Scott Peterson was found guilty nearly two decades ago. Many people are still in turmoil about the case, however, due to the lack of concrete evidence. Despite having already done two videos on Scott, I wanted to wrap everything up with one final super episode centered around not only the admitted evidence, but also the nonverbal communication from Scott's very first interview with the police from the very night of the incident.

I recall this case as it was happening. As a result, we wound up with the Lacy Peterson Act, which makes the murder of a pregnant woman count as two murders instead of one. This was significant.

So about this Lacey Peterson act why is killing a pregnant woman considered two murders but a woman killing her baby in an abortion is not considered murder and it's okay??

    • @oougahersharr
      @oougahersharr 3 года назад +255

@@rhondaphillips7664 That's because people can't seem to decide if pro-life or pro-choice is more appropriate. It's the inconsistency of government. However, when someone else kills the pregnant lady, they are taking two lives without informed consent of either. A pregnant lady aborting her baby is, at this time, considered a whole other matter. It is a touchy subject for many people and one I will not get into on a comment section because I don't wish to stir up more controversy. Thank you for your intelligent question, however. It is something to consider.

While I agree that he’s a piece of shit and clearly doesn’t give a shit about the search for his wife; I don’t agree that is is strange that he answers his phone during the search. In certain context, it would be suspicious but your comment didn’t present a context that is clear. What I mean is that during a search for a loved one, my phone would always be on me and I would answer my phone immediately hoping that there was news from someone that wasn’t necessarily at the search site.

Nice is a sort of manipulation. On one hand, we all do it at certain times because we are social creatures and getting along is pretty important, even as a means to survive. It's how people misuse it and even abuse others with the manipulation that really matters. I'm sure there's clues this neighbor gave you, probably on sort of a subconscious level that you picked up on and realized somehow that the nice words didn't match the behavior or the situation. I'd say good on you that you could see thru an act and taking a deeper dive into it can only serve you well in the future. A lot of people are fooled by just words and it's important to take in the totality of words, the context, and behavior - including body language and micro-expressions that don't register except on that subconscious level.

I have to say - that occasionally I speak about someone that is not with me, but I am describing an activity we did - I use the the term was. "Oh, she was so nice when we were setting up for the banquet." That doesn't mean I think she isn't nice now, or dead ... I am just describing a past event. Perhaps not proper English, but I am having a discussion, not giving a professional presentation.

    • @mysticobra1

@@Viewer92136 that makes sense, but I feel like saying someone was nice when setting up for the banquet, is using the adjective nice to praise the person during that time. My dad's boss saw him driving on the freeway in the very early morning hours on his route from Modesto to Richmond. He called police, and they never followed up. I think he did it, but police got the timeline wrong. He killed her the night before, then dumped her in the very early morning, went back to clean up and stage the house, let the dog out. Then went back to the marina to get an alibi and receipt in case he was ever placed there to give a reason to be there. Nobody drives hours alone on Christmas eve to go fishing in a tiny boat in the bay in bad weather to only be there for 20 minutes! With no fish to show for it.

He did not tell Laci about the affair and it wasn't any of Laci's friends who knew about it. It was Ambers friend who found out Scott was married, and she told him that if he didn't tell Amber the truth, she would tell Amber herself. So he was forced to tell Amber he had been married, but he lied and said "He had lost his wife", thus lessening her suspicion and gaining her sympathy. He did not elaborate and Amber didn't like to ask how he had lost his wife. This was 10 days before Laci went missing.......if Laci had known he was having an affair, for sure she would have told her family. Her sisters and her mother confirmed that. And any woman would know that Laci would not be calmly preparing for Xmas, in late pregnancy, if that bombshell had been dropped on her.

The detective trusted his gut feeling despite there being nothing obvious in Scotts demeanour. Many investigations start off with a hunch in an experienced detective or even a young cop. I remember when Peter Sutcliffe in Britain was interviewed in his home by two young cops and one of them got a bad feeling about him. He fit all the criteria of the kind of suspect they were looking for, and that young cop went to his superiors with a report and his suspicions. The poor guy was rubbished and ridiculed and even demoted to desk duty for his "presumption". Sutcliffe went on killing for a few more years......it turned out that young cops gut feeling was right. We all get that gut feeling sometimes. We know when someone is lying to us but we can't say why. I get a picture in my head of seemingly unrelated events but somehow the puzzle pieces come together and I can connect the events.....it gives a starting point to investigate.

A 3 year old boy was abducted off a street, ripped away from the older brother who was holding his hand and hustled into a car and driven off at speed. Cops were called and rushed to the scene. One cop had a hunch where the abdcutor might have taken the child and proceeded to a nearby park which was often used as a lovers lane. We are approximately two hours from the bay area, and most people leave really early in the morning to go ocean fishing, then are out basically all day. For just doing a quick fishing trip there are tons of closer places he could have gone. Then learning he wasn't prepared to catch anything specifically it is super sketchy even to someone who has never fished a day in their life. We literally have a river that runs right through the middle of our area.

It's possible, although I've heard one of the detectives say that SP wouldn't have risked Laci yelling too much, alerting the neighbours that were close by. Also she wouldn't be in the pool swimming (naturally), as this happened in December which is the coolest month in Modesto. From what I have heard he sounds like he was kind of obsessive about cleanliness. I never read the sister's book--it would be interesting to hear her take on this. Seems kinda weird that he was worrying about the pool when his wife and baby were missing--but there is a lot of things about him that are kinda weird.

@@mr.baseball370 Are you aware of the series of robberies that took place in their area at the time? One happened the day Lacy went missing, and witnesses recall her walking her dog while the robbery took place. They caught up to the two men that robbed that house and they swore their innocence without even being told about Lacy. The police listened in on one of their phone calls years later while one was in prison. He mentions Lacy and the other tells him to shut up about it.
Then, there’s a problem with Scott’s alibi. He went boating the morning she went missing. He supposedly wanted to take his new boat out for a test ride. He told this to detectives the same day. News about Lacy going missing quickly broke out and Scott was a possible suspect. The police informed the media of Scott’s whereabouts shortly after interviewing him. I’ll come back to this in a second...
News then breaks out that Scott is having an affair. His mistress makes a public announcement. Everyone, including Lacys family, now believe Scott is responsible for Lacys disappearance. Before the mistress spoke up, the family was on Scott’s side. Everyone is now dead against Scott for they believe he had a motive in killing Lacy. But they still didn’t have a body...
Months later, Lacy and her infant sons bodies are found in the same body of water Scott took his boat to that day. Now, what I can’t wrap my head around is why Scott would tell police he was at the location where he supposedly just dumped his dead pregnant wife’s body. He could have said any body of water and he told them the one where he disposed of his evidence? I find that hard to believe. Let’s not forget the news of his whereabouts was released the day of Lacys disappearance AND the two robbers from across the street were clearly following the case based on them mentioning Lacy without being asked. It’s reasonable to suspect they framed Scott.
Detectives working on the case purchased the same boat Scott used. They took it out to open water with a hundred pound dummy to determine how Scott unloaded the body. They found it was impossible to dump the body into the water without the boat tipping over. This test was filmed.
Autopsy reports also suggest the baby likely died around December 29th which suggested Lacy was not killed until then. That’s several days after Scott was taken into custody.
People ask why Scott hid his affair and the answer is simple. Who tells anyone they’re having an affair? There’s no quicker way to have everyone turn against you, _especially_ in this case, and that’s exactly what happened. Police asked him in the first interview if he was having an affair and of course his first instinct would be to say “no.” So, he had to follow through with that lie. That was his biggest mistake.
He shouldn’t have been having an affair and he certainly shouldn’t have lied to police about it. He’s a piece of shit, but I don’t think that makes him a murderer. Nancy Grace and the media buried him the second they found out about the mistress. His trial was clearly affected by the media attention it got and that’s why it was unfair. Members of the jury outright admitted to having heard of the case prior to being brought on.
I shouldn’t say I’m certain that Scott is innocent. I am certain that he didn’t get a fair trial, and a fair retrial would likely work in his favor. This is one of the most fascinating cases in 20 years.

Anyone interested in this case should check out ‘Blood Brother: 33 Reasons why my brother Scott Peterson is guilty’ by Anne Bird. It answers heaps of questions about the family dynamic and they are all kind of cold, ‘blank books’ like this. The book TLDR is that Laci was a super perky, sunny person and they were a colder, more reserved and rather sardonic family and found her cheerful ways irritating. Because Anne was adopted and met the Petersons as an adult, she came into the Peterson family as an outsider like Laci and was with Scott and the family constantly in the days after Laci went missing, horrified by their lack of concern about Laci and Conner. If Scott didn’t do it, the real murderer just happened upon a woman whose husband despised her and was the perfect person to frame. Kind of like that viral video where the guy is happy to be arrested so he can get away from his wife.

It's a tactic. Attorneys will use this same tactic when a defendant is being interviewed. They are usually scribbling on the paper. Doodling just to make the defendant feel uncomfortable about what they're saying. In reality the court reporter is already doing all the keeping up with everything a defendant has said and a copy is given to the attorney. They have no real need to take notes unless it's notes on body language or marking particular lies they detect. Mainly it's just a tactic to make any would be liar trip up from the added anxiety. When you're telling the truth and you're innocent you couldn't care less what they're writing. When your innocent however, you WILL show emotions through your body language. If I'd been Scott Peterson I'd have been a complete wreck and just asking over and over again," Has anyone heard anything or found her yet? Who's out looking for her? But there is no proof that Laci ever took the dog out that day and he could easily have put the dog in the yard with it's lead on, or he could have taken the dog in his vehicle near the park then put him out of his truck, knowing he would find his way home. My dog once pulled the lead out of my hand and ran all the way home in terror when thunder and lightning struck up and he was desperately scratching his paws on the door trying to open it when I arrived minutes later.

But although the evidence is circumstantial, that on top of the affair (not saying everyone who has an affair is a murderer) BUT, he had told Amber he lost his wife BEFORE Laci went missing, and then right before he got arrested, he changed his appearance, and had thousands of dollars on him heading towards the Mexico border! On top of ALL OF THAT, his behavior doesn't match up with a grieving/worried husband and father! 🤬🤬🤬 Thank you Logan @Observe for calling him out! Almost all cases were fought and won on only circumstantial evidence. It's how it was before DNA was a thing. Cases today are fought and won solely on circumstantial evidence . DNA isn't always at the scene of the crime. There's absolutely nothing wrong with circumstantial evidence.
Take a drink every time you read "circumstantial" :-)

Correct, and also DNA is circumstantial evidence, it requires the jury to still infer, by hearing the staTISTICAL testimony and other dna explained testimony. The ONLY direct evidence there is is witness (direct or from an accomplice) testimony or a videotape of the person doing the crime. I don't understand why these people don't understand why circumstantial evidence is in fact PERFECTLY GOOD evidence. Most cases are not won with direct evidence. 90-95% of cases are tried on circumstantial evidenced. Perhaps people need to read our Constitution, and research the rules of evidence. CSI effect is real. If DNA evidence isn't there-becauase none was found, does that mean that the victim murdered him/herself?

I grew up fishing (fishing trophies from 5 yrs old) & you're absolutely correct about fishermen ALWAYS know what they're going fishing for & take the correct bait, lures & poles with them. 2 other things that immediately does NOT make sense is that he took nothing with him to eat or drink not even anything to snack on. I've never seen that when going out on a boat, fishing from shore for a short period, yes. The biggest thing was the short amount of time he said he was "out fishing!" 1.5 hrs that's it! No FLIPPIN way!! #1 on a cool or cold day the water will be choppy (it's typically choppy there anyway) that causes you to go slower to get out to where you're going to fish (particularly so with his size of boat) & the same heading back in, that would mean he only actually fished for a little over an hour, all that work for 1 hour of fishing, no way you'd just get out, get things ready make a few casts & then leave. Absolutely not!!

The baby washed up separate and they say it came out of her in the water due to bloating, but they say the baby had duck tape wrapped around it's neck... They said back then that duck tape part was held secret because if somebody came forward knowing it then would know they were there or really knew something. Investigations will keep some things secret in the news to help them narrow down true witnesses versus nut jobs on the street wanting attention when people step forward with information.

I see a lot of people stating this was a circumstantial case as though that means it wasn't proven. This led me to believe a lot of people must not understand what circumstantial evidence is and what it means. Because, this case was proven with circumstantial evidence.
Circumstantial evidence is evidence that has no direct proof but is instead BASED ON A CERTAIN PROVABLE FACT or facts used to form a credible theory of the events of a case. Even the most credible eye-witness testimony is only circumstantial because there are so many influences that can have an impact on human recall.
In cases lacking direct evidence, the prosecution must attempt to provide evidence of the circumstances from which the judge and jury can logically deduct, or reasonably infer, a factual theory of the case that cannot be proven directly. It's up to the prosecutors to show through a set of circumstances that their theory of what took place is the only logical deduction-that the circumstances can be explained by no other possible theory.
