    There are only individual rights; race or any other demographic notwithstanding.
    We are all entitled to Equal Protection Before The Law.
    The only real justice is impartial justice.
    Racial discrimination is not authorized by the Constitution.

      What about the right to assemble? Isn't that a group right? What about state's rights? Don't states have rights?

      The right to assemble is individual.
      The legitimate rights of the collective/state/nation are voluntarily delegated to it by the individuals forming it; hence; legitimate collective rights must spring from individual rights.
      There are no black rights or white rights or men's rights or women's rights; only individual rights; and we all have the very same ones.

    4:13 just playing devils advocate: but isn’t the race-conscious interpretation somewhat incoherent & contradictory as it’s based on the intent of the policymakers not the policies themselves? The same policy could be either constitutional or unconstitutional based on whether it’s designed to help or harm minorities. It’s not that far fetched to imagine policymakers taking away rights from a minority group for their “betterment,” to “help” them. The justifications for some of the historical treatment of native Americans comes to mind.
    It’s worth noting that if the focus moves to the distribution of the effects of a policy across demographics to determine constitutionality, this too poses serious problems. The effects of even the most basic of laws like speed limits are not going to be perfectly even or proportional across demographic groups.

      This seems to reflect the argument between equity and equality. People should be treated equally, but devotion to equity creates injustice.
      On the other hand if someone is is born into poverty is there are argument for taking from the rich to create a more equitable outcome?

      the rich have become rich by taking from the people and forming conditions of poverty that people are born into. black communities have been historically ravaged by rich white people, and they have greatly profited off of it. now that people want to get their wealth back that they rightly deserve, people cry for billionaires? while disregarding their own colleagues? its pitiful really how selfish us americans have become, and so detached from context, history, and reality
