Therefore, he has no lawful authority to put a clamp on any vehicle without a court order on behalf of the city council. To get that court order to restrict the vehicle, the debt must be already accepted as a debt by the court, THEN once the order has been made you owe this money for the debt and it goes unpaid, the applicant (Birmingham Council I assume here) must then return to court as required to obtain the authority to clamp the vehicle and claim this as payment or to hold as security, to do this a "claim of title" must be made upon the vehicle by the bailiff preventing its sale or transfer however as its a tool for your livelihood. No court will ever authorise the clamping or taking of tools or anything that prevents you from working. Unless the debt was for the none payment of said tool or vehicle. The law makes clamping a vehicle without proper authority a criminal offence. Protection of Freedoms Act 2012 s54 *Offence of immobilising etc. vehicles* _(1) A person commits an offence who, without lawful authority-_ _(a) immobilises a motor vehicle by the attachment to the vehicle, or a part of it, of an immobilising device, or_ _(b) moves, or restricts the movement of, such a vehicle by any means,intending to prevent or inhibit the removal of the vehicle by a person otherwise entitled to remove it._ That makes the bailiff have to PROVE he has the authority not simply say so as clamp the vehicle. It can not be revoked either which is why they all swear an oath to uphold it as that's what was written it can not be repealed by King or government its forever. I had a problem with these melts before...they clamped my car and drove off so I tried getting it off to no avail then my uncle come walking down the street and said little tip lad let the tyre down a little bit should come off so done that and what do you know the little beauty slid straight off..the clamp is now at the bottom of a river not to be used again...went to the petrol station pumped the tyre back up good as new parked the car in the next street and went home to watch the melts return to see no car or clamp made my day seeing the melt standing there with that confused look on his face it was a picture 😂😂😂😂 respect to my uncle 🤜🤛

I had something similar a few years ago but managed to push the clamper away from my car just before he was going to click the padlock on the wheel clamp. Did exactly what you did chucked his clamp near his van and I drove off. Never heard anything even though he reported me.

if its attached to your vehicle and you cut it off, it isnt criminal damage because for one the only people that are allowed to clamp on the public highway are the dvla. You would probably get done for littering for throwing the clamp. Private companies are not allowed to clamp vehicles.

The whole of the UK is being ripped off by these companies, and the water company is just as bad. However, you need electric, you can buy water from Tesco or any other supermarket for cheaper than they are trying to charge,

This video content doesn't reveal what he owes money for. If it is for a Fine imposed by a Court then it is absolutely not a civil matter. If it is for a Civil debt then (despite the comic content) some poor sap somewhere has gad their income restricted because this guy owes the money. Always two sides to a story.
