Deposition of Nurse in Medical Malpractice Case

- This is the deposition of a nurse expert witness in a medical malpractice lawsuit.
Our client was a 49-year-old man who went to the emergency room after injuring his knee and leg. Doctors at the emergency department did diagnostic testing - x-rays - and diagnosed him with a knee sprain. They send him on his with and made sparse and unremarkable notations in his medical records. He was sent home.
Two days later, he rushed back to the ER. The doctors ultimately have to amputate his leg. Our lawsuit alleged the doctors failed to discover damage to his popliteal artery in his initial ER visit.
We brought the medical malpractice lawsuit against the ER doctors (and a PA) in Baltimore City. After a hard-fought trial, the jury awarded our client $5.2 million.
The client, a very good man, was kind enough to allow us to share depositions from his case to help educate others.

For some odd reason, I find the viewing of depositions in medical malpractice cases fascinating--the hours fly by. No joke.
I like reading the comments. It’s crazy how many people post bias opinions on these trials. It’s a true view into the human psyche.
You can tell immediately when somebody works in the medical field and gets overly defensive for the doctors being questioned.
It’s mind blowing how tribal people are. Evidence just doesn’t seem to matter to most people.
To see the same folks we rely on to save our lives in an emergency act like children arguing over sports teams is just crazy.

Everyone lied in this case except the patient.
I am sorry I disagree with this witness's testimony since I know that one miss by the nurses should have assessed the foot and leg related to the brace and talked to the patient about the signs and symptoms of the mount being too tight, the signs and symptoms of compartment syndrome or when to come back to the ER immediately back to have the leg rechecked. Also, teaching the patient about the need to keep the brace on and the importance of the mount. Discharge teaching is an integral part of nursing.
Discharge nurse lied.
The most significant part of the ER visit for this patient was verbalizing numbness of the foot and coldness, indicating compartment syndrome, which could or could not be accurate. Still, I would associate these statements with the brace or immobilizer. Therefore, I associate the immobilizer with compartment syndrome.
If a proper and real exams were performed the results would have been different. The patient had developed vascular changes in lnee after injury.

"is this a work injury?" is a legal question, not a 'mode of injury' question. You could be burned at work, you could fall, be crushed, lacerated or any number of things. The 'work' question is aimed at ascertaining liability
You can have both a comp claim and a medical malpractice claim.
I reported to the following Pathway Providers (a.)Intake DOS: Dr. Davis, (b.) Psychiatrist Dr.-NP Roseline Makinde, (c.)Psychiatrist Dr. Carter DOS:10/15/2021 & 02/14-18/2022, (d.)Anger Management Assessment, Fred Allen Smith DOS:11/09/2021, Theresa Hullins 03/29/2022 and thereafter; and thereafter; and NP Jennifer on DOS:04/01/2022 was under Egregious Emotional Duress. According to Dr. Carter intentional Malfeasance Psych Evaluations on the most part copied and pasted NP Roseline Makinde's Notes. Dr. Carter also stated when asked for diagnoses as she gestured and directed escorted me to leave her Office Encounter, "I diagnosed you the same as Dr. Mankinde's diagnoses." I confirmed by asking Dr. Carter was that the same person as Dr. Roseline❓Dr. Carter responded, "Yes❗" LATER after O received Medical Records 1/7/2022 and 02/23/2022 Spoliation of Evidence that was Tampered With- Deleted etc.

After watching all these videos, I just don't understand how the plaintiff won this case. I don't have an opinion on whether malpractice actually occurred or not, but as far as from a legal perspective and proof, I feel like this case was well defended. Something must have gone wrong at trial.
You have to remember you are watching just the defense version of the case. Parties don't videotape their own depositions so we can post those.
