We had an area near where I live that went crazy with speed humps. Someone tried fighting the council over them with a big petition, but they ignored it. Come the local council elections for the local wards and the OP decided to stand as an independent candidate with the primary goal of removing the speed humps. Anyway, he won. The two main parties were now in a tie for how many seats they held on the council ( who controls it ). The only way that they could get anything paid for or voted in ( including budget etc ) was to offer the olive branch to the one guy who could then swing the vote for them. He was approached by one of the main parties. He asked " are you gonna remove the speed humps? " they said no. The other party then approached him and he asked the same question. They said " it's not as simple as that, we've got to do this and this and this, and then maybe we might be able to do something. Can we count on your support when it comes to the voting on policy, budget, expenditure etc? " He said " No ". Our local city council was f*cked. Neither side could agree on anything. All the city council run facilities ground to a halt. He held out for 3 months. Eventually he was approached again. " If we remove all the speed humps, can we count on your vote during our time in office ". He said " Put it in writing first, then remove the speed humps and then we'll sit down and talk ". They sat on that for 2 more weeks and had no option but to cave in. He got the speed humps removed and in principle, he kinda said he may or may not consider voting in their favour for changes they may make, providing he converses with his voters and they were Ok with it. They had no choice. He did help vote through a few things, but to be honest, he wasn't really interested in the tedious stuff, he only got elected to get the speed humps removed. When they tried bringing in bigger changes like putting up the council tax, he said " NO ". When there were other changes that needed to be made but not as drastic, he reached out to his voters and used the majority rule from them to determine whether he would support or reject proposed changes. His one seat on the council caused chaos. Top bloke.
the speedbump one at the end... technicly, when a speedbump is made to be a hazard, it becomes a liability by law. speedbumps can only ENCURAGE you tro slow down. but if they FORCE you to or risk breaking your vehicle, then the one who installed them is liable. what if an ambulance needed to get in there to pull someone out in critical condition. those speedbumps could have resulted in not only further injury, but could easly damage an ambulance
That's one reason why I doubt the story was true. Speed bumps that bad would be deemed an unacceptable hazard to emergency services at least, and the HOA would have been forced to change them, at a minimum, if not fined for the hazard on top of that. I find it odd that nobody seems to have thought of notifying someone like the fire department about the hazard to get it condemned. Also, selectively applying any law or rule isn't legal. Any fair judge, presented with evidence that the HOA is not attempting to enforce a rule universally on all members, would rule "easement" of the restriction. The HOA would lose the case and in order to enforce it in the future, they'd have to both inform all members that it was going to be enforced, and give them sufficient time to comply, and only then could they begin to enforce the rule again.
I think the lawyer could just include in his discovery to the defense, a list of cases he researched and the rationale of the manager that defense must bring this issue up to dismiss. Any defense lawyer worth his salt would review the case law and write a motion to dismiss. But honestly that manager needs a dressing down on its a waste of taxpayer funding and honestly only penalizes those who cant afford decent representation, plus further penalizes the parole with a financial hardship as they must have a lawyer draft more motions, costing them money.
Story #1: That Rep had no business telling OP to not do something someone else told him to do, OP should have told his new Boss what happened and watched with satisfying glee as the Rep was thrown out of the Office.
Story 2: Goes to show you that the justice system is not just at all. The lead prosecutor was perfectly happy with allowing this person to twist in the Wind
Have a park near me where for the last 7 years had several permanent speedbumps and one larger removable one. Since I go there on a near daily basis for reasons ( Pokemon Go) I noticed every fall they'd remove the temporary bump and by the second good snow the " permanent " bumps had been removed by the plows. Every spring they'd put them all back and rinse and repeat. Finally I guess the town must have finally noticed a pattern, did a traffic study and realized nobody was using the park as the through road or raceway and last spring just removed the sad remains the plows had left and didn't bother to reinstall them.
I think that’s why the trailer park my brother lives in just has the removable ones so they can remove them to plow. Which is probably far cheaper in the long term than repairing them every single spring
Prosecutor's story, he's got his head on right. His job is serving Justice, his boss however ought to be fired. He's a I want to win regardless of the cost type of person and the type of person who gives prosecutors the "bad name" that the OP was worried about.
I'm pretty sure that if this isn't a gated community of an HOA then they would have to obey the cities ordinance for speed bumps and their speed limits too. Also I just said that towel on fire that gave them attention that they needed to clean the driveway and have a nice burn spot.

I think the other cases are considered precedent and openly available. It's not evidence gathered by the state.

But long high speed bumps are unnecessary
