Police Patrol stops at my Picnic Table to tell me this isn't my house; Lewiston, Idaho

  • Joe Storm (of www.cityoflewis...) did not receive any caller complaint. He was on patrol at about 9:30am at the Pioneer Park: www.google.com... when he saw me laying on my back on a picnic table with my shoes off. I probably laid there for about 20 minutes before he arrived to enforce this social norm. I'm not sure what law he could have cited me for? Vagrancy? I would have to see how they generalized that ordinance for the city. Would it stick in their courts? It's possible. There are plenty of boot-licking judges who got voted into their positions by homeless hating political groups.
What really gets me burned up (1:58) about Storms reasoning is that when given the opportunity to explain himself to me about the criminal activity that is a problem for this area, it sounds like a lie shaped towards my activity. He targeted me as his distaste for the public. He failed to bring up any past problems in the park that may have led up to his need to discipline me for having my shoes off in a public park.
I got news for you, Joe Storm, you are sucking off the government, burning gas money, using publicly funded resources, shaking people up and more on behalf of the backs of the tax payers. You suck from the government much harder than me, buddy!

Well, I don't consider this a bad interaction. If someone called/reported Travis was sleeping or appeared passed out on a park bench, the officer is required to check the situation out. If the officer ignored it and Travis had had a heart attack, the PD could be sued.

Frank Potter What I think is going on here is an attempt to criminalize being homeless, a trend that is occurring in a few places. Rather than address the problem directly, they try to use these ordinances to keep them from sleeping on park benches or in public places. They just don’t care about the fact that they have no home to go to.
So the police are probably instructed to look for anyone who might be homeless. That’s why you get the statements that it looked like your eyes were closed, and asking about the bare feet.

I show them my medical mj card and they didnt even bother looking at my oils setup which I offered to show them they said naaa. They let my friend off on the beer. I fell asleep while hanging out a ground level window at my sister's house in a nicer neighborhood of the Salem suburbs. I had a tough day the night before after receiving a medical procedure. I was laying my head on the window ceil and had done that during the night so that I could have a smoke with out having to fully dress and go outside and to not get smoke in the house... The old window comprise. Well after finishing up the smoke I obviously fell asleep while still partially out the window. I was inside my own home, no part of me was dangling out and the window was like 2feet off the ground. A neighbor called police at like 6am believing me to be a burglar or dead or something not good. I awoke terrified because it's a cop for 1, and hes talking so loud he was gonna and did wake up my whole family, and as I was at my sister's house would have pissed them all off at me for getting the cops called and they don't want me to smoke in the house, hence leaning out the window in the middle of the night. The cop understood the ridiculous nature of the neighbors calling 911 for a neighbor asleep in the house, and he was cool about it but he woke up my whole family and I was immediately bitched me at for something they never smelled, didn't bother them at the time I did it and hurt no one. But that neighbor that called must have a really sad and boring life. Who calls and emergency line over a guy alseep in his family's house

I am torn on this. One the one hand, I have no issues with a police officer walking by to see what's up. Yes, in this instance you were just chillin' and airing out your feet. But the park by me always has druggies and drifters hanging out there and my kids don't like going there. I always hear them talking about the "creepy guy by the swings" or "the woman wearing a trench coat" in 95° weather throwing up in the trashcan. Me and several other families will go through the park every Saturday cleaning up and repairing things to keep it nice. We even power wash all the benches and playground equipment when they need it. So yes, I want *EVERYONE* to enjoy the park. But finding whisky bottles, empty cigarette packs on the ground, etc. sucks. And here's another little observation I made: you are very combative, talk in a very disrespecting tone and are sarcastic just about the whole time. If he walked up and ask you how you are, just tell him what you're doing and show a little deference. Man, you'd be amazed how just doing those two things will lower the tension level and grease the friction. But you don't. You get all bowed up and flexed like a tiger about to strike. I try to put myself in the cops shoes and I can tell you that I would be a little pissy with you too. Contrary to what you believe, it's not all "us verses them" all the time. That is enough typing.

@Gutta Beezy I bet u want give me your address and call me a dumb ass. Look I've been harrassed by cops most are ass holes. But this guy was obviously trying to be a pain in the ass. Hell people like this is why they take shit out on people. This cop actually was pretty damn nice and respectful. Cops are allowed to ask if you're ok! That's the time you say yes iam fine. Now then if the cop says can I see you're identification? Then you can say he is harassing and looking for something. Hell I dont like this video because it's so fucking pretty. I wish this was how cops acted. Instead they walk up ask you what you're doing , what you're name is, do you have an ID . So they can run you're name. Then when they dont find anything they start purposely trying to provoke you. So they can body slam you or taze you then arrest you. But in this case the cop is simply asking the guy or you ok? Not what the hell do you think you're doing like most would. Then this smart ass guy instead of just giveing a sright foward answer. Thought he would take advantage of the conflict with cops at the moment and get him a few minutes of RUclips fame. So he purposely argues with the cop like some know it all citizens rights activists or some shit. Its these (DUMBASSES) that make the real harrassment cases not took seriously. This cop litterly put up with this prick who probably has some (iam privileged attitude) for a while and never lost his cool never got smart and was professional the whole time. Plus never once asked for an ID or anything. Iam sorry but for one a picnic table is for eating on. Not sleeping on. So if you see a man sleeping on a table in a park most people would think to there selfs " man I wounder if that guy is ok" but being a police officers job is to ( first perfect and serve) he is supposed to check on someone sleeping on a device that is not the normal thing for people to sleep on in public. Hell if that guy was drunk or high and overdosed on that table and people would have known that cop seen him but never checked on him. Guess what????????? We would be watching a RUclips video how ( COP SEES MAN LAYED OUT ON PICNIC TABLE AND DOES NOTHING TO CHECK ON THE MAN) thin the follow up story would be ( HOW DOES A COP WHOS JOB IS TO PROTECT AND SERVE. SEE A MAN SPRAWLED OUT ON A TABLE AND NOT CHECK ON HIM) then the family would say the police department owes them an explanation for letting there family member die. How can anyone see some one laying in the middle of a park on a table and not at the verry least ask if there ok. So stop with the petty ass bullshit. The people that are a (DUMBASS) like you are really starting to reach for shit now. Call out the ones doing the real harrassment. You're takeing away from them. Really bro! If this is harrassment then God be with you. Because there is no were in the world you're going to find a cop ( harassing) someone as little as this. P.S.- YOURE THE DUMBASS.

This guy, whether he was a resident enjoying the day or a transient enjoying the day, was or had recently been asleep across the bench by his own words
You can hear him yawn and deep stretch at the end.
If the officer was being disrespectful, rude or aggressive then I’d see more of a problem
Also just because something isn’t violating a law doesn’t mean that it isn’t violating a ordinance or lesser city code
Community outreach and protecting the public interest is supposed to be part of an officers duty
Anyone who wants to see a glorious utopia where the cops are always evil douchebags that are out to harass the innocent, where the public prefers minimal police interaction yet are furious when the police aren’t fast enough to arrive and where druggies, homeless and “free inhabitants” bring down the integrity of entire towns, I encourage you to visit parts of San Francisco, East Oakland, Eat Palo Alto, Santa Cruz, Central Sacramento and Berkeley
You’ll love all the trash and drug paraphernalia in parts of these towns, all the people asleep on the sidewalk and all the tents in what used to be at least decent places to bring your family for the day.
If this guy was homeless, there SHOULD be places ~in town~ that could attempt to assist him in life and get him back on his feet including temporary housing, job training and job placement assistance in addition to any counseling that a person MAY need if applicable, and if he isn’t homeless then he has no reason to be an asshole to the officer in the first place. Just talk to him and get the situation sorted out real quick and move on
Officer didn’t even ask for this guys ID (insanely common just to make sure the person isn’t wanted on any warrants or anything) officer just tried to see what was up with the (recently) sleeping ?transient? and trying to help keep the LC Valley from becoming the next Berkeley, CA or downtown San Francisco... or New Jersey... or Chicago
I’ve been approached 2x in my life for suspicion. In New Jersey waiting for my friends uncle to move a piano, and once in Davis, CA for walking around my friends apartments parking lot for a looong time
Both times police explained why they were there, I explained the situation and they set off on their way satisfied that I wasn’t(edit) casing the area
Simple and civil. Life often is, even if we are tried to be shown the opposite

I agree that that there are far too many examples of cops being assholes for no reason... are you saying that this is one of them though? Cause this one, like plenty of others didn’t give me the slightest feeling of that.
I’ve encountered 2 jerk/asshole cops (different from my “suspicion” encounters) but I’ve also had numerous interactions with cops just doing their jobs (traffic stops, at events, etc) that were just decent people.
Most cops aren’t cruel power-lording jerks out for a superiority fix. The ones that are need to be dealt with and I’ll always side against them, but what about this officer was so wrong? When did he give the man an attitude or restrain him?

It actually looked to me like the officer was trying to leave and the person filming kept him there asking silly questions. Picnic tables are not cots, and should not be slept on. Plus, with your shoes OFF? People eat on those things, that is nasty! And I also think it is great that a police officer would check on someone lying on the ground, or a table, or even a lawn chair or ANYWHERE for a long period of time. We all hear stories of cops AND civilians who walk by somebody passed out or dying on the sidewalk. Or stories of bodies lying in a place for days before someone realizes they are dead!
And how the $#%& is the cop supposed to tell if your eyes are closed from as far away as his car was? ''Well you're lying already!'' Oh, heavens no, you were not trying to start any trouble! Stop being so damn belligerent, the cop had a reasonable cause to check on you. You are just proving you are a jerk to cops and it is that kind of behavior that can put a cop in a bad mood he MAY take out on someone else. There are more good cops than bad ones, the news just rarely reports on the former. If a regular joe walked up and asked if you were okay, would you have given him attitude? That is all the cop was doing, and as he did not even come near you, I don't see why he owes you ANY explanation other than the perfectly good one he gave.

    • @miller17013
      @miller17013 6 лет назад

clearly if he wanted to give him trouble or cite him or make an arrest he could of easily just kept asking him question or for his ID this guy would of clearly got irate and give the officer cause to arrest him instead the officer didnt even ask for his ID which if he look out of place he has a right to ask for since as he said it is a problem area and he is allowed to check to make sure he isnt in the system, has warrants, or a sex offender but clearly the cop would be a better person if he just let these people do drugs and scout children how dare he do his job.

With the above said, how does a cop get away with such a thing when he's got a body cam? Well, how does one know it's on or not, no indication from what I see of it being switched on at all.

Mysterious Ways the analogy of the black man is not correct, for this would have ended somewhat differently. A taze here, a fist or two there up side the head, a legal neck chokehold, a resisting charge, injury to officer charge, some drugs mysteriously appearing from the ether charge, an interference charge and the biggie armed charged, because more than likely a black man would be armed, they generally have at least two. One on the left and right sides of their torso. 😉 Be safe.

thumbs-up defender's How did anything Ken said give you the impression that he is a liberal progressive? I'm pretty damn Conservative, but if I'm out in the park my taxes pay for and I'm not disturbing anyone, I don't want some pansy bootlicker to disturb my time off!

thumbs-up defender's wow...that escalated quickly! Your labeling him “a bum” started it. How do you know what Travis was wearing? Answer: YOU DON’T. So shut the fuck up, pea brain.

Yeah I don't want the government messing in my life especially with my free time. What the hell is political about that? And if by some stretch one carves out a political niche for this situation then it seems more conservative than anything else.

JusticeAA and once the nosy cop saw that he wasn’t dead he had to keep making snide comments about him having his shoes off. Pardon me? I’m in a park and want to take my uncomfortable shoes off for a few minutes kick back and enjoy nature? What makes that something that a cop feels the need to hassle a person about.

The officer was checking up on you. People do more than nap. Sometimes they die! If you lost consciousness due to a stroke or heart attack he might have saved your life.

Ok, I live next to a park. Literally, I view the park from my (apartment) bedroom window. We have had the occasional homeless person or people park in the apartments lot and sleep in the woods, then hang out in the park throughout the day. A couple of them were severely strung out on heroin or meth and we have a lot of children in the neighborhood. I personally feel law enforcement needs to let these people know they have noticed their presence and let them know that they will be checking. It's sad that we have to worry about the safety of our children this way, not to mention, worry that they could be watching for theft opportunities. Our car's catalytic converter was stolen in broad daylight by one of these guys. He was caught trying to sell it to a shop.
I don't believe the officer was out of line, but honestly, the guy posting the video was being a pretty obnoxious a-hole, in my opinion. I know some officer's get full of themselves, but most typically, these are good men and women who have chosen this line of work to keep people in their neighborhoods, safe and help people in trouble.

so if a guy and girl are lying on blanket in the park together no problem. But if your there by yourself then it is a problem?

You might be a homeless menace to society. Cops spend a lot of time & tax payer dollars pushing homeless people out of sight.

This wasn’t a big deal. He was literally just making sure you were ok. You’re the one making the big deal out of it. That’s the problem with these videos. You act like a victim and then start making remarks towards the police. He was walking away and you started saying your unnecessary comments when he just said he was just checking to make sure you’re okay. Grow up dude.
