I'm pretty sure that Nintendo doesn't have a legal right to stop their game being played at public venues, even paid ones. The question has already been settled with music. It's perfectly fine to play someone else's music at a live event. I don't see any reason that the same wouldn't also be true of games. It's just that someone has to challenge Nintendo in court, and not just roll over and take it. Considering there are a fair number of people who make their living in the economy that smash creates, I'm sure someone has incentive to challenge them. Then we can crowdfund their legal expenses, and tell Nintendo to fuck off once and for all.
