This US antisemitism bill is a legal maneuver to try keep the IHRC DEFINITION from judicial scrutiny. It was already adopted by the state department but had not been used for arrest because it's clearly unconstitutional. In this case, congress has required schools to include in their policy, students violating policy is an issue for the school board not the police. After the school says the students violated policy and are expelled they can be arrested for trespassing. The issue in trial will then be trespassing NOT the constitutional question of the policy, that issue would be sent back to the school and the students told to complete the schools in house appellate procedures first and then that could be brought to civil court. HOWEVER, the school will then claim they had no choice in defining the policy because it was ordered by Congress and the students told they have sued the wrong party.
So, how do students get the definition in the policy reviewed by the courts?
