    Why is it assumed the tenant is in the wrong? What about the landlord that does not do repairs? Just as many of them as bad tenants.

    I've been in a landlord (my friend)/tenant court case. Yup, BOTH parties did wrong in the case and the judge let them know about it. Both won/lost their case. The tenants had to pay back rent, and because of a mistake my friend made, didn't get as much rent as she wanted. FIRST. get a book on state landlord/tenant laws in the state you own property in that you want to rent. STUDY IT. Two: If your state requires certificates and inspections before renting, GET THEM. Three: Before buying a property and expecting the rent to pay off the mortgage, learn what liabilities you have if the tenant doesn't pay. mortgage companies do NOT like to foreclose on properties that have tenants in them. (there could be liabilities for renting a property purchased as a primary residence- look it up). RUclips has many videos which are not the total learning package, but will give a good idea of what you might be getting yourself into. it is NOT a get rich quick scheme, but takes constant hard work.

    I'd like to see a video about HOW to collect a judgement that you win in court. It's not like the judge says, "You win a judgement of $1000" and the tenant hands you a $1000. Once you win the judgement you have to hire people to chase the tenant and TRY to get some of the judgement you won!!

      That's right, it's called going to small claims, winning a judgement and then serving the former tenant with the help of a little detective aka skip tracing. Once you serve the papers go back to the court and seek a garnishment.

      Well I know the money hurts and puts people in a tough nerve wracking spot but if you win that judgement will stay on their credit report as not paying rent so most other landlords will be hesitant to rent to them

      @@thefrugallandlord2226 Yes, that's what Holly is saying. It isn't as easy as handing you the judgment right after the decision. You have suggested one way, if LL knows the tenants new address, and the ex-tenant is working and will keep his job upon receiving garnishment, and isn't already being garnished the maximum the law permits. Or it can be garnished from a bank account if he still has a bank account by the time the order processes, and if there's enough money in the account. There are other ways, too, but all cost more and more to the LL that won the judgment. Theoretically those costs are added to the tenants bill, but that's if he's found and if he/she has the money/account, and if it's worth the time and trouble.
      Ohio permits garnishment of vehicles by sheriff to auction(under some conditions). But losers of judgments aren't always the most "stand up" people and making things difficult often helps them escape their actions. Judgment losers that are in business and own properties are easier targets. Tenants that lose judgments can too often escape their obligation.

    We cleaned our apartment when we left. Then when i got the document after 3 weeks after moving, they took the money away from the deposit for "cleaning". I spend time for cleaning the apartment and gave it back in good condition. Now they're are charging a ridiculous $30/hr for 6 hours for cleaning a 1 bed room apartment. I don't understand If they're are cleaning it themselves why did they make is clean it.

    This is a one sided video, complying with landlords. There are several landlords that need to be sued in the United States of America. If tenants are being discriminated against, being treated unfairly by other tenants, there needs to be information on how to sue a landlord and tenants.

    We were evicted illegally and went to Court and the landlord wasn't even there. The judge ruled in his favor without even listening to our side of the story. I am disabled with severe allergies and very sick. Our previous landlord sold the place 1 year before we were evicted after living there for 9 years. In the State of WA the landlord is supposed to contaminated a disabled person until they can find a safe-place to live. This guy is a millionaire and wouldn't even let us gut a travel traitor on our rent property because he said it was HIS property. I am know living in my car. No lawyers will take our case because there is is not enough money. The landlord never fixed anything. Our water was full of black gunk that clogged the sewer line. We had mice and rats they came to the house for refuse after he started tearing down other buildings. The mice damaged our oriental area rug, 2 silk, scarfs and an antique handbag and we had to fix our own stove. We gave him written to fix these things.

      A landlord won't bother to sue a tenant unless there is good cause. Keep in mind there are fees involved and often times a lawyer. Landlords can afford this. Renters cannot. That's why they are renters 😂🤣😂

    My landlord evicted me , I left before the eviction date but didn’t turn in the keys. She proceeded with eviction. Shouldn’t I get charge for lost key. Not eviction on my record since the apartment was cleared out.

    I signed a stipulation agreement and I didn't know what that was but I did because they had said I was going to have eviction on my credit and I wouldn't be able to find me nowhere to live how can I change that because I have tenant evidence about the bugs in the night since all the things that was in the house and I never had a chance to that you just see that

    I'm in this situation we have had a leaky roof for almost 2 years but wasn't to bad just with heavy rain anyway started new roof did not finish it leaked everywhere in house did damage to tv and was not livable had to stay in hotel I confront landlord about this with video proof my rent insurance will not cover anything saying landlord problem landlord says won't cover anything and that house was livable which it wasn't that's how bad it leaked I so now not sure how to go about this about my property damage

    My tenant moved in 3 years ago and is only paying half of the local going rental rate. He has not had a rental increase in the 3 years he has lived in the unit. I bought the condo 1 year ago and when his rental lease ended we sent a request to up his rent by $13 per month. He refused the increase so now we are going to a tribunal hearing. He pays his rent late every single month and it is costing me out of pocket to serve him each month he’s been late being every month since we took over the unit. His rent is $752 per month for a 1 bedroom condo. The area’s going rental rate is $1,200/ month.

      You and the Tenant agreed to a set amount Contract or not. And the fact it has been 3 years before a complaint on your behalf proves the fact. So the court will look at that. In my area (not all countries even states are the same) a Landlord must give 2 months notice of a rental increase And it must be within a state set percentage of 2.5% and no more per year. And for paying rent late "every single month" I would be careful of your wording in a court room ..If he/she can prove otherwise Your credibilty with be gone You can evict a tenant for late rental payments over and over But it is a process to do so. Adding the $13 per month is also required. If the refuse it. Refuse the full sum of rent As it is not a payment. You can also request payment in rears

      @@freakyflow In Ohio, LL has to give at least 30 day notice of rent increase or termination if in a m2m lease. There is no cap on increase. But if a LL has a number of late rents accepted, it's hard to claim that suddenly late rents are unacceptable. But in Ohio, LL or tenant doesn't have to document the reason to terminate a lease, but both must give proper notice of termination. And of course, a termination of lease by LL is very different from Notice To Vacate, or an eviction.

      @@NomadChristian At least in Ohio, a new buyer is bound to the existing lease. But no lease lasts forever. The new buyer should have the opportunity to enter a new lease when the other one ends, or if they negotiate a new one with current tenant

    The only time I had a hearing where the landlord wanted to evict me the landlords lawyerspoke for an hour. Then it was my turn. I stood up and started to speak and the hearingofficer (not a judge) interrupted me and said; "I've heard this all before." Meaning from thelandlords side. I said; "Now you get to hear my side of the situation." She said; "No I don't.Sit down." That was the end of that. Needless to say, I lost.

      nightmare freddy- I AM NOT lying. That is EXACTLY the way it happened. Remember, this was a Residential Tenancy Hearing, NOT a court of law. The "hearing officers" (they are not judges) at thesehearings can just about do whatever they want. I believe you failedto understand that the situation was a Residential Tenancy Hearingnot a court of law. You might want to make sure you understand thesubject matter before you start calling people names. Whose theDUMB ASS NOW!!

I'm being evicted because my hours at work increased from 40 to 65 a week and I can only mow every other week, my landlord is one of those faux Christians who constantly harasses people because he thinks he's superior to everyone else. You don't know everyone's story kid

    My landlord is trying to evict me even though our rent is paid.. her excuse is because she feels like I've been living here too long and wants to give it to her family. Truth is my property keeps getting vandalized by her niece upstairs harassing me by stealing my mail. Damaging my things.. are electric isn't up to code so the circuit breakers are constantly blowing .. sewage water was dripping in my apartment instead of fixing these things she thought it was just a better idea I move . I told her to go ahead and evict me till then I will sit my ass down I'm tired of getting pushed around for no reason

    This video was b******* there's absolutely no advice for a tenant that has a landlord that's broken the law. Of course it's always the tenants fault and maybe 90% of the time that's the case but I'm part of that 10% that wants advice so not bias on behalf of the landlord!!

      Here is some real advice: read your rental agreement and do everything by the book. If your landlord is not living up to the agreement, leave. You're welcome.

Laws on the books that says any manager business owner or whatever can refuse to serve you also for any reason so I guess they don't like no f****** money? At least on the last part the first part is f***** up but the people don't seem to understand when they vote they control the legislature that make the f****** law the people don't seem to understand they ain't got no f****** balls when they are the masters of these legislators

      @@joejose8433 The issue with this video if you or anyone else hasn't noticed. This is advice for the Canadian Court systems. Some of it is practical like not arguing with the judge, or try to straighten out the issues before the court appearance. So Joe, while your comments might apply if... here in the US. One look at the Judges attire should have made small warning bells go off.

    I have a commercial property with a new tenant that has not paid a full month of rent since they moved in. He always has an excuse and keeps sending small amounts that never amount to a full month of rent. He lies about what he is going to do, has given me 2 bad checks, refuses to answer his phone when I call, and has also made substantial changes to the property (adding walls and rooms without getting written approval as required by the lease). I am out nearly a year's rent because the laws and courts are so bad. It has taken months just to get to court, and they are only scheduling us 15 minutes (!!) for the entire proceeding. I am now out thousands for the lawyer, and almost a full year of rent in addition to the fees I had to pay to the realtor. It will likely take me months to fix the damages and likely tens of thousands of dollars. I really wish that the legal system were more streamlined. Having to wait for 6 months to get into court for 15 minutes of their time is just ridiculous. My lawyer has warned me that this particular judge almost always rules in favor of the tenant, so what am I supposed to do? This guy is wrecking my property and the building and I just want him OUT so I can start over again.

      its not illegal to rent an illegal basement as long as the landlord claims the rental income...thats all the government cares about...they dont care if its illegal as long as they get the TAXABLE INCOME

    House I was renting got foreclosed. Then the commissioner of the court showed up at my house says he had possession of the house and wanted me to pay her. Covid it happened and no evection’s so I just been living in the house not paying rent. Can the court system sue me for all the rent -get the money from my bank account

    I want to know if a landlord can evict you because you refuse to sign a new lease that restricts your renters rights? I told his representative . This lease is for new tenants. I have paid rent for 35 years. MONTH TO MONTH RENT.He said we were being nice.IF I DIDN'T SIGN THIS NEW LEASE HE WOULD EVICT ME.

    I have to go to court against my apartment for a plumbing issue that they had to replace the toilet and shower for. There was a backup to our toilet which was our fault. I agreed to pay them back for it. They wanted over 1300 a month for the plumbing issue. Need remind you I already pay 1179 for rent as it it and other expenses. They made me sign an agreement to then pay 200 a week for it and I agreed (which was still too much). My hand was forced because I’m a single mother and didn’t have the time to move so I agreed to pay the amount of 200 a week. My nephew died in November and I had to spend money to travel and go to his funeral. So that caused me to miss like 3 weeks of payment. When I explained what happened about my family’s death they were unsympathetic to my situation. I told them I could catch up and they didn’t want to hear it and threatened to take to to court still. So I came home the other day to a document in between the crack of my front door. At this time, I have payed back damn near all of the balance already. The document states unpaid rent which is false because my rent is paid up. Should I go to court or try to have this paid off before. I don’t want this on my record so should I fight it out in court or just pay up the remaining balance before the court. HELP ME PLEASE ANYONE!!!

    I simply want to sell my rental home. I live far from the rental home, and found out that my home is now worth a lot more than I ever thought possible. My tenant is now claiming retaliation as my reason. Do both sides present their cases even if the judge finds my reason legitimate?

    My landlord is ripping me off. He won’t fix anything and came at me saying I owe late fees from 4 years ago. Been trying to find a new house but where I live no one wants pets and I can’t live without my dog Brandi so I’m stuck. Can’t afford to buy my own.. single mom son in college.     The problem is that the process is a long, difficult, and costly. It doesn't matter who is correct, most landlords would be fail because he didn't follow the procedure good enough. Landlords must have a lawyer to help him. Most small landlords would loose rent then sue the tenants. Many experience tenants would know that and use that to not paying rent. I don't say all landlords are good and all tenants are bad. All I say is the law is the problem here.

    NEVER EVER GET AN EVICTION ON YOUR RECORD ! JUST MOVE ! AS FAST AS YOU CAN ! IT WILL SCREW UP YOUR LIFE FOR YEARS ! Even if you have to go to a shelter the system will help you there . Believe in yourself and what your capable of . Use the resources "Homeless shelters are full of em" to start all over . You may even wind up with a place nicer than the one you left . It's called rapid rehousing where I live . Just turn in the keys if that's possible say ,SORRY ! and split !

      And if you don't show up for the court date you can default and the landlord not only wins but can get up to 10,000 in my state. So there is no running away, but you can appeal your eviction. It will buy you some time, and once that's in, the old eviction disappears. Start all over again. It's called a paupers affidavit.

      Without the law, landlords would do whatever they want, including fraud and stealing from the tenant outright. When profit is in question, people will do anything in their power to make it happen, even if it means breaking every rule possible.
      Long story short, the law is needed.
      Don't like it? Maybe you should consider other investments.

      Last time I checked, fraud, and stealing were already illegal. Aren't there laws against that? I hope so. By the same token, the law should protect the interests of BOTH parties, not just one. When a dad beat doesn't pay his rent as agreed to according to the contract he signed, why should the law not protect the aggrieved party? If the deadbeat destroys or steals from the property, why should the law protect his illegal acts?

      Besides landlords have all the power locally which is why the law is so strict in striking against them.
      Me suffering through a horrible first time landlord, who even walked in on me a few times while I was home, truly made me see the light on this.
      imo, everyone shouldn't be allowed to landlord. It should be barred and require certification on the same level that attorneys do.
      That would at least clean out the weasels.

      You sounded like a tenant. I was about to ask if you had some bad experiences with landlords :) Sounds like your landlord was a dufus. Don't worry, he won't be a landlord long. The market will eat him and hurt him much more than any law could.
      See, he'll go out of business, look like a loser to his wife , family and friends, FEEL like a loser because he lost all that investment capital, probably will have to file bankruptcy because he borrowed the investment capital, will end up divorced with child support and be an employee by day and a drunk by night. All because he didn't have integrity to begin with.
      I would not complain about landlords being required to have certification like attorneys. That would chop the competition by 2/3ds! Now there would be fewer rental properties for all the people that need a place to live. Supply and demand. Rents would be double, maybe triple what they are now, and there would be a whole lot more homeless people.

      MusketeerinFlorida i would have to look deeper into rather the effects would be that steep, but either way, there should at least be a national commission they have to answer to or something.
      Complain about someone like him performing an illegal lockout for instance, and you usually get an "eh, just take him to court" nearly every time which they love since they know no one wants to take days off work to get their moronic landlord into to court.
      Making some of the more serious offenses criminal _and_ civil so it would be easy to file charges if need be would help.
      But at least if a tenant is not paying up, it's because their income stopped flowing or something. When a landlord goes bad, it's usually always due to poor ethics and subpar business morals.
      Guys like that sully the renting experience for everyone.

      If you have a contract, the new owner must permit you to remain in the home during the remainder of the contract. If they want you to leave, they must pay for reasonable moving costs if you agree. If you are given an unlawful detainer, you must prove that you have a binding contract and be ready when the landlord lies and says that you are a drug dealer, user or some illegal violator. Unfortunately landlords retaliate if you file a lawsuit but you should as that is your right for redress as you have been harmed for breach of contract. If you don't have a contract and there is a new owner, you could delay moving out for up to a year with a good lawyer. If you don't have an experienced lawyer and you attempt to go pro se, the Judge will likely give you a few months. Some are assholes, few have compassion.

    The following reasons the 30 days are up tomorrow.. Evidence of land claim and property transfer legal claim to land deed I'm moving property too. Need to transfer mobile home and shed to the property I coown.. I still need to get permits and axles for the mobile home? Due to hurricane Irma it set me back on getting this done. So could someone explain to me if I did this correctly. I cannot afford and attorney.

    My landlords and there other tenants are definitely fitting these categories because one of them dangerous and damaging the property and has been violent with other tenants and didn't do nothing about it the police were called several times so in time I hope this place gets shutdown!!

    In the province of Alberta the courts are always in favour of the tenant. My advice to new landlords, sell your property and find another source of income. Otherwise, welcome to hell on earth. !!!!!!!!!!

    Going threw a lawsuit right now landlord kicked us out of our trailer we have a lease to the home and the landlady told use they don't to up hold our lease and kicked us out and told to leave in 10 minutes by her and police then the police followed us when we left then the the landlady calls me big mouth yells and my friends and boyfriend for trying to get our stuff that she had strange people throwing stuff out on the ground they stole items from use when we lived in the trailer we had cockroaches falling from the ceiling crawling on you nite and day had no heat windows leaked floors falling in doors leaked had to fix pipes breaking we now have to go to court and the landlady didn't want to explain why our recipes are not in order on their end and want gives our money back or give up the trailer a when we ask her about why they couldn't give us our money or either she got mad at us and told us to leave so now me and bf are living in friends backyard in a tent for now so yes there you have it

    I have one house for rent. Tenants removed my dining room linoleum, removed all gravel from my 75' long driveway without prior written approvals and are now fighting their eviction. This is my house and only I can remove anything from it. All this after I gave them a 25% reduction of rent and charged no deposit. So I don't care to hear about your rotten landlords. You have probably made them that way.

      Just because YOU are having a bad experience does NOT mean that other people have MADE their landlords like that. Ours had us move in to a country home with 4 kids knowingly, KNOWINGLY with no heat or hot water. The propane tank bone dry that was supposed to be full due to contact we signed, and took our 2k of deposite and rent plus security deposite and left the fucking state. It was December, right before xmas and we had to fork out over 4k to get heat, hot water, and propane. Fire wood stove he told us we could use we paid 250$ for a chimney sweep and he found massive numerous holes all over the duct work and a broken blower motor. Was also hooked up illegally to our furnace and therefpre fucked everything up with soot. We could have had a fire and been injured or killed. Now he's trying to evict us while not being refunded any money, wants his 800$ a month rent as well... So no, I dont think I MADE him do that shit. He has 7 properties he does not maintain he is a slum lord and gets away with it making money hand over fist. And we have 4 kids and here its xmas time again and well have to fork out more money. That comment was just pure ignorance

But, for every slumlord claim, there are good and decent landlords like me who were taken advantage of by tenants who made alterations to our home, stole numerous items from our property and now want their deposit back that they never paid. They will be taken care of legally and I suggest you do the same to your slumlord. Go to the Health Dept or City Hall where you live. Report that slumlord to every agency you can. Get an attorney or go to Small Claims Court, and recover your money.

If they produce any pictures that don't match yours, you can prove they are coming in unannounced. Document everything and protect your rights.

      @@alanunderwoodsr8622 I agree there are good landlords I've had a couple, my landlord now is evicting us purely out of spite because his family are very religious (I call them faux Christians) all because his wife asked my husband and I if we would go to church with her and we agreed that we would give it a try, we never said when we would go but apparently she expected us to go with her on Mother's Day but I already had plans with my children that day, well her husband got all upset and came to our house bitching that we made his wife cry because we spent that day with the kids and not her and that he gets really pissed when someone makes his wife upset, now he has told us if we're not out in 4 days he will enter our home while we're at work and put all of our stuff out including my dogs, he says he doesn't care what the law says he can do whatever he wants with his property and he will not be responsible for the dogs once he lets them out. There are a lot of bad landlords out there just like there's bad tenants, but you can't claim that all landlords are good people and the tenants made them bad that's bs

    Tenants have major entitlement issues. You don't like where u live, MOVE. You are not a tree. And if you feel like a tree, shut the F up and get a tree hugger.
    The reason u are not moving likely bcz u can't rent elsewhere. Be thankful u have a place to live cz no matter what u do landlord Will kick you out and there are Bounty Hunters who have the right to repossessed your belongings, including ur car to collect what's owed. Just get our!
