I see all the comments where these PCN's have caused people utter misery. Direct action is what is needed, cover the camera's, block the car park. The directors of these companies can be found as can the real offices. I am planning on getting some stickers made that can be used to cover the camera lens and the signs to sell to like minded people that have had enough.

Thank you for the video Richard.
I am having similar situation with NPM taking me to court, they are sending seperate claims instead of putting all the tickets in 1 claim.
I have to go to hearing next month, and another God knows when... They are demanding £1,200 for 5 tickets because I was parked for roughly 5 minutes on all occassions due to my work (delivery driver).
Sick and tired of these scammers asking for outrageous money, and constantly harassing working people. The government needs to put a stop to this!!!

@@paul_my_plumbs_uk as someone who's been batting these away. Never ignore the letters (in my opinion) ask for the signed contract between you, and verification of the debt in the form of the full accounting and deed of novation (for the transferring of debt). Read their letters carefully, they'll usually trip themselves up. If they keep ignoring, keep asking for proof. Once you get to 2 or 3 letters and they still ignore the proof. Let them know about the protection from harrassment act and the Administration of Justice Act 1970 section 40. If they send you even a ingle letter demanding or threatening after this then that should be enough cause of action and breach of duty to sue!. All the best!

Thank you Richard for posting this, very useful and I totally agree that these tactics are disgusting. I received one of these County Court Business Centre docs yesterday for a parking overstay 6/1/22 which was for £60 when I tried to pay it online within the 14 days before the discount rate expired the UKPC website only had £100 option available for me to pay. I took a screen print ,showing the date etc so glad I did now) I did try to call them, long story where they asked me to send in the proof, when I did that, they sent a response, we will respond within 35 days (took a screen print of that too) and next time I called them I was told it was now to late to appeal and my fine now £160 and gone to debt collectors. Lots of letters and phone calls made by me, the collectors actually every aggressive, I did give up calling them around 6/2022 & the debt pay now letters continued and now I have this Court Claim. I will try and some legal advice I think as if I acknowledge or file defense to what feels like a bogus set up I may incriminate myself into this farce which may have some legal standing. Very sad for 15mins overstay on a really cold and icy day where it took longer to walk carefully back to my car, in a car park in Reading (not my home town) where(I found out) this car park is notorious for these kind of stitch ups and scare tactics.

The BIGGEST MISTAKE people make when challenging parking tickets is not checking for ERRORS made by the parking company. If they dont issue a parking charge correctly, or have proper signage or follow the regulations, you can win your case at appeal or court stage. Parking Mate UK can help you appeal tickets easily.

I’ve had a fine for parking in my own car park space (allocated to my apartment) because I didn’t show the valid permit in the windscreen.
The afternoon before the fine was issued, I received my first covid jab (proof of this from the NHS) the jab caused me to feel nauseous, tired, out of breath and putting the permit on my car was the last thing on my mind…
    ZZPS keep sending me threatening letters, adding fees to the charge and claiming to take me to court. I’ve fought back stating the car space was my own, I haven’t done anything illegal or criminal. The signage states that parking is allowed by two means;
    1) A valid parking permit (to be visible in windscreen)
    2) pre-authorised vehicles
So why isn’t a system in place to register the cars of the residents whom live in the apartment complex!?
I had live in the apartment nearly two years before Parking Solutions Ltd have put in the place the parking rules etc and in my tenancy contact is does not state that a permit is needed to use the allocated parking space provided.
Please advise anyone? Am I doing the right thing by sticking to the militant approach? Am I in wrong?

Perhaps a look at the bottom of the paperwork will yield a clue.
If its from a company, it is a requirement that under s44 of the companies act 2004, a signature is required from the director or secretary. As these letters have none, this becomes fraud.
A complaint to the insolvency service regards abuse of corporate power might help.

We had a court date and the judge ordered the parking company provide photographs. When I sent my defence to the court (including witness statement), and copied in the parking company's legal team, they replied to me to sate that they had been instructed us to discontinue Court proceedings and close their file. The limitation period is six years. If the parking company has not brought a case against you before six years is up, it will be too late; they will be unable to force the debt. Once you have a CCJ, technically there is no limitation period. However, if the parking company has not enforced collection in the first six years of the CCJ, then things get a bit murky. The CCJ will drop from your credit record. The parking company will need to seek leave of the court to enforce the debt but they will be required to answer why they have not enforced the debt thus far. It is unlikely leave will be granted unless there are compelling reasons such as they were unable to find you. If you have lived at the same address all the time, they're scuppered. It's a grey area and there needs to be a test case.

I understand it’s very risky business to take these companies on, however, there is one sure way that these companies can be held to account, and that is a public uprising towards the government who are allowing these companies not only to rip off, but intimidate the motorist for the most simplest of mistakes. If everyone, who ever received a parking ticket wrote to their MP, then I’m sure that there would be enough people to force the government hand. severely regulate this crooked industry.

You still lose at the end of the day because you’ve then got to take time off work to attend court, then the stress of mounting your defence and waiting for a decision, loss of earnings all over parking a car. That system needs total reform. These debt companies should be capped at a maximum of treble the original fine. And told that they can’t levy on a persons property over a parking ticket or access their property without permission nor clamp vehicles. As a debt collection company all they should be doing is encouraging debtors to pay the balance offering payment plans.

    • @thefunkstarking

Yeah, I agree. This isn't about trying to get away with paying parking tickets or fines. It's about fairness. Paying for parking has a purpose, and fines are a way to control it, but these crooks are taking it too far. I see no issue with charging people a full days parking and maybe a small surcharge. When you're talking £100 fine because a 50p parking ticket isn't purchased, to me, it's obvious what their tactics are. It's way more in their interest for people to not buy a ticket and that's where the tactics come in with the poor signage, poor positioning of pay machines and even free parking for short periods of time! It may seem like a bonus getting a free 15 or 30 minutes, but it's a sure fire way to increase the amount of people parking without a ticket in the hope they go over the free time! It's gets me annoyed!!!

I've got a question. I had a £120 carparking fine from Park With Eaze for not paying for a ticket at a local nature reserve.
Now, the idea of parking fines is a punishment by financial loss, and also acts as a deterrent to never to do it again.
So the company is technically employed partially as a punishment service to non payers. However, what if that fine isn't a punishment to me ? Two days after I paid it, my multi millionaire friend, stuck the money back in my account.
So, technically, as a punishment service, it failed. I lost nothing, it didn't punish me from that angle, and it wasn't a deterrent as I'm an honest guy and had always bought a carpark ticket before, and will always plan to afterwards. It was just this one time I didn't , so I don't need the lesson in paying for my tickets. So on that front it failed as well.
Which leaves the questions, who gained and who lost out ? The carpark company obviously gained £120, but for what ? The fine didn't serve its purpose , as it made no impact at all. Which technically kind of makes it theft. The only people who loose out are the nature reserve, because as A type of 'fuck you' I'm no longer gonna use their carpark until I feel to . I'll park in the village outside.
So after all that, the carpark looses my custom, I've lost nothing because my friend stuck the money back in my account, and the carpark company gained £120 ...for providing a failed service.

There's a 2015 court case called Parkingeye v Beavis where this question was discussed. The charge of £100 was found not to be an unenforceable penalty unfortunately. This is authorised robbery. Parking Eye made £6.8 million profit in 2012 on a business model based solely on driver's inadvertently exceeding a free parking limit. You ask who benefits - it is them, but the court said that the site owner had an interest in managing the car park for the benefit of their customers so on that basis it was not considered a penalty.

I don’t want to be on the debt register either way but don’t want to let these goons get away with it. I want to fill out the claim but I’m stuck as I’m not a lawyer, my point it’s mechanical failure which I can prove, and no signed delivery of letters therefore no prof of communication with me. Anyway down to the point, defence or part admission ??

I can't advise you as I'm not a lawyer, but for me, I went full defence. My case was that the signage was so poor, I wasn't aware that it was pay and display, and I won. However, if you had mechanical issues and you were aware that you're in a pay and display, then that may be different. Sorry, I can't advise you anything beyond that, but I wish you good luck. We do need to show that these people are nothing more than crooks, though, that are just preying on people and trying to bully them into paying ridiculous fines. If you create your defence, there still maybe a chance they pull out though, so I'll keep my fingers crossed for you. Keep us all informed.

No I won the case! I think I mention it in 1 of the replies but for your sake I'll give you the details just incase. Basically these crooks didn't have any clear entry, so even though they had lots and lots and lots of these a4 sized signs on 8foot posts, there wasn't an actual sign in a clear legible format to say I was entering a pay and display car park. If you look up hartlepool marina you can see they have now put up a new sign which still isnt that obvious bit its better than before. That alone got it thrown out straight away. There maybe instances where these car parks win, and maybe they are legitimate and fair car parks, but we shouldn't just roll over when these crooks try and con us. I can spot so many ways they tried to trick people into thinking they weren't in a pay and display car park but many people just pay without putting up a fight. I fought them and I won!!! I did plan on doing a video but I'm not a fan a making them.

[Your Full Name] [Your Address] [City, Postal Code] [Email Address] [Date]
[Northampton Local Court Name] [Address] [City, Postal Code]
Subject: Parking Fine Appeal - Reference [Your Reference Number]
      Dear Sir/Madam,
I trust this letter finds you well. I am writing to present my appeal against the parking fine issued to me, as referenced above.
Upon receiving the initial letter, I observed that the provided photos lacked visibility of my vehicle's registration number. In response, I promptly submitted a letter via post, explicitly requesting evidence containing the registration number of my vehicle. Unfortunately, I received no response from the parking company until the recent court letter.
Crucially, I have not received any letters requiring my signature, and, to my knowledge, no correspondence has been delivered to my address since my initial inquiry. This is especially concerning given the recent developments. On 12th November 2023, Ofcom fined Royal Mail £5.6 million for failing to meet its First and Second Class delivery targets in the 2022/23 financial year. This situation could significantly impact the timely delivery of important business letters, adding another layer of complexity to the mitigating circumstances surrounding my case.
I wish to express my willingness to pay for a two-hour parking session at £4 per hour, even though my car spent only 10 minutes in the parking area. To accommodate the claimant, I am also willing to add 8% on top of the offered rate.
I must highlight that, upon entering the car park under mechanical failure conditions, I do not recall agreeing to any contractual terms, and the fine imposed appears disproportionate. Therefore, I kindly request a detailed breakdown of the costs to represent the loss of business due to my car being in the car park.
Additionally, I recall leaving the premises promptly after an employee approached me about my vehicle being parked there. This occurred at 9:10 AM, as I had spent only 10 minutes at the location. I left immediately after explaining the mechanical failure situation to the employee. I presumed any subsequent fine was issued in error, perhaps for another white vehicle, as I am not the sole owner of such a vehicle in the UK.
Moreover, I would like to address the inconvenience of the court being in Northampton while I reside in Slough, and the contravention took place in Hemel Hempstead. If a hearing is necessary, I propose conducting it in either Slough or Hemel Hempstead for practicality.
In conclusion, I hope for a thorough review of my case, taking into consideration the lack of communication, absence of evidence containing my vehicle's registration number, mitigating circumstances mentioned above, and the urgent mechanical situation that warranted my immediate attention.
I am hopeful that we can resolve this matter amicably and avoid further legal proceedings. Your understanding and cooperation are greatly appreciated.
Thank you for your attention to this matter.
      Sincerely,
[Your Full Name] [Your Signature] (if sending a physical letter)

Hi donnatella! So the first letter I got from the NCCBC was around 16th of Aug, I gave my defense and I received confirmation around the 20th of Aug. I then received a letter around the 17th saying they intend on going to court and they attached the their court questionnaire which I had to respond to within 7 days if I wanted to agree a settlement. At that point I rang them to say I would pay them 2 hours parking charge but they were to busy to answer. Then around the 1st of October I received my court questionnaire. Along with the questionnaire I sent a letter stating I'd never received any notification that I owed parking fines, however once I receive proof I will happily pay 2 hours parking fees with 8% compound interest. I've made a fair offer in my mind atleast! I then stated if that is not accepted I request a breakdown of all the charges and that I would happily go to court. I've not heard anything since. As you can see from the dates I've stated they were very quick to respond before and now I've heard nothing. Its my belief that they just tried to push me to the point where legal action was all they could do so they backed down. I cant guarantee this will be the same for you but I truly believe they are trying to frighten people into paying because there is no way they can justify the charges they attempted to put in people. I wish you all the luck in the world and please keep me I formed on whatever you do!

Council car parks are a different story but privately owed car parks are just out to trick people! Unlike barrier car parks which require no attendants, pay and display car parks rely on trust and It's a system that is regularly abused.
So car park attendants patrol them and stop those who are happy to take a chance and abuse that trust.

Paying to park has its reason, not only is it a business but it keeps it fair for the customer. What I am trying to combat is the parking companies who are blatantly out to try and catch people out by poorly displaying that it's a pay and display. For instance like I mentioned, the car park I was in had no entry board clearly stating it was a pay and display, the signs you pass are very high up and written in very small lettering. This is completely different to council owned car parks! Then I believe they put other tactics in to increase the amount of people without tickets, such as allowing your first 30 min to be free, however if they catch you there for a minute longer they issue you with a £100 fine! Why be so generous only to punish so harshly! That's 200x the cost of the 1 hour stay! What do you think they would prefer? They also removed parking meters from their original plans on the entrance in to the car park, so they even made it hard to see or find the parking meters.
