    reporting =/= incriminating self,
    u can just say an accident happened, don't need to say who you think is responsible

    No , it is not wrong, informing the
    authorities doesn't mean self incrimination.
    If we read the jurisprudence behind self-incrimination, lord Wallace who propounded this doctrine stated categorically, informing the concerned authorities regarding an offence and being asked to testify against himself are two entirely different things

      @@sriram8027 since you can't hit and run, you have to be present at the spot until police arrive, if the accident took place in secluded place, no third person is there, then it becomes the responsibility of the concerned party to call the authorities/ambulance.
      In the long run it will go in his favour, it will reflect that he is a law abiding citizen.

    it was done probably because many people were left to die on the road, who could have been saved if they were admitted to hospital or given first aid. but having said that, Indian mob is very dangerous and there are many people killed in vigilante justice.

    Wait why do we even the concept of self incrimination. A person who reports his own crime gets a lower punishment whereas someone who tries to run away should get higher punishment. Are we so bound by the written law that we forget the logic ?

    How is it bad, unless taking responsibility of once own action is bad. In an hypothetical scenario, somebody had just died and the culprit has audacity to flee the scene like a thief!?
    Best Law I would say.

      Well, here is it:
      Have you heard of the right against self-incrimination?
      In criminal cases, the accused is protected from incriminating himself, which means he cannot be forced to admit guilt, or take responsibility.
      Like, if the police asks you whether you did xyz crime, you can assert the right against self-incrimination to remain silent.
      It is upto the prosecution to prove that the accused is guilty beyond reasonable suspicion.
      The accused doesn't have to admit guilt. Or else, the Police or the athourities could force you to give a confession and admit guilt by and streamline the guilty verdict.
      Here, it extends the punishment for not reporting the incident to a Magistrate or Police.
      So, reporting the incident, in a way, is incriminating against one's self.
      Like, you commit a crime and the law says to you have to report it to the authorities so the authorities have a easy time identifying the guilty person. Which is in a way, violates the right against self-incrimination by punishing you for not incriminating against yourself.
      Like he said, the right against self-incrimination is written in the Constitution, and such criminal laws can only be made in accordance with the constitution.
      Here, it violates the right against self-incrimination by punishing you for not incriminating against yourself. Which violates the constitution.
      So, either Court declares the law "unconstitutional" or say
      Reporting ≠ Self-incrimination
      The latter is more likely as right against self-incrimination is already more restricted and limited.

    That's not correct what this advocate is saying . Suppose after an accident an injured person dies for lack of medical attention because of hit and run he should face more punishment

    Is this gender neutral? Because I saw a judgement where the lady who caused death due to negligent driving was released without punishment stating she was not drunk. Only fine was levied
