1. Gorath was never actually stated as a hologram in the film, all they said it was a fake non-existent asteroid and the real one was summoned later.
Xillens don’t even care about the earth, they came to abduct humans to use them as livestock and use Gorath to wipe out the remaining.
3. Toho isn’t a person it’s a studio, so they must’ve got approval to make that statement.
