They never bithered us again. Our house wasn't EVEN ASSOCIATED with woth the HOA.
Our HOA went after us for putting a climbing frame in the front yard without planning/building permission. We ignored them, they fined us, we ignored that, they assessed us penalties. After six months, the fines totaled $6,000. We paid our lawyer $100 to send them a cease and desist order. We also hinted that we might sell the house to someone with a subprime mortgage, who would then take in teenage foster children with sex offender records, and unleash them on the gentile neighbors.

The big problem is people do not know their HOA's rules and regs until something like this happens. As a land surveyor I try to warn people about this beforehand if possible.
Homeowners associations have jurisdiction over the common areas the lot house sits on is private property the same as any neighborhood that doesn't have an h o a. I would call this Homeowner Association squatting.

gphell33 that’s the problem, they didn’t foreclose the property. They illegally got the tenant evicted, because of court oversights. First of all, the lien that was set was under HOA terms, for a house that was not under the HOA’s jurisdiction. It wasn’t owned by them, therefore they can NOT set those fines. Then, the fact that they started renting it without the property owners consent, the one who’s name is on the deed, is how they’re trying to get this property under their control. If you squat in a house for 5 years in Florida, it’s officially yours. So, if they keep tenants in this property for 5 years, they will legally own it.
They have the authority to evict tenants in order to enforce a lien. They have a lien on the property and since the owner did not live there under the current law, they can evict those tenants in order to recuperate their money for the lien. Never buy an HOA house it is a trap. Unless you like paying a bunch of money to someone, so they can tell u how to live your life. They tell how many cars you can put on your property. What kind of grass you can have. How long you have to keep it, and god forbid there is a drought and water restrictions. Then they will fine you when it turns brown. Decided you want a bright pink house one day? No can't do that, you can only paint your house an approved color. I could go on but you get the idea. HOAs should be illegal. At least be stripped of most of the powers they have managed to lobby into existence.

Said parties to occur only on HOA approved holidays, between 6pm and 6:25pm, with HOA approved music, food, and party hats. All guests will have to be screened and approved and will require a $75 guest badge to cover background checks and DNA testing. Buses will have to be provided because parking is not allowed....and neither are buses.

HOA is not the only person to tell you how to do things on your property. Theres buildin codes, setback lines, ect. Thats why you live in the country. The only people who can that your property are government officals as it will be iminant domain. Course they are also required to give current market value of the property.
Building codes, setback, etc are primarily to protect all property owners rights. That way your neighbor can't do something that will harm your property, or build something unsafe that could not only burn their house down, but yours as well. These regulations exist and serve their intended purpose. HOA rules are about keeping "the wrong people" out, etc.

HOA's need to be abolished Nation Wide! Don't allow builders to build HOAs ever again. They always charge exorbitant fees, disallow you to plant flowers that are bright red, yellow or orange. They limit the color you can paint your house. It goes on and on. They have just turned criminal by what they did to this lady (I see when this was posted). I hope the HOA in question has been disbanded and not allowed to create a new subdivision anywhere.

Based on all of the news stories about terrible Florida HOAs, I have to assume that Florida is one of those crazy states that allows people to be unwillingly drafted into an HOA against their will if their neighbors agree to it.

I live in an HOA and they are unbelievably corrupt and do not act in the residence best interests.
report the corruption to the state if you have actual proof and not just some conspiracy theory
