  • So this will get mixed opinions
    however 1st day back at work after being ill
    I’m a self employed heating engineer who regularly goes into Birmingham, so I’ve been penalised for allegedly not paying the congestion charge in Birmingham £8 this is not for 24hrs this is per day so if I enter at 11:45pm and leave at 12:15 am that’s £16 to pay , if you may any sort of mistake with regards payment you get fined , the appeal process is non existent you can’t speak to a human at Birmingham council the charge just increases , my bank account shows lots of payments to BCC for clean air zone I’ve also paid over £1500 in fines this year for alleged non payment of clean air zone although my bank account shows a payment but for the incorrect day, I made the decision months ago enough is enough my vehicle passed the emissions test on its MOT so why am I even being charged ?
    Do all the diesel machinery and plant in the city being used for construction pay congestion charges ?
    This Baliff Karl Lewis doesnt play by the rules I showed proof the vehicle was not owned by the company he was chasing , he’s also been to my address previously and divulged sensitive information to 3rd parties in my absence,
    Today I was stopped by armed response police as apparently my vehicle was listed as stolen, after a little chat with the officers who were actually decent lads they removed my stolen vehicle marker agreed it was not a criminal matter and wished me well,

    I remember when Dvla came to the village I live in and clamped loads of vehicles. I went around and removed them for free without damage by disconnecting bottom suspension arm.
    We seen the guy later on and he just laughed

    Yes, it is illegal for private firms to clamp, apart from the police and dvla! Dear oh dear! What has England come to. We're being hit left right and centre as motorists. We pay road tax, don’t we? But no, that is not enough! They want more, more and more!

    Bailiff van was illegally parked on verge facing wrong way to traffic causing an obstruction and creating a visual hazard for vehicles exiting the junction. Where are the cops when u need em eh? Prob a parking ticket caused all that crap. What has global Britain become when working guys have to put up with this each day.

    Clamping of a vehicle on a public highway can only be done by public bodies, namely; a local authority, the police or the DVLA. Normally, vehicles are only clamped on a public highway if the vehicle has no excise licence, parked in no waiting or other restricted area (eg permit holders only).

    From what I see here, this guy is the bailiff, he is not West Midlands Police, the DVLA, or Birmingham City Council. Therefore, he has no lawful authority to put a clamp on any vehicle without a court order on behalf of the city council.
    To get that court order to restrict the vehicle, the debt must be already accepted as a debt by the court, THEN once the order has been made you owe this money for the debt and it goes unpaid, the applicant (Birmingham Council I assume here) must then return to court as required to obtain the authority to clamp the vehicle and claim this as payment or to hold as security, to do this a "claim of title" must be made upon the vehicle by the bailiff preventing its sale or transfer however as its a tool for your livelihood. No court will ever authorise the clamping or taking of tools or anything that prevents you from working. Unless the debt was for the none payment of said tool or vehicle.
    The law makes clamping a vehicle without proper authority a criminal offence.
    Protection of Freedoms Act 2012 s54
    *Offence of immobilising etc. vehicles*
    _(1) A person commits an offence who, without lawful authority-_
    _(a) immobilises a motor vehicle by the attachment to the vehicle, or a part of it, of an immobilising device, or_
    _(b) moves, or restricts the movement of, such a vehicle by any means,intending to prevent or inhibit the removal of the vehicle by a person otherwise entitled to remove it._
    That makes the bailiff have to PROVE he has the authority not simply say so as clamp the vehicle.
    If the law was broken here its the bailiff that broke it.

      There is also the Bill of Rights 1689 that goes back to Willian and Cathrine of Orange coming to Englaand from Holland in a small rebellion and becoming King & Queen of England and establishing the rule of law initiated no debt shall be valid unless agreed by a jury of your peers, etc these laws were created and sworn by our then MPs and even today's MPs judges Kings Queens etc still swear to uphold those rules made to protect the people from the shit they do.
      It can not be revoked either which is why they all swear an oath to uphold it as that's what was written it can not be repealed by King or government its forever.
      Try reading it, and see how much its ignored by laws written today. But Boris Johnson used it in his defence over partygate (the covid garden parties) and won with it. The courts uphold the law even 500 yr old laws.

    Tools of a trade are protected by law. It is illegal to claim or seize a person’s tools they rely upon to make a living. It’s in the court’s act that includes vehicles

      He has clamped the van so it can’t be driven away whilst they wait for the tow truck to turn up. It’s what happens when you don’t pay your bills and ignore the warning letters. All the ‘ I don’t give a fuck’ bullshit won’t get him anywhere unfortunately. There will be only one eventual winner unless he pays his debts.

    These bailiff think laws do not apply to them, they are a high risk to the country and their liability insurance should be sky high to keep them in the business , lawsuits galore get these fraudsters operating as bailiff when indeed they are criminals as they break laws as they wish !     I had something similar a few years ago but managed to push the clamper away from my car just before he was going to click the padlock on the wheel clamp. Did exactly what you did chucked his clamp near his van and I drove off. Never heard anything even though he reported me.

    So good this video, I watched this twice. These jobsworth have to get paid well for to even think bout doing this job. Clean air zones, what an absolute joke, never heard of such crap.       This video content doesn't reveal what he owes money for. If it is for a Fine imposed by a Court then it is absolutely not a civil matter. If it is for a Civil debt then (despite the comic content) some poor sap somewhere has gad their income restricted because this guy owes the money. Always two sides to a story.

    Bailiffs are not allowed to seize the tools of a trade only trade goods. So this van and everything in it was clearly for trade and so the van should never have been clamped.

      @@crouchingwombathiddenquoll5641 We used to have TV licence, and there was different rates for black and white, and colour, but it was all gone by the 80’s. We also used to have to have a licence to operate a CB as well, you got them from the police station but they were phased out also.

    Stupid bayliff is parked across a junction blocking sight of traffic for someone exiting that junction, that is irresponsible and dangerous. Can't see what is wrong with where the work van is parked. Well done gas man, this bayliff is ridiculous and pathetic .

    The Bailiff was acting illegally,as he can't take your van away as you need it for work.
    Your tools is a different matter as your only protected up to £1350 of your stuff for work.
