7 THINGS MEN SHOULD KNOW BEFORE GETTING MARRIED: STORIES OF FALSE CASES AND LEGAL BATTLES IN INDIA:
www.amazon.in/...
#lawyer #law #court #lawstudent
All i heard was never get married and don't drive vehicles 😂
Most third class law made by HOME MINISTER
Amit shah is only fit to be a businessman and not a lawmaker
Let's elect him again
reporting =/= incriminating self,
u can just say an accident happened, don't need to say who you think is responsible
Sounds good on paper but irl might be different case
Reporting=incriminating
As mentioned before, 5 years of prison due to negligence another 5 years for not reporting 😂
Looks like over the time who ever informs will be a suspect
Laws are not meant to ensure justice, they're meant to keep the people in line. That's all.
in india laws are meant to entrap young men in fake cases
No , it is not wrong, informing the
authorities doesn't mean self incrimination.
If we read the jurisprudence behind self-incrimination, lord Wallace who propounded this doctrine stated categorically, informing the concerned authorities regarding an offence and being asked to testify against himself are two entirely different things
The act of informing can clearly be used against you
@@sriram8027 since you can't hit and run, you have to be present at the spot until police arrive, if the accident took place in secluded place, no third person is there, then it becomes the responsibility of the concerned party to call the authorities/ambulance.
In the long run it will go in his favour, it will reflect that he is a law abiding citizen.
You can be present at the spot only when local people don't try to kill you.
it was done probably because many people were left to die on the road, who could have been saved if they were admitted to hospital or given first aid. but having said that, Indian mob is very dangerous and there are many people killed in vigilante justice.
BNS is a joke. Macaulay was better than current leaders
Macaulay was right about many things, especially English
Wait why do we even the concept of self incrimination. A person who reports his own crime gets a lower punishment whereas someone who tries to run away should get higher punishment. Are we so bound by the written law that we forget the logic ?
This actually makes sense, it forces the people not to be neglectful
is death in this scenario only concerned with human subject or an animal too.
Sir how can I contact you?
You are awesome. Love your honesty
How is it bad, unless taking responsibility of once own action is bad. In an hypothetical scenario, somebody had just died and the culprit has audacity to flee the scene like a thief!?
Best Law I would say.
Well, here is it:
Have you heard of the right against self-incrimination?
In criminal cases, the accused is protected from incriminating himself, which means he cannot be forced to admit guilt, or take responsibility.
Like, if the police asks you whether you did xyz crime, you can assert the right against self-incrimination to remain silent.
It is upto the prosecution to prove that the accused is guilty beyond reasonable suspicion.
The accused doesn't have to admit guilt. Or else, the Police or the athourities could force you to give a confession and admit guilt by and streamline the guilty verdict.
Here, it extends the punishment for not reporting the incident to a Magistrate or Police.
So, reporting the incident, in a way, is incriminating against one's self.
Like, you commit a crime and the law says to you have to report it to the authorities so the authorities have a easy time identifying the guilty person. Which is in a way, violates the right against self-incrimination by punishing you for not incriminating against yourself.
Like he said, the right against self-incrimination is written in the Constitution, and such criminal laws can only be made in accordance with the constitution.
Here, it violates the right against self-incrimination by punishing you for not incriminating against yourself. Which violates the constitution.
So, either Court declares the law "unconstitutional" or say
Reporting ≠ Self-incrimination
The latter is more likely as right against self-incrimination is already more restricted and limited.
That's not correct what this advocate is saying . Suppose after an accident an injured person dies for lack of medical attention because of hit and run he should face more punishment
Is this gender neutral? Because I saw a judgement where the lady who caused death due to negligent driving was released without punishment stating she was not drunk. Only fine was levied
My problem is what is 'rash' and 'negligent' act ?
Up to the Kotha to decide
I also find it laughable, it seems they have been going through laws made in Taliban Regime
This horse 💩 BNS should be discarded immediately. The most faltu set of hurriedly plagiarised and arbitrarily modified laws.
Indian jaise country main bns jaise law dekh ke lagta hai ki india toh African countries se bhi 1000 saal peeche hai😂
It was a last minute presentation
@@sasuke36571 indian laws treat men like how taliban law treats women
This section has removed by gazet notification after trucker protests all India, ur opinion
The biggest question is who supplies ganja to legislaters
Home ministry is busy
Good morning sir
No Nyaya in BNS
All i heard was never get married 🤣

Khali dimag shaitan ka ghar.
💔
Death of law in this case. I agree with your video that it’s laughable, while being a serious matter.
Since you are a divorce lawyer as well, please comment on taboos like open marriage, partner swaps, and fake marriage of LGBTQ persons.... dual life of people and marriage...
Actually this bns section 106 has no clarity even they don't know what we put in this section it's controversial section...
Law is very deep profession common people don't understand easily..
