    This is getting so much attention now that even if it goes to court and gets a settlement the only real “winner” is going to be her lawyer.

      Yah but that meas she will be also. Mostikely the lawyer will take a 33%-50% cut. It's still gonna be a lot of money for her. Unfortunately yes, she's giving up a lot, but she needs a food lawyer not to get screwed and get on $350.

    I'm a gambler and this never happens! Every wheel tilt I have ever had has always resulted in the wheel going dark and it lands on nothing and continues to spin! This is shady... The whole wheel is still lit up and has actually landed. The emotional distress alone, had this happened to me, would be devastating. She should definitely receive compensation. Something here is just not solidifying a common wheel tilt every gambler has been through. My honest opinion.

    I have been following this story. Even before you addressed it. The casino managers made a huge mistake by pushing their buttons after her WIN. She's a winner in my opinion. If she was recording, and, had a RUclips channel, She would have made more than the jackpot just for the viewing hours. LOL. Keep up the good work keeping us informed!

      Mark, based on what you just said about the tilt abd how it should have landed on the 350 but landed on the Jackpot supports the statement of any malfunction voids pay. It's unfortunate this happened, but based in the facts, she did NOT win the Jackpot. The machine malfunctioned and she doesn't get the jackpot. It's pretty clear

      A while back Brian Christopher had a jackpot (over $5000) and wheel tilt. The casino came in, looked at the slot and reset it effectively voiding the jackpot. Now, maybe as a regular and a slot channel personality, the casino did make it up to him, not anywhere near the voided win, but something. And it could have just been free play, versus an actual cash pay. It sucks, but the warning is front and center.

    I played a Montecarlo slot in AC and when i got the bonus the wheel started to spin backwards and didn't stop, i thought it was a special kind of bonus, until I was told it was a tilt. The attendent was going to pay me the lowest win on the wheel until I made a stink and told them if it didn't malfunction, i might have won the jackpot so I deserve more than that. They wound up paying me the next highest amount on the wheel. They were really great about it and it made me happy😊

    i remember the last time this happened in atlantic city they asked the company and the casino do they keep track of all the TILTS and if so do they pay out the money when the machine looks like you didn't hit BUT the machine Tilted because you did HIT! They shut up and settled the suit .

    Wow talk about a roller coaster ride and how things change with more details and facts. Thank you Marc for the great work you put into this one. Just imagine the anguish and emotional turmoil she has and is going through as anyone else would. Case on again and she should win if this was the same as the case years ago. This makes me hesitate to ever even try any of the Igt online games I play on our official Lotto Quebec casino site for progressives. This leaves me with trust and confidence issues in these games and the design now.

    So I hit bonus on a Cashman at Hollywood Morgantown PA. Instantly a watch dog reboot popped up. Now this has happened to us 3 different times at Hollywood casinos alway before a bonus round. This watch dog reboot always canceled the bonus rounds too

    I can definitely see the opportunity for emotional distress and I agree on your opinion for the average gambler but also know the rule of any and all malfunctions void wins. That said I favor the casino for going ahead and giving we the actual win that was originally to pay out. Great work Marc!

    Good luck to the casino finding a jury that doesn't have some bias towards the player, rather than the casino. The casino may be right, but still should offer some sort of settlement. If anybody would understand the odds, it would be them.

    As a former slot tech myself, She is not entitled to the jackpot. When you play slot it is implied that you agree to the rules such as malfunction voids all plays and pays. However she can sue for emotional distress if the suit is filed as such. She will loss if she goes after jackpot.

They will have Engineers and maybe slot techs testify in court how games are designed and work. Misunderstandings and feelings about the issue are not facts.

    I think, based on the before and after reset photos, that your analysis is spot on. I doubt it will go to court and expect there will be an out of court settlement negotiated by her lawyer, who will then collect at least half of the settlement.

      there is a statutory cap of 33% in new jersey when a lawyer takes a case on a contingency fee.

      That is incorrect. Lawyers can take a contingency or offer hourly rate in NJ. The contingency amount may be negotiated. Standard PI contingency for children is 25% cap, adults are generally 1/3 up to a million, then it goes down to 30% for a certain additional portion, then down to $25% after another milestone is reached. This is the standard Allstate form most nj attorneys use, including at our law firm. Notably, emotional distress would be considered personal injury as a tort, but the jackpot payout is not a tort, its contract based (between the casino & the player) with the rules spelled out. The question is whether the machine malfunctioned. If so, no payout . However, proving it malfunctioned is a different story. Normally, the plaintiff (player in this case) would have the burden of proof but I believe that since it also shows a jackpot, the burden may essentially switch to the casino to prove it did malfunction. Experts say different things, settlement usually occurs. I play in AC several times a year so this is not the first time, or tenth, I’ve seen machine malfunctions. Usually it’s because the “main door is open” or a player tapped the screen too hard, but I’ve never seen it malfunction & stop spinning. It’s always shut down & replayed the spin, stopping where it was supposed to or just keeps spinning while darkening the screen until a slot attendant arrives.

    From your video yesterday, the reset spin was also incorrect if it showed 2 wedges being highlighted and 2 wedges in a combination not listed in the rules, BTW. Shouldn't the reset spin have highlighted the one wedge as shown on the icon on the 3rd reel?
    I believe she has a real case if the actual spin and reset spin both failed.

    your first video you said... "the moment you press the spin button, your fate has already been decided. It records that entry into the logs inside of the slot machine... machines always have a historical record of every single spin..."
    Why is this not the ultimate deciding factor of what was really won?

      That will be the ultimate deciding factor - if we go by the book, she did not win the Jackpot. But, the perception of her winning the jackpot is there - so she might have a chance in court. We'll just have to see how it plays out. But, removing all emotion and everything else from this situation and just looking at the machine logs, it's going to show and prove that she won $350, not the jackpot.

      @@GambleSmart OK. I was not understanding since this video says your opinion is changing. There is no opinion that it recorded what was the true outcome. You were referring to your “changing opinion” about whether she still gets paid, even if the slot machine records said no jackpot was won. The perception of a win may be enough to get her a substantial settlement is what you were saying. Seems like a “tilt” should cause the wheel lights to turn off to help stop misleading customers that any visual wheel position is still valid, but even that might not be enough.

    Because I won a Progressive several years ago I observed a different verification experience than what seems to have occurred here. The win amount was displayed in the winnings window and the Progressive display reset to 50,000 about the same time. An attendant arrived and then several “men in suits” arrived. One of the men opened the slot machine and established a phone connection with the slot machine manufacturer. (Whoever manufactured Dollar Storm Caribbean Gold). I was told the manufacturer paid the six figure Progressive even though the check was issued by the casino.
    Does this mean there is an actual readable number that the machine stops at and the manufacturer and the casino administration can see to verify the win.
    This supports the tilt theory. The display does not match an appropriate number generated by the RNG to coincide with the (known?) progressive win number.

    I feel like the game is designed in a way where it is not possible to land on the Jackpot when you have a 2x. Because you cant multiply the progressive anyway. So you probably only have a chance at the jackpot if you get Wild - Wild - Spin with no multiplier.

    So a single diamond is lit and lands on jackpot space. Then the machine does a reel tilt. But when the reel tilt is cleared, the machine darkens the single diamond and lights the 1st and 3rd diamond? Why didn’t it just keep the single diamond lit and move the reel to the proper credit amount?
    Weird flaw.
    I can understand the common player looking at this and thinking “there just happened to be a malfunction when the jackpot symbol landed….yeah right, that’s rigged.” And there happens to be a game rule specifically for malfunctions on the jackpot. Common rule…
    The question is who is responsible for the malfunction? The player did everything correctly and turned out she’s playing a flawed machine without knowing it. But it’s possible the casino didn’t either.
    Easy to say, well she’s screwed because the game rules say…. But how would I feel if that were me?… Jilted, I think. I sure as hell wouldn’t play that game anymore.

    not that it's likely but what if the some one coded in an trap that if JP hit and game has taken in less then X then = error out?
    Out side of the usa there are Compensated slots that are on an pay out % and block wins when not at the payout %. And at least one had an back up error state if somehow it got to be away over it's pay out %.

    The problem still is lack of casino personnel not explaining the situation to the player. They just order you to spin the wheel after they open it up and expect you to do what they say with no communication of what they are doing and why they are doing it. The average player doesn't even know what a reel tilt is and what it means when it happens. I was about to ask the question regarding those photos in part 2 but you did explain that those were after the reel tilt. Just goes to show you that even photos can be misinterpreted or altered really with the tools we have today. I don't blame her for suing and well think the casino should settle with her just because of the way they handled the whole situation. Never know with a jury but just hope she gets more money than her lawyer will get in the end.

    she has a very good case. i would be surprised if she didn’t win something. if it goes to a jury i think they would vote in her favor based on what we are seeing in this photo/video.
    also want to add- despite the “malfunction” disclaimer everyone is going on about the game rules clearly state that if the corresponding lit up wedge pointer lands on the $ symbol, you win the jackpot. In this photo that is exactly what it landed on. So both sides have a valid argument here. I would be shocked if the casino/game manufacturer didn’t offer her some sort of compensation for this. It’s also bad publicity for the casino and IGT and i’m sure they want that to go away as quickly as possible.

    I don’t think this picture changes anything because a picture can be taken at a point and with the burst option on most phones the one picture that ‘proves your point’ will be the only one made available.

    I'm curious about something. The picture from the second video shows a completely progressive amount than the picture vein the 3rd video. By at least a dollar. Also the picture from the second video is very clear and obvious whereas in the third video the picture is blurry, it APPEARS as though the wheel is still in motion.

    Thank you for continuing to follow this story and to continue to address the issue with evidence. I will disagree with your conclusion that this changes things (for me). I am extremely sympathetic for the player here. She obviously did nothing wrong and is suffering unnecessarily. While I do not believe the player is due anything beyond the amount that should have been paid according to the machine ($350), if I were the casino operator I would absolutely be doing something to compensate the player in this instance.

    Question for you guys. My wife and I were at the casino last Sunday. We believe we won a jackpot but may have been a glitch or something. Just wondering how would I go about getting that investigated? Thanks, feel free to ask for more information if you like. But long story short we were playing the slot and got a bonus feature. Not too long after that a technician came over and said that it was showing we had won a jackpot and needed to clear it real quick. I looked up and saw the the jackpot just reset REALY recently.

    I believe the declaration needs to stand or a precedent might be set for every tilt to end up in court. I do think she deserves some type of compensation for the emotional roller coaster she experienced and is still experiencing. A jury will probably award the jackpot, though, if it gets that far.

    When she said she won the jackpot, the pesumption should have always been that the top prize symbol was hit. Even hough there was an errorr & she didn't win, the handling of the incident after the fact by casino was negligent & incompetent. You know that such a huge win being denied is going to see someone running to the media, legal action being taken to force the win, bad pr & the rest. They should have roped off the machine, informed IGT & the gambling commission of the situation & let it in their hands. This way, they stay clean by leaving the machine as is & get to pass the buck. If it goes to court, I will be astonished if she doesn't get a huge award from the jury as restitution

      This picture doesn't change things. That would be changing facts. People have lost big money on the Craps table because a Dealer made a bad call on Dice that were cocked on the table. It was an "opinion" or judgement call by the Dealer. People were furious, but the call stood.
      This slot photo shows that she clearly did not win. Period. "Emotional Distress"? Sorry. Next case.

    I think a settlement will get reached before it goes to trial. It would be interesting to see it play out in court. I would have thought I won the jackpot too and not even noticed the reel tilt. I feel like the casino will not want the continued bad publicity, but also won't pay the jackpot prize.

    What if landing on the jackpot wedge caused the tilt? Prove that didn’t happen. She deserves the jackpot if that was the case . Also, gaming commission should look at How many jackpots have been won at this particular Bally’s.

    Casinos have big time lawyers. Read several articles over the years in regards to them being sued. Point being, the HOUSE always win.
    They will not settle out if court, cause that would admit guilt, and they can hold you up in court to where that 1.2 million is gone in legal fees.

    The reel tilt indicator could be a malfunction, lights can go off even if they are not supposed to. To me, when the pointer lines on the wedge, she won. The casino needs to pay it out. Way smarter move, if not they will lose customers.

    Hmm yeah that's crazy!! Definitely still an error BUT it not only being a "tilt" but also lighting up that jackpot symbol might let them award her SOMETHING which is good!!!

      It’s possible, but apparently there is video footage of it as well (I’m guessing CCTV cam from the casino) that would verify this

    My wife was playing Crazy Money Deluxe this spring.
    It has a wheel in its bonus round. It stopped at the Grand. Red screen call attendant with a error message of the door ajar. Attendant opened and shut the door. Game came alive and moved over 1 part of the wheel off the grand. So not the big cash. I think it turned into $12.

    Even though there is emotional distress and what not, the machine logs, in court, will show, definitively that it wasn't a jackpot win - If malfunction voids all plays she's lucky if she gets the $350. It's a case of really bad location of the reel tilt - if the wedge tilted on 65 it wouldn't be news.

    If every spin is programmed, can a technician tell in advance when a machine is supposed to hit a jackpot? And if so, can a technician tell a friend or family member that a machine is supposed to hit in the next 100 spins so they are guaranteed a jackpot???

    Perhaps the courts need to make an example of the casinos and manufacturers; make them pay to incentivise them to redesign those things so it can not happen again. Of course, the solution is to get rid of the mechanical wheels. A digital display won't "tilt"
    (As much as i enjoy playing the reel types. )

      A digital display DOES tilt. It happened to my friend earlier this month (May). She was playing a machine that was one of the "video game display" types - not a "reel" type. She got a bonus. The machine went blank and displayed some kind of computer error along with the word "tilt". I think her win would have been between $100 and $200 before it went blank although I can't remember the exact amount. The slot technician came over and said they may not be able to reset the machine. We argued with them insisting that she won and she should get paid. It took about 15 minutes, but they got the machine to restart at the point just before it went blank and she got her win and we left the machine.

    Seems like million dollar malfunctions don’t happen very often. Just for PR they should pay it. Right or wrong this kind of thing makes people skeptical of the machines.

    What are the odds of it malfunctioning on that slice? Bottom line - it doesn’t matter where you’re looking, if it was a malfunction it’s void. How is it the machine told it to stop elsewhere and it didn’t if it’s random?

      I am a slot tech. I can guarantee you they don't. When I have to go in and figure out what happened and then explain it, it is obvious as hell they don't even know the pay lines

    Is there a continuous rng audit trail recorded on the machine or somewhere on a on-property server?
    If the machine generated a random number which corresponded to a $350 win in the machines prize lookup table when the lady pressed spin, then it shouldn’t matter where the wheel pointer landed - she sholdn’t be awarded the jackpot. Taking her claim to court in this case would be a complete waste of time and money.

    Regardless of the tilt, the machine malfunctioned twice, first by tilting and then by landing on the jackpot instead of continuing to spin. Give the lady the money as a gift, not as a win.

    What causes tell tilt? Can manufacturer program reel tilt when jackpot is hit? I’ll go with the jackpot in this case. Glad you are honest and open minded to agree with the lady’s point of view.

    Geez this incident shoulda been a scene in National Lampoons Vegas Vacation. Just imagine Chevy Chase walking up to a machine finally thinking he won a Jackpot only for it to be a malfunction. 😂
    In any event I agree, the lady should get something due to the emotional situation, maybe the manufacturer can fix this rare glitch in the future somehow.

    Doesn't change anything. It malfunctioned. Not the first time this situation has happened. The casino usually wins. I would try to get a settlement. However, I do now have more sympathy for her.

    If a machine tilts, why is it still sending the moving parts to the wrong spot? I thought a tilt would just say she won a $Million, but no actual winning line is on the screen or the arrow on the wheel.
