I've had them ask to search my vehicle at least three times when being pulled over and I say yeah, you can search right now. Then they say no don't worry about it and run my license and move on. I also don't look very sketchy though. I don't usually carry anything illegal though but one of those times I was underaged with a bottle of liqour in the backseat...

The police do not need consent in order to conduct a search under Terry v Ohio. The fact that the individual is lurking after hours in a high crime area at a store that has been repeatedly burglarized would give them reasonable suspicion.
He had the right to refuse a search. Was doing nothing illegal.

You don't need to do anything illegal to be detained. Officers need to have reasonable suspicion, and you may be found to be doing nothing wrong. That's literally the purpose of a detention.
He was loitering around closed businesses which was reasonable suspicious, ergo reasonable suspicion for a detention. He then gave consent to have his property searched. It's not that hard.

Then hours of time gets wasted being detained while they get what they need to go through your stuff. Then for making their job's "harder" you might get some of your stuff destroyed during the search. And you go to jail anyways. Would it really be worth it? Saying "i dont consent to a search" to an officer is basically you saying "i have drugs and i dont want you to see them"

If you decline a search they generally call a K-9 unit to sniff you out.

Had a similar situation when on a run late night and was cutting through a supermarket plaza at 1am. Bright white tank too running shoes and gym shorts sweating. When they asked me if I had a problem with a pat down I said if Im not free to leave he better go call his Sergeant. Dude then asked if I had been smoking because he could smell some pot and told him if he truly smelt pot hed of been patting me down already. We settled on him taking my social and running me and letting me go. I figured it was not worth the trouble.

All he had to say was no you can’t go in my bag. You may pat me down for weapons. And he would’ve been on his way .but the police will bully him into a search. Happens way too often
They didnt even have the right to pat him down, as that's only done when they have reasonable belief that a person is armed and dangerous. And he presented no threat, so if they went to court, the meth and paraphernalia would be thrown out. But the police asked his permission, they werent bullies about it. And he complied without coercion so there is nothing wrong here.

My bf & I recently got pulled over at 1am and he got a ticket then they asked to search the car, which we did not have to allow them to- but did just to prove we aren’t into bad stuff. That search took 40 mins and the cop looked disappointed as he walked back up to us and said have a safe trip back to st Pete lol but in all fairness we did get pulled over in Polk county fl 😂

Didn't seem like there was any probable cause on this one.
Man loitering on private property, burglaries in two businesses where the male is at, male claiming to be looking for cigarettes then said he's exercising. That's reasonable suspicion to conduct a stop, at that point in time you're being detained. You'll be frisked for weapons which is legal on it's own. Then you bring in the above facts, and that's your probable cause to search his bag. Not to mention consent was given so probable cause isn't needed.

@@alyssamurphy7792 you are right. They are required to get consent whenever they lack probable cause. If they have probable cause they won't ask your consent. Always refuse because your defense attorney can review your case and get it dismissed if the officers lacked probable cause and you refused consent thus established that the search was illegal and all evidence obtained must be thrown out.

@@alexis_dc2 you can but usually they will try and chase you down and if you doubt stop you will catch a charge. For example if you are riding in a car and get pulled over ask if you are free to leave. You could dodge a charge if they let you walk off on foot.

I was power walking at a random neighborhood the other day and noticed two cops patrolling the area. Funny how they didn't stop and search me even though I didn't live in the area. This was at 12 am. Odd time to be walking. Probably because I wasn't wearing booty shorts and a wig.

Theres mounting evidence that people who use illegal drugs make poor decisions. Drug users are even known to commit crimes to feed their addictions....there for, the cops profile and chase drug addicts around.....

I do have plenty of friends and family who are addicts and some have gotten locked up. some cleaned up out of fear, some met new plugs, some are dead because they wanted to keep using. the point is there has to be a more effective way of treating addiction than just throwing them in jail.
