    • @mattengland653
      @mattengland653 Месяц назад +8

      Fortunately for victims, that is not how alibis work Duke… a LEGAL “Alibi” is defined as PROOF that you were somewhere other than the point of interest at the time of interest that reasonably puts doubt about your ability to have committed the crime. This also, more importantly, needs to be corroborated through witness testimony and or physical/verifiable solid evidence:
      So in short - legally, to say “oh I was just driving around all night because that’s what I do” but yet there is no one to verify that’s “all you did” etc. is equitable to having NO alibi at all…
      It’s like saying “I went to work all day” yet no co-worker at said work, no customer/client/prospect/video etc. can concretely back that up - that is the exact same as having no alibi at all.. a judge will not allow that - he has NO alibi

    • @dukemetzger3784

      @@mattengland653 thank you for that, but that is what I was referring too, smart or not, if he wants to say that was what he was doing, then I guess its the same as him saying he has no alibi. I understand how stupid it is, but if he wants to stick with it, how can a judge force anything else. Honestly, I think this ploy is just a way for him to not have a provable lie. But regardless he is going to look real bad if he doesn't have that alibi.

All he had to do was leave his phone somewhere before doing the dirty deed then picking it up and driving around with it after doing the deed. They cannot pinpoint the exact time of death that accurately, so this was his attempt to cover his tracks. All Hyundai Elantra models after 2013 have the little black box inside. First of all, “innocent until proven guilty” is stupid in 2024. When that was written, cameras didn’t exist yet, neither did science the way we know it today. You had to treat people as though they were innocent because there was no legitimate proof. Now we can see a video of a school shooter or bank robber or home invader, so we know they are guilty before they are convicted by a jury and “proven” guilty, so let’s not act stupid, as if common sense evades us. You’re guilty once we have proof, and you’re not innocent at all, or you wouldn’t have gotten mixed up with police in 2024 for a case like this. Science doesn’t work like that today. Sorry. So it’s not innocent until proven guilty. He’s guilty.

    All they have to do to take this news muck and turn it back around from the vise versa they are trying to hash is figure how long his phone was off. And if it was enough time to commit the murder?
    And what about the knife?
    He bought a knife off Amazon supposedly. So where is it?
    Did he sell it, if so to who?
    Someone would have stepped forward being the profile of this event.
    And if he sold it on the internet then where is that to follow?

You drive 10 minutes its nothing but mountains, trails and the sky. With the cell phone thing, my cell service would go out in locations while driving(because i drove those same roads everyday) and my cell service went out 20 to 30 minutes in some locations. How can he NOT use his alibi in his own trial? That seems absurd. If he has no other alibi, what is he supposed to say? Just lie? I mean, innocent until proven guilty here right? We seem to forget that. Sure I think he did it, but we still have to presume his innocence until trial. What if for some reason he DIDN’T do it and that IS his alibi? Just driving around? And that judge could possibly not let him use his true alibi? That’s absurd.

    • @Jeffswife4life
      @Jeffswife4life Месяц назад

      I think what the judge wants to know is exactly where he was at the time of the murder. Driving around? Okay, where? What time. What about witnesses seeing him and providing testimony to prove that alibi. There is no way he didn’t know exactly where he was that night. No way at all. He knows exactly where he was. I’m sure everyone in that area know exactly where they were. It wasn’t that long after the bodies were discovered. It’s not like it was weeks or months after. If you don’t know what you were doing even in a 24 hour period you should get your brain checked. That’s just crazy. They want to know exactly where he was. Period. I was driving around is unacceptable. The whole thing is just nuts and I feel awful for these poor families. Let’s get on with the trial so we can see the evidence and hear the testimony of witnesses. Then we will see what it’s really all about. If he’s innocent then it will come out. If he’s guilty it will come out. That’s how these things work. And yes some people get wrongfully convicted. But this won’t be the case here.

    No other prosecutors /judges in any other cases NEVER asked for any writte alibi from the defendant before the trial. .. this is very sus, seems as the prosecutors do not have any evidence of his guilt , and they try to make up something out from his alibi before the trial. To ask defendant for alibi before the trial is the violation of Defendants' rights bcz prosecutots haver to provie by themselves if he is guilty or not . This is the weak case
    This is the first and only one sus case when prosecutors/judges are asking for aliby before the Trial and destroying the crime scene _ the evidence- before tha trial> Kohberger is innocent.
