    Thanks for the video. You say that you forget that you are a torts professor when grading but also say that it is unnecessary to state the burden of proof because it is obvious to you.
    Trying to figure out the level of analysis professors expect is very frustrating as a first-year student.

      The more analysis the better. The challenge for most is a time limited exam.

    Hello,
    Thank you this is invaluable as a 1L going into a final examination in under a month.
    I'm curious if this was an open book or closed book exam. If an exam is open book (mine is), do you recommend citing more sources and case law or even including short quotes from certain justices? Thanks!

      Not enough time for quotes or cases. Spend your time applying facts to law-that takes time.

    I put everything under subheadings. I tend to write a lot, though. Ended up with an A for midterms so I must be doing something right.

    I'm a random guy, too old for law school, but love law. So I've been eating up everything I can find... is law school material a decent source to "how the actual law works"? Not sure if my question is clear... anyhow. Love your videos.

      Law material helps to understand the content but not really how law works. You get a small sense of how the law works from reading some cases.

    13:30 Professor, It isn’t clear why this answer is better than simply citing the “but-for” test. One of my professors told us not to do this or explain to them that we know the law, and that it can actually hurt us on an exam. I know everyone grades differently; but there are an immeasurable amount of rules a student can explain which are irrelevant because they don’t apply…

    Perhaps my memory is fading, but it’s not this the same scenario you examined when grading a prior essay? If so, which response was preferred?

      Great memory! Yes, this is the same essay. I did it a second time, as many viewers don't examine the library to find older episodes.

    I have a question: what are all those books behind you? I see some law firms with lots of similar looking books. I'm not a lawyer, reason why I'm asking. Also, why do lawyers have all those books? Thanks.

      West Publishing has published cases from around the country. The particular series behind me is the Pacific Reporter, which has cases from some of the western States.

    There are no case laws in the students answer, such as those relevant enough to apply the law as were being decided by judges in similar case or legal Principles mentioned in the student's answer.

    okay, so how many points did this exam question get get? was it like 12 out of 15(maybe) ( -1 for land possessor, and -1 for not recalling respondeat superior, and -1 origination on that section, or some other value.

    Im so confused do I write a essay or memo they never taught anything about memos before and no college is open to help with tutoring etc.

      You need to talk to one of your professors and get some guidance. Also, most people are confused initially--the more you practice the better you will get at it.

      on the article because I think the article may potentially raise a few interesting legal questions.

      Learn Law Better yea, My Father is Federal Judge, and I had just shown him your video about how professors grade Exams. The fact of the matter is that you may have a carrier court reporter with 30 years in the court room, and knows the law as well as the sitting judge, but a law professor will have a teacher assistant fail them because they don’t include “ key words “ in their essay.

      @@Learnlawbetter Do law school professors assign alot of written work like the professors do in college or in a graduate program in a discipline such as English or History?

      @@davidsoto4394 Law school professors, except those in skills courses, assign no written work. This means that in most classes, the only assessment is one final exam at the end of the semester. I don't like that approach since it doesn't provide feedback to students.

      @@davidsoto4394 Over the years I've taught different courses, depending on law school needs. Right now I'm teaching Estate Planning, Federal Income Tax, Wills & Trusts, and Business Taxation. I've also taught Torts, Contracts, Civil Procedure, Criminal Law, Criminal Procedure, Advanced Torts, Business Torts, Products Liability, Business Associations, and State & Local Taxation.

    Comparative neg. and Contributory neg. is a discussion to have under Damages. The time factor stress got to them. (Time + Test^x) • Law School = Stress 🤓

    Professor, would it be unlawful discrimination if a college student who had a disability who tried to apply or applied to medical school were to be denied admission to medical school only based on the fact that the student might not have the manual dextarity or physical strength to do tasks like CPR, intubations, or administering injections? I am asking because I guess that these are things that medical students learn about ,and I would imagine they might get tested during medical school, and I would imagine that medical students are expected to do these skills under the direction and supervision of their professors during medical school.     What about negligence to not to apply the right way and law against an abuser white employer or person because of his status , And is that negligence, corruption or conspiracy against a open case 🫵🏻? ? ? ?
