    Dashcam driver is in a line of peak hour traffic and the traffic stops blocking the path of an AUDI driver trying to turn right!
    The dashcam driver first of all realises there is no KEEP CLEAR markings and is trying to turn right approx 20 meters up the road but traffic stops and the path for the AUDI is blocked from turning. The audi becomes aggressive almost immediately, at one stage the dashcam driver starts to reverse and the driver continues to toot so the reverse is aborted!

      Exactly. I do this all the time, so much easier than having to cross 2-3 lanes of traffic especially when its peak like this.

    Audi driver thinks his shit don't stink and he owns the road he's on a stop or giveway sign therefore he has to wait untill the road is clear in front of him not expect you to make way for him.

    I used to live a few hundred meters up the road, it’s a horrible intersection. I used to avoid it where possible. Having said that there was no need for the Audi driver to be on the horn, that was totally out of line.

      That's right. If it's a horrible intersection, you can just avoid it. If you don't know it's a horrible intersection, then you just have to suck it up and avoid it next time.

      I've lost count of how many times I've been through there. Stresshead AUDIot had a few choices to avoid trying to get out of there. Not too switched on, if they're a local.
      AUDIot would have better served themselves going the other way, turning left onto French Street, left around the bend into Jellicoe Street to a set of lights at Cavendish Road, then turning whichever way the like from there. Alternatively, right onto French, to a set of lights, turn right onto Old Cleveland Road, through the lights at Cavendish Road (can't turn right), turn right at the next lights into Harries Road, right into any of the next few streets, back to Cavendish Road. Either way would be way quicker & less stressful for them.

    Sometimes the cards don't fall the way you would like. There's no point having a tantrum. If that situation happened all the time to that driver, they could simply go a different way. There are lots of options according to Google maps.

    I always leave the intersection clear even if theres no signage, but the Audi driver was rude and happy to block trafic as well so, fair bump play on.

    As there was no Keep Clear zone on the road, it was plain rude of the Audi driver to push their way through and lay on the horn.

      Intersectons don't require a keep clear zone - it's a road rule that you don't enter an intersection when your exit from the intersection is blocked.

      @@wandpj unfortunately that’s just completely wrong. It’s a T intersection for the Audi. They are required to give way to all traffic before entering. The DC driver is under no obligation to give way. The way you can tell here is the lack of give way or other signage directing the DC driver (or other drivers on the road) to do so. Too many people assume everyone else has to give way to them when entering a road.

      @@visiontime6260 No, it's actually completely right. Queensland Road Rules s. 128 says, "A driver must not enter an intersection if the driver can not drive through the intersection because the intersection, or a road beyond the intersection, is blocked." The rule applies to any vehicle at any intersection, regardless of whether it has right of way.

    I tend to let people out by sitting back, but that road looks to busy at that time for a right hand turn. I’d have turned left and worked around. Regardless, in the absence of a ‘keep clear’ zone, you can’t demand to be let out, you can only hope to get out if it is clear. The Audi seems entitled, and rude. If you let him out he’d probably have hit a car coming the other way.

    Entitled Audi driver, not poor road design. It would be lost on the Audi driver that he pulled into the intersection from his stop intersection, blocking the left hand lane and expecting the dashcam driver not to block his/her path. Stuff them.

    Yet again we have different rules for different states in Aus. That rule of keeping these intersections clear when you are on a major road, is idiotic and causes so many accidents. If you have to keep all these intersections clear, the panel beaters will be over run with work and the govt corporation will be rubbing their grubby little hands together with all the fines they are going to collect on.
    If the road you are on is a terminating road, then you should not be able to proceed unless the way is clear both ways. Expecting to be able to push your way into traffic is not 'the law' and nor is it covered by insurance. In WA, not much of this exists. There are some instances where intersections have been marked, but the rest are unmarked and when there is a traffic build up, it is tough luck for the cars on side roads. They have to wait till the traffic clears or if a generous driver allows them in front of them, which is what normally occurs.
    Clearly the Audi driver is an impatient and entitled driver thinking he/she can just barge into an intersection and force their way across and everyone on the road must obey their command when they beep their horn. Seems that Audi, BMW and Merc drivers are the most obnoxious and aggro drivers on the road. They always seem to think they own it and can break any rule or law at will and think they are not to be held to account. I'm glad this guy stood his ground and only moved when the traffic ahead moved.

      @@johnnichol9412 In all my years of driving in WA both metro area and country, that rule you have quoted has never been used or even exists, as far as I know and I have driven to a lot of places in my state. If there is a main road and the traffic is heavy, then it's bad luck for the side roads. They have to wait till the traffic is clear. If you expect there to be big gaps left for people to enter and run the gauntlet thus causing an accident, then your traffic jam that is already hundreds of meters long will end up kilometres long. This is probably why it is not enforced or simply doesn't exist here in WA. Keeping open intersections for a terminating suburban road, on a main road, is idiotic and will only cause accidents, which we see hundreds of videos of on youtube.

The cam driver could have been courteous and let the audi out but the Audi driver is at a stop sign and must give way and has illegally blocked the traffic.

    When I leave my gas station, I got the same issue:
    It's a two lane inner city road and I want to go right (I am from Germany, so for Australians, it's like going left and think mirrored from now on).
    Speed limit there is 70km/h and in Germany the maximum speed often is the advised speed aswell, if there are no special conditions, like ice or fog for example.
    Many times, the only cars driving there are driving in the right lane. In Germany we something like a "Drive Right Demand", but not in Cities. Many people don't know this or don't care.
    The left lane is free and in those cities with multiple lanes, you are allowed to overtake from right aswell. Even if there would be no such thing - what is stopping you from beeing thoughtful and nice to other people, if your actions don't have consequences for anyone else?
    If every car is still driving in the right lane and don't let's me out, I start honking aswell, from about the 3rd car on (only if the left lane is free and they can change lanes).
    Here comes the funny thing: I am not in the wrong with this.
    German law also demands completely unsepcified, that you always have to drive thoughtful, defensive and social to every other traffic participant. Long story made short: You can be juristically correct and still be in the wrong. In this case, as I already asked previously: What stops you from driving in the left lane there and let me out? Nothing - exactly! So in fact, I can even go to the police and denounce them for disregarding unspecified traffic rules (which results in something like "blocking me in traffic").

    In the interest of traffic flow, it was an opportunity for the Audi to get a right turn without having to contend with traffic flow from his right ... I would have left him a gap & even given him the thumbs up if his way was clear. All that is hypothetical if you're going to be a dick and get on the horn though. People need to keep their emotions in check.

    not an intersection, its a side street that converges on a main road. The main road doesnt have to yield to traffic entering from the side. The entering traffic must yield, especially given theres a stop sign. Pretty sure audi guy would get KO'd by highway patrol if they saw him doing that. Given he drove through his Stop when it was not clear and then proceeded to block traffic.

      It very much is an intersection, and rule 128 says you must not block an intersection. Audi was discourteous with the horn, but DC broke rule 128.
      "intersection" means the area where 2 or more roads (except any road-related area) meet, and includes-
      (a) any area of the roads where vehicles travelling on different roads might collide; and
      (b) the place, other than a road-related area, where a slip lane between the roads meets the road into which traffic on the slip lane may turn.
      128 ENTERING BLOCKED INTERSECTIONS
      A driver must not enter an intersection if the driver can not drive through the intersection because the intersection, or a road beyond the intersection, is blocked.
      Penalty-
      Maximum penalty-20 penalty units.

      @@lesstockley4937the signs are clear, there was no obligation for the DC driver to give way. In fact it can be extremely dangerous for the Audi driver if someone does give way because the oncoming traffic may not be able to see them.

    Considering the break in the line is on the entrance to Kitchener not the exit, is the Audi driver illegally crossing a solid line? If you go to street view in Kitchener 2 car lengths back you would be crossing a solid line turning right.

      There is a gap for people turning right from the opposite direction, yeah.
      In Queensland, you cannot cross a solid white centre line for any reason.
      So if the intention of the markings is turn left only, then it's badly signed.

    Probably courtesy to not block the intersection...drivers coming toward you and turning need to get through. As for the Audi, probably safer that they couldn't go, as it's almost impossible for them to see what's going the other way.

      That one, in fact, has a stop sign, so even moreso than just a give way. There's also the fact there isn't a slip lane or median for the Audi to safely pull into, and they would be pulling blindly into potential oncoming traffic.

    What is an "intersection?" Where does one begin and end? Are you only required to "clear" an intersection if it's a 4-way or only if it's marked on the ground (as by limit lines or crosswalk markings)? Is there some other way of determining what is in or out of an intersection? Are you only obliged to "clear" an intersection if there's a traffic control device (traffic light, stop sign or whatever) controlling traffic in your direction? I don't know the local laws, so I can't answer the question of the video's title.

    Blocking a section like that is not good. I've been caught out by people doing exactly what the DC did while trying to get our ambulance up a side street on a priority call. I'm a paramedic not a traffic engineer but can't see any issues with the street layout/design. As for the Audi laying on the horn, well that's an infringement under the Queensland Transport Operations Regulation 2009.

      Pretty sure the dashcam driver would have reversed back for an ambulance under lights / siren. It was more that (a) There was limited space behind and (b) The audi was being a bully which didn't go down well.
      I was privy to the unedited video.
      One thing you've got to remember about an ambulance is they (1) have special privileges [i.e. can drive on the wrong side of the road, you have to give way to them when they are lights / siren] , (2) They are easy to spot (big meat wagon with flashing lights / siren), (3) Most people will go out of their way to let them through [more than they would cops / fire engine]

      Repeating the same flawed argument throughout all the comments wont make it right.

    That has been like that since 1982 that i know of it is bad design but also the audi also was full of his own importance cause anyone that traveks that area regularly knows its like that and he had used the side streets to get out of witing at the lights at the main road 100 m up the road

    I don't know about Queensland, but in NSW " You must not enter an intersection unless there’s space for your vehicle in your lane on the other side of the intersection. This includes all intersections and crossings, including intersections with traffic lights, railway level crossings and pedestrian crossings." The cammer blocked the intersection - wrong!

      Cam driver isn't in an intersection? Audi driver has driven through a stop sign which is visible on the street view and blocked the traffic. Cam driver had no obligation to let the Audi through, he could of been courteous and done so but he didn't have to

    I always have the mindset that if I need to make a right into a two lane road in peak hour I might as well go left and flip around else where so I don’t have to wait for 5 minutes and take risky gaps
    I totally understand the frustration the Audi has, but it’s not like Cam owner was in any fault either

      The incident has a lot of ambiguous ground. If it clearly mark out a "keep clear" zone then things would've gone out a lot simpler.
      But it seems unfair to me for blaming DC while there are very little to indicate there was an intersection. Sure it's easy for us backseat driver here to notice, but when you're on a busy road AND trying to make a right, meaning you're more likely to have your focus on the right side of the road, it's surprisingly common for law abiding drivers to miss that.

    After reading the actual legislation the Audi is indeed entering an intersection, a T-Intersection. With that fact established there is now this pesky *Part 11, Division 1, Section 128* road rule in most states, including QLD, which nearly everyone ignores, forgets or just plainly doesn't care about. Looking at those *Range Danger drivers*. This rule was broken by both vehicles. The cammer could not exit the intersection as it was blocked. The cammer right turn is a whole new intersection where he is permitted to enter, following the give way rules, as the road beyond (the side street) was clear.
    _Part 11, Division 1, Section 128 - Entering blocked intersections_
    _A driver must not enter an intersection if the driver can not drive through the intersection because the intersection, or a road beyond the intersection, is blocked._
    _Maximum penalty-20 penalty units._
    *Example -*
    _The intersection, or a road beyond the intersection, may be blocked by congested traffic, a disabled vehicle, a collision between vehicles or between a vehicle and a pedestrian, or by a fallen load on the road._
    Section 67 deals with giving way at T-Intersections but only refers to vehicles entering or travelling (ie moving) in the intersection as section 128 would be in affect otherwise. The Audi then broke this rule after the cammer moved on.

    A bot of both. Probably should have left space for the Audi driver to get through, but it doesnt always turn out that way. The Audi driver on the other hand should not have aimed directly at your car but should have tried for the big space in front of you and maybe you had room to go back a little, or the car in front could go forward a little. Either way, people are generally going to be more helpful to you if you dont keep honking your horn at them. I say 50 -50, each pays own damage

    So driving along and traffic come to a stop dc finds themselves in an awkward situation, the Audi driver deliberately drives forward blocking a lane of traffic, it’s easy to see who the knob is here. Dc could have done something different but they are not entirely at fault but the Audi driver is completely at fault and was an utter moron. If I was in the dc I wouldn’t have moved either after that and would have had words with the Audi driver thats sitting there on their horn.

    If I was the DC, leave enough gap, wave at Audi to stop with my palm and wait for my signal to proceed because he has no chance of clearing without vision of the oncoming traffic. Or the Audi should have turned left and made his way back.

      Never do that, never make decisions for other drivers. If things go wrong, they may well lawyer up and you could be found at least partially liable. The best bet is to be the constant in the equation, not the variable. Let them make their decisions, you stick with yours.

      Problem with that is that if the Audi has a crash (by your negligence or them not going when instructed or them going when instructed then a car coming around the corner hits them), they will blame you. Sure, you're not a traffic controller and you should never trust any other driver but they could still make it very difficult.
      What if the Audi crashes and gets pushed into you / or pushed into a pedestrian (lots around that area). How would you feel ? What if after the crash they lawyer up and try to implicate you ? Things aren't always black and white. People with money usually have influence as well (know people who know people who can fry you because they don't like you / think you're at fault). I've had that happen to me a few times in my life.
      Furthermore, the Audi drivers view would have been blocked big time by the van in front of the dashcam drivers vehicle.

    Not sure about aus rules but... Entering an intersection when you can't exit the other side is a traffic offence in NZ. Doesn't matter if its marked keep clear or not. Doesn't matter if you thought you could make it or not. I'm not sure what the Audi owner was hoping to achieve by tooting incessantly but the fact remains, by any rational standard and under NZ law this was dashcam owners fault.

    It's a poor manners on both the Audi and the DC part. Good manners would have the DC stop a little bit back to allow the Audi through. The Audi, however, once the intersection became blocked, should have just waited, especially since the Audi would not have had a clear view of the oncoming traffic to safely make the turn.

      If I was the DC I'd have pulled forward a little more to make sure the Audi couldn't cut through and drive the point home.     Could've waited and let him through, I guess, as you're stuck anyway, but then if the dick blasted across and hit someone going the other way they would possibly try and blame you.
    I tend to let people in if they're going the same way as me, but have been caught out by others following them trying to force their way in as well. I tend not to let them in if they're trying to cross like this Audi, just asking for trouble in busy traffic going both ways. Not because I'm making decisions for them, or a pseudo cop, but because I don't want some impatient knob to pull in front of a car coming the other way and getting hit a pushed into me. Selfish? maybe, but at least this way nobody gets physically hurt and no property damaged.
    There's no need to be an arse like the Audi driver and get all butt hurt. (but then, it seems stereotypical of them). Too easy to left turn and cross over/turn around later, or take a better route to begin with. I mean you're still going to be sitting on your arse in a comfortable chair with aircon and a decent sound system.... just like your lounge at home but without the alcoholic drink and a spouse nagging you.

      how is it an "intersection" if the only control markings are the stop sign/line telling the traffic from the side road to well, stop untill its safe to enter? By that logic one could just roll up to a stop, halt briefly then drive into traffic and blame anyone who runs into them for "not yielding".

      Where two roads meet, they “intersect” hence the term intersection. In NSW traffic must obey any signage, ie give way or stop. If the intersection isn’t signposted, the terminating road must yield. It’s not rocket science, just common sense.
