My neighbor upstairs renovated their bathroom and they put a overflow drain pipe with holes in them which caused a water leak and damaged my bathroom ceiling and the wall. Who is responsible for the damage in this case? The guy upstairs keep saying it was an accident and he didnt know and it is not his business that my property is damaged. How likely is that his insurance cover my damage and who’s responsible in this case?

For the drywall it would be the Association responsible. Any personal items you should put thru your own insurance.
If it's not that much it might not even be worth filing a claim.
Try to work out with him the personal items would be my suggestion.

Where are the pipes located? If you are living in an association as you mentioned more than likely they are responsible not you. If pipes under your kitchen sink or bathroom sink you could be responsible in that situation

This is in between my floor and cealing in the lower apartment they are saying the white pipes inside the fealing is my responsibility and the metal pipes are there responsibility

@@gazalakhan6484 if between your floor and ceiling ask them how In the heck are you responsible for them? This doesn't even fall within your responsibility. Anything below your floors, like subflooring, is the condo association responsibility and so is the ceiling. This makes no sense. Of course, maybe your state is different but most are very similar to Florida.

Am in a condo in mississauga,Toronto,
Canada and they are telling me the same thing that the drainage pipe under my toilet in the ceiling just below my floor where the water from my toilet flows it's leaking They are saying am responsible to fix the leakages damage it's caused In the ceiling below even though that drainage pipe is below my condo washroom floor
When I didn't have any access to maintain it in the first place ?
