Several years ago I worked at a thrift store and we regularly saw what we referred to as "the Goodwill shoe exchange" where someone would take a nice pair of shoes and leave their ratty ones. The Goodwills I worked at did have LP and did prosecute shoplifters
If you shoplift at DSW you can walk out with as many expensive shoes as you want. They won’t do a thing to you. My daughter used to be a manager there in a Colorado DSW. She was under strict instructions not to interfere with shoplifters.🤷🏻♀️

Back in the day when I was a cop, it took 6 of us to handcuff a 100 lb doped up girl. When it went to court, her lawyer asked all of us how tall we were and how much we weighed, as if to say “why did it take so many cops”. In the end, she was found guilty on all charges. It's really an ignorant line of questioning. Mental instability, drugs, and willpower can make anyone difficult to fully control (put in handcuffs). I've seen enough in EMS to know this.

That's the basics for retail theft, if you don't have your own security or loss prevention guys - there are some points that need to be established for an open and shut case. These are: 1) not having something in your possession as you approach displayed merchandise 2) selecting something from the displayed merchandise 3) carrying it or secreting (hinding) it on your person 4) walking past the registers without paying or making an attempt to pay 5) exiting the store (removing the unpaid merch from the store) That's the "open and shut" version, it may seem obvious to a arm-chair reader, but in the moment and the adrenaline, it's super easy to accidentally prevent a suspect from completing all the "steps" - and it gets a little harder if you don't have all of these points nailed, like in this case she never actually exited, but it's easily arguable with the CCTV footage that she was actively attempting to exit, and the video does show what the cashier said about the shoes... It has to be talked through in court if the suspect doesn't plead no contest. I did retail loss prevention about 20 years ago, and most of what that cops did was stuff we did in paperwork and compiling the event's CCTV footage. We rarely called 911, and in most cases by the time the cops showed up from our non-emergency call-in all we had to do was hand over out report, do a quick playback of the compiled CCTV to confirm the report text for their records and swap cuffs with the officer. If it ever got to the DA, our company had a legal team that would take all the video and reports and walk through them and then we'd prep with the DA for court. Never had to go myself but got close one time on a guy who went up for armed robbery and burglary charges (we called 911 for that one). That was a wild job.
That officer needs to go back to the academy. Demanding the store employee tell him "what happened?!! Tell me now!!". Control your scene dude. You have the option to detain. Don't put citizens in that predicament.

Very thorough police officer asking the right questions at the pay desk.
That's the basics for retail theft, if you don't have your own security or loss prevention guys - there are some points that need to be established for an open and shut case.
These are:
1) not having something in your possession as you approach displayed merchandise
2) selecting something from the displayed merchandise
3) carrying it or secreting (hinding) it on your person
4) walking past the registers without paying or making an attempt to pay
5) exiting the store (removing the unpaid merch from the store)
That's the "open and shut" version, it may seem obvious to a arm-chair reader, but in the moment and the adrenaline, it's super easy to accidentally prevent a suspect from completing all the "steps" - and it gets a little harder if you don't have all of these points nailed, like in this case she never actually exited, but it's easily arguable with the CCTV footage that she was actively attempting to exit, and the video does show what the cashier said about the shoes... It has to be talked through in court if the suspect doesn't plead no contest.
I did retail loss prevention about 20 years ago, and most of what that cops did was stuff we did in paperwork and compiling the event's CCTV footage. We rarely called 911, and in most cases by the time the cops showed up from our non-emergency call-in all we had to do was hand over out report, do a quick playback of the compiled CCTV to confirm the report text for their records and swap cuffs with the officer. If it ever got to the DA, our company had a legal team that would take all the video and reports and walk through them and then we'd prep with the DA for court. Never had to go myself but got close one time on a guy who went up for armed robbery and burglary charges (we called 911 for that one). That was a wild job.
That officer needs to go back to the academy. Demanding the store employee tell him "what happened?!! Tell me now!!". Control your scene dude. You have the option to detain. Don't put citizens in that predicament.
