      Where at all possible, people should try to live stream or stream to cloud storage, so that no amount of taking a phone will remove the evidence. Could be quite difficult in some forrest far from coverage though.

      The hypocrisy of demanding phones while filming the interaction yourself, the assault, the follow-up physical assault (remember, they're not the same things, kiddos), the attempted theft, the 3-in-1 of attempted detention/assault/theft at the car door and all of it on Crown Land.

    From the video, it is established prima facie that the NSW Forestry thugs committed the following offences under the Crimes Act 1900:
    1) Tampering with evidence (Section 317)
    2) Demanding Property with intent to steal (Section 99)
    3) Robbery (Section 94)
    4) Common assault (Section 61)
    Against a charge of Robbery, it might be argued that the thugs intended to restore the phones after deleting any videos they wished to censor, but Mark Graham and Andre Johnson held intellectual property rights to those videos, making the videos their property and their forcible deletion a permanent act of theft. I should also note that Section 118 indicates that "An intent to return is no defence".
    It may be argued that destroying the videos did not amount to "tampering with evidence" because the thugs did not know, and hence did not intend, to prevent the use of the videos in judicial proceedings. That argument is prima facie false given that, had they not being doing anything illegal (and hence had no fear of judicial proceedings), they would have had no motive for the assault; and also because once they commenced the assault, it was clear the videos were of their illegal acts, and therefore could, and probably would (aside from police corruption) be used in a court of law.
    With regard to an assailant raising "an issue of self defence", firstly that is just the testimony of a potentially indictable individual and cannot be deemed to automatically refute the claims of others present; and secondly, it is directly refuted by the video in which clearly the NSW Forestry thugs were attempting to obtain the phones, and Graham and Johnson to prevent that, such that the intent of the assault was for that purpose without shadow of doubt, and that even if an initial claim of self defence was valid (which is not evident on the video (though the video does not show the whole incident), clearly the physical aggression persisted beyond any point where that was the sole objective making the defence facially invalid.

      Notice at 0:15 you can see a ute parked in front of the other vehicle blockading the road. They forcibly stopped them, got out and then assaulted them. It must be opposite day, where assault and threats of violence is considered self defence and bravery.

    I cant get my head around how this isnt a textbook case of physical assault?!
    I'm a fully certified drone operator with $50m insurance, a ReOC/RePL. Makes me just want to drive up to coffs (not far from me) hover a drone over their operations all day every day. I can easily stay 100+m from their equipment and capture everything they do with a telephoto lens. So tempting!

    As a Queenslander, (I'm sorry 😞), I , and my brother, have worked in the Forestry for many years...20+ for him....9+ for me...
    Since HQP (Hancock's Queensland Plantations) A Boston🇺🇸 based company took over from the DPI, the obliteration of our state forests are unchecked.... We burn "Habitat" areas...Destructive weeds are not controlled, due to "budgets"...Zero 'fucks' are given about the Health of our supposedly sustainable forests...It's All about harvesting, and Planting is done as cheaply as possible, with no concern about the whether the trees live or die...." It's All about the Paperwork " is what we're told....
    Private Corporations have NO business fucking with our forestry....
    I'm sorry....I get passionate 🤔🤫🙄

      I know it’s pretty bad in Victoria too. It’s Japanese paper companies that are still have access to log old growth forests, even well-known trees that provide vital habitat for threatened native species aren’t safe. I think our political parties are way too corporate owned- no matter what side they’re on, left or right. The needs of their corporate donors override the preservation of what’s left of our old growth forests. There’ll be nothing left for our future generations.

    There are multiple options for iOS and Android to record video or photos straight to the cloud so if you lose your phone or it gets taken you still have the recorded evidence, ideal for situations like this or interacting with police

      @@woolaboola7381 A solution for mark would be to get some crowd funding to set up a wifi hotspot in the car and have a laptop he can send videos like this to. As FJ and Mark unveil this destruction these actions will only get more desperate.
      Depending on the age of Marks vehicle it shouldnt be too hard to set up a 240v source hell even one of those charge at home big batteries. Then you set up that power through a well managed cable system and have some wifi magic and OBS.
      I would be def interested in supporting that sort of crowdfunding if we could find people local to him that could contribute in some way in terms of power source cheap wifi router and the likes.

    No joke. When you mentioned telstra net at 5:45 the video stopped buffering because, and I didn't realise this, my parent's home telstra internet cut out. It happens so frequently that I barely notice it when it happens, the only reason I noticed this time was because of how effing funny it was.

      Is it raining at your place or was it recently? And does your connection come in on a copper pair, like your old phone line?
      The Liberal government seriously thought it was a good idea to hobble Australia with a literally 178 year old technology (copper twisted pairs, terminated in pits which flood), as if it would scale to modern performance and reliability requirements even when it rains.
      Unbelievable. Hopefully Cov19 has made them realised how vital performant and reliable Internet access is for Australia's financial security.
      I was working as a network engineer for an Australian radio and television entity and when we had to WFH we'd barely be able to get through our team meetings without key meeting participants dropping off the meeting because of how unreliable their NBN connection was and that was the only option for them at their residence, outside of using an even worse 4G connection.
      If significant numbers of Australians need to work from home, reliable and performant Internet access is absolutely vital.

      @@stephengentle2815 Unfortunately switching providers is not a fix for some people. For example in my block of units, only NBN infrastructure was available and even worse it was over HFC. So I was constantly being hit with both physical and logical outages (physical being problems with the awful HFC connection and logical being problems within the NBN network).
      Essentially, my connection was limited to the use of NBN infrastructure. So no matter what provider I went with, like Aussie Broadband for example, I still faced both the physical and logical issues of the NBN.
      My Internet connectivity would essentially go down at least once every 1-2 days and stay down anywhere from hours to days!!!!!
      Then one day I got super lucky and my units building got wired with Fibre-to-the-Basement by PIPE Networks, for TPG (TPG now own PIPE Networks). I was then able to get 100M down / 40M up, with *_NO_* physical or logical reliance on the NBN, at all.
      The result? Thus far what seems like a 2+ year uptime and actual downloads of 110Mbit/S+ down and 40Mbit/S up, with low latency and low jitter. I say "seems" like because if there have been any outages, I've not noticed them.
      Aussie Broadband is still at the mercy of the NBN. Hobbled by it, for some.

      I don't know why comment didn't post; and thankfully no one at work will figure out who I am so I can give you all the tricks.
      Someone who's worked there long enough (employee ID begins with C8) to be able to address this! L2/L3 tech support can do a drop test -- ask the consultant to escalate the matter not to a technician, but to L2 or 3 first to perform a drop check. It's quicker to do that than wait a week for a tech. L1 do not have access to this system whatsoever. The Continuity Assurance team can assist with this also, as well as CDT, though it's unlikely you'll speak to CA unless a SIIAM ticket is raised, and you will never speak with CDT, basically. Switching providers will do *nothing*. Telstra and Optus no longer have any infrastructure: nbn does. They are now retail service providers, like your electric company. They provide nothing but a bill. Your modem isn't even a modem anymore; your NTD is, the 'modem' is just a router now.
      The drop test by your RSP checks your connection *up to the PoE only*. There is no use in doing your own, in-home drop test, as it cannot determine if the issue is internal (wiring/device) or external (infrastructure), whereas an internal one done by an RSP only tests what's outside.
      If you're on FTTN and it's an infrastructure issue, it will *never be truly fixed* as the copper will *never* be replaced until new upgrades. If in an apartment building, go open the comms/electric cupboard and take a picture of the condition of the connection points. If it's messy, tangled and worn it's possibly the problem. *If there are no drops detected up to PoE, the issue is wiring or devices*, the fault *may not even be on your line*, but due to non-telco infrastructure around it causing excess voltage, or battery.
      An important tidbit to remember is that *there are no longer any directly employed CTs*, they are all contractors and are paid by job, not by hours, so they have no incentive to work hard. A line can have multiple faults that will not be detected until an existing one is resolved. I was in L3, and two exceptional cases were:
      * An underground LIC that was built before military munitions (explosives) shed installed right on top of said LIC (had to severed and relayed)
      * Fridges. A guy had a neighbour who restored fridges from the 50s, which use a ridiculous amount of power, and every time he turned them on, it will kill the other guy's internet. That was a shit-outta-luck one, literally nothing can be done
      * A dude's own electric fence
      Most CTs will check the line for a fault, resolve it, then do in-home testing -- if the in-home testing works, they won't perform another line check. Have them do it up to PoE again, because a line can have multiple faults concurrently that can't be detected until the most catastrophic one is resolved. Drop buzzwords on him like continuity assurance, complex data testing, L3 back of house, and most important -- GSM Technical Solutions. Hold them to account.
      nbnco dropped the ball hard during all of this. if you don't know what a CSLLA/PRI is, be glad you don't: it could take 3 - 4 weeks of no service to resolve.

    We went to the park next to state forestry in Coffs harbour and was threatened by the police with arrest for celebrating international forestry day. I have footage.
    Recently, we protested outside ch forestry and when the media turned up the police completely changed their tune. I enjoyed yelling lies and criminals at them and nsw state forestry. Killing the koala and burning their homes in coal fired power stations is considered a carbon offset allowing more fossil fuel use! You couldn't make up the level of incompetence and corruption in the national party. Yes, CH has been a National seat my entire life and now the poison and soil load in our waterways is so high from mismanagement we have no frogs calling, the quiet at night is weird and so sad.     As a labor voter/supporter I really need you to address the new tennancy law changes in QLD, that as of Oct 1st allow any owner of a rental property to break the lease at any time only giving 1 month notice. With this massive rental crysis and homelessness on the rise this change must have come from corruption and it would be biased for you to ignore it. Many renters would not be able to find a new rental within a month, so this change could lead to a massive increase in homelessness and certainly removes the last shred of security renters had in QLD.

    Just to correct you on the situation in WA, the ban on native logging is a nonsense. True they are going to stop logging but they are not going to stop mining which will result in the clear felling of those native forests, not to mention the extraction of water away from agriculture.     I was physically frightened and had my fight/flight response kick in just watching that video of Mark and the other person with him being assaulted like that.     Thank Jordies for giving this exposure. Mark is a tireless hero of mine and yes, he does 'have a job'. Several, in fact. And there I was thinking that the attacks in the 90's in the same areas of irreplaceable forest on peoples' lives, including my own - including cars with whole families inside - would become a thing of the past once protestors could record everthing.

    My husband wanted us to move from FNQ to Northern NSW… I put my foot down …told him no. Way would I move to NSW because they are just toooooo corrupt. Come on NSW. Make your govt accountable!

    I cannot in good faith believe what I am watching. Like I feel like I need to know what Mark did prior to this to justify these filthy fuckers actions. Truly sad when when deep down I have to accept what I am seeing. Even if Mark was being "disruptive" to their work, any normal person would just stop work, have smoko, call the cops - whatever. Who the fuck essentially works for the government and cares enough to assault someone over it. Mind blowing.

    I wish I was shocked by such violence but when people, such as these forestry workers, are acting so illegally in the first instance then such a violent response to stop being uncovered is predictable, sadly. That being said, in Victoria illegal logging practices under the State Labor Government are also taking place and laws enacted by the Labor Government have serious financial consequences, and even jail terms, for people who protest or try to expose these illegalities. I wish it was only the Lib's who were corrupt but it's not. Do an expose on the illegal forestry practices in Victoria as well.

    1:10 Uh...Ever heard of VicForests? I mean for sure, the whole manhandling protestors and whistleblowers isn't happening but we've got the same problems with logging despite years of ALP.
    Just for reference, I'm *not* one of those "Libural and LaboUr are da same" folk but I also don't shy away from calling out these kinds of things regardless of who does it.
